A glossary of terms used in this guide

The information contained in this guide relates to the admission of children to reception classes for the 2020/21 academic year, and to children who will transfer from infant school to junior school in September 2020.

Nursery schools generally cater for children between the ages of three and four.

Within the primary phase of education, there are three types of school:

Infant schools generally cater for pupils aged between five and seven. However, if the school has a nursery unit, it will cater for pupils aged between three and seven.

Junior schools cater for pupils aged between seven and 11.

Primary schools generally cater for pupils aged between five and 11. However, if the school has a nursery unit, it will cater for pupils aged between three and 11.

Community and voluntary controlled schools are funded by Derbyshire County Council with the headteacher and governing body responsible for running the school. The admissions policy is determined and administered by the county council.

Voluntary aided schools are jointly funded by Derbyshire County Council and a voluntary organisation, usually a church diocesan board. The headteacher and governing body run the school. The admissions policy is determined and administered by the governing body.

Foundation schools are funded by Derbyshire County Council but responsibility for running the school rests with the headteacher and governing body. The admissions policy is determined by the governing body.

Academies are funded directly by central government and responsibility for running the school rests with the headteacher and academy trust. The admissions policy is determined and administered by the academy trust.

All of the above schools are called mainstream schools.

Enhanced-resource schools are mainstream schools with additional resources, such as extra staff, for certain children with an Education, Health and Care Plan. Pupils are not generally taught separately and are included in the mainstream classes.

Special schools are attended by children with an Education, Health and Care Plan. Special schools provide for pupils whose disability requires a more comprehensive approach than a mainstream school or an enhanced-resource school can provide. Some experience of mainstream school may be possible. The council handles admissions for all special schools.

The normal area is a defined geographical area, which the school serves. You will be advised of your normal area school if you apply online or by phone. Alternatively, you can enter your postcode into an interactive tool on our website www.derbyshire.gov.uk/admissions to find out what your normal area school is. If you consider your child Catholic, it means they are also resident in the normal area of a Catholic school. If you are unsure about your child’s status regarding the Catholic school serving your area, contact the diocese for advice. The number is on page 5.

We use the word parent throughout the guide. It means anyone who has a parental responsibility in accordance with the terms of the Children Act 1989.

A few children with special educational needs require a detailed assessment by us. This was previously called a statutory assessment of special educational needs, however it is now known as an education, health and care needs assessment. The child’s requirements are set out in a document called a Education, Health and Care Plan.

The published admission number is the set number of places available at a school in a year group.

Obtaining a place for your child in a primary school

How to use this guide

Please read all the information contained in the guide before making an application. The council is not presently able to write to parents reminding them of when their child should start school.

If you are a parent living in Derbyshire, excluding Derby city, the information contained in this guide explains how you can apply for a primary school place for your child – whether that school is in or outside Derbyshire. If you are requesting a place at a school outside Derbyshire we will send the form to the neighbouring council for consideration and liaise with them through the process. The decision on whether the child can be offered a place will be taken by the council which runs the school, or the governing body if it is a voluntary aided, academy or foundation school. You may want to check with the school’s home council how places are allocated in that area. This does not include Independent schools. Similarly, if you live outside Derbyshire but want your child to attend a Derbyshire school you should make the application through your home council who will liaise with us.

Even if you have already approached a school or feel you have put your child’s name down at a school – that is not a formal application. A formal application can only be made by following the process explained in this guide.

How does it work?

You fill in one application only, no matter how many schools you want to apply for. There is no need to fill out a separate application for each school. Only make one application online or by phone. Derbyshire County Council acts as a clearing house for admitting all Derbyshire pupils to primary, infant and junior schools.

Transfer from infant to junior school When children are due to leave infant school and need to move to a different school for their junior education, parents must make an application. A place in a particular infant school does not guarantee a place at the associated junior school. Similarly, a place at a particular junior or primary school does not guarantee a place at a particular secondary school.

The closing date for parents to return forms is midnight on 15 January 2020. Applications are needed from all parents, including those who want their child to attend their normal area school.

Please note there is no automatic right to a place in any particular school, even where a child lives in the normal area of a school, has a sibling in attendance or attends an associated primary school.

Supplementary forms Some voluntary aided, academy and foundation schools may want you to fill in a supplementary form or provide documentation in addition to an application you make to us. Look at the school’s brochure to see if this is the case. This is so that they can apply their own admission criteria. For example, they might want proof of your address or proof that your child has been baptised. Supplementary forms are available from the relevant school and from Derbyshire County Council, including online. Any additional paperwork of this type should be returned to the school by the closing date. This supplementary paperwork is not instead of our application form. You will still need to make an application to us.

The application process explained

You will fill in one application form – either online or by phone – on which we invite you to state three preferences for any primary, infant or junior school.

 We ask you to put your preferences in priority order, listing your most preferred school first.

 The closing date is midnight on 15 January 2020.

 All applications are considered against each school’s published admission number (the number of places available in the year group).

 If there are more applications than there are places available at a school, places will be allocated according to the school’s published admissions criteria.

 If a child can be offered a place at more than one school, then a place will be offered at the highest priority school possible. We will offer you one place only.

 If you apply online your offer will be emailed on 16 April 2020 or you can log on to get the result.

 If you don’t have an email address your offer will be posted second class on 16 April 2020.

18 May 2020 Requested date for submitting an appeal in relation to Derbyshire schools if you are not happy with the school allocated to your child.

17 July 2020 Appeals normally heard by this date.

September 2020 Children start school. The school at which your child has been offered a place at will be in touch with you about the exact date.

You only make one application online or by phone.

You are invited to state three preferences.

Applying online

We prefer you to make your application online – which means you need not wait for the post before finding out which school your child has been offered a place at. If you have applied online we will email you with the outcome and you can view your offer online on 16 April.

Log onto www.derbyshire.gov.uk/admissions and you will find the online application form. This will be made available from 11 November 2019 until the deadline of midnight on 15 January 2020. The system will then close for a short period after this date and time and then re-open to accept late applications.

Internet access is available free of charge at all Derbyshire libraries and children’s centres. Some schools may also let you apply online using their computers.

The online application form will enable you to make your application and send it to us immediately. You will receive confirmation that your application has been received. Even after you have made 9

your application you will be able come back and make amendments at any time up until the deadline.

The advantages of making your application online are that you have the assurance that your application has been received and you will also be able to keep a record of the application you made.

When you apply online, you will need to give a username and password. Online applications will be issued with a unique identification number. Please make a note of these details.

The process should be easy to follow but if you have any problems you can ring the Admissions and Transport Team on 01629 537479 or make a telephone application.

Applying by phone

If you cannot access the internet, you can make your application by phone. This will be available until the call centre closes on 15 January 2020. The facility will then close for a short period after this date and time and then re-open to accept late applications.

Call Derbyshire on 01629 533190 and a member of our call centre staff will fill in an application for you.

The call centre is open between 8am and 8pm, Monday to Friday, and Saturdays 9.30am to 4pm.

What information will I need to hand when I’m applying by phone?

 You will need to have made a decision about the three preferences we invite you to make and your reasons.

 Your child’s full name.

 Your child’s date of birth.

 Your child’s address and postcode.

Why should I apply by phone?

 It’s quick and easy to do – usually around 15 minutes to complete a telephone application.

 Call centre staff can make sure the application is filled in correctly.

 Calls will be recorded as part of our commitment to training, audit and quality assurance. Call charges may vary and calls from mobile phones may cost considerably more.

 You will receive a copy of your completed application form either by email or in the post.

 If you want to change your mind you can phone Call Derbyshire, quoting your username, password and unique identification number, and amend your application – up until the call centre closes on 15 January 2020.

Important points

 Get your application in on time – via the internet or call centre. If you miss the deadline we will not be able to consider your application until we have dealt with the ones that we received on time.

 Don’t name the same school more than once as a preference – this will not increase your chances of a place.

 We will withdraw a school place where false information has been used to secure an offer.

 Think about listing your normal area school. You may want to consider including the normal area school as one of your preferences, though it does not have to be your first preference. If you do not include the normal area school as one of your preferences it may fill up with pupils who have said they would prefer to go to that school. This could mean the only school with available places may be further away and could mean you have to pay for transport to a distant school.

 If you do not make an application you cannot assume your child will get an automatic place at your normal area school. We will first offer places to those who have expressed a preference. If you do not make an application we will only be able to give your child a place at your normal area school if places are still available. If your normal area school is full we will give your child a place in the nearest school which has room. This could mean you paying transport costs to a distant school.

 Consider how your child will get to school when making your preferences. You are responsible for getting your child to school. If your child gets a place at a distant school, this could mean that you pay transport costs. Details of the transport policy are on page 19. Read these carefully before deciding your preferences.

 Only make one application online or by phone.

Late applications received after the closing date will be included only if the reason for the delay is considered exceptional and appropriate evidence has been provided. Other late applications will

The rules for getting a place at a Derbyshire school Who decides the rules?

In community schools and voluntary controlled schools, Derbyshire County Council decides the rules for getting places.

In voluntary aided Church of England, Catholic and Methodist schools, as well as foundation schools and academies the governors decide admission rules for their school.

The rules are known as ‘admissions criteria’

Under the 1996 Education Act, you have a legal right to express a preference for which school you want your child to attend. The county council and school governors have a general duty to meet this preference – as long as it does not “prejudice the provision of efficient education or the efficient use of resources” or the council or governors are required to take extra measures under the Key Stage 1 class size legislation.

Even if your child attends a nursery class at a school or co-located children’s centre you must make a new application for a reception place. Children do not transfer automatically. Similarly, a new application must be made for transfer from infant to junior school.

Parents should be aware that some junior schools do not have sufficient places to admit all pupils from the local infant school.

Attendance at a particular nursery gives no priority for a place at an infant or primary school. Similarly, attendance at a particular infant school gives no priority for admission to a particular junior or primary school, except in Eckington.

In law there is no automatic right to a place in any particular school

We will offer you one place, at the highest priority school possible.

Where we cannot offer a place at any of your chosen schools, your child will be allocated a place at the normal area school – if places are still available – or the next nearest school with places available.

You should bear in mind that school admissions for children starting school for the first time and for children transferring from infant schools to junior education are considered on an annual basis – so it is not possible to confirm that a place is available at a school before 16 April in the year before your child will join.

Each year primary schools have to admit eligible pupils on request up to their published admission number (as shown in the list at the back of the guide) which takes account of the amount of accommodation available.

