Asamblea General Consejo De Seguridad Septuagésimo Período De Sesiones Septuagésimo Primer Año Temas 35 Y 40 Del Programa Naciones Unidas A/70/1016–S/2016/711 Asamblea General Distr. general 16 de agosto de 2016 Consejo de Seguridad Español Original: inglés Asamblea General Consejo de Seguridad Septuagésimo período de sesiones Septuagésimo primer año Temas 35 y 40 del programa Los conflictos prolongados en la zona del Grupo GUAM y sus repercusiones en la paz, la seguridad y el desarrollo internacionales La situación en los territorios ocupados de Azerbaiyán Carta de fecha 15 de agosto de 2016 dirigida al Secretario General por el Representante Permanente de Azerbaiyán ante las Naciones Unidas Siguiendo instrucciones de mi Gobierno, tengo el honor de presentarle el informe del Ministerio de Relaciones Exteriores de la República de Azerbaiyán titulado “Actividades ilegales económicas y de otro tipo en los territorios ocupados de Azerbaiyán” (véase el anexo)*. Los hechos, cifras y datos estadísticos que figuran en el informe, tomados principalmente de fuentes públicas armenias, proporcionan pruebas suficientes y convincentes que demuestran la continuidad de las actividades de la República de Armenia en la región de Nagorno Karabaj y otros territorios ocupados de la República de Azerbaiyán1, en contravención del derecho internacional, incluida la implantación de colonos procedentes de Armenia y el extranjero, la destrucción y la apropiación del patrimonio histórico y cultural, la explotación depredadora, el saqueo y el comercio ilícito de bienes y recursos naturales y de otras riquezas en esos territorios, acompañada de una injerencia sustancial y sistemática en los derechos a la propiedad pública y privada. __________________ * El anexo se distribuye únicamente en el idioma en que fue presentado. 1 Los territorios de la República de Azerbaiyán que han sido ocupados por la República de Armenia son los siguientes: la región de Nagorno Karabaj, siete distritos adyacentes, a saber: Lachyn, Kalbajar, Zangilan, Gubadly, Jabrayil, Fuzuly y Aghdam; y tres enclaves rodeados por el territorio de la República de Armenia, específicamente las aldeas de Yukhary Askipara y Barkhudarly del distrito de Gazakh (Azerbaiyán), y la aldea de Karki del distrito de Sadarak de la República Autónoma de Nakhchivan de la República de Azerbaiyán. 16-14225 (S) 230816 250816 *1614225* A/70/1016 S/2016/711 Esas actividades se llevan a cabo a pesar de las oportunas notificaciones, las peticiones y la condena de la comunidad internacional, y en un contexto en que se están adoptando iniciativas a fin de alcanzar una solución política del conflicto ta n pronto como sea posible. Armenia finge participar en el proceso de solución del conflicto, cuando en realidad está aplicando medidas sistemáticas encaminadas a seguir consolidando el inestable statu quo de la ocupación. Las políticas y prácticas de Armenia en los territorios ocupados de Azerbaiyán socavan la posibilidad de lograr una solución política del conflicto y representan una amenaza inminente a la paz, la seguridad y la estabilidad en la región. Los intentos de ocultar las actividades ilegales en los territorios ocupados de Azerbaiyán bajo el pretexto de los “derechos humanos” o la “asistencia humanitaria” están, en esencia, viciados. No se puede refutar que: • En primer lugar, no se puede exigir privilegios que se erigen sobre la base de violaciones graves y sistemáticas del derecho internacional, en particular el derecho internacional humanitario y el derecho de los derechos humanos, y la denegación discriminatoria de los derechos y libertades fundamentales con respecto a las demás personas, en particular la población azerbaiyana, considerablemente mayor en proporción, que fue expulsada de los territorios ocupados como consecuencia de la agresión de Armenia contra Azerbaiyán. • En segundo lugar, las medidas de socorro humanitario que adopten los Estados, las organizaciones internacionales y otras entidades y órganos, deben tener, por definición, un carácter exclusivamente humanitario. Deben llevarse a cabo de conformidad con los principios de la neutralidad, la imparcialidad y el consentimiento del país