  • Law and Order
THE HAMLYN LECTURES Thirty-seventh series Law and Order Ralf Dahrendorf K.B.E., F.B.A. STEVENS Law and Order by Ralf Dahrendorf K.B.E., F.B.A. Professor of Social Science in the University of Constance; formerly Director of the London School of Economics In this book, based on his 1985 Hamlyn Lectures, Professor Ralf Dahrendorf considers the fundamental questions posed for the social order of free countries by the decline in respect for the law. Taking as his point of departure the terrors of our streets and the riots in our football grounds, Professor Dahrendorf discusses the implication for social order and liberty of such issues as unemployment, the cracks in the party system and the growing disorientation of the young. There are four major themes in the book— • The Road to Anomia—crime statistics are but the most dramatic symptoms of a loosening of social ties and norms. • Seeking Rousseau, Finding Hobbes—a widespread dream of goodness has resulted in the dismantling of some of the institutions designed to protect us from badness. • The Struggle for the Social Contract—underlying social changes have led from the class struggle to conflicts about the boundaries of society. • Society and Liberty—most reactions to the new condition involve threats to liberty—we need to reassert the links between law, order and liberty. Professor Dahrendorf has had a most distinguished career, both in his native Germany and in the United Kingdom. In Law and Order he offers a lively and stimulating analysis of a topic of vital importance in the life of every citizen.

INTRODUCTION: THE WHERE, WHAT, AND WHY OF LAW AND LrrERATURE When my first article on law and literature was published in 1989,2 it did not occur to me that I would once again undertake another survey related to the same topic, although I had noted that "the itch of literature" was upon many law professors' minds and that there was much "scratching of [the] pen."' Yet, when I was asked by several law school professors and one liberal arts college professor whether I would consider updating my earlier work, I must confess that I found myself wondering whether the pen-scratching spiders were now revealing their "curious" wares to more flies and whether they were making the parlour a more "habitable" place.4 In an attempt to determine which law schools offered some version of a law and literature course within the law school curriculum in 1987, questionnaires were sent to 175 American Bar Association accredited institutions, and the , Union College (B.S., 1979); College of St.

With the help of his University of Wisconsin colleagues John Kidwell, William Whitford, and Marc Galanter, Macaulay finally put torch 2 to tinder with the 1994 publication of Contracts: Law in Action (CLA). This new book for teaching the first-year law school course in contracts relentlessly develops an understanding of the law as delivered-the "law in action." 3 It then juxtaposes that evidence with traditional staples of more traditional contracts courses,4 and thereby exposes the chasm between con- tract law and real-life business and personal relationships. By focusing on contract law in action, this effort offers a real-life context for Gilmore's ideas of contract law' that is unique in this genre. It is in this real world that lawyers operate; the complex combination of law, business, leverage, com- mon sense, and ideology is what can give law practice its challenge and interest.