In the case of offers for places in schools in neighbouring councils, they make the decision and we make the offer on their behalf.

Admissions criteria

Community and voluntary controlled schools

Individual pupils who have an Education, Health and Care Plan which names the school will be admitted.

In deciding on admissions to all community and voluntary controlled schools in Derbyshire, the following order of priority will be adopted. Different rules apply in Eckington and part of the Long Eaton area. These rules are set out below and on the next page together with a list of the schools to which they apply.

1. Looked after children and children who were looked after but ceased to be so because they were adopted (or became subject to a child arrangements order or special guardianship order).

2. Children living in the normal area served by the school at the time of application and admission who have brothers or sisters attending the school at the time of application and admission.

3. Children living in the normal area served by the school at the time of application and admission.

4. Children not living in the normal area served by the school but who have brothers or sisters attending the school at the time of application and admission.

5. In the case of voluntary controlled church schools, children whose parents request a place on religious grounds.***

6. Other children whose parents have requested a place.

Where, in the case of 2, 3, 4, 5 or 6 above, choices have to be made between children satisfying the same criteria, those children living nearest to the school (measured by straight line) will be given preference. ****

Eckington Area

The admissions criteria for schools in the Eckington area are as follows:

Eckington Birk Hill Infant and Killamarsh Infant, Marsh Lane Primary, Ridgeway Primary and Renishaw Primary Schools.

As in all community and controlled schools, individual pupils who have an education, health and care plan which names the school will be admitted.

(i) Looked after children and children who were looked after but ceased to be because they were adopted (or became subject to a child arrangements order or special guardianship order).

(ii) Children who have brothers or sisters** attending the school at the time of application and admission.

(iii) Other children whose parents have requested a place. If there is insufficient room to admit all applicants, those children living nearest to the school – measured by the straight line distance – would

have priority.****

Eckington Junior and Killamarsh Junior Schools

As in all community and controlled schools, individual pupils who have an education, health and care plan which names the school will be admitted.

(i) Looked after children and children who were looked after but ceased to be so because they were adopted (or became subject to a child arrangements order or special guardianship order).

(ii) Children attending these schools’ main contributory infant schools (Birk Hill Infant and Killamarsh Infant) and who have brothers or sisters** attending the school at the time of application and admission.

(iii) Children attending these schools’ main contributory infant schools (Birk Hill Infant and Killamarsh Infant) at the time of application.

(iv) Children whose parents have requested a place at the school who have brothers or sisters attending the school at the time of application and admission.

(v) Other children whose parents have requested a place.

When in the case of (ii), (iii), (iv) or (v) above, choices have to be made between children satisfying the same criteria, those children living nearest to the school (measured by straight line) will be given preference.****

Parklands Infants and Harrington Junior (Long Eaton) The admissions criteria for these schools are as follows:

As in all community and controlled schools, individual pupils who have an education, health and care plan which names the school will be admitted.

(i) Looked after children and children who were looked after but ceased to be so because they were adopted (or became subject to a child arrangements order or special guardianship order).

(ii) Children living in the normal area served by the schools at the time of application and admission who have brothers or sisters attending the schools at the time of application and admission.

(iii) Children living in the normal area served by the schools at the time of application and admission.

(iv) Children not living in the normal area served by the schools but who have brothers or sisters attending the schools at the time of application and admission.

(v) Other children whose parents have requested a place.

Definitions

*Living in the normal area is defined as the child having settled residence in a property which is the child’s only or main residence. Documentary evidence, including proof of residence at the property concerned, may be required e.g. council tax/utility bills, sale/rental agreements. The County Council reserves the right to withdraw any offer of a school place which has been obtained as a result of misleading or fraudulent information.

Please note a place cannot be guaranteed for any child, even those living in a school’s normal area (or, in the Eckington area, attending a contributory primary school). 14

**The term brother or sister includes:

(a) a half-brother and/or a half-sister (b) a legally adopted child being regarded as a brother or sister (c) a step-brother and/or step-sister residing in the same family unit

***Parents seeking a place at a voluntary controlled school on religious grounds need to have a supplementary form completed by a Minister, Priest or Pastor or Religious leader if the child is a member of another Christian Church or world Faith, who know the family and can confirm regular attendance at public worship (Regular worship is defined as attendance at public worship at least once a month). The form is available from the Admissions and Transport Team or online and should be returned to the Admissions and Transport Team. Baptismal certificates, where appropriate, should also be supplied. Exceptional circumstances will be considered if explained in writing by the relevant religious leader.

****Route Measurement The Children’s Services Department has a Geographic Information System (GIS) to measure the straight line distance. It is measured by a standard straight line distance calculated to within two metres. The location of the home address is the Delivery Point Address (normally the house front door) which is sourced from the PAF (Postal Address File) component of Address Base. For schools the grid reference is taken from the postal address file and will normally be the centre of the school for primary phase schools, or the nearest gate or entrance for secondary schools. Residence – in all categories

The home address used for school admission purposes is the address where the child is residing at the time of both application and admission.

Where an application includes more than one address due to shared parental responsibility, we will use the address where the child resides for the majority of the school week (where they usually or mainly sleep between Monday and Friday).

Parents and carers are required to submit full details with supporting information to enable us to determine which address to use for the purpose of admission.

Where parents provide evidence that the child resides equally at both addresses during the school week, and we are unable to reach a decision based on the information received, parents will be asked to notify the Council of the mutually agreed address to be used for the purpose of school admissions.

Where the county council has reasonable grounds for believing the home address is not the child’s only or main residence it reserves the right to carry out investigations which may include visits to the property.

What to do if both parents cannot agree on the school(s) to be applied for Parents are expected to consult with each other and agree on the school(s) for which they wish to express a preference. The Council is unable to investigate whether applications have been agreed, or to resolve disagreements between parents. In the absence of agreement between parents the Council will process the preference of the parent who has care of the child for the greater part of the school week (see definition of residence). In cases where the Council is unable to determine the home address (see definition of residence), and/or there is no parental agreement or Court Order, the Council will be unable to process the application further until the matter has been resolved. Parents are encouraged to resolve disagreements as soon as possible, as delays may affect the availability of places at preferred schools.

Once a school place has been offered, any disagreement on the child’s placement will be a matter for parents to resolve.

Voluntary aided, academy and foundation schools The criteria for admissions to aided, academy and foundation schools are decided by each school’s governing body and are listed briefly on pages 57 to 85 of this guide in ‘Summary of admission policies 15

for voluntary aided, academy and foundation schools’. Full details can be obtained directly from the school.

Withdrawing an offer For admission procedures to be fair it is important that all the information you provide is accurate. If we find that any information provided by parents is misleading or fraudulent, the county council reserves the right to withdraw any offer of a school place.

Children of multiple births Where the final place to be allocated within the Published Admission Number would separate children of multiple births a place(s) will also normally be offered to the other child/children.

What to do if….

I have changed my mind about the school I want my child to attend

You can change your mind easily - as long as it is before the deadline on 15 January 2020.

If you have made an online application just log on and amend your form.

If you have made an application by telephone you must contact Call Derbyshire on 01629 533190.

But if you change your mind after the deadline preference changes will only be accepted where the Council agrees there is good reason for doing so, for example a change of address. Supporting evidence may be required.

You should be aware that whilst a change in your preference order may be accepted by the Council, dependent on the point it is received in the allocation process, it may not be possible to action the change until after the offer date, particularly if the change involves a school(s) in other council areas and preference information has already been exchanged.

You should bear in mind that if you wish to add a new school to your preferences this may be treated as late.

My circumstances have changed, such as change of address or change of current school

If you or your child’s circumstances change, such as a change of address or a change of current school, you must contact the Admissions and Transport Team immediately at [email protected] or call them on 01629 537479.

Any change in your circumstances might affect the allocation of a school place.

Changing your child’s school at other times

You may want to apply for your child to change schools other than when they are due to start primary, junior or secondary education. This could be because of a change of address. These are known as in- year admissions.

In-year applications for admission to school

Changing a child’s school is a very important step to take; it can affect your child in many ways. Guidance notes are provided by the council to help you through the in-year application process. It is important to read the notes before completing an application.

If you want to apply for a place at a school in Derbyshire you can do this online at www.derbyshire.gov.uk/admissions If you cannot access the internet you can apply by phone by ringing Call Derbyshire on 01629 533190. Internet access is available at all Derbyshire libraries, Children’s Centres and some schools may let you use their computer and telephone facilities to make an application. You may also complete a paper application form. To obtain a paper form, email [email protected] or phone the Admissions and Transport Team on 01629 537479 and ask for an in-year application form.

Alternatively, some schools in Derbyshire will accept approaches direct, but may still require you to complete the council’s application form. Please note schools are required to notify the council of all applications and their outcomes. lf you want to apply for a place at a school in another council area you should contact the council where the school is located in the first instance. Contact details are on page 86 of this guide.

How does it work?

The law enables parents of children seeking a school place to express preferences. Parents should be aware that admission authorities cannot necessarily guarantee a place for any child, even where they move into the school’s normal area. In law there is no automatic right to a place in any particular school.

You are invited to name up to 3 schools in Derbyshire at which you wish your child to be considered for a place. You should think very carefully about your choice of school(s); these should be listed in priority order (i.e. beginning with your most preferred school). It is advisable to consider including your child’s normal area school as one of your preferences though it does not have to be your first preference.

The Council operates a Fair Access Protocol (available at www.derbyshire.gov.uk/admissions) to ensure that children without a school place who find themselves in challenging circumstances are admitted to school as quickly as possible.

Do schools have waiting lists?

For primary and junior transfer applications, waiting lists will be maintained by Derbyshire County Council for oversubscribed Derbyshire schools. Waiting lists will be set up on 16 April 2020 and maintained until 31 December 2020. Children’s names will automatically be placed on these lists where it has not been possible to offer a place and they have given this preference a higher priority than the school at which they have been offered a place. A vacancy arises only when the number of offers to a

particular school falls below the published admission number (PAN) or, in cases where an admission authority has offered places above the PAN, when offers fall below the revised number. (This excludes places secured through the appeals process). Priority on the waiting list is determined according to the published admission criteria. This means that a child’s position on the list is not fixed and can go up or down the list as vacancies arise and/or further applications are received. The date of application does not affect waiting list order.

