It explores how doctors conceptualised sexual crimes and those who committed them, and how these ideas were implemented in medical and legal settings. It uses medical and criminological texts alongside information about specific court proceedings and offenders' lives to set out two overarching arguments. Firstly, it contends that sexual crime, and the sexual offender, are useful categories for analysis. Examining the medical theories that were put forward about the 'sexual offender', broadly defined, and the ways in which such theories were used, reveals important features of medico-legal thought and practice in relation to sexuality, crime, and 'normal' or healthy behaviour.

    List of paraphilias Paraphilias are sexual interests in objects, situations, or individuals that are atypical. The American Psychiatric Association, in its Paraphilia Diagnostic and Statistical Manual, Fifth Edition (DSM), draws a Specialty Psychiatry distinction between paraphilias (which it describes as atypical sexual interests) and paraphilic disorders (which additionally require the experience of distress or impairment in functioning).[1][2] Some paraphilias have more than one term to describe them, and some terms overlap with others. Paraphilias without DSM codes listed come under DSM 302.9, "Paraphilia NOS (Not Otherwise Specified)". In his 2008 book on sexual pathologies, Anil Aggrawal compiled a list of 547 terms describing paraphilic sexual interests. He cautioned, however, that "not all these paraphilias have necessarily been seen in clinical setups. This may not be because they do not exist, but because they are so innocuous they are never brought to the notice of clinicians or dismissed by them. Like allergies, sexual arousal may occur from anything under the sun, including the sun."[3] Most of the following names for paraphilias, constructed in the nineteenth and especially twentieth centuries from Greek and Latin roots (see List of medical roots, suffixes and prefixes), are used in medical contexts only. Taking Pedophilia Seriously Margo Kaplan* Abstract This Article pushes lawmakers, courts, and scholars to reexamine the concept of pedophilia in favor of a more thoughtful and coherent approach. Legal scholarship lacks a thorough and reasoned analysis of pedophilia. Its failure to carefully consider how the law should conceptualize sexual attraction to children undermines efforts to address the myriad of criminal, public health, and other legal concerns pedophilia raises. The result is an inconsistent mix of laws and policies based on dubious presumptions. These laws also increase risk of sexual abuse by isolating people living with pedophilia from treatment. The Article makes two central arguments: (1) although pedophilia does not fit neatly into any existing legal rubric, the concept of mental disorder best addresses the issues pedophilia raises; and (2) if the law conceptualizes pedophilia as a mental disorder, we must carefully reconsider how several areas of law address it.

JANSSEN* Independent researcher, Nijmegen, The Netherlands Abstract: A scientific nomenclature of erotic age preferences informed the mid- through late nineteenth century joint appearance of homosexuality and sexual abuse of minors on the medico-legal scene. Yet, even in the twenty-first century, legal, psychiatric and culture-critical dimensions of related terms are rarely cleanly distinguished. Review of primary sources shows the ongoing Western suspension of notions of ‘sick desire’, alongside and beyond the medicalisation of homosexuality, between metaphor, legal interdiction and postulated psychopathology. Virtually all early attention to erotic age preference occurred in the context of emergent attention to erotic gender preference. Age of attraction and age difference centrally animate modern homosexuality’s pre-modern past; its earliest psychiatric nomenclature and typologies (1844–69); its early aetiologies stipulating degrees of sexual differentiation (1890s); its concomitant sub-classification (1896–1914); its earliest psychophysiological tests (1950s); and, finally, its post-psychiatric, social scientific typologies (1980s). The two met after Brandes answered an Internet advertisement placed by Meiwes for a young man interested in “slaughter and consumption.” Meiwes testified in court that the killing began after the two engaged in sadomasochistic sex acts when, at Brandes’s request, he tried unsuccessfully to bite off Brandes’s penis, and then cut it off with a knife. The two then tried to eat the penis raw, then fried it in a pan trying unsuccessfully to eat it. Brandes eventually went unconscious from loss of blood after lying for hours in the bath- tub while Meiwes read magazines and drank wine. Meiwes then hung Brandes from a butcher’s hook and slaughtered him. The slaughter included severing his head, disem- bowelment, laying him out on a butcher block, and chopping his body into pieces. After the killing, Meiwes froze portions of the body, kept the skull in the freezer, buried other body parts in the garden, and ate 44 pounds of the body over the months to follow. Meiwes videotaped the entire event, watched it later to become sexually aroused, and spoke in court about how watching horror films as a child fueled his fantasies and long- time desires to commit such acts (“German Cannibal Tells of Fantasy,” December 3, 2003).

Fankhanel, M.A., Ed.D. Orlando, Florida October 2008 Abstract This study was design to gather basic descriptive data about paraphilic behaviors among gay men in Puerto Rico and the relationship of such behaviors with their mental and emotional state. Participants (N = 429) were recruited by availability at gay men socializing venues and events across the entire island of Puerto Rico. As such, results cannot be generalized to the entire gay men population of Puerto Rico. The results reflect that, the DSM-IV-TR paraphilias most reported by the participants were Voyeurism and Exhibitionism. The most reported less-common sexual fantasies, desires and/or behaviors were observing erotic pictures and partialism. Other DSM-IV-TR specific paraphilias, along with sexual fantasies, desires, and/or behaviors that could be considered under Paraphilias NOS were also reported by some participants. However, the design of the study does not allow differentiating between participants that only fantasized such paraphilias, versus those that have sexual desires and/or act out such behaviors. Over 90% of the participants reported good self esteem and stable mental and emotional health at the time of the study. Additionally, two-thirds of the participants aver feeling good during the experience of a less common sexual fantasy, desire, and/or behavior; feeling that remains, for the most part, after such fantasies, desires, and/or behaviors have culminated.
