C/458/13 Address of Outgoing Cathaoirleach

An Cathaoirleach, Councillor T. Joyce thanked the Members, the Manager, the Management Team and staff for their support during his year as An Cathaoirleach.

Outgoing Cathaoirleach’s Speech “I would like to begin by thanking my fellow Councillors for the honour of electing me as Cathaoirleach for the last year. I have thoroughly enjoyed my time in office and hope that I have discharged my duties effectively. In addition I thank the Leas Cathaoirleach, Stephen Fitzpatrick for his help over the year. Secondly, I would like to thank the County Manager, Management Team, Council staff for their help and assistance. In particular I would like to thank Aoife Farrelly, Lucia Crowley, Bríd Gaffney and Jim Ryan for their help over the past twelve months.

1 Some Highlights • It was a pleasure meeting individuals and groups across the County who are working tirelessly for the social, cultural and economic development of this county, for example - local residents and community groups, business associations, Arts and Cultural organisations and so many other areas. • I was delighted to progress long awaited schemes for community facilities in areas of the County that need it, for example – Shanganagh Bray Waste Water Treatment Plant and Leisure Centre. • I was particularly pleased that at a time when businesses across the Country are struggling, this Council was able to provide some relief in the form of a 2% rates reduction. While the reduction was quite modest, the fact that we were practically the only Local Authority in the Country to reduce rates reflects positively on us. • It was an honour for me to collect the Local Authority of the Year Award at the Chambers Ireland Excellence in Local Government Awards last November. Having first hand knowledge of the work that goes on behind the scenes by management, staff and my fellow Councillors, I have no doubt that this award was completely justified.

Finally, I would like to wish the incoming Cathaoirleach the very best of luck in the coming year. It is both a privilege and an honour to represent the people of Dún Laoghaire Rathdown as first citizen of the County and the political head of the Council. I see the role as an unrivalled opportunity to promote all that is good about local government, together with leading the way for change where necessary.

I am sure that the incoming Cathaoirleach elected tonight will put his/her own stamp on the role and articulate a vision for the year. I am also hopeful that he/she will continue to promote the idea of working together for the benefit of Dún Laoghaire-Rathdown and ultimately for ‘better local government’.”

An Cathaoirleach, Councillor T. Joyce invited nominations for the election of An Cathaoirleach.

Councillor C. Smyth was proposed by Councillor J. Bailey and seconded by Councillor R. Humphreys.

NO OTHER CANDIDATE PRESENTED THEMSELVES FOR ELECTION. AS COUNCILLOR C. SMYTH WAS THE ONLY CANDIDATE SHE WAS DECLARED ELECTED AS CATHAOIRLEACH TO HOLD OFFICE UNTIL THE ELECTION OF HER SUCCESOR. COUNCILLOR C. SMYTH WAS INVESTED BY THE OUTGOING CATHAOIRLEACH WITH THE CHAIN OF OFFICE.

The new Cathaoirleach then took the Chair.

Cathaoirleach’s Acceptance Speech “Thank you very much for electing me Cathaoirleach.

Firstly I would like to thank my proposer the Labour Group Leader Richard and my seconder Fine Gael Group Leader John and all the members for their support particularly my own group the Labour Party, Fine Gael and my Ward colleagues Denis, Donal, Hugh and Maria.

I would like to thank the former Cathaoirleach Cllr. Tom Joyce who has had a great year and has been very helpful over the last couple of weeks introducing me to my new role.

You don’t become Cathaoirleach on your own.

There are a large number of people I would like to thank who have helped and supported me being a Councillor and becoming Cathaoirleach.

I would like to thank my family for their ongoing loyal support especially my husband and mum.

Members of the Labour Party who have continued to support and help me since my co option ten years ago especially Betty, Clare, Martin, Nora and William.

My work colleagues who have allowed me to take time off work to attend meetings, which as you all know as a Councillor is a full time commitment.

My friends who have provided a distraction from politics especially in the last two years.

Owen Keegan, County Manager, the Management Team and the Council Staff who have always facilitated and responded to the queries I receive from constituents and helped me fulfil my role as Councillor. I can’t continue without acknowledging the role Owen Keegan has played in the last seven years as County Manager and I wish him every success in his new role as Dublin City Manager.

Finally the people of the Ballybrack Ward now the Killiney/Shankill Ward who have voted for me in 2004 and 2009. I couldn’t have done it without your support.

