One of the most important mechanisms of social regulation in late-Elizabethan and early-Jacobean England, law reform was a matter of, first, the “perfection” of the organization and expression of existing laws, legal instruments, and legal processes. However counter-intuitively, these officially-sponsored reforms were calculated to prevent more radical innovations that would generate “inconveniences,” systemic contradictions and uncertainties that threatened the law’s ability to produce just results. Second, law reformers generated a discourse on “execution” that targeted the character of legal representatives. This tradition of character criticism, delivered directly from the Lord Keeper’s mouth or circulated through other legal-political, literary, theatrical, didactic, and religious works, encouraged officers’ conscientious execution of their duties and alerted the English public to the signs of the abuse of authority. Law reform created a distinct critical orientation toward legal and governing activities that was reproduced throughout a system of justice in which an extraordinary number of subjects participated. It was a critical orientation, moreover, that ii was refracted in literature sensitive to the implications of the socio-political dominance of legal language, traditions, and officers. The principles and practices of law reform— along with the conflicts and anxieties that inspired and sprang from them—were appropriated by amateur and professional writers alike. Close readings reveal that Inns- of-Court revellers, Francis Bacon, John Donne and Shakespeare all engaged deeply with the potential, as well as the ethical and practical limitations, of law reform’s central role in local and national governance. In the Gesta Grayorum and Donne’s “Satyre V,” the reveller and the satiric speaker improvise on legal forms to compensate for the law’s imperfections that threaten the security and prosperity of the English subject. In Shakespeare’s Measure for Measure and The Winter’s Tale, the character of the legal- political officer and reformer is tested as he attempts to put policies and principles into practice. iii Acknowledgments Everything started with my dad’s grade nine English teacher. Without Grant Huffman’s guidance, dad would not have read the right books and certainly would never have waited for the right woman. My older brother and I would never have been born, a catastrophe (much like birth) that few recover from. In 15 Stories, one of the anthologies Grant edited in the ’60s and ’70s for secondary school students, the introduction starts with a baseball analogy: Baseball is a spectator sport, but no self-respecting spectator would go into the stadium without knowing at least (a) the language of the game and (b) some of its basic rules. Story-writing is a spectator sport, too, and, as a spectator reader, you owe it to yourself, and to the writer, to know some of the language of his game and a few of its basic rules…. You may never turn professional, but you should come to respect yourself as a reliable amateur critic.1 Grant was the best friend that the Strain family ever had, and his memory inspires my own desire to speak with the dead. I wish I could tell Grant that I’ve mastered more than a few of the “basic rules” of the reading and writing game by now; that I’ve turned pro, so to speak; and that I have a number of remarkable coaches to thank for that. Foremost among those coaches are my committee members, of course. I am most grateful for my supervisor, Lynne Magnusson, who taught me (however unwilling a student I was) not to lose hope every time I lost heart, not to despair every time I lost direction. Only my admiration for Lynne can keep pace with my debt to her: both defy reckoning. Here, as in everything, her instincts were infallible. Reproduced with permission from the Huntington Library. viii Chapter 1 Introduction: Perfection and Execution This dissertation recovers a history of law reform from early modern legal, literary, and political writings. The study of law reform reveals a concern for form and character that was common to legal-political authorities and writers alike. The broad participatory structure of early modern justice helped produce writers (not to mention readers and audiences) who were especially sensitive to the contribution of legal language, institutions, practices, and officers to the regulation of the commonwealth. The dominance of the law in everyday life made it a popular focus of criticism, and the law’s reform was of widespread concern. The principles and practices of law reform, together with the conflicts and anxieties that inspired and sprang from them, were appropriated by both amateur and professional writers. WILLCOX The English of the seventeenth century were a litigious race, who deplored their addiction to lawsuits without attempting to restrain it. They wept, but they went on suing. This fever of the times raged in city and country, among all classes, and its records are the voluminous archives of the courts. It is an interesting characteristic of the period, and its records have an added interest. The archives, particularly those of the London courts, are a mine of in- formation about the English people as they were, a mine which is only beginning to be opened. It is the purpose of this paper to dig an experimental shaft in a new direction: to examine the most illuminating cases in one county during the half century before the, Civil Wars, in order to examine through them the men and life of the times.' Pp. xii, 561. $12.50. "Freeborn" John Lilburne defied his first "establishment" at the age of seventeen. He sued Hewson, the master to whom he was appren- ticed, before the Lord Chamberlain of London for showering abuse upon him. During the stormy years which followed, Lilburne tilted with the Star Chamber, committees of the House of Commons, the Council of State and Cromwell's judicial commissioners. He wore himself out by his determined opposition to those in power at the comparatively early age of forty-three. Had this not occurred, Lil- burne certainly would have made Charles II a "gloomy" rather than a "merry" monarch. Perhaps he would have ended his days, not in prison at Dover, but banished to Massachusetts, where those who of- fended Charles were likely to be sent. There he unquestionably would have contributed to the already considerable discomforts of the Pil- grim Fathers. When, in 1637, Lilburne was arrested at the age of twenty-three by pursuivants of the Stationers' Company and tried before the Star Chamber for shipping seditious books from Holland to England, he stoutly refused to take the ex officio oath on the ground he should not be made to accuse himself. The Court of Star Chamber consisted of the judicial members of the Privy Council. At the time Lilburne was brought before it, the Court had a reputation for fairness in proce- dure and speed in decision-making that attracted many litigants to it from the common law courts.

