Judson A Compliant Court: The Political Effects of the Addition of Judgeships to the United States Supreme Court Following Electoral Realignments Lauren J. Judson ABSTRACT During periods of turmoil when ideological preferences between the federal branches of government fail to align, the relationship between the three quickly turns tumultuous. Electoral realignments especially have the potential to increase tension between the branches. When a new party replaces the “old order” in both the legislature and the executive branches, the possibility for conflict emerges with the Court. Justices who make decisions based on old regime preferences of the party that had appointed them to the bench will likely clash with the new ideological preferences of the incoming party. In these circumstances, the president or Congress may seek to weaken the influence of the Court through court-curbing methods. One example Congress may utilize is changing the actual size of the Supreme The size of the Supreme Court has increased four times in United States history, and three out of the four alterations happened after an electoral realignment. Through analysis of Supreme Court cases, this thesis seeks to determine if, after an electoral realignment, holdings of the Court on issues of policy were more congruent with the new party in power after the change in composition as well to examine any change in individual vote tallies of the justices driven by the voting behavior of the newly appointed justice(s). -

WILLIAM O'BRIEN, S.J.* Washington's First Appointees Although the work of the Supreme Court during the first few years was not great if measured in the number of cases handled, it would be a mistake to conclude that the six men who sat on the Bench during this formative period made no significant contribution to the develop- ment of American constitutional law. The Justices had few if any precedents to use as guides, and therefore their judicial work, limited though it was in volume, must be considered as stamped with the significance which attaches to all pioneer activity. Moreover, most of this work was done while on circuit duty in the different districts, and therefore from Vermont to Georgia the Supreme Court Justices were emissaries of good will for the new Constitution and the recently established general government. -