I started my political journey as soon as I could walk and drop leaflets for various Labour Party candidates in Local, European and General Elections. My public political journey started ten years ago after I won an internal Labour Party selection convention, which was a bitter sweet victory. I was then co-opted onto the Council and have retained my seat because the people of the Ballybrack Ward supported me in 2004 and 2009. I have travelled along smooth roads, bumpy roads, hills and bends on this journey, which I have tackled and enjoyed. I never thought I would get the opportunity to become a Councillor never mind Cathaoirleach. I feel very privileged becoming Cathaoirleach it is to date the highlight of my political life and I am humbled and honoured to be Cathaoirleach in Dun Laoghaire Rathdown where I was born, grew up, work and live.

In these on going difficult times that we are all experiencing it is not the time for political point scoring and I hope we all can work together for the betterment of all the citizens of Dun Laoghaire Rathdown. We can all work together to look out for each other especially the elderly, the young, the disabled and the most vulnerable.

I am not going to promise the sun, moon and stars. However there are a number of projects I would like to see initiated during my year as Cathaoirleach:

Shanganagh Castle The acquisition of the mid 18th century Shanganagh Castle as part of the proposed land swap, which was first mooted over a decade ago prior to the rezoning of the Woodbrook lands. The Castle is now in a serious state of disrepair. It is imperative that the Castle and the surrounding lands are brought into Council ownership without further delay. This will enable the final completion of Shanganagh Regional Park.

Dalkey Island Dalkey Island is an extraordinary heritage resource of national significance. As such it offers a unique insight into our past. The Dalkey Island project, which includes the preparation of a Conservation Plan, Bye Laws, a new management regime for the island and a programme of physical works will conserve this wonderful asset for the future.

Dun Laoghaire Baths The refurbishment of the Dún Laoghaire baths complex and the general upgrade of the area between Newtownsmith and the East Pier has long been an ambition of this Council ever since the baths closed in the mid 1980s.

The current position is that an application for a foreshore licence in respect of this project was submitted to the Department in December 2012. Once the foreshore licence is granted a Part 8 process will commence. I intend to do everything in my power to ensure that this long awaited project gets on site before my term as Cathaoirleach ends.

Marlay Park Regional Sporting Hub I am also committed to the continuing development of a sporting hub in Marlay Park, which will include, a full size athletic track, improved tennis courts, a modern golf Clubhouse, improved cricket facilities and a White Water Course and Centre.

Once again thanks very much for this honour and I look forward to working with you all over the next year.

C/465/13 Dún Laoghaire Harbour Company

Question: Councillor V. Boyhan “To ask the Manager to indicate what discussions have taken place with the Department of Transport in relation to taking part of all of the functions of Dún Laoghaire Harbour Company into the remit and responsibility of Dún Laoghaire-Rathdown County Council and to provide a brief written report on same?”

Reply: “A ‘National Port Policy’ was launched by the Minister for Transport Tourism and Sport, Mr Leo Varadkar T.D. in March 2013. The policy provides, among other things, for control of Dún Laoghaire Harbour Company to transfer to Dún Laoghaire Rathdown County Council. However, this is dependent on the enactment of enabling legislation.

The Department is to initiate discussions with the Council and the Harbour Company to determine the most suitable method of transfer to local authority control. No discussions have taken place to date.”

C/466/13 Property Tax

Question: Councillor V. Boyhan “To ask the Manager to indicate what plans, if any, he has to transfer the Government Property Tax on Family Homes, which fall into the ownership of Dún Laoghaire-Rathdown County Council, onto Council tenants and to set out if this decision is solely an Executive Function of Council Management or a Reserved Function of Councillors?”

Reply: “The Council will be liable to pay the Local Property tax on its Social Housing units and has over 4,000 Social Housing properties that will be subject to the Local Property Tax.

Under the FINANCE (LOCAL PROPERTY TAX) (AMENDMENT) Act 2013, all the Council’s social housing properties are to be included in the lowest valuation band for the first valuation period (2013 to 2016). While the legislation provides for the payment of the property tax in respect of Local Authority Housing at the lowest valuation band, which will give rise to a tax of €90 per annum in a full year and €45 in 2013, no decision has been made at this stage on how liability in respect of the Council's housing stock will be met. A report on this matter will be brought to a future meeting of the Council.”

C/467/13 Festival of World Cultures

Question: Councillor V. Boyhan “To ask the Manager to indicate what plans are being considered to re-launch the Festival of World Cultures?”

Reply: “At present there are no plans to relaunch the Festival. Even a slimmed down version would

5 require significant additional funds to produce, which in the current financial environment are beyond the Council. The Council is continuing to fund a wide range of events. It is anticipated that dlr Fusion will return in 2014 subject to adequate provision in the 2014 Budget.”

