On behalf 5 of the U.S. International Trade Commission, I welcome you to 6 this hearing on Investigation Nos. 701-TA-552 through 553 7 and 731-TA-1308 final, involving Certain New Pneumatic 8 Off-the-Road Tires from India and Sri Lanka. 9 The purpose of these investigations is to 10 determine whether an industry in the United States is 11 materially injured or threatened with material injury, or 12 the establishment of an industry in the United States is 13 materially retarded by reasons of imports of certain new 14 pneumatic off the road tires from India and Sri Lanka. 15 Schedules setting forth the presentation of this 16 hearing, notices of investigation and transcript order 17 forms are available at the public distribution table. All 18 prepared testimony should be given to the Secretary. Please 19 do not place testimony directly on the public distribution 20 table. 21 All witnesses must be sworn in by the Secretary 22 before presenting testimony. STEWART: Thank you Chairman Williamson, Vice 23 Chairman Johanson, Commissioners and staff, first Happy New 24 Year as you continue the second century of the Commission. 25 Petitioners in this case account for the vast majority of Ace‐Federal Reporters, Inc. 202‐347‐3700 11 1 the production in the United States of the domestic like 2 product. 3 Titan Tire is believed to be the nation's 4 largest OTR tire producer and the USW represents not only 5 workers at Titan's facilities but also at the two 6 Bridgestone facilities and the one Goodyear facility that 7 produce certain OTR tires. From the public prehearing staff 8 report and other record evidence submissions are clear. The 9 domestic industry has experienced declines in most of the 10 statutory factors the Commission looks at in trade remedy 11 cases. 12 By contrast, imports from India and Sri Lanka 13 collectively have increased both absolutely and relative to 14 domestic production in the 2013-2015 time period, and prior 15 to the preliminary affirmative countervailing duty 16 determinations in these cases in late June of this year.

(Titan) are cyclical in nature — and in times of cyclical decline, we focus on making a positive impact to the factors within our control. Such was the case with 2015; despite the challenging conditions, the impact we’ve been able to make has been significant. The construction and mining segments, as well as the production levels among our major OEM customers, have been slow to recover. Simultaneously, agriculture — especially in North America — experienced a particularly challenging year due to continued factors affecting farm profitability such as falling commodity prices and rising input costs. These challenging conditions ultimately translated to a 20 to 30 percent reduction in production levels of many of our major OEM customers — the hardest hit product categories being the “big iron” machines (150+ horsepower), which offer the greatest profit margin for Titan. Globally, a number of external factors including the strength of the U.S. dollar continue to negatively impact both our profitability and our sales. Despite the economic climate, 2015 was a productive year for Titan. By focusing on factors within our control, we made significant strides, globally, in gaining efficiencies and creating opportunities for future expansion and market share “When the markets gain. These cyclical declines are exactly that — cyclical. When the markets recover, recover, as they as they always do, we are better positioned than ever to capitalize on our long list of competitive advantages and gain global market share over the competition.

About the Solid Waste Management’s Hazardous Waste Program The Hazardous Waste Management Program regulates hazardous waste generation, transportation, storage, treatment, and disposal. It has authority over facilities subject to EPA RCRA Subtitle C. Such activities are overseen by EPA Region 4. The Hazardous Waste Management Program operates under the authority of the Hazardous Waste Management Act of 1977 (T.C.A. §68-212-101 et seq.) and various Hazardous Waste Management rules. Implementation of Tennessee's hazardous waste program began in October 1980. Regulation of hazardous waste is also a federal responsibility under the Resource Conservation and Recovery Act (RCRA). Tennessee has been authorized by EPA to administer the majority of the federal program and receives a grant in support of this effort.
