Trump further promised to crack down on special interest-influence by expanding the definition of lobbyist to include consultants and others who trade on inside government information and expertise.2 But Trump’s nascent transition team, which will shape his administration, is swarming with lobbyists and other special interests. Many of the lobbyists are working for the transition on areas for which they currently are lobbying the federal government. Meanwhile, many of those who aren’t lobbyists appear to have potential conflicts of interest. Vice president-elect Mike Pence reportedly said on November 15 that the transition team would be purged of lobbyists, but the transition team has not made the point official.3 Even if true, that remedy would not address cases such as a defense contractor working on defense interests, or a lawyer for health care interests working on health care reform. The Filibuster and Reconciliation: The Future of Majoritarian Lawmaking in the U.S. Senate Tonja Jacobi†* & Jeff VanDam** “If this precedent is pushed to its logical conclusion, I suspect there will come a day when all legislation will be done through reconciliation.” — Senator Tom Daschle, on the prospect of using budget reconciliation procedures to pass tax cuts in 19961 Passing legislation in the United States Senate has become a de facto super-majoritarian undertaking, due to the gradual institutionalization of the filibuster — the practice of unending debate in the Senate. The filibuster is responsible for stymieing many legislative policies, and was the cause of decades of delay in the development of civil rights protection. Attempts at reforming the filibuster have only exacerbated the problem. However, reconciliation, a once obscure budgetary procedure, has created a mechanism of avoiding filibusters. Consequently, reconciliation is one of the primary means by which significant controversial legislation has been passed in recent years — including the Bush tax cuts and much of Obamacare. This has led to minoritarian attempts to reform reconciliation, particularly through the Byrd Rule, as well as constitutional challenges to proposed filibuster reforms. HEMEL** I INTRODUCTION The year 2017 was, among other distinctions, the year of the Byrd rule. This once-obscure Senate procedural provision—on the books since 1985 but only recently the stuff of page one news1— featured prominently in several failed attempts to repeal the Affordable Care Act in the spring and summer. Then again at year’s end, the Byrd rule played a central role in the successful effort to rewrite large swaths of the Internal Revenue Code. While the Byrd rule has influenced the legislative process in the past, never before has it drawn so much attention from the mainstream and trade press, and never before has it shaped so consequential a law in such a significant way. One theme that runs throughout this article is that when it comes to the budget math mandated by the Byrd rule, numbers can obscure the truth. -

INTRODUCTION Despite bipartisan consensus on the need to expand federal appellate and district courts, it is unlikely that a lower court expansion bill could survive a Senate filibuster. We write to argue that a statutory measure expanding lower federal courts could be enacted via budget reconciliation because such a measure clears the reconciliation process’s highest hurdle, known as the ‘merely incidental’ standard of the Byrd Rule. The Byrd Rule (codified at 2 U.S.C. § 644) is a Senate procedural mechanism that limits the types of provisions that can be included in budget reconciliation bills, which require a simple majority of Senators to pass. Though measures must satisfy six distinct elements of the Byrd Rule to be included in a reconciliation bill, the criterion known as the ‘merely incidental’ standard typically is the most difficult hurdle to overcome. As we show below, a statutory measure expanding federal appellate and district courts meets the Byrd Rule’s ‘merely incidental’ standard. First used on a temporary basis in 1985 and 1986, the Byrd Rule was extended and modified until its incorporation into the Congressional Budget Act in 1990.1 The Senate Parliamentarian, a nonpartisan civil servant, determines whether text in a budget reconciliation bill satisfies the Byrd Rule.2 Senators challenge provisions they oppose and the Parliamentarian, after considering legal arguments for and against, recommends whether each contested measure can be included in the bill. -