C/468/13 Dún Laoghaire-Rathdown Fire and Rescue Services

Question: Councillor V. Boyhan “To ask the Manager to confirm whether a briefing and Q&A session with the Chief of Dublin Fire Brigade has been arranged for the Council. Please provide details?”

Reply: “The Chief Fire Officer, Dublin Fire Brigade will make a Presentation to the June meeting of the County Council.”

C/469/13 Covanta - Poolbeg Municipal Incinerator

Question: Councillor V. Boyhan “To ask the Manager to provide a brief report on the current status of the Covanta Incinerator Project and a schedule of payments Dún Laoghaire-Rathdown County Council have made to date for the project and copies of any Managers Orders issued in relation to this project since June 2012 to date?”

Reply: “Currently Covanta Energy Corporation is finalising finance for the construction phase of the project with a number of investors. Dublin City Council for its part has provided comprehensive rebuttals to various complaints which have been lodged with the European Commission in relation to State aid and Procurement issues.

Following close out of these two items, which is expected in the coming months, construction will recommence.

C/470/13 Online Planning Objections

Question: Councillor S. Fitzpatrick “To ask the Manager when the pilot period for submission of online planning objections will be completed, the success of the pilot to date, and if the Manager will make a comment on plans to fully roll out the service including advertising of the service on the Council’s website?”

Reply: “The pilot period for the introduction of planning submissions on line commenced in October, 2012 and the Planning Department has received 66 submissions on line to date. This represents 14% of all submissions received since October.

Difficulties have arisen with data transfer into the new system i.e. submissions made by the public are not transferring correctly into the new system. The Council’s IT and Planning Departments are in the process of examining an optimum method of data transfer prior to extensively advertising this new service.

A full roll out of the service will depend on the results of all options being examined and this examination will be completed this year.”

C/471/13 Rights of Way Protected in the Current or Previous Development Plans

Question: Councillor R. Humphreys “To ask the Manager the titles of court actions initiated in respect of rights of way protected in the current or previous development plans, and the right of way to which each relates, which of these remain to be finally disposed of, the length of time that has elapsed since the last step taken in each such action, and whether the Council will apply to have the action in each relevant case dismissed for want of prosecution?”

Reply: “The attached Table contains the reply to all of the elements of the question raised with respect to 18 separate Circuit Court Appeals. The title of each Court action is in the name of each of the Appellants listed in Column 3. The Council is the sole Respondent in each case.

Each of the listed Court actions arises from the making of the 2004 Development Plan.

The status of each Court action (i.e. whether resolved or not) is identified.

The last “step” taken in the legal proceedings and when that “step” occurred in the cases where the Appeal by the landowner is unresolved is set out in Column 7.

It is considered that neither the circumstances or status of each case nor the investment in costs and effort warrant the initiation of a legal action by the Council “to have the action in each (of the) relevant case(s) dismissed for want of prosecution”, as suggested by the question.”

HOUSING Under the Housing (Miscellaneous Provisions) Act 2009 there is a requirement for each housing authority to have in place an action plan outlining measures to address homelessness. The current Dublin Region’s Statutory Homeless Action Plan for the Dublin Region covers the period 2010 to 2013.

The Dublin Region Homeless Executive commenced consultation with interested parties as part of its programme of consultation in developing a new statutory framework action plan for 2014 to 2016. The deadline for receipt of submissions from interested parties was the 17th May 2013. It is expected that a regional framework action plan 2014-2016 will be tabled at the Housing Strategic Policy Committees of the four Dublin local authorities in September 2013 and will be subsequently presented to the four Councils at their Council Meetings for formal adoption in October 2013.

Question: Councillor R. Humphreys “To ask the Manager to provide up to date details or estimates of the amount of money owed to the Council broken down by headings under which such debt arises, and details of the steps in each case being taken to collect same?”

Individual Council Departments have devolved responsibility for the collection of income due to the Council in respect of charges/costs determined by their Department. The Finance Department is responsible for the collection of commercial rates, non domestic water charges, household charge, nppr & outstanding waste charges arrears. Departments continuously monitor income collection performances as part of their budgetary control process with the Finance Department exercising a central monitoring function.

12 Each Department has in place internal procedures for the pursuit and collection of monies owing to the Council. These procedures include a combination of the following enforcement methods:

• Issue of initial invoice • Issue of subsequent reminder notices and letter • Issue of warning and enforcement notices. • Telephone contact with individual debtors • Use of frequently asked questions (faq’s) facility on Council Website • Continuous promotion of alternative payment options(direct debit facility etc) • Facilitation of phased payment agreements • Referral to debt collection agencies • Use of Stubbs Gazette debt collection service • Discontinuation of supply of service • Institution of legal proceedings

The Council continuously examines the options available to it to maximise the collection of outstanding income due to it and utilises those strategies considered most appropriate depending on the particular category of debtor involved.”

