The terms and conditions that need to be complied with before a Certificate of Environmental Audit may be issued are set out as follows:‐ • groundwater quality is restored to provide for the beneficial uses as set out for segment B in SEPP(Groundwaters of Victoria) 1997; • remnant areas of PAH contamination and odour be excavated and validated to comply with the objectives for all sensitive use set out in the SEPP (Prevention and Management of Contamination of Land) 2002 Other related information:‐ • The Environment Protection Authority has determined that groundwater at the site has been cleaned up to the extent practicable and has identified that the site is a Groundwater Quality Restricted Use Zone; and • Groundwater at then site is polluted with arsenic, manganese benzene, chlorobenzene, TPHs, naphthalene and phenolics with regard to the relevant beneficial uses under the SEPP(Groundwaters of Victoria) 1997 This Statement forms part of an environmental audit report (ERM reference 0088692‐01 Rev 0) dated 11 August 2008. Richard Wolfe of ERM Australia Pty Ltd Environmental Auditor pursuant to the Environment Protection Act 1970 Page 2 of 44 ENVIRONMENT PROTECTION ACT 1970 STATEMENT OF ENVIRONMENTAL AUDIT I, Richard Wolfe of ERM Australia Pty Ltd, a person appointed by the Environment Protection Authority (‘the Authority’) under the Environment Protection Act 1970 (‘the Act’) as an environmental auditor for the purposes of the Act, having:‐ 1. been requested by David Penfold of Mirvac Victoria Pty Ltd (Mirvac) to issue a certificate of environmental audit in relation to the site located at the corner of Pickles and Graham Streets Albert Park Victoria 3206, being the former meter shop of the Port Melbourne gasworks described as Crown Allotment 11 Section 82 City of South Melbourne Parish of Melbourne South on Certificate of Title 02347 Folio 245 (‘the site’) owned/occupied by the Mirvac; 2. had regard to, among other things:‐ (i) guidelines issued by the Authority for the purposes of Part IXD of the Act; (ii) the beneficial uses that may be made of the site; and (iii) relevant State environment protection policies/industrial waste management policies, namely: • Victorian State Environment Protection Policy (Groundwaters of Victoria) 1997; • Victorian State Environment Protection Policy (Prevention and Management of Contamination of Land) 2002; and • Victorian State Environment Protection Policy (Waters of Victoria) 2003; in making a total assessment of the nature and extent of any harm or detriment caused to, or the risk of any possible harm or detriment which may be caused to, any beneficial use made of the site by any industrial processes or activity, waste or substance (including any chemical substance); and 3. completed an environmental audit report in accordance with Section 53X of the Act, a copy of which has been sent to the Authority and the relevant planning and responsible authority. HEREBY STATE that I am of the opinion that:‐ The site is suitable for the beneficial uses associated with:‐ • medium and high density residential use (including townhouses) • parks and reserves; • recreation/open space; • agriculture; • commercial use; and • industrial use.