    LIONS IN CONFLICT: ELLESMERE, BACON AND COKE - THE PREROGATIVE BATTLES* THE SECOND PATRON’S ADDRESS ACADEMY OF LAW SYDNEY, 4 OCTOBER 2013 When Sir Edward Coke was appointed Chief Justice of the Court of Common Pleas in 1606, he was the first for a century who had never appeared as an advocate in that Court. Such appearances were restricted to the handful of senior counsel called serjeants-at-law–––the QC's of the day. Coke had only been coifed as a serjeant the day before his elevation. The coif was a white silk cap worn in court, which Coke once called the helmet of Minerva, traditionally the goddess of wisdom, whom he called, revealingly the goddess of counsel. Coke brought to his new task the full force of his considerable intellect. His encyclopaedic knowledge and his output were prodigious. The Latin inscription on his tombstone correctly describes him as having been a “living library”. However, his mind was so narrow and unsubtle, so incapable of jettisoning detail, so often inconsistent, that no one has ever speculated that he wrote the works of Shakespeare. Macaulay described him as a: “… pedant, bigot and brute [but] … an exception to the maxim … that those who trample on the helpless are disposed to cringe to the powerful”.1 The Institutional Imperative Coke’s aggressive pursuit of the institutional interests of his new Court became as fervid as his advocacy of the interests of the King had been prior to his appointment. His transmogrification was as passionate and as complete as that of Thomas Becket’s transition from Henry II’s Chancellor to the office of Archbishop of Canterbury, a matter with which I have already dealt.2 As a regrettably anonymous pundit once put it: “Where you stand depends on where you sit”.

    Sarah Jones and the Jacob-Jessey Church: The Relation of a Gentlewoman Stephen Wright Sarah Jones was a member of the London semi-separatist congregation founded in 1616 by Henry Jacob, and then led by its successive pastors John Lathrop (from 1625 to 1634) and Henry Jessey (1637 to 1662). Though sharply hostile to the government, ministry and liturgy of the Church of England, this congregation refused to renounce it formally,and was thus able to maintain contact with godly parishioners, whilst gathering members from across parish boundaries.1 At the end of April 1632, many of these members were arrested at a house in Blackfriars’ precinct in London, and brought before the Court of High Commission.The accused included Sarah Jones of Lambeth. Despite her gender, Jones responded defiantly to questioning by Edward Sackville Earl of Dorset (the Queen’s Lord Chamberlain), George Abbot and Richard Neile (Archbishops of Canterbury and of York),William Laud (Bishop of London), and the King’s Advocate of the Court of High Commission, amongst the most powerful and intimidating males in England. On 8 May, having appeared first of all the accused, she was asked by Laud: ‘Doe you come to the church?’ S. Jones,‘None accuseth me to the contrary.’ London: Where were you upon Sunday was sennight?’ S. Jones, ‘When I have done evill and my accuser come, I will answer.’King’s Advocate:‘I doe accuse you, take your oath and you shall know your accusation.’ S. RANDALL, JR.* "I would like to venture the' suggestion that the privilege against self-incrimination is one of the great landmarks in man's struggle to nake himself civilized."' The period of English history beginning with the defeat of the Spanish Armada in 1588 and ending with revolution and the execu- tion of Charles I, in 1649, contained events which profoundly influ- enced the development of English and American constitutional law. The supremacy of Parliament and the scope of the Royal preroga- tive,2 the jurisdiction of the common law courts and of the Chancery, the power of the IKdng to tax without the consent of the Commons, these were among the issues over which dispute raged. This period generally coincided with the long career of that brilliant and irascible lawyer and judge, Sir Edward Coke.