C/475/13 Replacing Beach Signs

Question: Councillor R. Humphreys “To ask the Manager the updated position regarding replacement of beach signs which referred to the Beach Bye Laws 2009?”

Reply: “The Beach Bye Laws 2012 came into effect on the 1st January 2013. The existing signs relating to the dogs were removed and the new signs were erected. The new signs were erected at entrance points to Seapoint, Sandycove and Killiney Beach and relate to the new Beach Bye Laws 2012. The blue Code of Conduct signs located at Seapoint, Sandycove and Killiney Beaches were also modified to take account of the new bye laws.”

An application was received from Gordon and Stephanie Connor to acquire an area of land at 44 Oakton Park, Ballybrack, Co. Dublin as shown outlined on Drawing No. PL-13-227. The land is registered in the Land Registry, Co. Dublin to the Council under Freehold Folio No. 15151. The land was acquired by the Council for Housing and Roads purposes.

At the Dún Laoghaire - Rathdown District Committee Meeting held on the 20th January 1988 a report on allocation of “No Value” open spaces in the Ballybrack area was discussed.

There is no record that the proposed allocation of “No Value” open spaces in the Ballybrack area was placed before Full Council for a formal decision.

Representations have now been made on behalf of Gordon and Stephanie Connor of 44 Oakton Park, Ballybrack, Co. Dublin to have the plot of land measuring circa 31.2 sq. metres as shown outlined in Red on Drawing No. PL- 13- 227 to be formally transferred.

The land is registered in the Land Registry, Co. Dublin to the Council under Freehold Folio No. 15151.

The relevant Council Service Departments have no objections to this proposed disposal.

The following terms and conditions to apply: 1) Title to be conveyed shall be Leasehold only for a term of 250 years subject to a rent of €5.00 per annum if demanded. 2) The title to be conveyed shall be Leasehold Interest only. 3) The purchasers will be responsible for Council’s Legal costs. 4) That a 3 metre wayleave be retained in respect of 225mm foul sewer as shown highlighted in yellow on Drawing No. PL-13-227. 5) No structure shall be erected within the wayleave area. 6) A gate of 2.3 metres wide must be provided so that vehicle access is possible to the manhole. Details with regard to the specification, construction and type of boundary walls must be agreed in advance with the Council. 7) No agreement enforceable at law is created or is intended to be created until an exchange of contracts has taken place.

This proposed disposal is included as an item for consideration at the Dún Laoghaire Area Committee Meeting (Planning, Transportation and Water Services) to be held on 5th June 2013.

Dún Laoghaire-Rathdown County Council Arts Office Arts Grants 2013 Closing Date: Wednesday 27th of February at 12 noon Guidelines for making an application

Dún Laoghaire-Rathdown County Council has a scheme of grants for the purpose of providing financial assistance to individual artists, arts groups and arts organisations engaged in arts projects or events at local or county level. Grants are also available to support the professional development and arts practice of individual artists, arts groups and organisations.

Individual artists, arts groups and arts organisations working in all art-forms (architecture, circus, craft, dance, film, literature, music, opera, spectacle, street art, theatre, traditional arts and visual arts) are eligible to apply. Collaborative applications are also welcomed.

Grants are available for the arts activity taking place between the 1st of July 2013 until the 30th of June 2014.

Other opportunities available through Dún Laoghaire Rathdown County Council Arts Office include the Tyrone Guthrie Bursaries and the Concourse Award. The closing date for the Tyrone Guthrie Bursaries is the 27th of February while the Concourse Award will be advertised later in the year. Funding Strands: • Event/Project Support– Funding to support the production of an event, festival or long- term project by an individual artist, arts group or arts organisation that will allow the public an opportunity to engage with or experience the arts. The applicant/s must clearly define the outcome in the application. • Participation and Learning – Funding to support projects that have a collaborative approach between the artist and the participants. Examples of potential successful applications may include, but are not limited to, arts initiatives in formal and informal education settings, healthcare and community settings. They should inspire artists and initiatives to engage, consult and collaborate with a community or place within Dún Laoghaire-Rathdown County or provide opportunities for growth and development within the participatory arts sector. • Professional Development and Arts Practice Support– Funding to develop or support studios, to purchase materials or equipment or to support the professional development of an artist, arts group or arts organisation. This could take the form of a bursary to allow the artist time to complete a specified body of work or a training opportunity such as a course. This cannot be used to fund third level training or travel. Please note that a maximum of 20% of the total funding available for Arts Grants will be awarded to Professional Development and Arts Practice Support applications.

