    The Filibuster and Reconciliation: The Future of Majoritarian Lawmaking in the U.S. Senate Tonja Jacobi†* & Jeff VanDam** “If this precedent is pushed to its logical conclusion, I suspect there will come a day when all legislation will be done through reconciliation.” — Senator Tom Daschle, on the prospect of using budget reconciliation procedures to pass tax cuts in 19961 Passing legislation in the United States Senate has become a de facto super-majoritarian undertaking, due to the gradual institutionalization of the filibuster — the practice of unending debate in the Senate. The filibuster is responsible for stymieing many legislative policies, and was the cause of decades of delay in the development of civil rights protection. Attempts at reforming the filibuster have only exacerbated the problem. However, reconciliation, a once obscure budgetary procedure, has created a mechanism of avoiding filibusters. Consequently, reconciliation is one of the primary means by which significant controversial legislation has been passed in recent years — including the Bush tax cuts and much of Obamacare. This has led to minoritarian attempts to reform reconciliation, particularly through the Byrd Rule, as well as constitutional challenges to proposed filibuster reforms. Then again at year’s end, the Byrd rule played a central role in the successful effort to rewrite large swaths of the Internal Revenue Code. While the Byrd rule has influenced the legislative process in the past, never before has it drawn so much attention from the mainstream and trade press, and never before has it shaped so consequential a law in such a significant way. INTRODUCTION Despite bipartisan consensus on the need to expand federal appellate and district courts, it is unlikely that a lower court expansion bill could survive a Senate filibuster. We write to argue that a statutory measure expanding lower federal courts could be enacted via budget reconciliation because such a measure clears the reconciliation process’s highest hurdle, known as the ‘merely incidental’ standard of the Byrd Rule. The Byrd Rule (codified at 2 U.S.C. § 644) is a Senate procedural mechanism that limits the types of provisions that can be included in budget reconciliation bills, which require a simple majority of Senators to pass. Though measures must satisfy six distinct elements of the Byrd Rule to be included in a reconciliation bill, the criterion known as the ‘merely incidental’ standard typically is the most difficult hurdle to overcome. As we show below, a statutory measure expanding federal appellate and district courts meets the Byrd Rule’s ‘merely incidental’ standard. First used on a temporary basis in 1985 and 1986, the Byrd Rule was extended and modified until its incorporation into the Congressional Budget Act in 1990.1 The Senate Parliamentarian, a nonpartisan civil servant, determines whether text in a budget reconciliation bill satisfies the Byrd Rule.2 Senators challenge provisions they oppose and the Parliamentarian, after considering legal arguments for and against, recommends whether each contested measure can be included in the bill.

The MRPA impacted the ground and was destroyed. At the time of the mishap, the MRPA was operated by a mission control element (MCE) from the 20th Attack Squadron (ATKS), Whiteman AFB, Missouri. The estimated cost of aircraft and munition damage is $5.2 million. There were no injuries or damage to other government or private property. While transiting to the operations area, the MP identified a layer of clouds directly ahead and above the MRPA’s altitude as haze and flew the MRPA into an area of rapidly changing weather undergoing the beginning stages of thunderstorm development. Lightning was present in the vicinity of the MRPA. The MQ-1B is not equipped with lightning protection, thus the effects of lightning induced high voltage throughout the wiring in the MRPA’s wings, damaging the left and right wing control modules.

It had been only fourteen years since the first powered flight and ten years since the Aeronautical Division of the U.S. Army Signal Corps had been formed. Air power was in its infancy and growing. The possibilities were endless. New innovations were occurring everywhere you looked but the Great War raged in Europe and the U.S. was gearing up for its part in that war. Three squadrons familiar to us all were formed at Kelly Field, Texas - the 55th, 77th and 79th Aero Squadrons. It is believed the first 78th Aero Squadron was also formed there. Only the 55th’s history would survive this initial formation to connect with the current squadrons. The Air Service hadn’t yet figured out what it would look like, so there were many fits and starts as the service grew. By September the three squadrons had their designations changed to Aero Construction Squadrons. On Sept. 17, 1917 the 55th Aero Construction Squadron was on its way to N.Y. for deployment to France.

EXECUTIVE SUMMARY AIRCRAFT ABBREVIATED ACCIDENT INVESTIGATION MQ-1B Predator, T/N 08-3245 USCENTCOM AOR 7 JANUARY 2016 On 7 January 2016, at approximately 1000 hours Zulu (Z), while conducting a combat support mission in the United States Central Command (USCENTCOM) area of responsibility (AOR), the mishap remotely piloted aircraft (MRPA), an MQ-1B Predator aircraft, tail number (T/N) 08-3245, forward deployed from the 432d Wing, Creech Air Force Base (AFB), Nevada, experienced a primary control module (PCM) failure resulting in loss of aircraft control. The MRPA impacted the ground and was destroyed. At the time of the mishap, the MRPA was operated by the mishap mission control element (MMCE) from the 20th Attack Squadron (20 ATKS), Whiteman AFB, Missouri.

The Senate will continue considering the Endless Front Act (the $100 billion technology innovation package). Additionally, budget hearings across all agencies are ongoing this week. Biden/Capito Infrastructure Negotiations Collapse President Biden and Senator Shelley Moore Capito (R-WV) met again this week to negotiate a bipartisan agreement on infrastructure. Biden on Friday rejected the Republicans’ offer, proposed by Capito to add about $50 billion to their $928 billion infrastructure plan. With Biden calling for $1 trillion in new spending, both sides remained hundreds of billions apart. Accordingly, it has been reported that bipartisan infrastructure talks between Biden and Capito are over as of this evening. The president will now focus on working with a bipartisan group of 20 senators. Meanwhile, Senate parliamentarian Elizabeth MacDonough has effectively ruled that Democrats can only use the budget reconciliation process one more time during 2021. MacDonough determined that a revision to the 2021 budget resolution cannot be automatically discharged from the Senate Budget Committee, requiring Democrats to secure at least one Republican vote on the panel whose members are split 11-11 along party lines. Democrats had hoped to use reconciliation to advance the President’s Build Back Better agenda – passing the American Jobs Plan, the American Families Plan, and health care reform proposals to expand the Medicare program and lower the price of prescription drugs over multiple reconciliation packages.