Some voluntary aided, foundation and academy schools may maintain waiting lists beyond this date. Please check with the school concerned. Some neighbouring councils have different rules on waiting lists. Please check with them if applicable.

The Council does not maintain waiting lists for in-year admissions for community and controlled schools. Some voluntary aided, academy and foundation schools in Derbyshire and schools in other council areas may maintain waiting lists for in-year admissions and if your application is refused you should contact the school to place your child’s name on the waiting list. If you wish to place your child’s name on the list for a Derbyshire school for the next academic year you will need to make a new application in the term preceding the new academic year to update their application details and confirm your continuing interest. Priority on the waiting list is determined according to the school’s oversubscription criteria.

Appeals

When parents are unable to obtain a place for their child at the school they want, they can appeal against the decision to an appeal panel independent of the council and the school. Appeals in the primary and junior transfer round will normally be heard by 17 July 2020 and for in-year admissions will be held within 30 school days of the appeal being lodged.

The decision reached by the independent panel will be binding on the council and the parents. A further application in respect of the same school will not be entertained in the same academic year unless significant and material changes in circumstances arise.

Infant (Key Stage 1 and Foundation) Appeals

By law, subject to certain limited exceptions, no infant class may contain more than 30 pupils. Infant classes are those in which the majority of pupils will reach the age of five, six or seven during the school year.

Admissions authorities can refuse to admit a child if to do so would require the school to take action such as employ an extra teacher or build an extra classroom to keep infant classes at 30 or less.

Parents can appeal in this situation but the appeal panel can only uphold an appeal in limited circumstances.

The panel must dismiss the appeal where:

a) it finds that the admission arrangements complied with admissions law and were correctly and impartially applied; or b) it finds that the admission arrangements did not comply with admissions law or were not correctly and impartially applied but that, if they had complied and had been correctly and impartially applied, the child would not have been offered a place; and it finds that the decision to refuse admission was one which a reasonable admission authority could have made.

The threshold for finding that an admission authority’s decision to refuse admission was not one that a reasonable authority would have made is high. The panel will need to be satisfied that the decision to refuse to admit the child was ‘perverse in the light of the admission arrangements’ i.e. it was ‘beyond the range of responses open to a reasonable decision maker’ or ‘a decision which is so outrageous in its defiance of logic or of accepted moral standards that no sensible person who had applied his mind to the question could have arrived at it’.

How will my child get to school? Transport to the normal area school

We provide assistance with transport for full-time infant, junior and primary school pupils who do not live within statutory walking distance of their normal area school. This distance is two miles for children under eight and three miles for children over eight. It is measured by the shortest available route.

Bus passes or refunds are issued where appropriate and special contract transport is arranged if public transport is not available.

There may be exceptions to the transport rules if we agree that the route to the normal area school is hazardous for a child, accompanied if necessary, to undertake on foot.

Spare places on a contract bus may be provided on a concessionary basis for children who are not normally entitled to free transport; however a charge will be made.

Transport to other schools

Parents who send their children to a school which is not their normal area school will not normally receive assistance with transport (children living outside the county attending Derbyshire schools should apply to their home council). However, assistance with transport will be provided when a child attends a school, other than the normal area school, which is beyond the two/three mile limit but is closer to the child’s home than the normal area school.

Transport to faith schools

The provision of subsidised transport to faith schools ceased in September 2015, with protection offered to pupils in key years – i.e. those who entered Year 6 and Year 11 in 2015 who were previously entitled by right to assistance. The Authority has not contracted any buses to provide transport to faith schools since July 2016.

If you are in receipt of benefit

Children of primary age who are entitled to free school meals or whose families get the maximum level of working tax credit are entitled to free transport to the nearest suitable school where the distance from home is more than two miles. This distance is measured along the nearest available route.

Each year, we check whether parents are still eligible for transport assistance. If parents are no longer eligible, for example because they no longer receive the relevant benefits, they may have to meet their child’s transport costs.

Transport for pupils with special educational needs and/or disabilities

Transport will be provided for pupils with special educational needs and/or disabilities who attend their nearest school, where the journey exceeds the statutory walking distance as outlined above or in other cases in accordance with the council’s transport policy.

Provision of transport will not generally be made if the preferred school is further away from the child’s home than another school considered appropriate by the council.

If a parent’s request for help with transport is refused and they feel that they may have special family circumstances which warrant help, then they can ask for the decision to be reviewed. Am I entitled to free school meals?

From September 2014 all pupils in Key Stage 1, Reception, Year 1 and Year 2 will be offered a Universal Infant Free School Meal which will be funded by the Government. As well as this all pupils, regardless of their age, whose parents receive the following support payments are entitled to receive 20

free school meals:

 Income Support  Income Based Jobseeker’s Allowance  Income Related Employment and Support Allowance  Support under part VI of the Immigration and Asylum Act 1999  The guaranteed element of State Pension Credit  Child Tax Credit, provided they are not entitled to Working Tax Credit and have an annual income (as assessed by HMRC) that as of 6 April 2019 does not exceed £16,190.  Universal Credit - if you apply on or after 1 April 2018 your household income must be less than £7,400 a year (after tax and not including any benefits you get)

Children who receive Income Support or Income Based Jobseeker’s Allowance in their own right are also entitled to receive free school meals.

As well as the pupil receiving a free school meal the school will also qualify for the Pupil Premium which provides additional funding for the school.

Early years education

All children have the right to a free early years education place in the term* following their third birthday, subject to the availability of places. Free places are available for up to 15 hours per week over a minimum of two days and may be taken with more than one early year’s providers. Parents may choose their free early years provision from a range of schools, academies, private, voluntary or independent (PVI) educational settings, including childminders, or a combination of these. Schools and PVI providers should, where reasonably practicable, be flexible in how they offer the free entitlement. The 15 hours must be provided free of charge. Some providers will be able to offer additional hours for which parents will be charged, but this cannot be a condition of accessing the free provision.

From September 2017, many three and four year olds will be eligible to an additional 15 hours of free early year’s education. These additional hours are primarily for the children of working parents in households where both parents are working (or the sole parent is working in a lone parent family) and include self-employed and those working on zero hours contracts. Parents must check their eligibility with HMRC. If they are eligible they will be issued with an 11 digit code which they should take to their school/provider in order to secure a place for the additional hours. Parents are only legally entitled to start claiming for a 30 hours place the term following the date they receive the decision from HMRC. Free early years education funding is available for eligible two year olds the term following their second birthday in some schools and many day nurseries, pre schools and childminder settings. If the household income is less than £16,190 a year and receiving Tax Credits/or is less than £15,400 and in receipt of Universal Credit/ or if parents are on certain benefits, children can access up to 15 hours per week with an early years provider. Parents may choose their free early years provision from a range of council-run, private, voluntary or independent educational settings or a combination of these. Some parts of Derbyshire provide council-run nursery schools or classes. Children may be considered for a place on a part-time basis of up to 15 hours per week, but usually they cannot join until the start of the term following their third birthday.

Parents should contact the head teacher/manager of the relevant school or setting which they wish their child to attend. If too many places are requested in council-run schools or nurseries, governors will use the following order of priorities:

1. Looked after children and children who were looked after but ceased to be so because they were adopted (or became subject to a residence order or special guardianship order).

2. Children living in the normal area served by the school at the time of application and admission who have brothers or sisters attending the school at the time of application and admission. For a definition of living in the normal area see note * on page 14.

3. Children living in the normal area of the school at the time of application and admission.

4. Children not living in the normal area served by the school but who have brothers or sisters attending the school at the time of application and admission. See note ** on page 15.

5. Other children whose parents have requested a place.

Where, in the case of 3 or 4 above, choices have to be made between children satisfying the same criteria, those children living nearest to the school (measured by the nearest available route) will be given preference.

PVI providers will set their own admissions criteria which must be made available on request.

Please note:

Eligible two year old children securing a place in a school nursery will automatically move into the three and four year old provision.

Parents have no automatic right to a nursery place for their child in their normal area school. Parents should not be allocated places in more than one council-run school for their child. The rules on admissions and appeals, as explained on pages 13 to 18, do not apply to nursery schools and classes.

Priority should be given to children accessing the universal offer of 15 hours before places for the additional hours are allocated.

If a child cannot be admitted to a nursery class at their parents’ preferred school they should make representations to the headteacher in the first instance.

Providers of nursery education should adopt an inclusive approach, promoting equality of opportunity, particularly to the most disadvantaged, children in care and children with a disability or special need.

Transferring from early years to primary education

Primary education

Children who have received early years provision or attended a council run nursery school or class will normally go into full time infant education in September in the school year in which they become five years old.

A place in a school’s nursery class or co-located chiIdren’s centre childcare setting does not guarantee a reception place; a new application must be made for a reception place.

By law, you must arrange for your child to start school full time at the beginning of the term (in this context, a term is as defined in legislation, see below) after his or her fifth birthday – unless you make arrangements to educate your child otherwise than at school.

All children are eligible for a full-time place in the September following their fourth birthday.

On the offer of a place you have the right to defer admission until later in the school year but not beyond the point at which the child reaches compulsory school age and not beyond the beginning of the final term of the school year for which the place was offered. You can also request that your child attends part-time until they reach compulsory school age.

If your child is summer born (i.e. born between the beginning of April and end of August) and you do not take up a reception place in the academic year and choose to make an application for the following September, the application will normally be considered for admission into year 1.

Exceptionally, if your child is summer born and you do not feel they are ready for school you can request that they enter reception class in the September after their fifth birthday. If you are considering this option you should in the first instance discuss it with your child’s pre-school provider, prospective future headteacher and any other professionals involved as soon as possible. If after discussion you then wish to make a formal request you should contact the Admissions and Transport Team for a copy of the Council’s policy on the admission of children outside of their normal age group by emailing [email protected] or call 01629 537479.

Requests should be submitted in the spring term and no later than the 31 March preceding the normal year of admission and will need to be accompanied by evidence to show that delayed admission into reception would be in the child’s best interests. All relevant factors will be considered when assessing requests against the Council’s policy on the admission of children outside of their normal age group.

Please note that if a request is not agreed then a place may be offered in year 1.

Note In this context, ‘term’ relates to one third of the academic year i.e. autumn, spring and summer. Parents should note that we operate a six term year – for example – Derbyshire’s autumn term one and two are equivalent to one term as defined in legislation.

Children’s Centres

Derbyshire has children’s centres across the County. These provide a range of services to children under 5 and their families. This includes the provision of early years education with day care in some centres as well as a range of services including family support, health access and links to Jobcentre Plus, training and adult education.