In addition to the above strands, An Cathaoirleach’s Arts Award of an additional €1,000 will be awarded at the recommendation of the selection panel and as approved by An Cathaoirleach. It will be awarded to a proposal of outstanding merit from all the funding strands that the selection panel believe would benefit from the additional funding. The Award may be presented at a future Council function.

Eligibility: • A maximum of two applications will be accepted from any individual, group or organisation. This is of particular relevance to those applying to the Participation and Learning strand. • The success or otherwise of previous grant aided activities will be taken into account when assessing the applications and previous grant reports submitted by applicants will be available to the selection panel. • Applications that involve strategic partnerships and collaborations will be favourably considered particularly where match funding is available. • In regards to applications from organisations only not for profit organisations will be considered. • Grants will not cover building programmes, third party grants, assistance to cover loans or deficits, projects which could be undertaken on a commercial basis, charity fundraising events or the hire fee of Council premises.

Conditions: • Successful applicants will be required to acknowledge the support of Dún Laoghaire- Rathdown County Council in writing on all promotional materials. Guidelines for making an application

Dún Laoghaire-Rathdown County Council provides financial assistance to artists and arts practitioners to attend the Tyrone Guthrie Centre for a period of 2 weeks.

Funding is available for attendance at the centre from the 1st of July 2013 until the 30th of June 2014. Dates should be organised by the recipient with the Tyrone Guthrie Centre. Payment will be made directly by dlr Arts Office to the Tyrone Guthrie centre. Two bursaries will be awarded for this period.

Other opportunities available through Dún Laoghaire Rathdown County Council Arts Office include the dlr Arts Grants and the Concourse Award. The closing date for the dlr Arts Grants is the 27th of February while the Concourse Award will be advertised later in the year. On 12th April 2013 statutory notice was published in the Irish Times of the Council’s proposal to take the above roads in charge, and to declare the roads in the above estates to be public roads. Maps and schedule were available for inspection for one month.

Submissions received. Three submissions were received within the statutory timeframe;

Two in relation to Wingfield and one in relation to Cairnfort.

Wingfield: The first submission is from a resident in Cairnfort and refers to two small areas of decorative planting. The submitter requests that these areas be taken in charge stating that as there is no management company for Wingfield, the areas should not be private areas. These areas are indicated on the drawing as areas to be privately managed and it has been confirmed with Parks Section that the areas will not be taken in charge, the intention is that they will be maintained by the residents.

The second submission, also from a resident in Cairnfort, refers to the provision of double yellow lines at certain locations in Wingfield. This is not a taking in charge matter, and the submission has been referred to Traffic and Water Services for consideration and reply.

Cairnfort: The submission is from a resident in Cairnfort and refers to surface water drainage and ponding in cul-de-sacs in Cairnfort. This matter can be addressed after the estate has been taken in charge. There are sufficient funds available to enable the Council to carry out the necessary repair works.

No objections to the proposed declarations were received in relation to Cruagh Manor or Cruagh Wood.

It is recommended that the roads within the above mentioned estates should be declared public roads and the estates taken in charge.

Accordingly, it is recommended that the following resolution is passed by the Council:

The following report of the Manager, copy of which had been circulated to the Members, was CONSIDERED:

“Taking in Charge of :- (1) un-completed roadway from Wyattville Link Road to Brides Glen Luas Stop and (2) roadway adjacent to Druid Valley and Tullyvale, Loughlinstown, Co. Dublin.

Following consideration by the Dun Laoghaire Area Committee at it’s Meeting on the 25th April, 2013 and the Dundrum Area Committee at it’s Meeting on the 8th May, 2013, a report on the taking in charge of the roads described at (1) and (2) above was tabled for consideration at the May County Council Meeting on the 13th May, 2013.

It was reported that a submission had been received in respect of the proposals to take the roads in charge during the public consultation process. However, the objection to the taking in charge of the road at No. (2) above was withdrawn and the necessary resolution required to declare that road to be a public road in accordance with Section 11 of the Roads Act, 1993 was

40 passed in accordance with Minute No. C/423/13.

Since that Meeting, discussions have been continuing in relation to the issues with the taking in charge of the road at No. (1), the road from Wyattville Link Road to the Brides Glen Luas Stop. Following these discussions and an exchange of correspondence, the objection to the taking in charge of this road has been withdrawn.

It is now in order to proceed to declare this road to be a public road in accordance with the provisions of Section 11 of the Roads Act, 1993 and the necessary resolution is set out below.

