Agenda No. 03 GRANT OF TIME BOUND PROMOTION (TBP) TO CANTONMENT BOAim EMPLOYEES.

There are 11 {Eleven) Cantonment Board Fund Servants whom the time bound promotion scales are due and have completed 9, 18 and 27 years of service and have not been granted any promotion. Sh. Nazir Ahmad Bhat, Junior Pharmacist (placed at serial no. 11) have not been granted any promotion from the date of his appointment. However, the said official have been re­ designated from the post of Compounder to Junior Pharmacist vide Dte, DE, NC letter No. 6/32/B/Cantt/ DE/NC/58 dated 29-06-2016. Since, due date of his 1st time bound promotion was 01-05-2-007 and his pay scale as per 6th CPC was to be revised from 52-20200 +(2400 GP) to 5200- 20200 +(2800 GP). The same was also to be revised from 5200-20200 + (2800 GP) to 29200-92300 (Level -5) at the time of implementation of 7th CPC w .e.f 01.01.2016. Further, due date of his 2nd time bound promotion scale was due w .e.f. 01-05-2016 and his pay scale is to be revised from 29200-92300 (Level -5) to 35400-112400, Level 6).

All the employees mentioned below are eligible for grant of next pay scale. The total financial implications of such promotion comes to Rs.34,350/- per month. The expenditure shall be met under Budget head F(9)a, E(G)a & F(l)a. The necessary provision has already been made in the concerned budget heads. s. Agenda No.04 MEDICIAL REIMBURSMENT

To consider and approve a medical reimbursement claim for Rs . 58,450/- submitted by Shri, Mohd Ayoub Sheikh, Water carrier of this Office. The said bill has been verified and countersigned by Authorized Medical Attendant of this Office. This office also verified the same and found correct as per existing Medical Rules. Sanction to incur the aforesaid expenditure of the Cantonment Act' 2006 may kindly be accorded by the board.

Agenda No. OS NOTING/ CONFIRMATION: ALLOTMENT OF PARKING SPACE IN FRONT OF G B PANT CANTONMENT GENERAL HOSPITAL

Board may note and confirm Agenda by circulation No. 01 dated 08/11/2019 called for annual contract for collection of parking fee for the period up to 31st March'2020 from the date of execution of contract agreement. The last date of receipt of online-off-line bids/tenders was fixed up to 24.10.2019 up to 1200. No on-line bid uploaded by any tenderer/ bidder probably due to non­ availability of internet facilities presently in the valley and due to prevailing situation. However, 05 off-line tenders/bids were received by this office which was opened by this office. The details of OS tenders/bids offered by the tenderers/ bidders are as tabulated below:-

The highest bid has offered by Sh. Mohd Yousuf Rather S/o Assaud Ullah Rather R/o Gorepora Barsoo, for Rs. 2,20,000/- ( Rupees two lac twenty thousand only) for the period up to 31st March'2020 i.e. for 4 }'2 months only w.e.f. 16/11/2019. It is pertinent to mention here, that the last year's bid for the year 2018-19 i.e. for the period 21.04.2018 to 20.04.2019 was approved by the Boa rd for Rs.3, 76,000/- (Rupees three lac seventy six thousand only) which is higher than the previous bid received and seems reasonable. Board may note and confirm.

Agenda No.06 RESERVATION OF SEATS FOR WOMEN (ORDINARY ELECTION IN CANTONMENT BOARDS)

.. Reference DG, DE New Delhi letter No. 76/38/Reservation of wards/C/DE/2019 dated 21.11.2019.