Extended services – childcare

Many schools offer before and after school activities for which there is a small charge. This can either be delivered by the school or by a partner organisation. For further details of which schools offer out of school childcare please contact Call Derbyshire on 01629 533190.

Children with special educational needs

The term ‘special educational needs’ is used when children have a learning difficulty or disability, which makes it harder for them to learn than most children of the same age.

A child with special educational needs may need extra help or different help from other pupils of the same age. Only a few children with special educational needs require a detailed assessment by us. This assessment was formally called a statutory assessment of special educational needs, however from 1 September 2014 it is known as an education, health and care needs assessment.

Following education, health and care needs assessment, the Council may decide to issue an Education, Health and Care Plan which describes your child’s needs and how they should be met. It gives you the opportunity to express a preference for which school your child should attend.

It is Derbyshire’s policy to meet children’s needs, wherever possible, in mainstream schools including those schools with enhanced resource status.

Most children with an Education, Health and Care Plans will be educated in mainstream schools, but places at enhanced resource and special schools are given to some pupils with an Education, Health and Care Plan.

Placing a child outside their normal age group

The year group with which a child is taught has implications for a child’s social as well as educational development. We believe it is better for children to stay within their peer group. For children whose attainments either fall significantly below or exceed the expected levels at a particular key stage, the Council considers that in almost all cases a child’s individual needs can be met by schools without accelerated or delayed admission to another year group.

Exceptionally, a child may be admitted outside of their normal year group. Such a decision will be based on the circumstances of each case and before making a formal request parents are strongly advised in the first instance to discuss the matter with their child’s current headteacher, prospective future headteacher and any other professionals involved. If after discussion, parents wish to make a

formal request they should contact the Admissions and Transport Team for a copy of the Council’s policy on the admission of children outside of their normal age group by emailing [email protected] or call 01629 537479.

Requests should be accompanied by evidence to show that the child’s admission outside of their normal age group is in the child’s best interests. All relevant factors will be considered when assessing requests against the Council’s policy on the admission of children outside of their normal age group.

Please note that if a request is not agreed then a place may be offered in another year group. School charging policy Charges may not be made for any cost associated with anything your child does during the school day. Schools may ask for voluntary contributions for school visits.

Each governing body is required to tell parents details of the school’s charging and remissions policy.

Will my child have to wear uniform? Uniform is decided by each school’s board of governors.

Other financial assistance The County Council has no general scheme of assistance to provide school clothing, clothing grants or any other financial help to parents. In exceptional circumstances, where a child is prevented from attending school, the council’s education welfare service can give advice on what financial help might be available. For transfer from infant schools to junior schools 98% were offered their first preference and 99% one of their three preferences.

Oversubscription Criteria Where schools have more applications than places, Governors will apply the following criteria in the order listed.

Children who have an Educational Health and Care Plan (EHCP) (see Note 1) which names the school will be admitted. This will reduce the number of places available. 1. Catholic looked after or previously looked after children. (See Notes 2 and 3). 2. Catholic (see Note 3) children living in the parish(es) served by the school 3. Catholic (see Note 3) children living outside the parish(es) served by the school 4. Other looked after or previously looked after children (see Note 2). 5. Catechumens, Candidates and members of Eastern Christian Churches (see Notes 4, 5 and 6) 6. Children of other Christian denominations whose membership is evidenced by a minister of religion (see note 7) 7. Children of other faiths whose membership is evidenced by a religious leader (see note 8) 8. Any other children not within categories 1-7.

First priority within the Oversubscription Criteria will be given to applications from children who will have siblings (see note 9) attending the school at the proposed time of admission. Distance

Tie Breakers If any of the above categories are oversubscribed, (after sibling priority) preference will be given to children who live nearest to the school. The county council has a Geographic Information System (GIS) to measure the route. It is measured by a straight line distance calculated to within two metres. This measurement is taken from the postal address file, normally the house front door. For schools the grid reference is again taken from the postal address file and will be the centre of the school. The distance will be measured by the local authority and that data will be supplied to the governors.

In a very few cases, it may not be possible to decide between the applications of those pupils who are the final qualifiers for a place (eg children who live at the same address or have the same distance measurement). In this exceptional situation, if there is no other way of separating the applications then the governors will admit the additional child above the planned admissions number. If however, admission would result in the legal limit of 30 children being exceeded, then the place will be allocated by drawing lots.

Notes (these form part of the oversubscription criteria) 1. An Education, Health and Care Plan (EHCP), is a plan made by the Local Authority under section 37 of the Children and Families Act 2014, specifying the special educational provision required for a child. 58

2. A “looked after child” is a child who is: (a) in the care of a Local Authority, or (b) being provided with accommodation by a Local Authority in the exercise of their social services functions (see the definition in s.22(1) of the Children Act 1989) at the time of making an application to a school. A “previously looked after child” is a child who: (a) ceased to be looked after because they were adopted (this includes children who were adopted under the Adoption Act 1976 [see s.12 adoption orders] and children who were adopted under the Adoption and Children’s Act 2002 [see s.46 adoption orders] , or (b) became subject to a child arrangements order (under the terms of the Children Act 1989 s.8, as amended by s.12 of the Children and Families Act 2014 - an order settling the arrangements to be made as to the person with whom the child is to live), or (c) became subject to a special guardianship order (see S.14A of the Children Act 1989 - an order appointing one or more individuals to be a child’s special guardian [or special guardians]). 3. ‘Catholic’ means a member of a Church in full communion with the See of Rome. This includes the Eastern Catholic Churches. This will normally be evidenced by a certificate of baptism in a Catholic Church or a certificate of reception into full communion with the Catholic Church signed by a Catholic Priest and stamped with the parish stamp. For the purposes of this policy, it includes a looked after child who is part of a Catholic family where a letter from a priest demonstrates that the child would have been baptised or received if it were not for their status as a looked after child (i.e. a looked after child in the process of adoption by a Catholic family). For a child to be treated as Catholic, evidence of Catholic baptism or reception into the Church will be required. Those who have difficulty obtaining written evidence of baptism should contact their Parish Priest. 4. ‘Catechumen’ means a member of the catechumenate of a Catholic Church. This will normally be evidenced by a certificate of reception into the order of catechumens or a letter of verification signed by the parish priest and stamped with the parish stamp. 5. ‘Candidate’ means a candidate for reception into the Catholic Church. This will normally be evidenced by a letter of verification signed by the parish priest and stamped with the parish stamp. 6. ‘Eastern Christian Church’ includes Orthodox Churches, and is normally evidenced by a certificate of baptism or reception from the authorities of that Church. 7. ‘Children of other Christian denominations’ means children who are members of a Church or religious community that practises Trinitarian baptism recognised by the Catholic Church, and is normally evidenced by a Baptism Certificate , a Certificate of Dedication or a letter of verification signed by the minister of religion for that church. 8. ‘Children of other faiths’ means children who are members of a religious community that does not fall within the definitions 3-7 above. This is normally evidenced by a Baptism Certificate, a Certificate of Dedication or a letter of verification signed by the religious leader of the community. 9. ‘Siblings’ means a child who lives as a brother or sister in the same house, including natural brothers or sisters with either one or both parents in common, adopted brothers or sisters, stepbrothers or sisters, foster brothers or sisters, or the child of a parent’s partner where the child for whom the school place is sought is living in the same family unit at the same address as that sibling. It also includes natural brothers or sisters where the child for whom the school place is sought is not living in the same family unit as the same address as that sibling. 10. A ‘parent’ means all natural parents, any person who is not a parent but has parental responsibility for 59

a child, and any person who has care of a child. 11. Home Address: The governors of each school use the same definition as used by the Local Authority within which the school is located. 12. For the purposes of this policy, parish boundaries are as shown on the map available on the school website

Oversubscription criteria for English Martyrs Academy Where schools have more applications than places available, Governors will draw up a ranked list based on the criteria listed below and will allocate places accordingly. Oversubscription criteria for St Joseph’s Academy, Langwith Junction

Where schools have more applications than places available, Governors will draw up a ranked list based on the criteria listed below and will allocate places accordingly. Children who have an Educational Health and Care Plan (EHCP) (see Note 1) which names the school will be admitted. This will reduce the number of places available.

First priority within the Oversubscription Criteria will be given to applications from children who will have siblings attending the school at the proposed time of admission.

2. Children resident within the civil parishes of Youlgrave and Middleton by Youlgrave.

3. Siblings of pupils attending the school at the time of admission. For the purposes of this criterion, siblings shall include children brought up in the same household.

4. Children of whom at least one parent or carer has regularly (i) worshipped at the Churches and Chapels of Youlgrave and Middleton Parishes for a period of at least one year prior to the date of application (ii).

5. Other children whose parents have requested a place.

Notes: (i) Regular means an average attendance of once per month (ii) Church attendance must be verified by a letter from the relevant priest, minister or churchwarden.

Oversubscription Criteria Where the number of applications exceeds the standard number then the governing body will allocate on the following criteria:

Children with a Statement of Special Educational Needs or an Education Health Care Plan which names the school will be admitted.

1. Children who are in public care and children who were in care and have become subject to a child arrangement, special guardianship or adoption order.

2. Children of parents living in the Parish.

3. Children who have a sibling in school at the time they are admitted (sibling means a brother or sister or an adopted brother or sister, or fostered at the same address).

4. Children of whom at least one parent or carer has regularly (1) worshipped at St John the Baptist, Tideswell for a period of at least six months prior to the date of application (2).

(1) Regular means an average attendance of once per month. (2) Church attendance must be verified by a letter from the relevant priest, minister or churchwarden.

5. In the event of a tie break priority will be given to other children who live nearest the school as measured by the straight line. (*See note below).

*Note If any of these categories are oversubscribed, the governing body will make a decision based on the shortest distance between the applicant’s home and the main entrance of the school as measured by the council. The nearest to the school will be given priority. This distance “tie breaker” will be in any of the five categories, if two or more applicants are equal in all other respects.

4. Children of whom at least one parent or carer has regularly (A) worshipped at a church within Wirksworth Team Ministry (B) for a period of at least one year prior to the date of application (C).

A. Regular means an average attendance of once per month. B. A list of churches within Wirksworth Team Ministry is available in school. C. Church attendance must be verified by a letter from the relevant priest, minister or churchwarden.