In accordance with the provisions of Section 11 (2) of the Roads Act, 1993, the declaration of roads to be public roads is a reserved function. As this is a reserved function of the County Council, it is necessary to pass the following resolution to confirm the road to be a public road:-

41 (a) Any group of members who are present at the meeting at the time when the business of making the appointments is reached and comprising the number of members necessary for the purposes of this paragraph may nominate a person to be a member of that body and the person shall be so appointed on that nomination without any vote being taken, and (b) The members of the body then remaining to be appointed shall be appointed successively by the members of the local authority who are not members of any group referred to in clause (a) and who were present at the meeting at the time when the business of making the appointments was reached

The district of Dún Laoghaire-Rathdown was designated as an LSP in 2007 and a Sports Coordinator was appointed in April 2008.

The Council has been requested to nominate two members – one from each of the Dún Laoghaire and Dundrum sides of the County to sit on the Board of the Sports Partnership for a period of 2 years (subject to the life of the Council).

The current members of the Sports Partnership are Councillors Barry Saul and Stephen Fitzpatrick. Nominations are sought for the two vacancies.”

“The Council is entitled to nominate three of its Members to the Board of Southside Partnership for a period of one year.

In accordance with Southside Partnership procedures one third of the membership of each sector on the Board stands down after one year and they are either re-nominated or replaced by a different nominee.

The Board has requested that the Council in deciding on its nominees to have regard to the Government’s policy in relation to gender balance and the geographic remit of the Board.

For the purpose of electing Members of the Council to the Partnership, the Council Members may form groups in accordance with the rules established by Schedule 10 of the Local Government Act, 2001.

The current members are Councillor S. Fitzpatrick, Councillor H. Lewis and Councillor B. Saul. Councillors Fitzpatrick & Lewis were appointed to the Board on 11th June 2012 and Councillor Saul was appointed to the Board on 2nd July 2012. 3 nominations are now sought for the positions.”

“Putting People First: An Action Programme of Effective Local Government includes the following statement at paragraph7.3.8

“It is intended to convene a special forum or colloquium of the elected members of the four authorities to consider the options for the introduction of a directly elected Mayor for a Dublin metropolitan area, which will be put for decision through a plebiscite in 2014. This would provide for suitable democratic debate and consultation on all dimensions of the issue. Among other things, it would allow for due democratic consideration of the powers, structures and functions of an office of mayor and the changes required in the powers, structures and functions of local authorities and other relevant bodies in this context. Proposals for a directly elected mayor for the Dublin area would, as is the case in the local government system generally, be subject to the need to maximise efficiency in local government arrangements, to avoid cost increases and to achieve savings where possible”.

In this regard the Dublin Lord Mayor invited An Cathaoirleach and the Mayors of Fingal and South Dublin County Council to a meeting on 14th May 2013 to discuss this matter. The attached report and minutes of the meeting set out the proposal considered at this meeting and the approach agreed to this matter. This report was considered by the Corporate Policy Group at a meeting on 30th of May 2013. The Corporate Policy Group agreed that the matter would be included on the Agenda for the June County Council meeting with a view to agreeing on the four nominees from Dún Laoghaire-Rathdown for the proposed Working Group.

The foregoing report is submitted for consideration and decision by the Members.

The Lord Mayor wrote to Minister Hogan on 20th March 2013 and received a response 25th April 2013 which outlined issues to be considered. The Colloquium is to forward a recommendation to the Minister by year end 2013 for his consideration. The Minister / Government will then make decisions on the next steps in preparation for the plebiscite.

46 Putting People First:Action Programme of Effective Local Government, paragraph7.3.8

Introduction The Minister for the Environment Community and Local Government, Mr Phil Hogan, has indicated in correspondence (attached) that he considers the role of the colloquium will be to identify options for the local governance of the Dublin metropolitan area under the leadership of a directly elected Mayor .

Timeline As the plebiscite of the citizens of the 4 Dublin Local Authorities on this issue must take place in Dublin at the next local elections in May/June 2014, this process must be concluded by the end of 2013. Given the scale and complexity of the issues referred to, this is significant task. It is also an opportunity for the local authorities to shape the future of local democracy and governance in the region. There is also a requirement to engage constructively with the elected representatives, the public and other stakeholders in the metropolitan area to assess their requirements and priorities.

Structure of Colloquium While the Lord Mayor of Dublin was tasked with initiating/calling the colloquium, it is up to Dublin Local Authorities to formulate and agree how the process will be undertaken. At a meeting on the 14th of May, convened by the Lord Mayor of Dublin and to which the Cathaoirleach of Dún Laoghaire Rathdown County Council and Mayors of Fingal and South Dublin County Councils were invited, proposed the following structure and approach be considered.

