It is the third of a planned trilogy on the conflict over slavery. Causes of the Civil War and The Civil War will follow. This volume begins with a letter Lincoln penned in the midst of the Civil War, as Union forces retook territory and the U.S. Government Core Documents had to decide how to deal with freedmen and former slaveholders in the subdued rebel territory. It concludes with Frederick Douglass’ reflections in 1883 on a nation still divided racially—still, as he saw it, half slave and Selected and Introduced by half free.     ABOUT THE AUTHOR Louis Fisher is Specialist in Constitutional Law with the Law Library of the Library of Congress. The views expressed here are personal, not institutional. Earlier in his career at the Library of Congress, Fisher worked for the Congressional Research Service from 1970 to March 3, 2006. During his service with CRS he was Senior Specialist in Separation of Powers and research director of the House Iran-Contra Committee in 1987, writing major sections of the final report. Lincoln's Ten Percent Plan Former Confederate states would be readmitted to the Union if 10% of their citizens took a loyalty oath and the state agreed to ratify the 13th Amendment which outlawed slavery. Not put into effect because Lincoln was assassinated. 653. Assassination of April 14, 1865 While sitting in his box at Ford's Theatre watching "Our American Cousin", President Lincoln was shot by John Wilkes Booth. 654. John Wilkes Booth An actor, planned with others for six months to abduct Lincoln at the start of the war, but they were foiled when Lincoln didn't arrive at the scheduled place. April 14, 1865, he shot Lincoln at Ford's Theatre and cried, "Sic Semper Tyrannis!" ("Thus always to tyrants!") When he jumped down onto the stage his spur caught in the American flag draped over the balcony and he fell and broke his leg. He escaped on a waiting horse and fled town. He was found several days later in a barn. He refused to come out; the barn was set on fire. Booth was shot, either by himself or a soldier. 655. Ex Parte Milligan 1866 - Supreme Court ruled that military trials of civilians were illegal unless the civil courts are inoperative or the region is under marshall law. 656. Radical Republicans After the Civil War, a group that believed the South should be harshly punished and thought that Lincoln was sometimes too compassionate towards the South.

    ••••••••••••TENNESSEE CONSTITUTIONAL HISTORY Settlement and 1796 Constitution • The area that became Tennessee was part of the 1663 land grant of North Carolina from Charles II. • In violation of the British Proclamation of 1763 prohibiting settlements west of the Appalachian Mountains, the Watauga settlement was founded in 1771. (T. R's "Great Leap Westward" He wrote that Robertson and Sevier were two of the three greatest leaders in the development west of the mountains, the third being George Rogers Clark) The Watauga Association adopted articles to govern their settlement in 1772—this was the first government west of the mountains. The last British Governor of Virginia, the Earl of Dunmore, wrote in 1774 that Watauga was "a dangerous example to the people of America of forming governments distinct from and independent of his majesty's authority." In 1775, Richard Henderson purchased a large area of Kentucky and Middle Tennessee from the Cherokees--20 million acres for 6 wagon loads of goods. The governments of Virginia and North Carolina refused to recognize it. It was Henderson who was behind the settlement of Nashville in 1779-80. James Robertson led most of the men and the livestock over land to the settlement. John Donelson led a flotilla by water, down the Tennessee River to the Ohio, up the Ohio to the Cumberland, and up the Cumberland to the settlement. The Cumberland Compact was signed in 1780. It provided for the government of the settlement. · After being ignored by North Carolina for many years, the eastern settlements attempt to form the state of Franklin in 1784.

Kosar Analyst in American National Government Government and Finance Division Summary The veto power vested in the President by Article I, Section 7 of the Constitution has proven to be an effective tool for the chief executive in his dealings with Congress. Since the founding of the federal government in 1789, 35 of 43 Presidents have exercised their veto authority a total of 2,550 times. Congress has overridden these vetoes on 106 occasions (4.2%). Presidents have vetoed 80 appropriations bills, and Congress has overridden 12 (15.0%) of these vetoes. This report will be updated at the beginning of each new Congress. Constitutional Basis and Importance To become law, the U.S. Constitution (Article I, Section 7) provides that all bills that have been approved by both houses of Congress must be presented to the President for his approval and signature.1 The President may sign a bill into law within the 10-day period (excluding Sundays) provided in the Constitution,2 let it become law without his signature, or veto it. The Constitution states that, when the President vetoes a bill, “he shall return it, with his Objections to that House in which it shall have originated.” This type of action is called a “regular” or “return” veto. If, on the other hand, Congress has adjourned within the 10-day period after presentation of the bill to the President (thereby preventing the return of the bill to Congress), the President may simply withhold his signature, and the bill does not become law — a practice that has been dubbed a “pocket” veto.3 The President’s veto authority is among his most significant tools in legislative 1 These bills include joint resolutions, but do not include proposed amendments to the Constitution, which require a two-thirds vote in each house, and are sent directly to the states for approval.

THE MAKING OF FEDERAL ENFORCEMENT LAWS, 1870-1872* XI WANG** The Fifteenth Amendment represented the highest achievement of the Republican party's Reconstruction politics. By prohibiting the national and state governments from depriving citizens of the right to vote on the basis of race, color, and previous condition of servitude, the Amendment conferred suffrage on newly emancipated African- American men, thus constitutionalizing the principle and practice of black suffrage which was first established in early 1867. Black partici- pation in Reconstruction not only helped to consolidate the outcomes of the Civil War and congressional Reconstruction, but it also rede- fined the course of American democracy. In order to maintain the vitality and validity of the Fifteenth Amendment, the Republican party had to permanently and effectively implement that Amendment in the South, where anti-black suffrage forces mounted high.
