Annual Report 2012-13 1 Annual Report of Biodiversity Board, Bangalore for the year 2012-2013 (As per Rule 19(3) of Karnataka Biologica Diversity Rules 2005) I . Introduction The Government of passed the Biological Diversity Act 2002 No. 18 of 2003, on 5th February, 2003 The Act provides for conservation of biological diversity, sustainable use of its components and fair and equitable sharing of the benefits arising out of the use of biological resources, knowledge and for matters connected therewith or incidental thereto.

II. Constitution of the Board: As per the Act each State is supposed to establish State Biodiversity Board under section 22 of the Act. Accordingly the Govt. of Karnataka has established the Board Vide G.O.No. FEE 125 ENV 2003 dated: 19-06-2003 and it started functioning from 1 st August 2003. The Board shall be a body corporate by the name aforesaid, having perpetual succession and a common seal, with power to acquire, hold and dispose of property, both movable and immovable. a. A Chairperson who shall be an eminent person having adequate knowledge and experience in the conservation and sustainable use of biological diversity and in matters relating to equitable sharing of benefits, to be appointed by the State Government; b. Not more than five ex officio members to be appointed by the State Government to represent the concerned Departments of the State Government; c. Not more than five members to be appointed from amongst experts in matters relating to conservation of biological diversity, sustainable use of biological resources and equitable sharing of benefits arising out of the use of biological resources.

III. Functions of the Board:

1. The functions of the Board as per section 23 of the Act are :

a. Advise the State Government, subject to any guidelines issued by the Central Government, on matters relating to the conservation of biodiversity, sustainable use of its components and equitable sharing of the benefits arising out of the utilization of biological resources; b. Regulate by granting of approvals or otherwise requests for commercial utilization or bio-survey and bio-utilization of any biological resource by Indians; c. Perform such other functions as may be necessary to carry out the provisions of the Biological Diversity Act, 2002 or as may be prescribed by the State Government.

3. Appointment of Nodal Officers:

As per the Government order No.FEE 17 ENV 2009 Bangalore dt 3/2/2009 the Deputy Conservator of Forests (Social Forestry) in Karnataka of all districts, in addition to their present duties shall act as the nodal Officers and link between the State Biodiversity Board and BMCs at various levels.

4. Appointment of Authorized Officers:

As per the MoEF notification No. S.O. 120(E) dt 7/1/2009 the Forest officers not below the rank of Range officers in their respective jurisdiction are authorized to file complaints under Section 61 (a) of the Biological Diversity Act 2002.

IV Constitution of the Committees by Board and meeting of these committees:

During the year 2010-11 the Board constituted the following committees for a period of three years.

1. Expert committee on Heritage Site 2. Expert Committee on Agro Biodiversity

The committees will have the following assignment 1. Expert Committee on Heritage Sites. 1. Identification of sites for declaration as Biodiverity Heritage Site. 2. Frame Rules for preparation of Management plan for conservation of Biodiversity Heritage sites. 3. Scrutinize the objections submitted by various stakeholders on declaration of Biodivesity Heritage Site. 2. Expert Committee on Agro Biodiversity 1. Identification of Agro Biodiversity Hotspots of various Agriculture/Horticulture crops including local varieties /land races 2. Recommend action for conservation and sustainable utilization of the local varieties / land races of agricultural crops. 3. Advise the Government on geographic indicators and IPR issues in respect of the above.

Deliberation on considering “Kan lands” in Sagar, Soraba, Shikaripur and Hosanagar taluks of Shimoga district to declare them as Biodiversity Heritage Sites. b. Third meeting of Expert Committee on Heritage Site was conducted to discuss the following points.

1. Providing incentives to owners of the Heritage Trees 2. Proposal on Mango orchard in Kirugavalu village, Malavalli Taluk, Mandya District to decalre as Biodiversity Heritage Site. c. First Meeting of Expert Committee on Agro Biodiversity was held and the following issues were discussed:-

1. Incentives to farmers who are maintaining traditional varieites of crops. 2. Declaration of Mango farm in Kirugavalu village of Mandya district as Agro biodivesity Heritage Site. 3. Declaration of Varada River basin as Agro Biodiversity Heritage site. 4. Project on conservation and utilisation of deep water rice genetic resources of Varada River Course in of Karnataka (Nutritional value analysis) 5. Issues of permission by GEAC/MoEF for conducting Bio safety research level II field trials of transgenic corn hybrids by Monsanto Indian Limited. 6. Issues of permission by GEAC/MoEF to conduct confined field trials for event selection of transgenic rice events (Hybrid Rice SPT maintainer events) by E.I.Du Pont, India Pvt. Ltd.

The Board has undertaken following activities:

1. Formation of Biodiversity Management Committees (BMCs) 2. Awareness training on Biodiversity and related issues to BMC’s, villagers, government servants, colleges, university students & teachers, general public. 3. Preparation of PBR through BMC’s with the guidance from NGOs, Forest Departments and Universities and Colleges etc., 4. Preparation of proposal for declaration of some areas as heritage sites under Biodiversity act. 5. Funding to carryout Research Projects / Special Studies on Biodiversity

2. Biodiversity Awareness Training Programme: The Karnataka Biodiversity Board has taken up the training programme on creation of Awareness in respect of Biodiversity and its related issues including Traditional Knowledge Biodiversity documentation and Management Plan. The Training module covers the following: Biodiversity and its importance. 1. Components of Biodiversity and its types. 2. Status of Biodiversity 3. Stakeholders in Biodiversity 4. CBD and Biodiversity Act and Rules 5. Functions of National Biodiversity Authority (NBA) Karnatka Biodiversity Board (KBB) and Biodiversity Management Committees (BMCs) and other departments in conservation of Biodivesity. 6. Biodiversity Hotspots and declaration of Biodiversity Heritage Sites. 7. Community Traditional knowledge related to crop, Animals and health care of humans and livestock. 8. Causes for the loss of Biodiversity. 9. Link between wild and domesticated Biodiversity. 10. Access of bioresources, sustainable use of their components and equitablesharing of benefits arising out of use of bioresources. 11. Awareness on conservation of Biodiversity. 12. As per Biological Diversity Act Biodiversity Management Registers are to be prepared. The Register shall contain comprehensive information on availability, knowledge of local biological resources, their medicinal or any other use and traditional knowledge associated with them.

People’s Biodiversity Registers were taken up in varios districts at Gramapanchayath level as suggested by the National Biodiversity Authority and direction of Secretary, Environment of Forests, Government of India while addressing the State Biodiversity Boards at Ooty meeting to review the working of State Biodiversity Boards. People’s Biodiversity Registers is a panchayat level register that documents local biodiversity and the local community’s knowledge on biodiversity including its conservation and traditional uses.

The Forest Department, Universities, Colleges & NGOs have been involved as Nodal agency to guide and give technical expertise to Biodiversity Management Committies in PBR documentation.

5. Declaration of Heritage Trees

Karnataka Biodiversity Board has intiated a programme to identify certain trees in various districts which are unique, historical and have high significance. The same will be considered for declaring as Heritage Trees.

9. Heritage Site Management Rules

The Karnataka Biodiversity Board has prepared draft rules on the Management of Biodiversity Heritage Sites and submitted to Government for approval.

10. News Letter:

Karnataka Biodiversity Board is bringing out a quarterly a News letter by giving details of important information and articles from various sources on various components of Biodiversity. So far 11 i ssues have been released. News letter is being published in local language Kannada also.

Details of legal proceedings:

1. A criminal complaint (No 579/2012) was filed on 24/11/2012 against UAS Dharwad and Mahyco and Monsanto companies and others in principal JMF Court Dharwad for using 6 local varieties of Brinjal for Bt. Brinjal Development without previous approval from National

Annual Report 2012-13 17 Biodiversity Authority, Chennai. Secretary, NBA as the first complainant and Deputy Conservator of Forests, Karnataka Biodiversity Board and Deputy Conservator of Forests (Dharwad) are the 2 nd and 3 rd complaints respectively.

University of Agricultural Sciences, Dharwad and three other respondents in this case suceeded in getting six months stay on the proceedings of Criminal Complaint (No 579/2012) on 5/9/2012 in the circuit bench of High Court of Karnataka, Dharwad. Karnataka Biodiversity Board has furnished parawise replies to its Advocate, National Biodiversity Authority to file objections to vacate the stay.

2. Environment Support Group, a Bangalore based NGO has filed a PIL No (41532/2012) in the Hon’ble High Court of Karnataka in the matter of implementation of Biological Diversity Act 2002 against Ministry of Ecology and Forest, GoI, National Biodiversity Authority, Karnataka Biodiversity Board and Government of Karnataka.

Karnataka Biodiversity Board has appointed a lawyer to plead in the court and has prepared parawise replies and submitted in the Court through its lawyer.

3. Environment Support Group, a Bangalore based NGO has filed applications 6/2012 and 12/2012 in National Green Tribunal, Chennai, (NGT) challenging transfer of 9273 acres of Amrit Mahal Kaval land in Challakere taluk of Chitradurga District. Karnataka Biodiversity Board is one of the respondents in their applications and has furnished parawise replies to Governemnt for approval.

IX. Visits to the Board by Experts, important dignitaries etc.

1. Sri. S. Shivanna, Hon’ble Minister for Ecology and Environment, Planning and statistics and Chairman, Karnataka Biodiversity Board, Bangalore-01, visited the Board office on 30/08/2012 and a brief presentation was made before him regarding activities of the Board. X. Any other important matter dealt with by the Board.

1. Auction of tamarind fruits in Tamarind Grove at Nallur village conducted on 28/9/2012 in presence of Chairman, Biodiversity Management Committee and Publics. Amount received Rs. 1.01 lakh has been deposited in the account of Biodiversity Management Committee.

2. Karnataka Biodiversity Board released an amount of Rs.10.00 lakhs towards conducting Second Indian Biodiversity Congress (IBC) and Expo 2012 (From 9th to 12 th December 2012) at Indian Institute of Science, Bangalore.

3. Karnataka Biodiversity Board released an amount of Rs.1.00 lakh towards organizing National Biodiversity Congress (NBC) from 27 th to 30 th December 2012 at Thiruvananthapuram.

4. Member Secretary was one of the panelists and gave lecture in the side event – “Challenges for regulatory agencies to tackle Bio piracy”, on 17 th October 2012 in the CoP -11 held at Hyderabad.

5. Member Secretary, attended 2 nd Indian Biodiversity Congress held at Bangalore.

a. Member Secretary chaired the plenary session – “How Genetics, Genomics and Bio informatics can help in documenting, conserving and managing Western ghats Biodiversity and gave the plenary lecture.

b. He participated in panel discussion on “Green politics and gave lecture on the subject “Chance for conserving Biodiversity in a climate of weak regulation” on 11/12/2012.

6. On 21 st April 2012 Member Secretary attended the Workshop organized by Kuvempu University at Shimoga and gave lecture on “Conservation of Western ghat Forests” 7. Member Secretary visited ZSI and BSI, headquarters at Kolkata from 27/12/12 to 31/12/12 to pursue of Biodiversity related subjects. ZSI has accepted to publish “Faunal Biodiversity of Karnataka” and process is under way.

8. As a member of following Expert Committee constituted by National Biodiversity Authority under Biological Diversity Act 2002 and Rules, valuable inputs were provided by Member Secretary.