It is brought to the notice of the Board that as per direction issued vide above reffered letter, the prepration for holding of Ordinary Election in Badamibagh Cantonment Board have been initiated as per the Cantonment Electoral Rules (CER) 2007. In accordance with the said rules, necessary publication for drawing of lots for reservation of two seats for 'Women' have been made in two local news papers vide this office notice no. CB/BB/7/Gen/Election /788 dated 11th Dec'2019. Also, same was circulated to all elected Board Members and were pasted at prominent

places of all wards. The drawing of lots for reservation of seats for Women shall be carri~d out by the President Cantonmnet Board, Badamibagh in presence of members of the Board and general public who may wish to witness the proceedings as per programme as under:-

Resolution No.06

Before starting lots, Shri Bilal Ahmad Wani, elected board member from ward no.7 was un­ satisfied with Cantonment Electoral Rules (CER) 2007 and submitted that lots should be drawn in the wards which never remained reserved for women and further submitted that the said rules are sick in nature. However, CEO clarified that lots to be drawn as per rule 7 of CER 2007. Accordingly, lots were drawn by the President Badamibagh Cantonment Board, the ward no. 02 & ward no. 07 declared as reserved wards for women. The whole proceedings were witnessed by all present members and some residents of cantonment area whose details are given below:-

(i ) Shri Azan-ul-Nabi r/o sonwar ward no.OS

(ii) Shri Mohammad Haazim Malik r/o sonwar ward no.OS and

(iii) Sh. Javeed Akhtar Bhat r/o Iqbal colony ward no.07

Therefore, the Board unanimously, considered and approved to float appropriate proposal to competent authority to notify the same in the Gazette .

... Agenda No.07 ANNUAL SUPPLY OF SCHOOL BOOKS FOR THE YEAR 2019-20

Refer this office tender notice No. 9/2/4035/CB/BB/2 dated 14/11/2019 and e-procure Tender Id: 2019_DGDE_518695_1.

Online and offline tenders were invited from contractors/firms/suppliers for Annual Supply of School Books for the year 2019-20 in Second Call. In response to the tender notice, only three offline bids were received from the below mentioned firms, despite being re-tendered on second time. After evaluation of the technical bids, the financial bids were opened in favour of all the bidders, the item wise rates of books are attached as Annexure-B.

In view of above, the Board may consider and approve the lowest rates quoted by the firm M/s Friendz Enterprises, as per Annexure-B being reasonable. It is pertinent to mention here that no bidder has quoted the rates for the books that are being issued by the J&K Board of School Education (JKBOSE), in this regard this office has approached JKBOSE, the same will be procured from them if ava ilable.

Agenda No. 08 ANNUAL SUPPLY OF SCHOOL UNIFORMS FOR THE YEAR 2019-20

Refer this office tender not ice No. 9/2/3098/CB/BB/2 dated 14/11/2019 and e-procure Tender Id: 2019_DGDE_518670_1.

Online and offline tenders were invited from contractors/firms/suppliers for Annual Supply of School Uniforms for the year 2019-20 in Second Call. In response to the tender notice, one online and three offline bids were received from the below mentioned firms, despite being re-tendered on second time.

Resolution No.08

Unanimously, considered and approved as per agenda side. Moreover, the Board also resolved to complete procurement process well within Feb, 2020.

Agenda No. 09 CONSERVANCY SERVICES TO STATION HQ, BADAMIBAGH

The Board provides conservancy services to, Station HQ, Badamibagh Cantt under section 110 of the Cantonments Act, 2006. For the year 2019-20, a draft Conservancy Agreement amounting to Rs. 8,37,26,879/- sent to the PCDA, NC for vetting, which has allowed an amount of Rs. 8,29,98,023. The PCDA, NC has disallowed Rs. 7,28,856/- projected for the salary of clerical staff and depreciation charges in respect of conservancy vehicles in providing conservancy services to Station HQ for the year 2019-20. Further, a draft conservancy agreement for the year 2020-21 amounting to Rs. 10,57,92,118/- forwarded to Stn HQ cell , 31 Sub Area vide letter no.11/5/3128/CB/BB/786 dated 10.12.2019 for further transmission to ·PCDA, NC for it s vetting/con cu rre nee.

Agenda No. 10 UN-AUTHORIZED CONSTRUCTIONS

To consider the report submitted by the field staff of this board regarding un-authorized constructions carried out by the below mentioned offenders who were asked to stop the un­ authorized construction and notices under sect ion 239 of the Cantonments Act, 2006 have already been issued. The offenders are liable to action warranted under section 247, 248 & 320 of the Cantonments Act, 2006.

Agenda No. 11 BUILDING APPLICATION OF SH. VISHAL DHAR & VIKAS DHAR

Ref, CBR No.06 dated 15.10.2019.

It is submitted that Sh. Vikas Dhar & Sh. Vishal Dhar was provided an opportunity to furnish stay vacation order as requested by him before the Board on 15.10.2019.

Sh. Vikas Dhar & Vishal Dhar served legal notice dated 18.10.2019 received by this office on 21.10.2019 along with the copy of directions dated 18.06.2019 of Financial Commissioner Revenue, J&K Srinagar wherein Tehsildar Srinagar, South had been directed to survey and determine whether the construction was going not on the land in dispute but on a different survey number not involved in the dispute, and in such a situation the construction work should not be interfered with.

Moreover, Sh.Vikas Dhar & Vishal Dhar has also provided copies of Tehsildar South, Srinagar report dated 29.06.2019 & 15.10.2019 submitted to worthy Financial Commissioner J&K Srinagar wherein Tehsildar South has stated that "Sh. Vishal Dhar & Vikas Dhar are intending to use the land

Copies of documents provided by Sh. Vikas Dhar & Vishal Dhar were forwarded to Sh. V.K. Sawhney vide this office letter No.4/7/2907 / CB/BB/ 639 dated 23.10.2019 for his parawise comments.

Sh. V.K. Sawhney has provided the comments wherein he has stated vide reply of Para 8 that any land obtained under the Agrarian Reforms Act cannot be gifted as has been done in this case.

Vide reply of Para 13 it is stated that 945/802 is also under dispute before Ld. Financial Commissioner which is the land covered by mutation 1403 and 1409 which are under challenge.

Vide reply of Para 14 it is stated that building application shows an area of 05 Kanai 01 Marla 190 Sqft. They do not have any land whatsoever of this area at the site except the land under dispute. In support of this he has provided a copy of Tehsildar South, Srinagar report dated 26.10.2018.

Further he alleges vide reply of Para 16, 17 & 19 that no demarcation of the property has been done.

The Building application committee & JE report dated 03. 11.2017 submitted that approx 06 kanal area available on spot where building permission sanction / granted by the Board vide CBR no.18 dated 12.04.2018. In view of controversy involved in the case, the CEO recommended to suspend the execution of sanction of building application granted by this Board vide above CBR till finality of the case subjudice before Ld FC, J K, Srinagar.

The case file is placed before the Board. Board may decide accordingly.

Resolution No.11

The Board has thoroughly perused the agenda with connected documents and after long discussion on the issue reso lved that there is no reason to stop the ongoing const ruction on khasra no.946/802 in the light of Tehsildar south letter dated 15.10.2019. Board further resolved that the Tehsildar conce rned be asked for revenue documents in r/o kha sra no.11/00/945/802 and 946/802 with ownership documents and to confirm if any case/ litigation pending thereon. As and when the concern revenue authorities forward their report, board will ensure further action accordingly. However, CEO has submitted his stand same as submitted in the agenda side. Agenda No. 12 BUILDING APPLICATION OF WASEEM All BHAT

A building application dated 20.09.2019 submitted to this office by Sh . Waseem Ali Bhat S/o Ali Mohammad Bhat R/o Palpora, Sonwar Ward No.04 for the construction of two storey with roof residential building on land bearing Khasra No. 166 at Palpora, Sonwar (page no.11).

This office vide letter no. 4/7/4031/CB/BB/49/ 208/635 dated 23.10.2019 forwarded the matter to the DEO for confirmation of the status/location of the land involved in the case. (Page no.22)The DEO vide its letter no. DEO-BP/land status/BB Cantt/Vol-111/55 dated 26.11.2019 has intimated that the land of proposed construction falls in GLR Survey No. 40-22 is recorded as private land (page no. 24).

The case was referred to building committee vide this office letter No. 4/7/4031/CB/BB/49/208/636 dated 23.10.2019 for its recommendation (page no.23). The report of building committee is still awaited.

The JE vide report dated 13.12.2019 (Pg 25-26) submitted:

(i) That the land/plot involved in the application falls outside 500 yards from 2 FOD wall and not attract restriction of SRO No.96 dated 02.07.2004. (ii) That the building plan is not in conformity with the Badamibagh Cantonment Board Building Bye Laws or as per other applicable provisions except that no fire gap left at H/o Ajaz Ahmad (applicant's brother) and at H/o Tariq Ahmad of the proposed building. The applicant was informed vide this office letter no. 417/4031/ CB/BB/49/208/602 dated 25.09.2019 and the applicant vide his application dated 12.10.2019 states that he has small plot for construction and cannot maintain fire gap at H/o Aijaz Ahmad and H/o Tariq Ahmad. Since the applicant owns a small plot and is not possible for the applicant to leave OS feet fire gap. Therefore, the building application may be placed before the Board to consider the building application on merits as prescribed under section 06 of present Badamibagh Cantonment Building Bye­ Laws or otherwise. (iii) That as per records of this section, no litigation is subjudice related to title of the land before any forum. (iv) The measurements of the plot tally with the measurements of the site. (v) That construction I development charges for the subject building payable as under:-

This office vi de letter no. 4/7/314 2/CB/BB/216/55/774 dated 30.11.2019 forwarded the matter to the DEO for confirmation of the status/location of the land involved in the case. (Page no. 28}The DEO vide its letter no. DEO-BP/land status/BB Cantt/Vol-111/9 dated 10.12.2019 has intimated that the land of proposed construction falls in GLR Survey No. 40-155 is recorded as private land (page no. 30).

The case was referred to building committee vide this office letter No. 4/7/3142/CB/BB/216/55/775 dated 30.11.2019 for its recommendation (page no.29). The report of building committee is still awaited.

The JE vide report dated 13.12.2019 (P- 32) submitted:

(i) That the land/plot involved in the application falls outside 500 yards from 2 FOD wall and not attract restriction of SRO No.96 dated 02.07.2004. In such circumstances, the Board/CEO is free to take any appropriate action against the applicant. Agenda No. 14 PREPARATION OF LAND USE PLAN

As approved by the board vide above referred resolution the spatial plan for land use to be followed in the Cantonment has been prepared. The plan in question depicts all the proposed residential, institutional and mixed area. Resolution No.14

The Board has perused the agenda with connected documents mainly Land Use Plan prepared on the basis of GLR/GLR plan and resolved that complete proposal be circulated to the Elected Board Members for their comments and suggestions, if any. Agenda No. 15 NOTIFICATION OF CIVIL AREA

Ref CBR No. 14 dated 17.07.2019.

To consider the directions of Directorate vide Dte. letter no.12/1/Cantt/DE/NC/36 dated 25.10.2019 to include B4, private and requisitioned lands in the proposed civil area. Accordingly a fresh proposal has been prepared as per directions in above referred letter, maps showing the pockets of civil area, categories of land and schedule of GLR survey numbers with area to be included in the civil area as well. As per unnumbered para 2 of para 4 of above referred letter, the

,,. .._ • civil area can include lands of any category, there is no bar as such, though their management shall remain with the previously designated authorities except in case of B3 and B4 lands where management will change to Cantonment Board, Badamibagh consequent to their inclusion in the civil area. The civil area has been proposed in two pockets excluding Bungalow area (25 no's of wazirdari properties). Pocket no. 1 includes Batwara Ward No. 01, Shivpora Ward No. 02 & 03. Pocket no. 02 includes Palpora Ward no.04, Sonwar Ward No.OS, lndranagar Ward No.7 and part of Ward no.06 which falls outside the Army security wall.

Resolution No.15

CEO has apprised the board about the directions of higher authorities and merits I benefits of notified civil area in a cantonment area but the Board did not want any notified civil area in Badamibagh Cantonment Board. Therefore PCB allowed the board to decide the agenda by voting. Accordingly, 07 vote casts against the agenda by all elected board members and 01 vote of CEO cast in favour of agenda. Hence, the agenda rejected.

Agenda No. 16 DISCUSSION ON PROPERTY TAX

A representation duly signed by Shri Bilal Ahmad Wani, elected board member of ward no. 07 and seconded by the Vice-President of Badamibagh Cantonment Board dated nil submitted to this office under clause 10 of business regulation of this Board. Accordingly, this agenda is framed and said representation is put up before the Board for discussion. The Board may decide representation.

The Board has perused the said representation and resolved to kept in abeyance the property tax bills. However, CEO apprised the Board that there is no such provision exists in the

Greetings! Sir, in context of the pu blic resentment against issuance of notices u/s 66 Cantt Act 2006. It is my duty in the capac ity of an elected member of the Board, to present the opinion/view of th e res idents co llecti vely before the August Board . I request your good self to kin dl y take note of the fo llowing:

I) That, the matter of assessment of property tax was brought before the Board on I 0 - 07 - 20 12 vide Agenda po int No: 0 I. The Board resolved unan imously vide CBR No: 0 I Dated I 0-07-2012 to start the process fo r assessment of pro perties. However the process was never completed. 2) That, vide agenda No: 22 which reads (gist) "The rates of property tax hnve not been revised by the Board since 1965 which ' as fixed at I0 %. The Board ma approve th e rate of property tax to 20% of annua I ratable va lue fo r lands and bu i! dings or a portion thereof used for residential purpose and to 30 % of annun l ratable alue for lands and build ings or a portion thereof used for commercial ; purpose. Yide CB R No 22 Dated I0 -1 0-20 17 whi ch was record ed partially to th e by the then Member Secretary uftl 11.; Board Shri Kapi l Goyal .. All tltt: 1:lt:1.:tt:tl members of the Board opposed the proposed revision unani mous!):· 3) That, all the elected members not only opposed the rev ision of'the said tax but also opposed the issuance of notices u/s 116 of Cantt Act 2006. The un dersigned will corroborate the statement ' wi th documentary evidence before the Board. 4) That, the Board has to fo ll ow the due course of law as prescribed in the Cantt Act 2006 u/s 68, 69 and 3 19 before issuing notices u/s 11 6 and subsequently bills for property tax. The notice u/s 69 & 3 19 has not been issued /published till date. 5) That if the above mentioned noti ces have been issued I publi shed then 1 request yo ur good self to place copy of those notices before th e Board .

The apprehension (recorded) of the fo rmer CEO Sh. Kap ii Goyal and that of the elected members has come tru e, as issuance of noti ces u/s 66 has ca used angui sh and resent me nt among the residents of th e Ca ntonment Arca aga inst th e Cantonment Boa rd. The Srinagar municipal ity docs not charge prope1ty tax to the inhabitan ts of the SMC so how ca n we charge the same to the residents of Cantonment \ hen people are from the same socio-economic background? Just a 15 feet wide road at Ward No: 04 (Pa lporn ) is the bo undary line between the SMC & Cantonment. So when its neighbors in the muni cipa lity are not being charged property tax, how can we?. If we do so, it is bad in law as we ll as clear discrimination aga inst the residents of the Badami Bada mi Bagh Cantonmen t. The imposition of property tax in Cantonment area is contrary to the principle of natural justice.

The State has been chargin g house tax fo r some time in the past under "Urban Immovable Property Tax", but the same act was repealed in the year 2002 by the then finance minister Sh. Abdul Rahim Rather on the floor of State Legislati ve Assembly. It is pertinent to mention here that economic acti vity in Kashmir is in bad shape. Since, The Disturbed Area Act has been imposed in the State of J&K in the year 1989 it can be construed that the state of J&K cannot be treated like any other state of the Country. The year, 2008, 20 I 0, 20 16 and present year stand testimony to the fact that people of the Kashmir are reeling under severe economic & social uncertainty. Besides the fact that since 201 4 fl oods metro logical department has issued ad visory eighteen times to move to the safer places. Since the year 20 14 these advisories and th e present security scenario of Kashmi r, besides repeated low tourist arri va ls, has adversely a fleeted th e economic activity of the va lley. Under such circumstances, chargi ng the propert) tax to the residents of the Cantonment is i ll ogica I and unjustified. I request your good elf to pl ace the subject mat ter before the August Board on the agenda side in the coming meeting of the Board fo r consideration under Business Regulation No: IO of the B.B.Cantt.Board. With all the humility at my disposal I request the members of the August Board that imposition of property tax be kept in abeyance till Srinagar Municipality imposes such /likewise tax.
