MINUTES OF THE SENATE AGRICULTURE AND NATURAL RESOURCES COMMITTEE

The meeting was called to order by Chairperson at 8:30 am on Wednesday, January 27, 2021, in room 144-S of the Capitol.

Final action on: SB38 — Establishing the Kansas pesticide waste disposal program and permitting up to $50,000 to be transferred annually from the Kansas agricultural remediation fund to a new Kansas pesticide waste disposal fund. Chairperson Kerschen called for final action on SB38.

Tamera Lawrence of the Revisor of Statutes Office explained the bill.

Some discussion followed. Senator Peck raised a concern about the language on page 3, line 14 and asked to strike the language that says with no identifiable owner or responsible party. Senator Francisco raised the question of the meaning of that particular phrase..is it the pesticide or the site with the unidentifiable owner. Senator Peck then moved and Senator Fagg seconded to amend the bill by striking the language that says no identifiable owner or responsible party. Senator Francisco again raised her previous concern. More discussion followed and Senator Peck withdrew his motion.Senator Francisco then moved and Senator Doll seconded that line 14 would read with no identifiable party that have been abandoned or illegally dumped at that site. Motion carried. Senator Peck then moved and Senator Francisco seconded the bill,as amended,be favorably passed. Motion carried.

Hearing on: SB39 — Changing Kansas department of agriculture division of animal health license, permit and registration renewal deadlines and allowing the animal health commissioner to recover the actual cost of official calfhood vaccination tags. Chairperson Kerschen opened the hearing on SB39.

Tamera Lawrence of the Revisor of Statutes Office explained the bill.

Dr. Andy Hawkins spoke in favor of the bill. He told the committee that the bill sets September 30 as the license, permit, and registration deadline for KDA's large animal programs and provides KDA the ability to recover the actual cost of providing RFID tags for OCV use as we continue promoting and enhancing animal disease traceability within the state of Kansas and beyond.(Attachment 1)

After a brief discussion, Chairperson Kerschen closed the hearing on SB39.

Hearing on: SB40 — Updating provisions related to the Kansas department of agriculture division of conservation. Chairperson Kerschen opened the hearing on SB40.

Tamera Lawrence of the Revisor of Statutes Office explained the bill.

Kenneth Titus spoke in support of the bill. He believes that the adoption of this bill will clarify the operation of the Division of Conservation and provide much needed modernization of the Conservation Districts Law and related acts.(Attachment 2)

A balloon amendment with some language changes was presented to the committee. Senator Doll moved and Senator Fagg seconded to add this amendment to the bill. Motion carried. (Attachment3)

Chairperson Kerschen closed the hearing on SB40.

With no further business before the committee, Chairperson Kerschen adjourned the committee at 9:20.