Priority will next be given to children living in the normal area served by the school at the time of application and admission who have brothers or sisters attending the school at the time of application and admission. 3. Priority will next be given to children living within the normal area at the time of application and admission. A map of the school’s normal area is available on the schools website. Children living on the boundary line will be considered to be living within the normal area. 4. Priority will next be given to siblings of pupils who will already be on the roll of the school at the time of the admission. For the purposes of this criterion, siblings shall include children brought up in the same household 5. Other children Tie-break ‘If in categories 2-5 above a tie-break is necessary to determine which child is admitted, the child living closest to the school will be given priority for admission. 2. Children with a sibling already on the school roll at the time of application and admission. For the reasons of clarity a definition of sibling is as follows:  A brother and/or sister  A half-brother and/or half-sister  A legally adopted child regarded as a brother or sister  A step-brother and/or step-sister residing in the same family unit

3. Children who live within the ecclesiastical parish of St Mary the Virgin.

4. Children whose parents/guardians have requested a Christian education. A letter of support from a priest, minister or pastor, who knows the family and can confirm *regular attendance at public worship, must be included with the application.

5. Other children whose parents request a place and who can be accommodated within the admission number.

The order of applicants within any of the above criteria will be determined by their proximity to the school. This will be measured by straight line distance as plotted on the children’s services department geographic information system. This measurement is taken from the postal address file, normally the house front door. For schools the grid reference is again taken from the postal address file and will be the centre of the school.

*Regular Church attendance for at least a year prior to the date starting school for a parent or carer. It is not necessary for the child to attend with the adult to meet this requirement. They would need to attend at least once a month. The Churchwarden would monitor this as different clergy come each week to take services. The school would need to inform the church if this was needed.

Dinting CE Voluntary Aided Primary, Glossop

Oversubscription Criteria Children who have a statement of Special educational needs or an EHC which names the school will be admitted before the criteria are applied.

The school will always give priority to children living in the parish of Holy Trinity, Dinting Vale, but is pleased to consider applications from families not resident in the parish, unless the total number seeking admission exceeds the school’s published admission number. Where applications for admissions exceed the number of places available, the priority will be determined as follows:

1. Looked after children and children who were looked after but ceased to be because they were adopted (or became subject to a child arrangements or special guardianship order). 2. Children resident in the ecclesiastical parish of Holy Trinity Dinting: a map is available in school.

3. Children who will have siblings in school on the date that they will take up the place (siblings are brothers and sisters, as well as step, adopted or fostered brothers and sisters resident at the same address).

4. Children of whom at least one parent or carer has regularly (1) worshipped at their local church for a period of at least one year prior to the date of application (2).

(1) Regular means an average attendance of once per month. (2) Church attendance must be verified by a letter, from the relevant priest, minister or churchwarden.

(the application should be supported by a letter, signed by a priest, minister or pastor indicating regularity and duration of church attendance).

5. Other children whose parents have requested a place.

Tie Breaker In the event of Governors having to make a choice between applications of equal strength, places will be allocated on the basis of those children living nearest to the school.

3. Children who have brothers or sisters already attending the school. (iii)

4. Children of parents resident in the Parish (or beneficial area) in which the school is situated. (iv)

5. Other children.

(i) ‘Looked After’ children include any child who is subject to a Full Care Order, an Interim Care Order, accommodated under Section 20 of the Children Act 1989 or is remanded or detained in Local Authority accommodation under Criminal Law, adopted children and children with a residence or special guardianship order who were previously looked after.

(ii) The DBE recommends that the description, Children whose parent/s* (the church attendance of one parent is satisfactory to fulfil the criteria) are regular (i.e. at least once a month) worshippers at St. Peter and Paul Parish Church and who must support their application with a letter of confirmation (specifying both the regularity and duration of [for the period of at least one year prior to the application] church attendance) from the Parish Priest or a Churchwarden.

Children whose parent/s* (the church attendance of one parent is satisfactory to fulfil the criteria) are regular (i.e. at least once a month) worshippers at another Anglican Parish Church and who must support their application with a letter of confirmation (specifying both the regularity and duration of [for the period of at least one year prior to the application] church attendance) from the Parish Priest or a Churchwarden.

Children whose parent/s* (the church attendance of one parent is satisfactory to fulfil the criteria) are regular (i.e. at least once a month) worshippers at a Christian Church recognised as a member of Churches Together in England and who must support their application with a letter of confirmation (specifying both the regularity and duration of [for the period of at least one year prior to the application] church attendance) from the Priest or Minister concerned. (b)

(iii) ‘Sibling’ means a child who matches the criteria below who will be educated in school at the time of admission.  Children who have one or both natural parents in common.  Children who are related by a parent’s marriage.  An adopted or fostered child.

(iv) ‘Resident’ means that the child’s ordinary place of residence is a residential property at which the person or persons with parental responsibility is/are living at the time the application for the school place is made.

When the school is oversubscribed a tiebreaker will apply. In the case of a tie, priority will be given to the child living nearer to the school, measured by the straight line from the front door of the child’s home address (including flats) to the main entrance of the school, (using the Local Authority’s computerised measuring system).

Eckington Junior School

The admissions criterion for Eckington Junior School is as follows:

(i) Looked after children and children who were looked after but ceased to be so because they were adopted (or became subject to a residence order or special guardianship order).

(ii) Children attending Eckington Junior School’s main contributory infant school, that is Birk Hill Infant School and who have older brothers or sisters* attending the school at the time of application and admission.

(iii) Children attending the main contributory infant school (Birk Hill) at the time of application.

(iv) Children whose parents have requested a place at the school who have brothers or sisters attending the school at the time of application and admission.

(v) Other children whose parents have requested a place.

Fairmeadows Foundation Primary, Newhall

Oversubscription Criteria If the school is oversubscribed after the admission of pupils with a Statement of SEN or an Education Health Care Plan where the school is named in the statement, priority for admission will be given to children who meet the criteria set out below in order:

1. Children in Care or a child who was previously in care but immediately after being looked after became subject to an adoption, child arrangement or special guardianship order.

2. Children who have siblings currently attending the school at the time of their admission.

The term sibling includes a half-brother or half-sister, a legally adopted child who is regarded as a brother or sister, a step- brother or step-sister who resides in the same family unit.

3. Where there are clear medical or social grounds provided and these are supported by a written statement of evidence from a doctor, social worker or education welfare officer at the time of original application.

4. Children of staff at the school where a member of staff has been employed at the school for two or more years at the time at which the application for admission to the school is made.

5. Proximity of the child’s home to the school measured by the local authority computer generated measuring system (information on this is available on request) with those living nearest being given priority. Proximity will also be used as a tiebreaker in the event of oversubscription in any of the above criteria.

For reasons of clarity a definition of sibling is as follows:  A brother and/or sister  A half-brother and/or half-sister  A legally adopted child regarded as a brother or sister.  A step-brother and/or step-sister residing in the same family unit. The older sibling should be attending the school at the time of new admission.

3. Other children who live within St Mary’s Parish boundary and/or the normal catchment area of Fritchley CE (Aided) Primary School. A map of St Mary’s Parish Boundary is available in the School Office.

4. Children of whom at least one parent or carer has regularly1 worshipped at a Christian Church, recognised as a member of Churches Together in England (including Religious Society of Friends (Quakers) and Fritchley Congregational Chapel) for a period of at least one year prior to the date of application2.

5. Other children whose parents have requested a place at Fritchley CE (Aided) Primary School.

In cases where the last available place pertains to a single place of residence from which two or more applications have been received, the allocation of places within that place of residence will be made by the drawing of lots.

Hathersage St Michael’s CE Voluntary Aided Primary

Oversubscription Criteria The Governing Body will use the priorities below when considering parents’ (see footnote (i)) requests for the admission of their children to the School.

1. Children with a Statement of Special Educational Needs or an Education Health Care Plan.

2. Children in public care and children who were looked after but ceased to be because they were adopted or became subject to a child arrangement or special guardianship order.

3. Children of families residing within the parish of the school. (The parishes of Hathersage and Outseats).

4. Siblings (see footnote (ii)), adopted or foster brothers/sisters of pupils attending the school in the year of admission.

5. Children whose parents have requested education in the Christian Faith and who can provide evidence that one parent has regularly attended a Christian church for one year (see footnote (iii)).

6. Children of staff in either or both of the following: a) Where the member of staff has been employed at the school for two or more years at the time at which the application for admission to the school is made and/or b) The member of staff is recruited to fill a vacant post for which there is a demonstrable skill shortage

7. Others that don’t fall into any of the above categories.

Tie-breaker: Pupils living nearer the school would have preference. This would be judged by the straight line. (See footnote (iv))

(i) Where evidence is provided at the time of application of an exceptional social, medical or pastoral need of the child which can most appropriately be met at this school, the application will be placed at the top of the category in which the application is made. Distances are calculated on the basis of a straight-line measurement between the front door of the child’s home address (including the community entrance to flats) and the main entrance of the school using the local authority’s computerised measuring system. In the event of distances being the same for two or more children where this would determine the last place to be allocated, random allocation will be carried out and supervised by a person independent of the school. All the names will be entered into a hat and the required number of names will be drawn out.

In deciding on admissions to John King Infant Academy and Longwood Infant Academy, the following order of priority will be adopted. 1. Oversubscription Criteria

The school welcomes applications from parents of pupils with special educational needs. A pupil with a Statement of Special Educational Needs or an Education Health Care Plan which specifies the school will be given automatic priority for admission.

In the event that applications received by the governors exceed the number of places available, preferences for admission will be determined using the following criteria:

1. Children in care (Looked After Children).

2. Siblings, including half brothers and sisters or adopted/foster brothers and sisters of pupils already in the school and living at the same address at the time of the proposed admission. 3. Children of staff who are employed as class teachers within the school.

4. Children of whom at least one parent or carer has regularly worshipped at a Christian church, which is a member of Churches Together in England, for a period of at least 6 months prior to the date of application.  Regular attendance means an average of at least once per month.  Church attendance must be verified by a letter from the relevant priest, minister or churchwarden.

5. Residence in the ecclesiastical parish of Killamarsh, the normal catchment area of the school.

6. Other children whose parents have requested a place.

Should the number of applicants of equal merit exceed the remaining places available, the shortest distance from home to school will be used as the determinant. The school uses the County Council’s Geographic Information Service (GIS) to measure the straight line calculated to within two metres. The measurement is taken from the postal address file, normally the house front door. For the school, the grid reference is also taken from the postal address file and is the centre of the school.. In the event that the distance between two or more homes and the school is the same the decision will be made by drawing lots.

