The subcommittee met at 9:10 a.m., at West Madison Agricul- tural Research Center, Hon. Herb Kohl (chairman) presiding. Present: Senator Kohl. STATEMENT OF SENATOR HERB KOHL Senator KOHL. It’s a privilege to be with you and we do appre- ciate very much your taking the time, folks, to come to this hearing on food safety. I know everybody has busy schedules and I believe our topic demands some thoughtful attention and that’s exactly what we’re going to give it today. We’re also happy to have such a good gathering here this morning. I especially want to thank our witnesses. Some of you traveled all the way from Washington. We appreciate that very much. Oth- ers have traveled all the way across town. Whether you came 1,000 miles or 5, nevertheless, the important thing is to make progress on the thing that we care about very much and that’s food safety. As the chairman of the Senate subcommittee that funds our pri- mary food agencies, both the FDA and the USDA, I think we have not just an opportunity but also an obligation to turn comments and ideas into meaningful actions and accomplishments. We cer- tainly have enough scientific and intellectual heft in this room to make a difference. By way of introduction, our panels will include the Commissioner of the Food and Drug Administration, Dr. Andrew von Eschenbach, the Director of the FDA Center for Food Safety and Applied Nutri- tion, Dr. Bob Brackett. Dr. Brackett, I’m happy to say, is returning to his home roots. He is a Wisconsin native and a UW graduate. We also have with us Dr. Pat Verduin, the Senior Vice President of Scientific and Regulatory Affairs for the Grocery Manufacturers and Food Products Association; Mr. Tom Stenzel, President and CEO of the United Fresh Produce Association, which represents growers, shippers and packers for fresh vegetables and produce; Ms. Caroline Smith DeWaal from the Center for Science in the Public Interest, a group representing consumers and finally; Dr. Michael Pariza, the Director of the Food Research Institute, which is located right here in Madison. FDA regulates a wide range of products valued at more than $1 trillion in the U.S. economy. The agency plays a key public health role. FDA is responsible for the safety of most foods (human and animal) and cosmetics, and it regulates both the safety and the effectiveness of human drugs, biologics (e.g., vaccines), medical devices, and animal drugs. In congressional hearing testimony and at other public venues, former FDA Commissioners, interest group representatives, and former high-ranking individuals in the agency or in the Department of Health and Human Services have argued that FDA is underfunded and at risk of being unable to fulfill all the statutory responsibilities assigned by Congress. Reports by the Institute of Medicine, the Government Accountability Office, and the FDA Science Board have made similar observations. The main voices in support of FDA budget levels, past and present, have been representatives of the various presidential administrations. Calls for cutting the FDA budget or maintaining it at the current level come from organizations, such as CATO and the Hoover Institute, that propose limitations on the agency’s authority and, therefore, its need for funding.

LD 659 has been signed by Governor Mills and will now become law.     Importation Would Threaten Public Health and the Integrity of the U.S. Prescription Drug Supply with No Guarantee of Any Cost Savings Opening our closed distribution system to importation would gravely compromise the integrity and safety of the U.S. prescription drug supply. Importation presents a huge opportunity for unscrupulous suppliers and/or criminal organizations to increase the flow of substandard, adulterated or counterfeit drugs – including pills laced with deadly fentanyl – into the U.S. FDA is the gold standard in ensuring the safety and effectiveness of medicines for the U.S. market. Importation would have the same effect as repealing current FDA and consumer protections. • No Secretary of HHS, of either party, has been able to certify that importation is safe, nor have they been able to certify that it would provide significant cost savings to Americans. Even in 2020, despite claims to the contrary, the Secretary was no more able to certify than his predecessors and questionably circumvented the statute by punting the responsibility to state governments. • FDA Commissioner Stephen Hahn stated in 2020 that “Consumers and physicians purchasing medicines cannot be assured the products they are receiving are legitimate, safe, or effective if they are obtained from outside of the FDA-regulated pharmaceutical supply chain.”1 • Four former FDA Commissioners from both Republican and Democratic administrations wrote a letter to Congress stating that importation “could lead to a host of unintended consequences and undesirable effects,
