Belousovitch* New Soviet Parliament: Process, Procedures and Legislative Priority When Gorbachev restructured the Soviet legislature in December 1988, the way in which Soviet laws are made began to change fundamen- tally. Since 1977, the right to initiate legislation has rested in the two chambers of the USSR Supreme Soviet and in its organs, in individual deputies of the Supreme Soviet, in the USSR Council of Ministers, and in various state agencies and public organizations.' In practice, how- ever, ministerial-level agencies have played the principal role in the leg- islative process. Working groups, consisting of invited academics (e.g., economists, jurists, and scientists) and practical specialists (ministerial officials and others with a direct interest in the proposed legislation), would form within- the bureaucracy for the purpose of preparing initial drafts. 2 The working draft would then move through bureaucratic chan- nels for coordination and clearance by interested agencies, and eventu- ally reach the USSR Council of Ministers for final approval and presentation to the Presidium of the Supreme Soviet (the "Presidium"). -

Department of the Interior Civic Engagement www.nps.gov/civic/ Civic Engagement and the Gulag Museum at Perm-36, Russia Through communication with former prisoners and guards and an international dialogue with other "sites of conscience," The Gulag Museum at Perm-36, Russia, is building all its programs on a foundation of civic engagement. In December 1999, National Park Service (NPS) Northeast Regional Director Marie Rust became a founding member of the International Coalition of Historic Site Museums of Conscience. At the Coalition’s first formal meeting, Ms. Rust met Dr. Victor Shmyrov, Director of the Gulag Museum at Perm-36 in Russia, another founding institution of the Coalition. Dr. Shmyrov’s museum preserves and interprets a gulag camp built under Joseph Stalin in 1946 near the city of Perm in the village of Kutschino, Russia. Known as Perm-36, the camp served initially as a regular timber production labor camp. Later, the camp became a particularly isolated and severe facility for high government officials. In 1972, Perm-36 became the primary facility in the country for persons charged with political crimes. Many of the Soviet Union’s most prominent dissidents, including Vladimir Bukovsky, Sergei Kovalev and Anatoly Marchenko, served their sentences there. It was only during the Soviet government’s period of “openness” of Glasnost, under President Mikael Gorbachev, that the camp was finally closed in 1987. Although there were over 12,000 forced labor camps in the former Soviet Union, Perm-36 is the last surviving example from the system. -

McLeod EVIEW R ABSTRACT This Article introduces to legal scholarship the first sustained discussion of prison LA LAW LA LAW C abolition and what I will call a “prison abolitionist ethic.” Prisons and punitive policing U produce tremendous brutality, violence, racial stratification, ideological rigidity, despair, and waste. Meanwhile, incarceration and prison-backed policing neither redress nor repair the very sorts of harms they are supposed to address—interpersonal violence, addiction, mental illness, and sexual abuse, among others. Yet despite persistent and increasing recognition of the deep problems that attend U.S. incarceration and prison- backed policing, criminal law scholarship has largely failed to consider how the goals of criminal law—principally deterrence, incapacitation, rehabilitation, and retributive justice—might be pursued by means entirely apart from criminal law enforcement. Abandoning prison-backed punishment and punitive policing remains generally unfathomable. This Article argues that the general reluctance to engage seriously an abolitionist framework represents a failure of moral, legal, and political imagination. -

AFSC’s interest in prison reform is strongly influenced by Quaker (Religious Society of Friends) activism addressing prison conditions as informed by the imprisonment of Friends for their beliefs and actions in the 17th and 18th centuries. For over three decades AFSC has spoken out on behalf of prisoners, whose voices are all too frequently silenced. We have received thousands of calls and letters of testimony of an increasingly disturbing nature from prisoners and their families about conditions in prison that fail to honor the Light in each of us. Drawing on continuing spiritual insights and working with people of many backgrounds, we nurture the seeds of change and respect for human life that transform social relations and systems. AFSC works to end mass incarceration, improve conditions for people who are in prison, stop prison privatization, and promote a reconciliation and healing approach to criminal justice issues. Slavery by Another Name History Background By Nancy O’Brien Wagner, Bluestem Heritage Group Introduction For more than seventy-five years after the Emancipation Proclamation and the end of the Civil War, thousands of blacks were systematically forced to work against their will. While the methods of forced labor took on many forms over those eight decades — peonage, sharecropping, convict leasing, and chain gangs — the end result was a system that deprived thousands of citizens of their happiness, health, and liberty, and sometimes even their lives. Though forced labor occurred across the nation, its greatest concentration was in the South, and its victims were disproportionately black and poor. Ostensibly developed in response to penal, economic, or labor problems, forced labor was tightly bound to political, cultural, and social systems of racial oppression. Setting the Stage: The South after the Civil War After the Civil War, the South’s economy, infrastructure, politics, and society were left completely destroyed. Years of warfare had crippled the South’s economy, and the abolishment of slavery completely destroyed what was left. The South’s currency was worthless and its financial system was in ruins. For employers, workers, and merchants, this created many complex problems. With the abolishment of slavery, much of Southern planters’ wealth had disappeared. Accustomed to the unpaid labor of slaves, they were now faced with the need to pay their workers — but there was little cash available. In this environment, intricate systems of forced labor, which guaranteed cheap labor and ensured white control of that labor, flourished. For a brief period after the conclusion of fighting in the spring of 1865, Southern whites maintained control of the political system. -

