NARIMAN, J. Leave granted. 1. The present appeal arises out of the demolition of Babri Masjid. We are concerned in this case with two FIRs lodged on 6th December, 1992. The first viz. Crime No.197 of 1992, is against lakhs of kar sewaks alleging the offences of dacoity, robbery, causing of hurt, injuring/defiling places of public worship, promoting enmity between two groups on grounds of religion, etc. The IPC offences were, therefore, under Sections 153-A, 295, 297, 332, 337, 338, 395 and 397. The second FIR 1 viz. FIR No.198 of 1992 was lodged against eight persons named therein - Mr. L.K. Advani, Mr. Ashok Singhal, Mr. Vinay Katiar, Ms. Uma Bharati, Ms. Sadhvi Ritambara, Mr. Murli Manohar Joshi, Mr. Giriraj Kishore and Mr. Vishnu Hari Dalmia, two of whom are dead due to passage of time viz. Mr. Ashok Singhal and Mr. Giriraj Kishore. The FIR alleges offences under Sections 153-A, 153-B and Section 505 IPC. 46 further FIRs pertaining to cognizable offences and 1 FIR pertaining to non- cognizable offences were also lodged. Initially, a Special Court set up at Lalitpur was to try these cases but subsequently notifications were issued by the State Government, after consultation with the High Court, dated 8 th September, 1993 whereby these cases were to be tried by a Special Court at Lucknow.

Arguing forcefully for social justice, this book contains a selection from Kancha Ilaiah's columns in popular newspapers like The Hindu, the Deccan Herald, the Deccan Chronicle, the Hindustan Times among others, and journals like Mainstream and the Economic and Political Weekly. Dalit Lynching at Dulina: Cow - Protection, Caste and Communalism Context October, 2002, 5 men were brutally killed in the presence of, and possibly by, a large and violent mob on the main road outside the Dulina Police Post, near Jhajjar town (district Jhajjar) Haryana in front of the police and several senior district officials. All 5 killed were Dalits, believed by the mob at the time to have been engaged in cow-slaughter. Newspapers covered the incident widely at the time. There were widespread protests over the lynching from Dalit groups, and some political parties. There was also violent opposition by local dominant groups to the arrests by that followed about a month later. In November and December 2002 a seven-member P.U.D.R team conducted an investigation into the incident and its aftermath. We visited villages Badshahpur and Teekli in Gurgaon district, and Dulina, Suhra and Talao in Jhajjar district, as well as Rohtak and Jhajjar towns. We met several police and district officials, the MLA from Bahadurgarh, a Bajrang Dal office-bearer of Haryana and VHP member, the Teekli Gaushala Committee, Jat leaders and Dalit activists, representatives of local political organisations, and families of victims. We attended a customary Panchayat (‘Sarv-Khap’ Panchayat) and were present at the ‘surrender’ of some of the accused at the PWD guesthouse in Jhajjar. Over 3 months after the incident, there continue to be several contesting versions of what happened at Dulina. The responses by the state and segments of civil society in Haryana and the rest of north India, is revealing.

More recently, however, and in an idiom that resonates with many contemporary Indians, Swami Dayananda Saraswati (1930-) has made the more controversial claim that the attempt to convert another person is itself an act of violence. In three parts, the paper 1) describes Dayananda’s claims, while bringing them into conversation with the arguments of earlier critics of Christianity (e.g., Mahatma Gandhi, Sita Ram Goel, Ashok Chowgule, Arun Shourie), 2) analyzes and critique Dayananda’s use of the term “violence,” and 3) demonstrate how the claim that conversion is an act of violence blurs somewhat easily into a justification of acts of violence against those who attempt to convert others. Sarsanghchalak or the Supreme Leader of the RSS, KS Sudershan while addressing a rally on the eve of the 75th founding day of the RSS in Nagpur, called upon the Muslims and Christians of the country to prove their patriotism. Later, the RSS at the end of its Bangalore session on March 7, 2002, came out with another warning to the Muslims: “Let the Muslims understand that their real safety lies in the good-will of the majority”. This statement came in the aftermath of the carnage of the Muslims allegedly organized by the cadres of the RSS in Gujarat. Votes and Violence: Electoral Competition and Ethnic Riots In
P1: KAE 052182916Xc05 CY386B/Wilkinson 0 521 82916 X April 26, 2004 12:53 5 The Electoral Incentives for Hindu-Muslim Violence Why do some political leaders in some Indian states impress upon their local ofﬁcials that communal riots and anti-Muslim pogroms must be pre- vented at all costs? Why do governments in other states fail to protect their minorities or even incite violence against them? In previous chapters we showed that factors such as declining state capacity or India’s changing level of consociational power sharing cannot explain the geographical or historical patterns in the effectiveness of states’ response to the threat of communal violence. In this chapter, I argue that we can best explain state- level variation in levels of Hindu-Muslim violence if we understand the electoral incentives facing each state’s government. I show that states with higher degrees of party fractionalization, in which minorities are therefore pivotal swing voters, have lower levels of violence than states with lower levels of party competition. This is because minorities in highly competitive party systems can extract promises of greater security from politicians in return for their votes. The chapter is organized into three parts. First, I develop the theoret- ical argument about the importance of state-level electoral incentives and outline the conditions under which high levels of multiparty electoral com- petition will lead to higher levels of state protection for minorities. Second, using data from 1961 to 1995 for 14 major Indian states, I show that greater party fractionalization leads to a statistically signiﬁcant reduction in states’ levels of Hindu-Muslim riots.
