1. General Introduction

Lele Community Development Center (LCDC) is non-profit, non- political, non-governmental organization established in 2011. It was registered (22nd March 2011) at the District

Administration Office, Lalitpur and affiliated to the Social Welfare Council (7th April 2011),

Nepal. The organization aims at reducing poverty of rural and urban communities through integrated and sustainable development interventions.

The school building construction project is completely funded by Good Neighbors

International (GNI) . GNI is a humanitarian and development international NGO in general consultative status with the United Nations Economic and Social Council (ECOSOC). It is started from South Korea in 1991 with a mission to make the world without hunger, where people live together in harmony and respect human rights of Neighbors suffering from poverty, disaster and oppression. It has been working continuously with the concept of sustainable community development and enhancing the capacity of poor community people to improve their livelihood and quality of life. GNI has been working in Nepal since 2002 with the objective to improve lives of people, especially children through education, income generating activities, skill development, health/WASH services, advocacy, network building and emergency relief in 20 districts.

2. Project Description and Rationale

Kathmandu district is one of the three districts located in , which itself is located in the hills of Bagmati Zone, Central Development Region, Nepal. The district is located from 27°27′E to 27°49′E longitude and 85°10′N to 85°32′N latitude. The district's headquarters is Kathmandu Metropolitan City, also the capital of Nepal. The district covers an area of 395 km². According to the national population census 2011, the total population of the district is 1,744,240 comprising of 831,239 female (47.66%) and 913,001 male (52.34%) residing in 436,344 households. has an average population density of around 4,416 people per square km.

GNI Nepal has been working in two Municipality (previous Kavresthali, , Sangla and

Jhor Mahankal VDCs) of Kathmandu district since 2002. Of the two municipality (Tarkeshwor and ) are situated at northen part of the district headquarter, Kathmandu Metropolitan

City .

GNI Nepal has been supporting 647 sponsored children of 8 community schools and their family through education, health, water and sanitation, income generation, partnership and network building, advocacy, and disaster risk reduction in Kathmandu district.

A massive 7.8 magnitude earthquake having epicentre in Barpak, Gorkha district struck

Nepal at 06:11 GMT (11.55 AM Nepali time) on 25 April 2015. Altogether, 8,983 people died,

22,323 people were injured, 602,593 houses were destroyed and 284,483 houses were partially damaged (Ref: Ministry of Home Affairs) in the country. Furthermore, public institutions such as health facilities, schools, government offices were badly damaged and regular life of Nepalese people was highly affected. Although the impact of disaster is clearly seen in all of the population of affected areas but pregnant and lactating mothers, adolescent girls, newly-born babies and people with disability are among the most vulnerable groups.

UN-OCHA situation report indicated that 31 out of 75 districts are severely or moderately affected by the earthquake in country’s western and central regions including hilly and mountainous areas. Two community schools in GNI Nepal catchment area (Kathmandu) have been badly affected by the earthquake. Kavresthali Secondary School is one of the

2 | Page completely damaged from earthquake. After earthquake, the teaching and learning environment at school is highly affected because of lack of classrooms. The community people, school management committee (SMC), parent teacher association (PTA) and parents were actively involved to resume the classes at the school and constructed temporary learning center (TLC) for the operation of classes. The TLCs are made up of bamboos and tarpaulins.

Currently with the support of Bibon Buddhism (One of the Korean organization) and

Samyang international Nepal, the school has been able to construct eight classroom and one room has been utilized for school's administration office, one for science lab, one for library.

Since the infrastructure built with the supports of donors is still insufficient, the school is unable to provide the five rooms have been used as the regular classroom. And those five rooms are insufficient for the classes, thus the school has been continuing other classes in

TLC. The TLCs that are in current uses are also not in good condition thus students and teachers have been continuing the study in a fearful environment. The rooms are in the dangerous condition to operate in. The school doesn't have the facility of good drinking water, healthy toilet and suitable playground. The school has been teaching the students with the child friendly education and the school is trying hard to create the appropriate study environment for the students and also to build the proper infrastructure as well as committed to provide quality education.

The overall learning environment of the school, enabling conditions, internal efficiency are very much affected by the lack of suitable infrastructure in schools, therefore construction of school building is necessary to overcome all these problems and address right to quality education of the children.