Snyder Auschwitz Never Again Lecture 3 Laudatio Annetje Fels-Kupferschmid Award 2017 Timothy Snyder Excellencies, distinguished guests, friends, ladies and gentlemen, “Conventional wisdom is like a sheet of ice, covering the dark sea of the undiscovered”. “Does the narrative [offered by the historian] move like an icebreaker?” “Does it leave in its wake a view of the deep, black line through white ice – a passage, that others may follow?” These words come from one of the books by Professor Timothy Snyder. I thank the jury of the Annetje Fels-Kupferschmidt Award for asking me to talk about this scholar and public intellectual, whose work I have been following for fifteen years. The quoted passage applies very well to him. Through his consistently excellent publications and presentations, about the Holocaust and mass violence in general, all of which receiving a huge audience, Timothy Snyder has indeed been just that – an icebreaker. More than anyone else, this laureate of the award has brought together two distinct scholarly universes. There is the universe of Holocaust Studies and German Studies, on the one hand. And there is the universe of scholarship on Eastern Europe under Communist rule, on the other. More convincingly and effectively than anyone else, Snyder has drawn the attention of specialists and laypeople alike to the lands of Europe where the regimes of Hitler and Stalin committed mass murder. -

Thomas Sherlock Confronting the Stalinist Past: The Politics of Memory in Russia Attempting to reverse the decline of the Russian state, economy, and society, President Dmitry Medvedev and Prime Minister Vladimir Putin have paid increasing attention over the past two years to the modernization of Russia’s socioeconomic system. Aware of the importance of cultural and ideological supports for reform, both leaders are developing a ‘‘useable’’ past that promotes anti-Stalinism, challenging the anti-liberal historical narratives of Putin’s presidency from 2000—2008. This important political development was abrupt and unexpected in Russia and the West. In mid—2009, a respected journal noted in its introduction to a special issue on Russian history and politics: ‘‘turning a blind eye to the crimes of the communist regime, Russia’s political leadership is restoring, if only in part, the legacy of Soviet totalitarianism....’’1 In December 2009, Time magazine ran a story entitled ‘‘Rehabilitating Joseph Stalin.’’2 Although the conflicting interests of the regime and the opposition of conservatives are powerful obstacles to a sustained examination of Russia’s controversial Soviet past, the Kremlin has now reined in its recent efforts to burnish the historical image of Josef Stalin, one of the most brutal dictators in history. For now, Medvedev and Putin are bringing the Kremlin more in line with dominant Western assessments of Stalinism. If this initiative continues, it could help liberalize Russia’s official political culture and perhaps its political system. Yet Thomas Sherlock is Professor of Political Science at the United States Military Academy at West Point and the author of Historical Narratives in the Soviet Union and Post-Soviet Russia (Palgrave Macmillan, 2007). -

TowE t INTRODUCTION The Soviet Constitution guarantees many of the same funda- mental rights as are guaranteed in the Constitution of the United States, plus several others as well. Indeed, these rights are described in greater detail and appear on their face to be safeguarded more emphatically in the Soviet Constitution. However, the mere existence of constitutional provisions for fundamental rights does not necessarily guarantee that those rights will be protected. Western scholars often point to discrepancies between rhetorical phrases in the Soviet Con- stitution and actual practices in the area of fundamental rights.' Soviet legal scholars insist, however, that such criticism should be aimed instead at Western constitutions. Andrei Vyshinsky has stated that it is precisely in the area of fundamental rights that "the contra- dictions between reality and the rights proclaimed by the bourgeois constitutions [are] particularly sharp." 2 Soviet legal scholars claim that bourgeois laws are replete with reservations and loopholes which largely negate their effectiveness in protecting fundamental rights generally, and those of the working man in particular.3 There is undoubtedly some truth in both claims, for, as Professor Berman has stated, "The striking fact is that in the protection of human rights, the Soviet system is strong where ours is weak, just as it is weak where ours is strong." 4 The full impact of this statement can only be understood by comparing the different approaches which * The author wishes to acknowledge the helpful comments and suggestions of Dr. Branko M. -

The Viehofen Forced- Labor Camp (1944-5) Based on the stories and the diary of Greta Balog and Olga Balog (written by Miki Granski) September 2007 The Viehofen Forced-Labor Camp Balog Family 1 Introduction This report summarizes the events during 1944-5 when my mother‘s family (Balog), was taken from Subotica, Yugoslavia to a forced-labor camp in the village of Viehofen near the city of St. Polten, Austria. It is mainly based on the stories and the diary of my mother, Greta Balog, and my aunt, Olga Balog, as told to me over the years. In essence, this report also follows the life story of my grandfather, Dr. Ernst Balog. Although I heard stories about the Viehofen camp over the years, in reality I knew very little about it; It was only in 2007 that I heard the name Viehofen (before that we just referred to it as the "Austrian camp" or "St. Polten", which is the name of the nearest city in Austria). In 2005, I came across an article in the Wiener Zeitung that mentioned my grandfather name (Reference 2). The article is about Roszi Wolf who was an inmate at the camp and lost her father who apparently died in one of the bombings toward the end of the war (See Section 8.1). Mrs. Wolf was looking for some evidence about her father's death, and the search ended when his death certificate, written by my grandfather, who was the camp's doctor, was found. I showed the article to my family, who were very interested, but then dropped the subject again.
