La "Fin des Temps" ouvrant à la conquête définitive du monde par l'extension du Dar al-islam, passe par la venue d'un Messie politique qui vaincra l'Antéchrist, le dajjâl, incarné nécessairement par un juif, dont tous les disciples sont aussi des juifs. Le jihadisme est inséparable d'un montage mental et psychique qui suscite un noyau archaïque de Violence et de Mort. Les paradis offerts par la Mort en Guerrier dans le nom de Dieu sont ceux de la Jouissance absolue. Le judaïsme rabbinique-talmudique, celui auquel s'oppose violemment le Coran médinois, semble être l'antithèse absolu du montage des jouissances jihadistes. Les textes originels, Coran et Hadiths, ont été interprétés par un des deux courants de l'islam dans une version d'héroïsation, de légitimation et de sacralisation de ce noyau originaire de destructivité. Dès leur origine, la figure et la personne du Juif (al-yahoud) représente donc le point critique qu'il s'agit d'éradiquer aussi bien métaphysiquement que dans sa réalité effective. Les processus d'adhésion et cet "univers de sens" jihadistes ne conduisent pas nécessairement à une addiction à la jouissance archaïque absolue. De nombreux "radicalisés" en France et en Europe sont plutôt des infra-jihadistes pris dans la recherche d'une vindicte restaurant leur narcissisme moïque blessé. Leur engagement sur le chemin de la restauration de la Gloire de Dieu leur fait espérer une plénitude identitaire rétablissant un sentiment de musulmanité glorieuse. A ce niveau, la Haine-du-Juif inhérente à la lecture radicale du Coran et des Hadiths se trouve potentialisée par les nombreux discours complotistes-antisémites, véhiculées par les réseaux sociaux et les prêches dans un nombre conséquent de mosquées et de salles de prière. Notre recherche sur les mécanismes d'emprise mentale et d'addiction psychique se poursuivra autour d'une analyse des processus narratifs et de fiction inhérents aux textes eux- mêmes dans leur lecture radicale. 2 Abstract : Jihadism, in its milder or radical forms, always has an apocalyptic dimension. The "End of Time" opening to the final conquest of the world by the extension of the Dar al- islam, through the advent of a political Messiah who will defeat the Antichrist, Dajjâl, necessarily incarnated by a Jew, of which all followers are also Jewish. Jihadism is inseparable from a mental and psychic assembly that creates an archaic nucleus of Violence and Death. Paradise offered by the Warrior of Death in the name of God is that of absolute pleasure. Judaism under Rabbinic and Talmudic expressions, the one the Koran of Medina is violently opposed to, seems to be the absolute antithesis of the jihadist idea of enjoyment. The original Qur'an and Hadith texts, have been interpreted in one of the two branches of islam in a heroic, legitimate and sacred version in this original nucleus of destructiveness. Ever since the beginning of time, the figure of the Jew (al-yahoud) represents the critical point and it is to be eradicated both physically and mentally. The accession process and the "universe of meaning" jihadists do not necessarily lead to an addiction to archaic absolute enjoyment. Many "radicalized" in France and Europe are rather infra-jihadist caught in the search of restoring vindictiveness narcissism, even though they are hurt. Their commitment on the path to restoring the glory of God is their hope for a true identity restoring a sense of fulness in the Muslim religion. At this level, the feeling of Hate-the-Jew inherent in radical interpretation of the Koran and the Hadith is potentiated by the many complotistes and anti-Semitic speeches, carried on by social networks and sermons in a significant number of mosques and prayer rooms.     THE " CONSTITUTION OF MEDINA " SOME NOTES The document known as the "Constitution of Medina" (1) has been studied by western scholars among whom was already J. Wellhausen who analyzed and divided the document into articles. His division was adopted by Wensinck, Watt and others, and it is also followed in the present study (2). There are, however, certain problems in the "Constitution" which seem to remain unsolved. In the present paper an attempt is made at elucidating some of these problems (3). 1. "The Jews of Banfr so-and-so" One of the main objects of the "Constitution" was to deter- mine the relations between the Muslims and the Jews of Medina within the framework of a new kind of unity. But whereas the identity of the Muslims who are dealt with in articles 2 - 10 of the document is fairly clear, the Jews who are treated in I) See Ibn Hisham, 11,147-150. This is the version of Ibn lshaq (d. 150H1767) which is also reproduced in Ibn Sayyid al-Nas,I, 197-198; Ibn Kathir , Bidiiya, 111,224-226. Strangely, it also has the juristic status of being the most ambiguous and complex, as it lacks a coherent, genuine legal shape and doctrine. Qu- ranic references to d_ himma or ahl al-kitāb (People of the Book) complicate the landscape. However, the d_ himmī’s juristic corpus has played a major role in organising the cohabitation, domination or exclusion of non-Muslims in conquered territories for centuries. Convivencia in al-Andalus represents a unique experience in the history of Islamic law and Eu- rope, the results of which are still felt today. But what is to be learned from the former inclusion / exclusion of d_ himmī?Thisissue,linkedtounder- standing ›otherness‹, is fundamental to studying Convivencia and grasping its mechanisms. A wide legal arsenal has been used to drag musicians into court and throw them unceremoniously into gaol. In Tunisia, there are two kinds of rappers. First, there are ones like El General and Mos Anif who captured broad international interest at the outset of the 2010-2011 overthrow of General Zinedine Ben Ali. At the time, their popularity resided in texts denouncing both corruption and social injustice. Yet they were couched in a profound respect for Tunisia’s traditional moral and religious values and were noted for their absence of verbal violence, swear words or insults. Un regard discret pour capturer les arts de la scène, une archive sonore pour nous transmettre les mélodies et textes déclamés sur le vif, une lumière pour éclairer les rencontres artistiques. Nous commençons avec Tunisia Clash de Hind Meddeb, en compagnie de rappeurs, poètes modernes et urbains pris dans une bataille pour la liberté de s’exprimer. Au mois de mai, le film de Jumana Manna « A magical substance flows into me » nous montre la diversité des chants et instruments de Palestine, la magie des liens musicaux tissés dans l’histoire. Et, comme chaque saison, un groupe de programmateurs choisit le film du mois de juin, dans un atelier construit cette fois- ci avec les habitants de la Busserine. In this respect, "political interpretation" means to read the text in the light of reader's contemporary political concepts, theories, values and models. In this regard, this paper will study on this kind of reading, namely política) interpretation of the Qur'an. How the Qur'an is explained by political concepts or in other words how the Qur'an is politicized is the main subject of the paper.     Title: Assessing Apostasy, Blasphemy and Excommunication (takfir) in Islam and Their Modern Application by States and Non-State Actors A Thesis Submitted for the Degree of Doctor of Philosophy by Masaki Nagata Supervised by Dr. Mohamed Elewa Badar Brunel Law School Brunel University June 2016 Abstract In certain contemporary Muslim majority states apostasy and blasphemy are not merely religious sins; they are acts which potentially have legal, or extra-legal, consequences. Although apostasy has not been criminalised in many such states, extrajudicial killings of apostates are carried out by some extremist groups and individuals. Such groups always justify these murders of fellow Muslims and non-Muslims on the grounds of apostasy and blasphemy. The concept and use of takfir (excommunication) is also a serious issue in Muslim majority states. Groups such as Daesh (also known as Islamic State of Iraq and Syria) rely on takfir to attack fellow Muslims, despite there being no legal basis in Shari’a for the use of takfir or for criminalising apostasy. Although the concept was developed by people, not God, takfir are now being used to bypass rational human judgement. Their use plays a major role in many of the religious issues confronting Muslim majority states, such as the criminalisation of apostasy and blasphemy. This thesis analyses the central issues of apostasy, blasphemy and takfir collectively, as their history and their contemporary use and misuse by extremist groups are inextricably entwined. The key finding is that the right to punish apostasy and blasphemy and to issue declarations of excommunication (takfir), all originally reserved in Islam for God only, have been appropriated by man.

The biggest determinant factor which led to maintain these traditions among the society was the notion of asabiyya. The tie of blood and tribe was higher than every other bond in the society. Even sometimes the tribes were fighting with each other for years just to take revenge of one of their members who was killed by the other tribe.