In cases where the last available place pertains to a single place of residence from which two or more applications have been received the allocation of places within that place of residence will be made by the drawing of lots.

Oversubscription Criteria In the event of oversubscription within any of the criteria listed below, preference will be given to applicants who live closest to the school, as measured in a straight line (by a computerised geographical information system) from a point on the school site to a point at the pupil’s home, i.e. as the crow flies, both identified by the Local Land and Property Gazetteer. Where two or more pupils are equal in all respects and it is therefore not possible to differentiate between them, a method of random allocation by drawing lots will be used to allocate places (supervised by someone independent of the Trust). Pupils who have a Statement of Special Educational Need or an Education, Health and Care Plan, where a Trust academy is named in the child’s statement will be admitted. In this event, the number of places that remain available for allocation will be reduced.

1. Places will first be allocated to a ‘looked after child’ or a child who was previously looked after but immediately after being looked after became subject to an adoption, child arrangements, or special guardianship order. A looked after child is a child who is (a) in the care of a local authority, or (b) being provided with accommodation by a local authority in the exercise of their social services functions in accordance with section 22(1) of the Children Act 1989 at the time of making an application to a school. An adoption order is an order under the Adoption Act 1976 (see section 12 adoption orders) and children who were adopted under the Adoption and Children’s Action 2002 (see section 46 adoption orders). A ‘child arrangements order’ is an order settling the arrangements to be made as to the person with whom the child is to live under section 8 of the Children Act 1989 as amended by section 12 of the Children and Families Act 2014. Attendance at a particular nursery does not guarantee admission to the same academy for primary education. All admission applications to Trust academies must be made to the respective local authority and will be considered against the oversubscription criteria listed above The above criteria (2-5) may be overridden and priority given to an applicant who can establish any of the following:  pupils with special educational needs that can only be met at a particular Trust academy(e.g. where the school has specialist provision)*;  children of travellers, pupils with exceptional medical, mobility, or social grounds that can only be met at a particular Trust academy *.

*Applications in these categories must be supported by a statement in writing from a doctor, social worker or other relevant professional. This is necessary because you will be asking the academy to assess your child as having a stronger case than other children. Each case will be considered on its merits by the governing body of the respective Trust academy

Langwith Bassett Junior Academy

Oversubscription Criteria If the school is oversubscribed, after the admission of pupils with a Statement of Special Educational Needs or an Education and Health Care Plan where the school is named in the statement, priority for admission will be given to those who meet the criteria set out below, in order:

1. Looked after children and children who were looked after but ceased to be so because they were adopted (or became subject to a child arrangements order or special guardianship order).

2. Children who have a sibling attending the school at the time of application and admission. Sibling is defined as • A brother and/or sister 76

• A half-brother and/or half-sister • A legally adopted child being regarded as a brother or sister • A step-brother or step-sister residing in the same family unit

3. Children living in the normal area served by the school at the time of application and admission. A map of the school’s normal area is available in school.

4. Children attending Linton Primary School Nursery who live outside the normal area served by the school. (The School acknowledges the adjudicator’s view that “Parents do not have to send their child to a nursery; they may prefer to keep the child at home or to access other forms of childcare until the child reaches compulsory school age at the beginning of the term in which the child turns five).

5. Other children who live outside the normal area served by the school. Where in the case of 2, 3, 4, or 5 above, choices have to be made between children satisfying the same criteria, those children living nearest to the school (measured straight line) will be given preference.

Litton CE (Aided) Primary

Oversubscription Criteria

1.Children who have a Statement of Special Educational Needs which specifically names the school. 2. Children in Public Care (and children who were in care and became subject to an adoption, residence or special guardianship order.) 3. Children who live in Litton with a sibling already at the school. (Children whose main residence is in that part of the civil parish of Litton that falls within the ecclesiastical parish of Tideswell who will have at least one sibling (step/half/adoptive brothers or sisters living at the same address) at the school at the time of admission 4. Children who live in Litton Children whose main residence is in that part of the civil parish of Litton that falls within the ecclesiastical parish of Tideswell 5. Children from the Wider Area who will have at least one sibling already at school, (step/half/adoptive brothers or sisters living at the same address) at the school at the time of admission, who live the closest distance to the school, where distance is measured by the most direct walking route from the front door of the residence to the front door of the school (using the LA Geographical Information System described in the LA admissions document) 6. Children Whose Parents Attend a Christian Church Children from the wider area where one parent can demonstrate that they have regularly, on an average of once per month, attended a Christian church during the preceding 12 months prior to application. Attendance should be verified by a member of the church leadership. 7.Children from the Wider Area who live closest to school.

In the event of the above criteria resulting in a tie break to the taking of a place, we will use the closest distance to the school as the deciding factor measured by the Local Authority GIS system.

Longstone CE Voluntary Aided Primary, Great Longstone

Oversubscription Criteria Children who have a statement of Special educational need or an Educational Health Care Plan (EHC) which names the school will be admitted before the oversubscription criteria are applied.

In the event of places being oversubscribed, the governors will take into account the following criteria, in order of priority:

1. Looked after children and children who were looked after but cease to be because they were adopted (or became subject to a child arrangement or special guardianship order).

2. Residence in the ecclesiastical parishes of Ashford in the Water, Sheldon, Longstone and Wardlow, and the civil parish of Cressbrook.

3. Siblings of pupils who will already be on the roll of the school at the time of the admission. For the purposes of this criterion, siblings shall include children brought up in the same household.

4. Any other child whose family has applied for a place and who does not qualify for consideration within the above criteria.

In the case of over-subscription in any of the above criteria, the following will be used as a tie-breaker:

 The distance the child lives from the school.  This will be judged using Derbyshire County Council’s geographic information system to calculate the straight line distance. The calculation will be made from the child’s home front door to the centre of the school.

Loscoe Primary School

Children whose parent/s* (the church attendance of one parent is satisfactory to fulfil the criteria) are regular (i.e. at least once a month) worshippers at St. John’s Parish Church and who must support their application with a letter of confirmation (specifying both the regularity and duration of [for the period of at least one year prior to the application] church attendance) from the Parish Priest or a Churchwarden.

3. Children whose parent/s* (the church attendance of one parent is satisfactory to fulfil the criteria) are regular (i.e. at least once a month) worshippers at another Anglican Parish Church and who must support their application with a letter of confirmation (specifying both the regularity and duration of [for the period of at least one year prior to the application] church attendance) from the Parish Priest or a Churchwarden.

4. Children whose parent/s* (the church attendance of one parent is satisfactory to fulfil the criteria) are regular (i.e. at least once a month) worshippers at a Christian Church recognised as a member of Churches Together in England and who must support their application with a letter of confirmation (specifying both the regularity and duration of [for the period of at least one year prior to the application] church attendance) from the Priest or Minister concerned. (b)

5. Children who will have a sibling attending the school at the time of the proposed admission. (c)

6. Children resident within the Ecclesiastical Parish (or Beneficial Area) of Newbold. (d)

7. Other children.

In the case of a tie, priority will be given to the child living nearer to the school, measured by the straight line distance from the front door of the child’s home address (including flats) to the main entrance of the school, (using the Local Authority’s GIS system). In cases where the last available place pertains to a single place of residence from which two or more applications have been received or where the distance between two or more children’s home and the school is the same the allocation of places within that place of residence will be made by the drawing of lots. This will also be the case where parents have shared responsibility for a child following the breakdown of their relationship and the child lives for part of the week with each parent.

1. Any children in care of a Local Authority and children who were looked after but ceased to be because they were adopted or became subject to a child arrangement or special guardianship order.

2. Children living in the catchment area (as defined by the Local Authority).

3. Children who have siblings currently attending the school at the time of admission. The term brother or sister includes:  a half-brother and/or sister  a legally adopted child regarded as a brother or sister  a step-brother and/or sister residing in the same family unit

4. Other children whose parents have requested a place.

Where choices have to be made between children satisfying the same criteria, those children living closest to the school (measured as defined by the Local Authority) will be given preference.

Pennine Way Junior Academy, Church Gresley

Oversubscription Criteria If the number of applications for admission to the school exceeds the school’s Published Admission Number, the following order of priority is used to allocate the available places:

1. Children in care and adopted children as defined in the School Admissions Code (2014).

2. Children having a brother or a sister currently attending at the time of their admission. Brother or sister includes a half-brother or half- sister, a legally adopted child who is regarded as a brother or sister, a step-brother or step-sister who resides in the same family unit; 3. Children attending Church Gresley Infant and Nursery School 4. Children living in the Pennine Way Junior School normal area;

5. Children who have medical or social grounds provided this is supported by a written statement of evidence from a doctor or social worker at the time of original application;

6. Other children on the basis of proximity of the child’s home to school as measured by the straight line distance with those living nearest being given priority.

Proximity will also be used on a tiebreaker in the event of oversubscription in any of the above criteria.

Pilsley C of E (Aided) Primary, Bakewell 80

Oversubscription Criteria Children who have a Statement of Special Educational Needs or Education Health Care Plan which names the school will be admitted.

1. Children in public care and children who were in care but became subject to an adoption, residence or special guardianship order.

2. Residence within the normal area, as defined by the home estate of Chatsworth (map held at school and on the school website).

3. Siblings, adopted/foster brothers or sisters of pupils still attending the school and residing at the same address.

4. Children of whom at least one parent or carer has regularly worshipped at a church recognised by Churches together in Britain and Ireland for a period of at least six months prior to the application. Regular means attendance of on average once per month. Church attendance must be verified by a letter from the relevant priest, minister or senior lay person.

5. All other children not eligible under the above criteria.

In the event of governors having to make a choice between candidates with cases of equal strength, preference will be given to families who live nearest to school, as measured straight line. This will be done according to the County’s Geographical Information System and will measure the straight line distance from the front door to the centre of the school.

If an admission is requested for twins or other multiple births, Governors will not split siblings.

Poolsbrook primary

Redhill Primary (Foundation), Ockbrook

Oversubscription Criteria Parents are advised that priority is given to pupils who live in Ockbrook but this in itself does not guarantee a place.

Where applications for admission into the school exceed the number of places available, the following criteria will be applied in the order set out below, to decide which children to admit. Where after the application of any criterion, there is still a case of oversubscription; the next criterion in the list shall be applied. If after application of all criteria set out in the list there is still oversubscription, then the remaining places available shall be determined by the drawing of lots.