afectado, respetando plenamente la soberanía, la integridad territorial y la unidad nacional de los Estados de conformidad con la Carta de las Naciones Unidas, como se reafirmó en los principios rectores de la asistencia humanitaria que figuran en el anexo a la resolución 46/182, relativa al “Fortalecimiento de la coordinación de la asistencia humanitaria de emergencia del sistema de las Naciones Unidas”, aprobada por la Asamblea General el 19 de diciembre de 1991. Sobre todo, los intentos de cambiar la composición demográfica de los territorios ocupados de Azerbaiyán antes de que estallara el conflicto, que incluyeron el aumento artificial del número de armenios en esos territorios y la prohibición del regreso a sus hogares y propiedades a cientos de miles de desplazados internos azerbaiyanos, junto con la destrucción o la apropiación de bienes, no pueden en modo alguno tener un carácter humanitario y ser compatibles con las normas de derechos humanos y los principios rectores mencionados. Otro hecho vergonzoso y censurable revelado en el informe es que la explotación de los recursos naturales y otras riquezas en los territorios ocupados de Azerbaiyán se ha convertido en un negocio lucrativo y es una de las fuentes de ingresos de Armenia y el régimen separatista subordinado que ha establecido en esos territorios. En el informe se afirma de manera inequívoca que hay un claro vínculo entre la explotación y el saqueo de los recursos naturales y otras riquezas en los territorios ocupados de Azerbaiyán y la posición nada constructiva de Armenia en el proceso de solución del conflicto. 2/121 16-14225 A/70/1016 S/2016/711 El derecho internacional prohíbe la adquisición de territorio por la fuerza, de modo que cualquier ocupación militar se considera de carácter temporal y no implica la transferencia de la soberanía sobre el territorio ocupado. En sus resoluciones 822 (1993), 853 (1993), 874 (1993) y 884 (1993), el Consejo de Seguridad condenó el uso de la fuerza contra Azerbaiyán y la ocupación de sus territorios, y reafirmó la soberanía y la integridad territorial de Azerbaiyán, así como la inviolabilidad de sus fronteras reconocidas internacionalmente. En esas resoluciones, el Consejo también reafirmó que la región de Nagorno Karabaj era u parte integrante de la República de Azerbaiyán y exigió el retiro inmediato, completo e incondicional de las fuerzas de ocupación de todos sus territorios ocupados. Otras organizaciones internacionales han adoptado una posición similar. La comunidad internacional tiene la responsabilidad de velar por que Armenia cumpla estrictamente sus obligaciones internacionales. Es igualmente importante que todos los Estados, de conformidad con sus obligaciones internacionales, adopten medidas eficaces que impidan que sus personas físicas y jurídicas lleven a cabo cualquier actividad que atente contra la soberanía y la integridad territorial de Azerbaiyán, incluida la participación en una actividad ilícita, o su facilitación, en la región de Nagorno Karabaj y otros territorios ocupados de Azerbaiyán. La presencia ilegal de las fuerzas armadas de Armenia en los territorios ocupados de Azerbaiyán es el principal factor de desestabilización y el mayor obstáculo para la solución del conflicto, que podría intensificarse en cualquier momento. El conflicto solo podrá resolverse si se respetan la soberanía y la integridad territorial de la República de Azerbaiyán, dentro de sus fronteras reconocidas internacionalmente. La ocupación militar de los territorios de Azerbaiyán no representa, y no representará nunca, una solución al conflicto. Cuanto antes Armenia acepte esta realidad y retire sus fuerzas armadas de los territorios ocupados de Azerbaiyán, más rápido se resolverá el conflicto, y ambos países y sus pueblos podrán disfrutar de las posibilidades de cooperación y desarrollo económico, lo que les permitirá aplicar con éxito la Agenda 2030 para el Desarrollo Sostenible. Como usted señaló acertadamente en su declaración en la reunión de alto nivel del Consejo de Seguridad celebrada el 11 de febrero de 2011, “la paz, la seguridad y el desarrollo son interdependientes” (S/PV.6479, pág. 2). En el documento final de la cumbre