A Colloquium Steering Group (4) who will delegate the consultation process, up to and including draft wording for the plebiscite, to a Colloquium Working Group (16).

Directly Elected Mayor Potential Approach for discussion

Steering Group Chaired by Lord Mayor Comprises of Chairs of Dublin Local Authorities Supported by Director of Services x 4 Provide guidance and decision making and recommend draft wording for the plebiscite to respective Local Authorities

The role of the steering group is to: 1. ensure that that the colloquium meets its objective and time deadlines 2. review the draft proposals from the working group 3. Agree final wording for plebiscite and send agreed proposal to the 4 councils 4. update the Minister for the Environment, Community and Local Government on progress

47 and emerging issues 5. communicate the outcome of the process to all relevant parties

Colloquium Working Group The working group will be made up of 4 elected representatives from each local authority, nominated at their June Council meetings, and supported by 4 officials (1 nominated by each local authority). The Lord Mayor, Cathaoirleach and Mayors will be ex-officio members of the working group. The Chair of the Working Group to be elected by the group at it’s first meeting. The nomination process should be completed by the end of June to allow for meetings of the colloquium to commence in July. The Colloquium will meet in various locations across the region.

The role of the working group will be to 1. agree the work programme 2. consider a range of appropriate options for the introduction of a directly elected Mayor for Dublin 3. arrange for effective and timely communication and consultation with elected representatives, the general public and other stakeholders. 4. prepare a draft proposal as outlined above 5. recommend to the steering group the wording of the proposal be sent for adoption by each local authority within the time frame 6. identify and secure each councils’ expertise and/or agree use of external expertise as required.

Colloquium Co-Ordinator The progress of the process will be co-ordinated by an official of Dublin City Council agreed by the Lord Mayor

Engagement and Consultation Widespread communication, consultation and engagement must be arranged and rolled out across the region on the potential role and impact of a directly elected mayor. “Your Dublin - Your Voice” will include questions on governance and the potential role of a directly elected Mayor in their quarterly survey. Potential other additional methods could include, public debates, talks from other cities, media and social media programmes, street engagement and facilitated workshops. This programme of work will be planned by the Colloquium Working Group. The engagement phase must conclude by mid October to feed into the final recommended time frame.

Support required from all four Dublin Local Authorities It is envisaged that the colloquium will need the following supports: • Strategic and administrative support • Research capacity - to gather existing working documents on the role of the elected mayor in addition to research from other cities and manage information requirements from the members of the colloquium • IT Capacity - shared working space (for members of the colloquium and other councillors), discussion forum, social media (blogs, twitter etc) • Communication and Media support • Public consultation support

While some elements may be outsourced, most of the support may come from existing resources. The appointed officials will co-ordinate an effective regional support structure identifying responsibilities for each element.

Budget Budgetary provision will be required to cover expenditure on the colloquium. The budget will depend on scale of consultation planned and the extent of outsourced support required.

The following report of the Manager, copy of which had been circulated to the Members, was CONSIDERED:

“Rationale for amendment The amendment is necessary following the signing of the Roads Act 1993 (Classification of Regional Roads) Order 2012 (S.I. No. 54 of 2012) on the 23rd February 2012, by the Minister for Transport, Tourism and Sport, which classified the R138 Regional Road from its northern

51 intersection with the Dún Laoghaire-Rathdown County Council Administrative Area boundary to its junction with the N31 at Mount Merrion Avenue.

The proposed amendments to the Bye-Laws are an administrative exercise which is envisaged will simplify the Bye-Laws regarding the above road classification and remove the need for any further amendments as part of any future road classification orders.

The Department of Transport, Tourism and Sport have confirmed that the classification change (Classification of Regional Roads) Order 2012, (S.I. No. 54 of 2012) was part of their on-going plan to reclassify national routes from within urbanised areas.

It should be noted that:- 1. There are no changes to any speed limits in the draft Bye-Laws; 2. There is no change to the drawing TT-107-01-09.

Relevant Legislation Road Traffic Special Speed Limit Bye Laws are made under the Road Traffic Act, 1961-2010. The legislative basis for the application of speed limits can be found in Part IV of the Road Traffic Act 1961 as amended by Part II of the Road Traffic Act 2004 (no. 44 of 2004). This legislation provides for the establishment of a range of speed limits and apportion to the Minister and local authorities, powers and functions in relation to the determination of those speed limits and their application.

The Council’s current Road Traffic Special Speed Limit Bye-Laws 2009 were adopted by Council on 9 November 2009 and came into operation on 11 January 2010.