Given the circumstances described above, the teaching-learning scenarios at the schools are adversely affected. Hence, the reconstruction of school is in need to impart quality education and meet the goal of education of Government of Nepal, International Headquarter of Good

Neighbors International and also the education goal of GNI Nepal and and also the goal of

LCDC (Lele Community Development Center).

3. Construction of School Building

GNI Nepal had a consultancy service to design the school building for the construction

3 | Page project that consist all child-friendly aspects to be addressed. Further the design was was approved from DUDBC, CLPIU and NRA. According to the architectural design, structural analysis, specification and cost estimation, the construction project proceed further.

Therefore, the bidder shall submit the financial proposal separately for each components i.e. materials, civil works, electrical work, metal-alum work and construction work.

4. Objectives

The main objective of the Kavresthali school building construction is to build child friendly school buildings at Tarkeshwor-2, Kavresthali of Kathmandu district.

The specific objectives of school building reconstruction are:

1. To construct child-friendly and disable-friendly schools building in compliance with

the guideline of Central Level Project Implementation Unit (CLPIU) and National

Reconstruction Authority (NRA).

5. Scope of the Work

The construction works will be done at 1 school of Kathmandu i.e. Shree Kavresthali

Secondary School, Tarkeshwor- 2, Kavresthali. The construction of school building should be done on the basis of design and drawing provided by the organization. The project should be completed on the 31st October 2017.

6. Activities

For the construction of school building, the company/firm shall:

i. Conduct consultation meeting with school officials at site.

ii. Conduct meetings regularly with GNI Nepal, LCDC and other relevant

stakeholders.

iii. Construction of school building according to the design, drawing and specification

iv. Reporting

v. Updating the progress of the work

vi. Preparation and submission of report periodically 7. Expected Deliverables

Expected results of the reconstruction of school building are as follows:

i. Inception Report with detailed methodology and work schedule within two weeks

of contract.

ii. Final Report incorporating the feedback from GNI Nepal and LCDC.

iii. Monthly planning

iv. The final delivery should include:

a. Monthly progress report

b. Monthly expenditure status report

The report shall be submitted in English Language in the form of:

1. A hard and electronic copy of the Inception Report.

2. Hard copy and an electronic copy of monthly planning.

3. Hard copy and electronic copy of Monthly Progress Report

8. Duration

The project will start immediately after the agreement signed by both parties and must be completed on the 31st of October 2017.

9. Contractor’s Obligation

The contractor shall;

1. Commence construction immediately after signing the agreement.

2. Construct the school building in accordance with the design, drawing and

specification (Annex).

3. Comply the directors of GNI Nepal, LCDC and its nominated technical supervisor.

4. Only use new materials of type and quality specified in the Bill of Quantities

(Annex).

5. Keep the construction site safe i.e. free of hazardous materials, waste and debris.

6. Not obstruct or unnecessarily interfere with public roads or footpaths on or

surrounding the project site.

7. Corporate with the community/ies working on or inhabitating the project site,

including employees and subcontractors of GNI Nepal, LCDC, government officers

and/or representative of other non-government organizations.

8. Comply with all applicable laws, statutes, ordinances, regulations and by-laws

during the construction and indemnify GNI Nepal and LCDC against any penalties,

fines or other expenses payable by GNI Nepal and LCDC as a result of a failure of

the contractor or its employees, sub-constructors or agents to comply with this

sub-clause.

9. Accept full responsibility for the care and security against bad weather, vandalism,

or any untoward events of the school under construction form the commencement

date until the contractor handovers the school building to LCDC and receives a

certificate of Final Acceptance.

10. Ensure the compliances of GNI Nepal and LCDC child protection policy by

employees directly or indirectly involved in the reconstruction project.

10. Inspection and Testing

At any time prior to the issuance of a certificate of final acceptance, LCDC has the right to reject all or part of the works which after inspected are found to be defective or low quality; materials, workmanship, finishing or any other construction, not conforming to the outlined requirements including survey, drawings, specifications and the Bill of Quantities. The contractor shall, at its own cost and expense, promptly rectify such defects and/or non- conformity to the satisfaction of LCDC.