de las Naciones Unidas para la aprobación de la agenda para el desarrollo después de 2015, titulado “Transformar nuestro mundo: la Agenda 2030 para el Desarrollo Sostenible”, los Jefes de Estado y de Gobierno y los Altos Representantes, reunidos en Nueva York en septiembre de 2015, afirmaron que no podía haber desarrollo sostenible sin paz, ni paz sin desarrollo sostenible. Dichos dignatarios pusieron de relieve que el programa se implementaría de manera compatible con los derechos y obligaciones de los Estados en virtud del derecho internacional, y reafirmaron que era necesario respetar la integridad territorial y la independencia política de los Estados, y que todo Estado tenía, y debía ejercer libremente, la soberanía plena y permanente sobre la totalidad de su riqueza, sus recursos naturales y su actividad económica (véase la resolución 70/1 de la Asamblea General, preámbulo, párr. 8; y párr. 18). 16-14225 3/121 A/70/1016 S/2016/711 Le agradecería que tuviera a bien hacer distribuir la presente carta y su anexo como documento de la Asamblea General, en relación con los temas 35 y 40 del programa, y del Consejo de Seguridad.     SUMMARY REPORT On Implementation of RA Government Anti-crisis Action Plan Introduction 1. The Republic of Armenia was able to withstand the first tide of the global financial and economic crisis firstly thanks to efficacious financial control leading to historically high financial system stability indicators and, secondly due to the lack of “hot” money in Armenia’s financial sector. Besides, domestic financial markets did not maintain too strong ties with global sub-prime markets. In particular, unlike developed economies, Armenia’s banking and financial institutions escaped panic with relatively low demand for liquidity. While GDP growth was below target in 2008, there was a 6.8% growth recorded in the same period against a 5% average for the CIS countries. Note that Armenia is ahead of Russia (5.6%) and Ukraine (2.1%) as for economic performance indicators. 2. Nevertheless, like many other countries, Armenia was not spared by the crisis, with the bulk of its impact coming down on the real sector which experienced some downward tendency. This was chiefly conditioned by the following factors: · Reduced remittances from abroad · Lower raw material and mineral ore prices on the global markets · Lower demand for Armenian commodity and service exports due to curbed global demand · Shrinking influx of investment into Armenia due to the lack of liquidity in the global economy. 3. Falling real estate prices on the global markets led to diminished interest for domestic immovable assets. This, coupled with (or conditioned by) reduced investment, ended by freezing the main driving force of Armenia’s economics – the building sector. Inferior household income and altered consumer behavior, on the one hand and reduced foreign demand on domestic goods and services, on the other hand, resulted in less activity in number of economic branches in Armenia.

    MEMORANDUM-OF-UNDERSTANDING ARM: Public Efficiency and Financial Markets Program, Subprogram 2 -Consultation Mission, 17-26 June 2018- 1. Scope of the visit. A consultation mission 1 visited Yerevan from 17 to 26 June 2018 to: (i) Finalize the proposal for Subprogram 2 policy actions under the Public Efficiency and Financial Markets Program (PEFMP), and (ii) Undertake consultations to reach consensus and assess the Authorities' readiness to reflect agreements in a Memorandum of Understanding (MOU). This would enable the mission to be upgraded to Fact-Finding status, quick-starting Subprogram 2 processing within ADB. 2. This visit followed the consultation mission that had been fielded during May 15-21, 2018, to (i) present to the new government and to the new senior leadership of the Ministry of Finance (MOF -The Executing Agency) the reform objectives of the ongoing Public Efficiency and Financial Markets Program (PEFMP), and (ii) seek guidance from the Authorities about the way forward for the PEFMP, including whether it still reflects Armenia's economic policy priorities. The Authorities re-asserted their interest and commitment to the reform agenda of the PEFMP.
