A APLICABILIDADE DO FEMINICÍDIO PARA MULHERES TRAVESTIS E TRANSEXUAIS Renata Lukrafka Kowalczuk1 Ana Paula Cacenote2 INTRODUÇÃO A presente pesquisa tem como tema o feminicídio como circunstância qualificadora do tipo penal homicídio e, mais especificamente, a aplicação deste para mulheres transexuais e travestis. Ao analisar-se o texto que insere a qualificadora no Código Penal, percebe-se, a primeira vista, uma forte exclusão à mulheres de origem não biológica, a partir o termo “condição de sexo feminino”. Objetiva-se, portanto, apresentar e explicar o tipo feminicídio, bem como apontar a diferença entre transexuais e travestis. A partir disto, espera-se informar a respeito das leis e decisões que respaldam a aplicação do feminicídio para mulheres de origem não biológica, de maneira a informar os (futuros) operadores do direito desta interpretação legal. Justifica-se a escolha do tema a fim de dar visibilidade a este grupo vulnerável, para viabilizar a busca por igualdade, justiça e liberdade na sociedade brasileira. 1 METODOLOGIA A seguinte pesquisa é de cunho teórico, de natureza qualitativa, com fins explicativos. Justifica-se a elaboração desta pelos fins de ampliar a visão da sociedade e, especialmente, de juristas e futuros juristas, à questão da aplicação do feminicídio como circunstância qualificadora do crime de homicídio para mulheres transexuais e travestis, ou seja, aquelas cujo sexo biológico não é feminino, a fim de dar visibilidade a este grupo vulnerável, para viabilizar a busca por igualdade, justiça e liberdade na sociedade brasileira. 2 REFERENCIAL TEÓRICO O crime de feminicídio está previsto no art. 121, §2º, inc. IV do Código Penal (DEL nº2.848/1940), neste inserido pela Lei nº 13.104/2015. Neste dispositivo, é definido como homicídio “contra a mulher por razões da condição de sexo feminino” (BRASIL, 2015), e figura-se como homicídio qualificado, tendo a pena de reclusão previsão de doze a trinta anos. Ainda, no mesmo artigo, em seu § 2ºA, diferencia-se o feminicídio do femicídio (homicídio perpetrado contra mulher): Considera-se que há razões de condição de sexo feminino quando o crime envolve: I - violência doméstica e familiar; 1 Acadêmica do Curso de Direito
