ANNEXURE to the Memo. No.A-11019/5/2019-DP&AR/SS.II(1), dated 01.06.2020 Recommendations of the Departmental Promotion Committee for grant of regular promotion to the post of Superintendent. (For comments from the officials concerned) The DPAR informed that as per the Recruitment Rules of the erstwhile post of Superintendent Gr.II the sanctioned strength was 212. The post was Group ‘C’ and Non-selection post. The post of Superintendent Gr.II were to be filled up as follows: Promotion by non-selection method: (a) Assistants and Assistant-cum-Translator in Finance Department with 5 years of continuous service in either of or both the posts, failing which 10 years of continuous service both as Assistant and UDC of which at least 1 year should be regular service in the post of Assistant … … …. 70% (b) Senior Grade Stenographers with 5 years of continuous service in the post, failing which with 10 years of continuous service both as Senior Grade Stenographer and Junior Grade Stenographer, of which at least 1 year should be regular service in the post of Senior Grade Stenographer …. …. 20% (c) By departmental examination …….. 10%. Note: For being considered for promotion, a pass in the Higher Accounts Test is essential. 2. The DPAR informed that the erswhile post of Superintendent Gr.II was filled up on regular basis until the year 2000. However, the DPAR resorted to ad-hoc promotion from 2002 to 2005 due to non-finalization of seniority list in the feeder cadre of Assistant and pending litigations seeking exemption from passing Accounts Test(Higher) filed by one Tmt. R. Meenatchi, Assistant. -: 2 :- 3. The DPAR further informed that the Government of Puducherry amalgamated the erstwhile posts of Superintendent Gr.II and Superintendent Gr.I into a single post and redesignated it as Superintendent vide G.O.Ms.No.106 dated 07.01.2006 with retrospective effect from 01.01.1996. This led to further litigations challenging the amalgamation order by the Pondicherry Executive and Technical Officers Association, Puducherry and the Pondicherry Stenographers Welfare Association, Puducherry. The case attained finality in 2015 after the contesting parties reached an out of court settlement which got the seal of approval of the Hon'ble Supreme Court. Thus, the amalgamation of erstwhile posts of Superintendent Gr.II and Gr.I into Superintendent came to stay. Subsequently, the Recruitment Rules for the amalgamated post of Superintendent was also issued with the approval of UPSC vide G.O.Ms.No.9/2019-DP&AR/SS.II(1) dated 02.02.2019 and notified in the Supplement to the Gazette No.6 dated 05.02.2019. The method of recruitment is as follows: 10. Method of recruitment, By promotion whether by direct recruitment or by promotion or by deputation/absorption and percentage of the vacancies to be filled by various methods. 11. In case of recruitment by Promotion promotion/deputation/ Assistants with 5 years of service in the grade absorption, grades from which rendered after appointment thereto on a regular promotion/ deputation/ basis and who have passed the Accounts absorption is to be made. (Higher) Test conducted by Dept. of Personnel and Administrative Reforms (Personnel Wing), Puducherry. 4. Meanwhile, the Government made ad-hoc appointments to the post of Superintendent upto 2017, pending notification of Recruitment Rules. The Committee noted that though the erstwhile post of Superintendent Gr.II was amalgamated with the erstwhile post of Superintendent Gr.I with effect from 01.01.1996, the G.O. was issued only on 07.01.2006 and the amalgamation attained finality only in 2015 after multiple round of litigations. In view of the merger of Superintendent Gr.I and Superintendent Gr.II into Superintendent as narrated above and the absence of Recruitment Rules for the post of Superintendent those who were promoted as Superintendent Gr.II from 2002 to 2006 and then as Superintendent from 2010 to 2017 on ad-hoc basis may now be regularized into Superintendent Gr.II, to be deemed as Superintendent. -: 3 :- 5. The DPAR informed that as per the Supreme Court order dated 09.01.2015 in the SLP(C) Nos. 25025, 25026, 34171 & 35570 of 2013 filed against amalgamation order, which was passed after the settlement among litigants, the 31 Stenographers who were eligible for promotion to the erstwhile post of Superintendent Gr.II as on 07.01.2006 (i.e. date of issue of amalgamation order) were promoted on ad-hoc basis to the post of Superintendent on 24.03.2015. This ad-hoc promotion was according to their inter-se seniority with Assistants. This was as per one time settlement only and after this tranche of ad-hoc promotion, the post of Stenographer got delinked from the hierarchy for promotion to Superintendent. As per the Supreme Court order dated 09.01.2015, 31 Stenographers elegible as on 07.01.2006 and promoted on 24.03.2015 have to be promoted notionally with effect from the date of promotion of Assistants to the post of Superintendent made in the year 2010 and 2013. Now that the said Assistants are being considered in the various panel years, these Stenographers Gr.II are also to be therefore considered as per their inter-se seniority in their panel years. 6. Also, after the amalgamation of Superintendent Gr.I and Superintendent Gr.II no Limited Departmental Competitive Exam for promotion from Assistant/Stenographer Gr.II to Superintendent Gr.II was conducted from 07.01.2006 onwards. 7. The DPAR informed that the quota of 21 vacancies earmarked for LDCE was filled up on regular basis in 2004 & 2005 and hence no regularization is required in their cases. 9.