All children whose Statement of Special Educational Needs or an Education Health Care Plan which names the school will be admitted.

1. Children in care or a child who was previously in care but became subject to an adoption, child arrangement or special guardianship order.

2. Children living in the designated area, which is the parish of Ockbrook as defined by the LA in 1993;

3. Children who have siblings currently attending the school at the time of application; who also will be on the school roll at the time the child starts school

4. Where parents can demonstrate that admission to the school is necessary for the social or medical well being of their child. Supporting evidence from a doctor or social worker will be required at the time of application. This statement should provide independent advice which sets out why the child’s needs would be better met at Redhill Primary than elsewhere.

5. Children of staff at the school where the member of staff has been employed for two or more years at the time at which the application for admission to the school is made.

6. Other children by distance from the school with priority for admission given to children who live nearest to the school as provided to the school by the Derbyshire County Council Geographic Information System, with those having the shortest distance taking the highest priority, (see note below). Should Derbyshire County Council not provide this information then the proximity shall be measured by the distance as the crow flies from the entrance to the School reception to the front door of the child’s home with those having the shortest distance taking the highest priority.

2. Siblings, including half brothers and sisters or adopted/foster brothers and sisters of pupils already in the school and living at the same address at the time of the proposed admission.

3. Children of whom at least one parent or carer has regularly worshipped at a Christian church, which is a member of Churches Together in England, for a period of at least 6 months prior to the date of the application.

 Regular attendance means an average attendance of at least once per month.  Church attendance must be verified by a letter from the relevant priest, minister or churchwarden.

4. Residence in the ecclesiastical parish of Dronfield with Holmesfield, the normal catchment area of the school. A map of the ecclesiastical parish is available in school.

5. Other children whose parents have requested a place. Should the number of applicants of equal merit exceed the remaining places available, the straight line distance from home to school will be used as the final determinant. Distance will be measured by the straight line from the front door of the child’s home address (including flats) to the main entrance of the school. The current Local Authority system for measuring this will always be used.

St George’s CE Voluntary Aided Primary, New Mills

Children who have a Statement of Special Educational Needs or an Education Health Care Plan, where the school is named as being the most appropriate educational setting for the child, will be admitted.

Oversubscription Criteria 1. Looked after children are those who are either looked after by the local authority or children who are looked after but cease to be because they were adopted (or became subject to a child arrangement or special guardianship order).

3. Live in the normal catchment area served by the School. A map defining the catchment area forms part of this policy and can be viewed in school upon request.

4. Request for C of E education for those resident outside the normal catchment area. In this case children of whom at least one parent or carer has regularly (1) worshipped at St. George’s Church or any other Anglican church for a period of at least one year prior to the date of application (2). (1) Regular means an average attendance of once per month. (2) Church attendance must be verified by a letter from the relevant priest, minister or churchwarden.

5. Resident in the Parish of St George’s Church but outside the catchment area. A map defining the Parish of St. George’s Church forms part of this policy and can be viewed in school upon request. Home address is determined by the address which child benefit / tax credit is paid to.

6. Other children whose parent(s) have requested a place.

The order of applicants within any of the above criteria will be determined by their proximity to the school. This will be by straight line. The Children’s Services Department has a Geographic Information System (GIS) to measure the straight line distance. Oversubscription Criteria 1. Children looked after in public care including adopted children.

2. Children living within the beneficial area of the school (within the boundaries of the ecclesiastical parish of Matlock) and children living in the village of Riber.

3. Siblings, adopted or foster brothers/sisters of pupils attending the school at the time consideration of the application is given and living at the same address as the sibling at the time of application.

4. Children who live outside the beneficial area of the school but whose parents/guardians/carers has regularly (1) worshipped at St Giles Church, Matlock for a period of at least one year prior to date of application (2).

5. Children who have worshipped at an Anglican church other than St Giles Church for a period of at least one year prior to the date of application.

6. All other children.

When there are more applications than available places pupils will be admitted on the basis of the straight line distance from school measured to the main entrance to the school. (Distance will be measured by the straight line from the front door of a child’s home address to the main entrance of the school using the LA’s computerised measuring system with those living closer to the school receiving the higher priority.)

5. Children who members of other Christian Churches who are members of other Christian denominations (footnote 4) whose parents have sought the written support of their minister and live within the former parish of our St Joseph’s Staveley; Staveley and Barrow Hill.

6. Children who are worshipping members (i.e. at least once per month for at least a period of 12 months prior to application) of other World Faiths whose parents wish their children to be educated in a Christ centred environment and whose parents have the written support of their Faith Leader.

7. Children with a specific educational, medical or emotional need relevant to the school provided that appropriate written evidence from a suitably qualified professional e.g. Doctor or Social Worker submitted with the application.

8. Children whose parents are seeking a Christian environment for their children’s education.

9. Other children.

2. Children who have a sibling attending the school at application and admission (the term sibling shall include step and/or half brothers or sisters resident at the same address as well as adopted and/or fostered siblings).

3. Children living in the normal school area of Long Eaton.

4. Children living outside the normal school area whose parents are supportive of the Christian ethos of the school.

5. Children with special needs that could be best provided for at St Laurence.

6. Other places to be allocated by proximity to the school.

In the event of the governing body having to make a choice between candidates who tie on the criteria above then the precedence will be given to the children living nearest to the school. 8. Any other children. Within each of the categories listed above, the following provision will be applied. The attendance of a brother or sister at the school at the time of enrolment will increase the priority of an application within each category so that the application will be placed at the top of the category in which the application is made after children in (i) above (see note 8)

Tie Break Priority will be given to children living closest to the school determined by the shortest distance. Distances are calculated on the basis of a straight-line measurement between the front door of the child’s home address (including the community entrance to flats) and the centre of school, using the children’s services departments General Information System. In the event of distances being the same for two or more children where this would determine the last place to be allocated, random allocation will be carried out and supervised by a person independent of the school. All the names will be entered into a hat and the required number of names will be drawn out.

Notes (these notes form part of the oversubscription criteria) 1. A Statement of Special Educational Needs is a statement made by the local authority under section 324 of the Education Act 1996, specifying the special educational provision for a child. An Education, Health and Care Plan is a plan made by the local authority under section 37 of the Children and Families Act 2014, specifying the special educational provision required for a child. 2. A ‘looked after child’ has the same meaning as in section 22(1) of the Children Act 1989, and means any child who is (a) in the care of a local authority or (b) being provided with accommodation by them in the exercise of their social services functions (e.g. children with foster parents) at the time of making application to the school. A ‘previously looked after child’ is a child who was looked after, but ceased to be so because he or she was adopted, or became subject to a child arrangements order or special guardianship order. 3. ‘Catholic’ means a member of a Church in full communion with the See of Rome. This includes the Eastern Catholic Churches. This will normally be evidenced by a certificate of baptism in a Catholic Church or a certificate of reception into the full communion of the Catholic Church. For the purposes of this policy, it includes a looked after child who is part of a Catholic family where a letter from a priest demonstrates that the child would have been baptised or received if it were not for their status as a looked after child (e.g. a looked after child in the process of adoption by a Catholic family). For a child to be treated as Catholic, evidence of Catholic baptism or reception into the Church will be required. Those who have difficulty obtaining written evidence of baptism should contact their Parish Priest [who, after consulting with the Diocese, will decide how the question of baptism is to be resolved and how written evidence is to be produced in accordance with the law of the Church]. 4. ‘catechumen’ means a member of the catechumenate of a Catholic Church. This will normally be evidenced by a certificate of reception into the order of catechumens. 5. ‘Eastern Christian Church’ includes Orthodox Churches, and is normally 90

evidenced by a certificate of baptism or reception from the authorities of that Church. 6. “children of other Christian denominations” means children who belong to other churches and ecclesial communities which, acknowledge God’s revelation in Christ, confess the Lord Jesus Christ as God and Saviour according to the Scriptures, and, in obedience to God’s will and in the power of the Holy Spirit commit themselves: to seek a deepening of their communion with Christ and with one another in the Church, which is his body; and to fulfil their mission to proclaim the Gospel by common witness and service in the world to the glory of the one God, Father, Son and Holy Spirit. An ecclesial community which on principle has no credal statements in its tradition, is included if it manifests faith in Christ as witnessed to in the Scriptures and is committed to working in the spirit of the above. All members of Churches Together in England and CYTÛN are deemed to be included in the above definition, as are all other churches and ecclesial communities that are in membership of any local Churches Together Group (by whatever title) on the above basis. 7. “children of other faiths” means children who are members of a religious community that does not fall within the definition of ‘other Christian denominations’ at 6 above and which falls within the definition of a religion for the purposes of charity law. The Charities Act 2011 defines religion to include: A religion which involves belief in more than one God, and A religion which does not involve belief in a God. Case law has identified certain characteristics which describe the meaning of religion for the purposes of charity law, which are characterised by a belief in a supreme being and an expression of belief in that supreme being through worship. 8. ‘brother or sister’ includes: (i) all natural brothers or sisters, half brothers or sisters, adopted brothers or sisters, stepbrothers or sisters, foster brothers or sisters, whether or not they are living at the same address; and (ii) the child of a parent’s partner where that child lives for at least part of the week in the same family unit at the same address as the applicant. 9. A ‘parent’ means all natural parents, any person who is not a parent but has parental responsibility for a child, and any person who has care of a child. 10. Taddington and Priestcliffe CE Aided Primary

Oversubscription Criteria Individual pupils who have a Statement of Special Educational Needs or an Education Health Care Plan which names the school will be admitted.

1. Looked after children or children who were looked after but ceased to be because they were adopted (or became subject to a child arrangement or special guardianship order).

2. Residence within the catchment area – a map is available in school.

3. Siblings of pupils attending the school at the time of admission, including step-brothers and sisters, adopted children, and other children living permanently in the household. (Places cannot be allocated on the basis that a sibling is a former pupil, including siblings who were on roll at time of application but will have left by the time the child starts school.)

4. Children of whom at least one parent or carer has regularly worshipped at a Christian Church for a period of at least one year prior to the date of the application.

(1) Regular means an average attendance of once per month. (2) Church attendance must be verified by a letter from the relevant priest, minister or churchwarden.

5. Other children whose parents have requested a place. Those living closest to the school as measured by straight line using the LA’s Geographic Information System(GIS).