(3 boxes). Frank, John P., 1917-2002- John P. Frank, a noted attorney and constitutional scholar, was born in 1917. He received his LL.B. at the University of Wisconsin, and his J.S.D. from Yale University. He was law clerk to Justice Hugo L. Black at the October, 1942 term, among other prominent positions. He taught law from 1946 to 1954 at Indiana and Yale Universities. He has authored 12 books on the Supreme Court, the Constitution and constitutional law. A senior partner with the Phoenix firm of Lewis and Roca, which he joined in 1954, Frank was lead counsel on the ground-breaking Miranda v. Arizona case, and served as counsel to Anita Hill during the Clarence Thomas confirmation hearings. While serving on the Committee on Rules of Civil Procedure, Frank led a group that worked on drafting revisions to Rule 11 attorney sanctions. Frank also served from 1960 to 1970 on the Advisory Committee of Civil Procedure of the Judicial Conference of the United States. Scope and Content: The collection consists of research into U.S. Supreme Court nominations of the 19th and 20th centuries, and includes 8 inches of printed materials and 7 microfilm reels (35mm), 1823-1939 (bulk 1860-1939), collected by Frank, for a research project concerning Supreme Court nominations. -
Does Eliminating Life Tenure for Article Iii Judges Require a Constitutional Amendment?
DOW & MEHTA_03_15_21 (DO NOT DELETE) 3/17/2021 6:41 PM DOES ELIMINATING LIFE TENURE FOR ARTICLE III JUDGES REQUIRE A CONSTITUTIONAL AMENDMENT? DAVID R. DOW & SANAT MEHTA* ABSTRACT Beginning in the early 2000s, a number of legal academicians from across the political spectrum proposed eliminating life tenure for some or all Article III judges and replacing it with a term of years (or a set of renewable terms). These scholars were largely in agreement such a change could be accomplished only by a formal constitutional amendment of Article III. In this Article, Dow and Mehta agree with the desirability of doing away with life tenure but argue such a change can be accomplished by ordinary legislation, without the need for formal amendment. Drawing on both originalism and formalism, Dow and Mehta begin by observing that the constitutional text does not expressly provide for lifetime tenure; rather, it states that judges shall hold their office during good behavior. The good behavior criterion, however, was not intended to create judicial sinecures for 20 or 30 years, but instead aimed at safeguarding judicial independence from the political branches. By measuring both the length of judicial tenure among Supreme Court justices, as well as voting behavior on the Supreme Court, Dow and Mehta conclude that, in fact, life tenure has proven inconsistent with judicial independence. They maintain that the Framers’ objective of insuring judicial independence is best achieved by term limits for Supreme Court justices. Copyright © 2021 David R. Dziengowski INTRODUCTION “Periodical appointments, however regulated, or by whomsoever made, would, in some way or other, be fatal to their necessary independence.”1 At the conclusion of the American Revolution in 1783, the average human lifespan was about thirty-five years.2 The Framers, dissatisfied with the Articles of Confederation, convened the Constitutional Convention in Philadelphia, Pennsylvania, on May 25, 1787. Article III of the resulting U.S. Constitution provided judges of the “supreme and inferior Courts” with presumptive life tenure.3 Fast-forward more than two centuries. ~epartment of Wustite PROCEEDINGS IN THE SUPREME COURT OF THE UNITED STATES IN MEMORY OF JUSTICE GOLDBERG Monday, October 15, 1990 REMARKS OF THE ATTORNEY GENERAL OF THE UNITED STATES MR. CHIEF JUSTICE, and may it please the Court: The Bar of this Court met today to honor the memory of Arthur Joseph Goldberg, Associate Justice of the Supreme Court from 1962 to 1965. Arthur Goldberg served the Nation with distinction as a lawyer, soldier, Cabinet officer, Supreme Court Justice, and diplomat. Born in Chicago in 1908, he was educated in the Chicago public schools and at Northwestern University, where he , was first in his law school class and Editor-in-Chief of the Law Review. By special dispensation, Arthur Goldberg sat for the Illinois bar examination before he reached the age of 21. He was admitted 'to the Illinois bar in 1929 and began a general law I practice in Chicago. He opened his own law office in 1933, and soon began hanaling labor matters for clients such as the United Steelworkers and the Chicago Newspaper Guild. During World War II, Arthur Goldberg served under William J. Donovan as Chief of the Labor Division in the Office of strategic services. He carried out several intelligence missions to Europe, where he organized transportation workers into a valuable Allied intelligence network. After the war, he resumed his law practice and soon gained recognition as a preeminent labor lawyer. He served as general - 2 counsel to the United Steelworkers from 1948 to 1961. As general counsel to the Congress of Industrial Organizations, Arthur Goldberg played a major role in the merger of that organization and the American Federation of Labor in 1955. -

The Constitution in the Supreme Court: The Protection of Economic Interests, 1889-1910 David P. Curriet The Supreme Court's first hundred years virtually ended with the death of Chief Justice Morrison R. Waite in March 1888. Five of Waite's brethren-Stanley Matthews, Samuel F. Miller, Joseph P. Bradley, Samuel Blatchford, and Lucius Q.C. Lamar-left the Court within the next five years, and a sixth-Stephen J. Field-hung on after his powers had faded.1 By 1894, Melville W. Fuller2 presided over an essentially new Court consisting of David J. Brewer, Henry B. Brown, George Shiras, Howell E. Jackson, and Edward Douglass White3 in addition to the three holdovers, John M. Harlan, Horace Gray, and Field. Jackson and Field soon gave way to Rufus W. Peckham and Joseph McKenna; Gray and Shiras, after the turn of the century, were replaced by Oliver Wendell Holmes and William R. Day. William H. Moody and Horace R. Lurton served briefly at the end of Fuller's term, and another mas- sive turnover accompanied Fuller's death in 1910. Thus the per- sonnel of Fuller's twenty-one-year tenure is well separated from that of the preceding and following periods. Moreover, although twenty Justices sat during this time, eleven did the lion's share of the work: Harlan, Gray, Fuller, Brewer, Brown, Shiras, White, t Harry N.
