Builders’ Association of India (BAI), estd., in 1941, is the Apex Body of Indian Construction Industry, having about 20,000 Construction Companies as its members, with around 180 Centres or Branches spread throughout the country. BAI acts as a bridge between the Government and Construction Industry on policy advocacy of the Government and contribute to the economic development of the country. As you are aware, the COVID-19 pandemic and the lockdown enforced in the Country over the last 2 months has caused severe disruptions to the human life like never before and has adversely affected or in fact brought to standstill all spheres of economic activity in the Country. The Infrastructure industry has been no exception and has suffered severe disruption and losses. The Finance Minister of the Govt. of India as part of ‘Atmanirbhar Bharath’ to provide succour and relief to various sectors of the Industry that have been adversely affected has provided Financial Packages for revival of the Industrial sector. As a part of the Atmanirbhar Bharath the MORT&H has notified the following measures for providing relief to the Contractors/ Road developers of Road sector. (i) Schedule-H condition in EPC Contracts to be relaxed to enable payments at monthly interval for the work completed as per specifications (ii) To allow extension of time to contractors under Force Majeure Clause due to COVID pandemic as per instructions in Ref. No. F.18/4/2020-PPD of Department of Expenditure and in accordance with Contract. (iii) Direct payments to approved subcontractors by the Departmental authority towards works done by them wherever competent authority is satisfied that it is required for early completion of work in accordance with contract. (iv) Expeditious approval of change of scope whenever required and payment to the extent of work executed as per specification. (v) Waiver of penalty of delay in submission of Performance Security / Bank Guarantee for new contracts entered into during March 2020 to September 2020, (vi) Performance Security provided by contractor/supplier to be returned by the Contractor (Government Department/Agency) as is proportional to the supplies made/contract work completed as per amendment to GFR 171 issued vide F.18/4/2020-PPDby Department of Expenditure. (vii) Retention Money deducted by the Employer/ Bank Guarantees provided by Contractor/Supplier in lieu of release of retention Money returned to the Contractor (Government Department/Agency) as is proportional to the Supplies made/Contract work completed. Though this measure has not been announced by GOI, they are being requested to consider the same. The above relief measures notified by the GOI/ MoRT&H may be extended to the Contractors/Suppliers executing the Road works, Irrigation works and other Infrastructure works being undertaken by the State Govt./ State Govt. floated PSU’s. The (Maha) Dalit Factor in Bihar’s Politics Shreyas Sardesai* Until the 2010 election for the Bihar Assembly, elections in the state were largely analysed in terms of a six caste categories – Upper castes, Yadavs, other OBCs, Pasis, other Dalits and Muslims. Since 2007 however, Bihar politics has witnessed new developments and the caste dimension of elections cannot be fully understood without taking into account two additional caste categories, namely EBCs or Extremely Backward Classes, and Mahadalits. This chapter seeks to analyse the emergence of latter and its implications. In August 2007, the Nitish Kumar led JDU-BJP government set up the Bihar State Mahadalit Commission to “identify the castes within Scheduled Castes who lagged behind in the development process” and to “study [their] educational and social status and suggest measures for [their] upliftment”. In April 2008, 18 Dalit castes were brought under the Mahadalit category to begin with. These are Bantar, Bauri, Bhogta, Bhuiya, Chaupal, Dabgar, Dom/Dhangad, Ghasi, Halalkhor, Hari/Mehtar/Bhangi, Kanjar, Kurariar, Lalbegi, Musahar, Nat, Pan/Swasi, Rajwar and Turi. Three months later Dhobi and Pasi castes were also added to the Mahadalit category based on the Commission’s recommendation and then Chamars were also included in the Mahadalit category by the state government in November 2009 on the grounds that they too were lagging in literacy and economic status and were victims of untouchability at the hands of other Mahadalit castes1.
