Ford, Ph.D. Principal, Rivanna Archaeological Services, LLC December 4, 2020 Pen Park Cemetery Survey City of Charlottesville M ANAGEMENT S UMMARY Since 2000, several depressions have been noted in the ground surface adjacent to and east of the Pen Park cemetery. At the request of the City of Charlottesville, in September of 2019 Rivanna Archaeological Services staff visited Pen Park Cemetery and confirmed the presence of the unusual depressions. Based on their size, orientation and clustering, it was believed that they could be unmarked burials. In order to determine more conclusively the nature of the surface depressions, Rivanna Archaeological Services proposed a two-tiered research design composed of a Ground Penetrating Radar survey surrounding the entire Pen Park cemetery, as well as ground-truthing of a limited number of surface features and radar anomalies designed to verify the identity of the potential burials. On July 15, 2020, NAEVA Geophysical Inc. conducted a Ground Penetrating Radar survey on a ca. 0.28-acre project area surrounding the Pen Park cemetery enclosure. Based on profile and plan view visualizations, NAEVA identified a total of 43 potential grave shafts located predominantly east of the Pen Park cemetery. An analysis of the Ground Penetrating Radar findings documented that the 43 newly identified grave shafts were located to the rear and behind the Pen Park cemetery, were arranged in at least three rows, and that the grave shafts extended the whole length of the Gilmer, Craven and Hotopp family sections. It is believed that this population of individuals likely represents enslaved African Americans owned by the Gilmer, Craven and other families, as well as possibly African Americans employees and their families associated with the 1866 – 1904 Hotopp farm and vineyard operation at Pen Park. Because of the certainty that the surface depressions and Ground Penetrating Radar anomalies represented a significant sized burial ground, the limited excavation and ground-truthing originally proposed as part of the research design was abandoned. The project area is an approximately 12,800 square foot (0.28 acre) area surrounding the Pen Park cemetery, a brick, stone and iron fence enclosure composed of three sections containing members of the Gilmer, Craven and Hotopp families. The area surrounding the Pen Park cemetery is covered in sod with plantings of large deciduous and evergreen shrubs and trees. Elevation of the project area is approximately 400 feet asl, and the ground slopes down slightly to the south and east. The project area is underlain by the Catoctin greenstone formation, a northeast-southwest oriented band of igneous rock.1 Soils in the project area are a Yadkin clay loam with slope between 2 and 7%. Electronic resource, Accessed September 21, 2020. https://websoilsurvey.sc.egov.usda.gov/App/HomePage.htm. 1 Pen Park Cemetery Survey City of Charlottesville P ROJECT B ACKGROUND AND O BJECTIVES Rivanna Archaeological Services, LLC [RAS] was contacted by the City of Charlottesville in late August of 2019 regarding the presence of several potential graves located outside of and adjacent to the east side of the existing Pen Park cemetery enclosure. On September 3, 2019, RAS staff visited the Pen Park cemetery to conduct a preliminary examination of the ground surface surrounding the existing enclosure. RAS staff confirmed the presence of a limited number of east-west oriented oblong depressions along the east side of the Pen Park cemetery, surface indications that suggested the presence of unmarked graves. Based on the strong potential for the presence of unmarked graves outside of the Pen Park cemetery, RAS developed a research design that proposed a Ground Penetrating Radar (GPR) survey surrounding the Gilmer-Craven-Hotopp family enclosure, coupled with limited archaeological excavations designed to ground-truth a limited number of surface indications and/or GPR anomalies. The goal of the project was to determine if the several potential graves were in fact human interments and to gain a greater understanding of the quantity and extent of potential graves in this area. 2 Pen Park Cemetery Survey City of Charlottesville P REVIOUS R ESEARCH Historical Research A limited amount of historical research has been conducted on the Pen Park property and its associated Gilmer, Craven and Hotopp cemeteries. This research was largely driven by local events including the purchase of the then 134-acre Pen Park estate by the City of Charlottesville in 1971, student research through the Historic Preservation Program of the University of Virginia School of Architecture in the late 1990s, and a conditions and preservation survey of cemeteries maintained by the City of Charlottesville in 2003.

In fact, the U.S is the world’s largest KTI producer – contributing 27% of the total HT manufacturing and 32% of the KI services.1 In order to grow and maintain these positions, the United States, like its peers in Europe and Asia who are also large contributors, has built an extensive R&D infrastructure composed of three strong players: the private sector, the public sector and universities. In terms of expenditures and numbers of employees, the private sector dominates the R&D enterprise, but the university sector, largely funded by the US government, is also an important component both directly and indirectly.

Many of these courses are repurposed as high-end mixed-use development, high-density residential, or big-box development. The sustainable benefits the golf course once provided either diminish or leave completely. As our countryʼs 21st Century needs shift towards food, water, and energy security, bankrupt golf courses can offer repurposing opportunities to plan for those needs. The Methods HIA includes a report on the health impacts of the Existing Conditions alternative park and golf course plans as well as research Literature Review regarding high priority focus areas that were identified by Health Equity Analysis the Community Advisory Committee, including: physical Recommendations activity, social cohesion (community connectedness), Monitoring safety, and environmental health. Evaluation Conclusion Key findings from this Health Impact Assessment include: Obesity The area surrounding the golf course lies within the Fitchburg census block group (014.03.2) ranked #1 for obesity. Nearly 1 in 4 (24%) children ages 2-17 in this area are obese. Within the #2 ranked census block group (014.02.3), 46% of children ages 2-17 were overweight/obese. Mothers giving birth residing in the area also show a higher rate of obesity (30%), when compared to the rest of Fitchburg (21%) and Dane County (22%). Physical Activity Residents and stakeholders perceive there is inadequate open green space and play space for the neighborhood. Residents and stakeholders perceive that access to physical activity opportunities outside of the neighborhood is limited due to language and transportation barriers. Residents living in the Pines apartment complex are perceived to be particularly isolated and lack opportunities for physical activity.

Though the need to face such problems was ubiquitous across the former slaveholding republic, each state contended with such matters uniquely, producing a series of different solutions to the same fundamental problems. Principal among them: Why were there so many legacies of slavery contested in court? How should the law treat slavery and former slaves after the supposed end of the peculiar institution? In what ways did litigants themselves help to shape the meaning of freedom? How complete was the abolition of slavery if the institution itself remained open to ongoing litigation? State courts and individual petitioners were forced to confront the altered legal terrain of the post-Civil War South and negotiate the precise meanings of the Thirteenth Amendment, the end of slavery, the transformation of the former slave states, and ultimately, the reunification of the United States. Evaluating the many responses to these issues exposes legal Reconstruction’s many possibilities; some would become the road not taken, while others set the standard for managing slavery’s remaining legal quandaries.
