AN ACT CREATING A BARANGAY TO BE KNOWN AS BARANGAY NEW LOWER BICUTAN IN THE CUT OF TAGUIG, METRO MANILA
Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:
1 Section 1. Creation of Barangay New Lower Bicutan.— New Lower 2 Bicutan Proper in Barangay Lower Bicutan, City of Taguig, Metro Manila is 3 hereby separated from Barangay Lower Bicutan and conslilulcd into a distinct 4 and independent barangay to be known as Barangay New Lower Bicutan.
5 Sec. 2. Territorial Boundaries. - The territorial boundaries of 6 Barangay New Lower Bicutan shall consist of permanent natural boundaries 7 identified as follows:
8 “Bounded on the Northeast by M.R.T. Avenue (formerly Pio Felipe 9 Street);
10 On the East and Southeast by Laguna dc Bay;
11 On the South by Teodoro Santos Street, Taguig Bethel Temple, Lots 12 350, 50 and 249 PLS 272; and
13 On the West and Northwest by Barrameda Street, Maguindanao Street,
14 Alfredo Cruz Street, Transmission Line, and Barangay Signal Village 15 Proclamation No. 172 Psd-13-002057.”
16 Sec. 3. Conduct and Supervision of Plebiscite.- The plebiscite 17 conducted and supervised by the Commission on Elections (COMELEC) in 1 Barangay Lower Bicutan pursuant to City Ordinance No. 69, Series of 2008 of
2 the Sangguniang Panlungsod of the City of Taguig, which ratified the creation 3 of Barangay New Lower Bicutan as proclaimed by the City Board of
4 Canvassers on December 28, 2008, shall serve as substantial compliance with 5 the plebiscite requirement under Section 10 of Republic Act No. 7160, as
6 amended, otherwise known as the “Local Government Code of 1991”.
7 Se c . 4. Incumbenl Barangay Officials.— Ihc incumbent barangay 8 officials of Barangay New Lower Bicutan, City of Taguig shall continue to
9 hold office until such time that their successors have been duly elected and 10 qualified.
11 Sec. 5. Public Infrastructure and Facilities. - All public 12 infrastructure and facilities for public use existing therein at the time of the
13 approval of this Act are hereby transferred witliout cost or compensation to 14 and shall be administered by the new barangay.
15 Sec. 6. Internal Revenue Allotment Shares.— Barangay New Lower 16 Bicutan shall be entitled to Internal Revenue Allotment (IRA) shares pursuant 17 to Section 285 of Republic Act No. 7160, as amended, otherwise known as the 18 “Local Government Code of 1991”.
19 S ec. 7. Separability Clause. - If for any reason, any part or
20 provision of this Act is declared unconstitutional or invalid, other parts or 21 provisions hereof which are not affected thereby shall continue to be in full 22 force and effect.
23 Sec. 8. Effectivity. - This Act shall take effect fifteen (15) days after 24 its publication in theOfficial Gazette or in any newspaper of general 25 circulation.