11. Subcontracting

The contractor shall not subcontract any part, or the whole of the works without the prior written consent of LCDC. In the event, the works are sub-contracted by the contractor; the sub-contractor(s) shall comply with all the terms and conditions of LCDC. The approval of

LCDC will not relieve the contractor of any of its liabilities or obligations. The contractor shall be liable to GNI Nepal and LCDC for the acts, omissions and default of the sub-contractors.

12. Budget and mode of payment

The consultant shall submit budget sheet with detailed breakdown including applicable taxes at the time of proposal submission.

a. The payment shall be made to the account of the company/firm

b. The payment will be made though Account Payee cheque.

LCDC will release 25% of the agreed amount upon signing the agreement. Upon received of the reports and found to be the satisfactory work, LCDC will release the next instalment according to the agreement.

13. General Qualification of the Firm

All public, private and non-governmental organization, registered under the authorized agency of the government of Nepal having the proven experience in the related field are eligible to apply for the project

The company/firm with expertise as outlined below:

a) Proven knowledge and experience of the work on construction school building

b) Highly qualified team to complete the reconstruction project

c) Adequate human resources and equipments required for the project

d) Clear understanding on rights based perspectives

e) Good Understanding and knowledge of governance

f) Strong rapport with ministries, departments and district level line agencies and

other organizations implementing school reconstruction project

g) Ability to maintaining transparency and accountability

h) Company/firm or association should have PAN, Company registration, VAT

registration and Tax clearance certificates etc.

In case of Joint Venture (JV) , all the partners shall be jointly are severely liable for the execution of the agreement in accordance with the terms and condition of the agreement.

Maximum number of JV shall be three. The qualification required of the parties to the JV shall be as specified in school building reconstruction in Kathmandu district.

14. Responsibilities of the company/firm or association

The company/firm or association will be responsible to accomplish the task outlined by this

ToR and ensure the delivery of outputs stated above within the agreed budget and timeline.

15. Responsibilities of LCDC

Remaining within the policies and practices of GNI Nepal head office, its primary responsibility is to help company/firm or association to achieve the objective of this ToR.

16. Responsibilities of GNI Nepal

GNI Nepal will provide technical and financial for the successful completion of the project.

17. Documents to be submitted by the bidder

a. A copy of company/firm registration

b. Organization profile

c. Bid security (5%)

d. A copy of Tax clearance certificate

e. VAT and PAN registration

f. Audit Report

g. Signed CVs of the technician

h. Statements and documents, if any, acknowledging the individual and/or company’s

capability for carrying out the similar kind of services

i. Any other relevant documents

18. Acceptance of Proposal

All rights to accept/reject proposal, without giving any reason, shall be reserved with LCDC,

Lalitpur. If deemed necessary, the company/firm shall be asked for modifications and presentations of the proposal before approval.

The company/firm or association will be selected through Quality Based Selection (QBS) method among the short-listed firms selected from applying firms of this EOI. EOI will be evaluated on general qualification 10%, project related experience 70% and manpower and financial capacity 20%. Only the short-listed consultants will be invited to submit their technical and financial proposal as per teh Request for Proposal decomunts to be issued to them.

19. Management of the Work

The selected company/firm or association shall manage the assessment and be accountable for the timely delivery of the expected quality service.

20. Termination of the Contract

LCDC may terminate the agreement, if the company/firm or association commits a breach in the performance or observance of any of its obligations under this ToR. The company/firm or association shall be notified in written form seven days prior to the termination of the agreement.

21. Confidentiality

During the performance of the assignment or any time after expiry or termination of the agreement, the company/firm or association shall not disclose to any person or otherwise make use of any confidential information which the company/firm or association has obtained or may obtain in the course of the project to LCDC the respondents or otherwise.

22. Copyright

The copyright of the documents produced by the company/firm or association under this

ToR completely belongs to LCDC.

23. How to Submit the proposal/bid

The proposal/bid should reach the address below via courier or hand delivery by the 25th of

June, 2017, 17 hrs (Nepal Local Time). Please, enclose the proposal in an envelope, do seal and mark it with “School Building Reconstruction" and send to:
