Pope Nicholas’s speech about simony and papal election, 1059 Draft translation by Charles West, September 2019 Source: MGH Concilia VIII, pp. 382-3 (JL 4431a) The Lord Pope Nicholas, presiding over the synod in the Constantinian basilica, said: “We decree that there should be no mercy for the simoniacs to protect their indignity, and we condemn them according to the sanctions of the canons and the decrees of the holy fathers, and we declare with apostolic authority that they should be deposed. About those who were ordained by simoniacs not for money but freely, since this question has now been debated for a very long time, we remove every knot of doubt, so that we permit no one henceforth to hesitate over this decree. Since the poisonous calamity of the simoniac heresy has until now grown up to such an extent that hardly any church can be found that is not corrupted in some part by this disease, we permit those who have been freely ordained already by simoniacs to remain in their orders, according not to the censure of justice but to the perspective of mercy, unless perhaps some fault from their life stands against them according to the canons. There is such a multitude of these people that since we are not able to enforce the rigour of canonical vigour upon them, it is necessary that we incline our spirit for the moment to the zeal of pious condescension. We do this on condition, however, that by the authority of the Apostles Peter and Paul we absolutely forbid that any of our successors should ever take this permission of ours as a rule for themselves or anyone else, since the authority of the ancient fathers did not promulgate this by command or concession, but the great necessity of the time extorted it from us by permission. -

Now We see His teachings attacked and His reverence outraged, His Church embattled and His Vicar opposed. So many souls redeemed by His blood are now lost, the choicest portion of His flock, a people faithful to Him for nineteen centuries. How can We bear to look upon His chosen people exposed to a constant and ever- present danger of apostasy, pushed toward error and vice, material miseries, and moral degradation? Likewise to guarantee its indisputable sovereignty in international matters, it has been found necessary to create under special conditions the Vatican City, recognising the full ownership, exclusive and absolute dominion and sovereign jurisdiction of the Holy See over that City; His Holiness the Supreme Pontiff Pius XI and His-Majesty Victor Emmanuel III, King of Italy, have agreed to conclude a Treaty, appointing for that purpose two Plenipotentiaries, being on behalf of His Holiness, His Secretary of State, viz. His Most Reverend Eminence the Lord Cardinal Pietro Gasparri, and on behalf of His Majesty, His Excellency the Cav. Benito Mussolini, Prime Minister and Head of the Government; who, having exchanged their respective full powers, which were found to be in due and proper form, have hereby agreed to the following articles: Article 1 Italy recognizes and reaffirms the principle established in the first Article of the Italian Constitution dated March 4, 1848, according to which the Catholic Apostolic Roman religion is the only State religion. -

As pilgrims to the tombs of the Apostles Peter and Paul, you "come to see Peter" (cf. Gal 1:18) and his collaborators in the service of the universal Church. You thus confirm your "unity in the same faith, hope and charity, and more and more recognize and treasure that immense heritage of spiritual and moral wealth that the whole Church, joined with the Bishop of Rome by the bond of communion, has spread throughout the world" (Pastor Bonus, Appendix I, 3). 2. As Bishops, you have been endowed with the authority of Christ (cf. Lumen Gentium, 25) and entrusted with the task of bearing witness to his saving Gospel. The faithful of Scandinavia, with great expectation, look to you to be steadfast teachers of the faith, selfless in your readiness to speak the truth "in season and out of season" (2 Tim 4:2). By your personal witness to the living mystery of God (cf. Catechesi Tradendae, 7), you make known the boundless love of him who has revealed himself and his plan for humanity through Jesus Christ. -

Stabile* INTRODUCTION My writing in recent years has explored the question o f what Catholic social thought and Catholic legal theory add to our considera- tion of various legal questions. That project proceeds from the premise that faith and religion are not to be relegated to church on Sunday (or temple on Saturday, or other equivalents); rather, faith and religion are relevant to our actions in the world.