Oversubscription Criteria Where applications for admissions exceed the number of places available, the following criteria will be applied in the order set out below to decide which children to admit.

Children who have a statement of Special Educational Needs or an Education Health Care Plan that names The Curzon Primary School will be admitted.

1. Children looked after in public care. Looked after children are those who are either looked after by the local authority or children who were looked after but ceased to be so because they were adopted (or became subject to a child arrangement or special guardianship order).

2. Children whose home is in the Parish or beneficial area in which the school is situated, and who have one or more siblings currently attending the school at the time of application and admission, and of whom at least one parent or carer has regularly worshipped at a Christian church for a period of one year prior to the date of application.

3. Children whose home is in the Parish or beneficial area in which the school is situated, and who have one or more siblings currently attending the school at the time of application and admission.

4. Children whose home is in the Parish or beneficial area in which the school is situated, and of whom at least one parent or carer has regularly worshipped at a Christian church for a period of one year prior to the date of application.

5. Children whose home is in the Parish or beneficial area in which the school is situated.

6. Children who have one or more siblings currently attending the school at the time of application and admission, and of whom at least one parent or carer has regularly worshipped at a Christian church for a period of one year prior to the date of application.

7. Children who have one or more siblings currently attending the school at the time of application and admission.

8. Children of whom at least one parent or carer has regularly worshipped at a Christian church for a period of one year prior to the date of application.

9. All other children whose parents have requested a place.

Siblings are considered to be children who live at the same address and either have one or both natural parents in common; or are related by a parent’s marriage, or are adopted or fostered.

In the event of an over-subscription of children meeting any of the above criteria, the Governors will give priority according to the proximity of the child’s home to the school – the local authority’s system will be adopted to measure the shortest distance from home to school as the straight line.

The Fitzherbert CE Voluntary Aided Primary, Fenny Bentley

Oversubscription Criteria 1. Children in public care, including those children recently leaving public care through adoption, child arrangement order or special guardianship.

2. All children whose Statement of special educational (SEN) needs or an Education Health Care Plan (EHC) names Fitzherbert as choice of school.

3. Residence in the parishes (beneficial areas i.e. Church boundaries) of Fenny Bentley, Thorpe and Tissington (a map is available in the school).

4. Siblings, adopted, step or foster brothers / sisters of pupils who are resident at the same address who are in school at the time of application and admission.

5. Children of regular worshippers at the Parish Church who live outside the school’s defined area. Regular worship means attendance of one service per month over a sustained period of time (12 to 24 months). This application must be supported by a letter from the relevant priest or church warden.

6. Other children whose parents have requested a place.

Where, in the case of 4, 5, and 6 above, choices have to be made between children satisfying the same criteria, those children living nearest to the school (measured by the nearest available route) will be given preference.

The County Council has a Geographic Information System (GIS) to measure the straight line distance.. The measurement is taken from the postal address file, normally the house front door.

For schools, the grid reference is again taken from the postal address file and will be the centre of the school.

Tintwistle CE (Aided) Primary

Oversubscription Criteria 1. Looked after children or adopted children who were previously looked after.

2. Children with any special medical or social circumstances affecting the child where these needs can only be met at this school.

3. Children who are resident in the parish of Tintwistle.

4. Children who have a sibling in school who will still be attending school the following year.

5. Children of staff who have been employed in the school for more than two years or who will meet a skills shortage.

6. Children whose parents are involved in the work and worship of Christ Church or URC, Tintwistle.

7. Children whose parents are involved in the work and worship of a Christian church, as recognised by Churches Together in Britain and Ireland.

8. Children who live nearest to the school, measured along the shortest safe walking route.

If there are not enough places to admit all applicants meeting any one criterion, the governors will apply the subsequent criteria, in order of priority, to all these applicants. Children with a statement of special educational needs naming the school do not form part of the oversubscription criteria and should have a note from the local authority indicating that they will be admitted.

Notes (a) Professional supporting evidence from e.g. a doctor, psychologist, social worker, is essential if admission is to be made under the criterion for special medical or social circumstances, and such evidence must set out the particular reasons why the school in question is the most suitable school and the difficulties which would be caused if the child had to attend another school.

(b) A map showing the boundaries is available from the local authority.

(c) Siblings include step, half, foster, adopted brothers and sisters living at the same address and full brother and sister living apart.

(d) A parent is any person who has parental responsibility for or is the legal guardian of the child.

(e) By involved in the work and worship of a church we mean named on the electoral roll of the church. It is sufficient for just one parent to be involved. Parents wishing to inform the school of their commitment to the church should complete the school’s supplementary form. This information will be verified with your incumbent or minister or other church officer.

(f) Straight line will be calculated by the Local Authority’s GIS using postal addresses to within 2m of the front door. The school’s grid reference is calculated from the centre of the school. In the event of a tie break a random paper draw will be undertaken by an independent body.

The Mease Spencer Academy

Oversubscription criteria When the school is oversubscribed, after the admission of pupils with an Education, Health and Care plan or a Statement of Special Educational Needs naming the school, priority for admission will be given to those children who meet the criteria set out below, in priority order:

1. Looked after children and children who were previously looked after but immediately after being looked after became subject to adoption, a child arrangements order, or special guardianship order.

2. Priority will next be given to children living in the normal area served by the school at the time of application and admission who have brothers or sisters attending the school at the time of application and admission. 3. Priority will next be given to children living within the normal area at the time of application and admission. A map of the school’s normal area is available on the schools website. Children living on the boundary line will be considered to be living within the normal area. 4. Priority will next be given to siblings of pupils who will already be on the roll of the school at the time of the admission. For the purposes of this criterion, siblings shall include children brought up in the same household 5. Other children

Tie-break ‘If in categories 2-5 above a tie-break is necessary to determine which child is admitted, the child living closest to the school will be given priority for admission. Distance is measured from the child’s home to the front gates of the school in a straight line. Children from multiple births will both/all be admitted if they meet this criteria. Admission of children outside their normal age groupParents may request that their child is admitted outside their normal age group. To do so parents should include a request with their application, specifying why admission out of normal year group is being requested and the year group in which they wish their child to be allocated a place.

When such a request is made, the academy trust will make a decision on the basis of the circumstances of the case and in the best interests of the child concerned, taking into account the views of the headteacher and any supporting evidence provided by the parent.

Waiting lists

The school will operate a waiting list for each year group. Where the school receives more applications for places than there are places available, a waiting list will operate until the end of the first term after the beginning of the school year. This will be maintained by the Academy Trust and it will be open to any parent to ask for his or her child’s name to be placed on the waiting list, following an unsuccessful application.

Children’s position on the waiting list will be determined solely in accordance with the oversubscription criteria. Where places become vacant they will be allocated to children on the waiting list in accordance with the oversubscription criteria. The waiting list will be reordered in accordance with the oversubscription criteria whenever anyone is added to or leaves the waiting list.

Turnditch CE Voluntary Aided Primary

Oversubscription Criteria If the school is oversubscribed, after the admission of pupils who have a Statement of Special Educational Needs or an Education Health Care Plan which names the school, priority will be given to those who meet the criteria set out below:

1. Children in public care and children who were looked after but ceased to be because they became subject to a child arrangement, special guardianship or adoption order.

2. Residence in the school’s defined area including the parishes of Hazelwood, Shottle, Idridgehay and Ireton Wood. (See map in school).

3. Siblings of current pupils (older sibling must be in school when younger sibling starts).

For clarification the definition of a sibling is as follows:  A brother or sister.  A half-brother or half-sister.  An adopted brother or sister.  A step-brother or step-sister.  A child for whom the school place is sought is living in the same family unit at the same address as that sibling.

4. Children of whom a least one parent carer has regularly (1) worshipped at All Saints Church, Turnditch for a period of at least one year to the date of application (2).

(1) Regular means an average attendance of once per month. (2) Church attendance must be verified by a letter from the relevant priest, minister or churchwarden.

5. Children who live outside the school’s defined area who are regular worshippers at a Parish Church with no church school (see 4 above for criteria of regular worshipper).

6. Any other children.

In the event of oversubscription a final choice will be made on the basis of the travelling distance the child lives from the school. Distance will be measured using the Local Authority’s computerised measuring system.

4. Children of whom at least one parent or carer has regularly worshipped at a Christian church for a period of at least one year prior to the date of application. For the reasons of clarity a definition of:-  regular” means an average attendance of once per month  “Christian church” is as defined by the Council for  Churches in Britain and Ireland  Church attendance must be verified by a letter from the relevant priest, minister or church warden.

5. All other children not eligible under the criteria.

Where choices have to be made between children satisfying the same criteria, those children living closest to the school (as defined by the Local Authority) will be given preference.

Whitecotes Primary

This academy follows the same arrangements as the Council’s admissions policy – see pages 13-16 of the guide

William Gilbert Endowed CE (Aided) Primary, Duffield Oversubscription Criteria After the admission of pupils with a Statement of SEN or an EHC, the following criteria will be applied:

1. Children looked after by a Local Authority or adopted children who were previously in care (as defined in the school admissions code).

2. Children from families living in the ecclesiastical parish (beneficial area) in which the school is situated with siblings. Older siblings should be attending the school at the time of application and admission. (See map, which is available at school).

3. Children from families living in the ecclesiastical parish (beneficial area) in which the school is situated, without siblings.

4. Children of whom at least one parent or carer has regularly (Footnote 2) worshipped at their local Church for a period of at least 1 year prior to the date of application. (Footnote 3).

5. Children living outside the area but with a sibling already attending the school.

6. Children living outside the area without a sibling already attending the school.

In the event of the school being oversubscribed in any of the above criteria the distance tie-breaker will be applied:

Distance will be measured from the front door of the child’s home address to the main entrance of the school (using the Local Authority’s computerised measuring system). Those living closer to the school receive the higher priority.

If the distance between two or more children’s homes and the school is the same, the allocation of the place will be made by the drawing of lots.

In cases where the last available place pertains to a single place of residence from which two or more applications have been received (twins, triplets, etc.) the statutory limit may be exceeded.

Footnote 1 Sibling refers to brother or sister, half brother or sister, adopted brother or sister, step brother or sister or the child of the parent/carers partner where the child from whom the school place is sought is living in the same family unit at the same address as that sibling.

Footnote 2 Regular means an average attendance of once per month.

Footnote 3 Church attendance must be verified by a letter from the relevant priest, minister or churchwarden.