Public Consultation As per Section 9 of the Road Traffic Act 2004, the proposed amendments will be put on display in County Hall, Harbour Square, and Dundrum Offices for a period of a minimum of four weeks. An advertisement will be placed in a national newspaper. The proposed amendments will also be available for download on the Dún Laoghaire– Rathdown County Council website www.dlrcoco.ie. As part of this consultation process, the National Roads Authority and An Garda Síochána are being fully consulted with. An Garda Síochána have reaffirmed their support of the amendments to the Bye-Laws. The Council are awaiting formal communication from both organisations.

Following the consultation process, a report will be presented to the elected members as soon as possible thereafter. A resolution of the County Council is required to amend the Bye Laws.

1.0 DEFINITIONS and GENERAL 1.1 Dún Laoghaire-Rathdown County Council in exercise of the powers conferred on them by section 9 of the Road Traffic Act 2004 (no 44 of 2004), and subject to the written consent of the Garda Commissioner and the National Roads Authority, relating to national roads and motorways hereby make the following bye-laws in respect of the area comprising the administrative area of the Dún Laoghaire-Rathdown County Council, as defined by the map prepared in accordance with Section 10 of the Local Government (Dublin) Act 1993.

1.2 These Byelaws shall come into operation on the 11 day of January 2010. In these bye-laws: “the Act of 1961” means the Road Traffic Act 1961 (No 24 of 1961); “the Act of 1993” means the Roads Act 1993 (No. 14 of 1993); “the Act of 1994” means the Road Traffic Act 1994 (No 7 of 1994); “the Act of 2001” means Local Government Act 2001; “the Act of 2004” means the Road Traffic Act 2004 (No. 44 of 2004); “the Minister means the Minister for Transport; “administrative area” has the meaning assigned to it by the Act of 2001; “built-up area” has the meaning assigned to it by the Act of 2004; “commissioner” means the commissioner of the Garda Síochána; “distance” means distance as measured along the centre line of a road; “local road”, “regional road”, “national road”, and “motorway” have the meaning assigned to them, respectively, in the Roads Act 1993; “Minister” means Minister for Transport; “speed limit” applies to a road in both directions unless specified otherwise;

1.4 Default speed limits apply, except where special speed limits or road works speed limits apply and subject to the provisions of Section 10 and Section 11 of the Road Traffic Act 2004, to the following public road categories. (1) Built-up area speed limit is 50 kilometres per hour for all mechanically propelled vehicles. (2) Regional and local roads speed limit is 80 kilometres per hour for all mechanically propelled vehicles. (3) National roads speed limit is 100 kilometres per hour for all mechanically propelled vehicles. (4) Motorway speed limit is 120 kilometres per hour for all mechanically propelled vehicles.

1.5 Special speed limits may be specified in bye-laws and applied as follows: (1) 30 kilometres per hour, which shall only be applied in respect of a road or roads

53 (other than a motorway) in accordance with guidelines issued by the Minister under Section 9 (9) of the Road Traffic Act 2004. (2) 50 kilometres per hour, in respect of any road other than a road in a built-up area (3) 60 kilometres per hour. (4) 80 kilometres per hour, in respect of a motorway, a national road or a road in a built-up area. (5) 100 kilometres per hour, in respect of a motorway, a non-urban regional or local road or a road in a built-up area. (6) 120 kilometres per hour, in respect of a dual carriageway that forms part of a national road that is not a motorway in accordance with guidelines issued by the Minister under Section 9(9) of the Roads Traffic Act 2004.

1.6 The speed limit does not apply to a driver of a fire brigade vehicle, an ambulance or the use by a member of An Garda Síochána of a vehicle in the performance of the duties of that member or a person driving or using a vehicle under the direction of a member of the Garda Síochána, where such use does not endanger the safety of road users.

1.7 The Dún Laoghaire-Rathdown Speed Limit Byelaws as dated 11th May 2004 are hereby revoked.

1.8 All previous Speed limit Byelaws of Dún Laoghaire-Rathdown County Council and all subsequent amendments to those By-Laws are hereby revoked.

2.0 Citation

2.1 These bye-laws may be cited as the Dún Laoghaire-Rathdown County Council Road Traffic Special Speed Limit Bye Laws, 2009.

3.0 Special Speed Limits 3.1 First Schedule – Special Speed Limit 50 km/h 50 km/h shall be the speed limit for mechanically propelled vehicles on public roads located within the boundary of Dún Laoghaire-Rathdown County Councils administrative area (as shown on the county boundary map prepared in accordance with section 10 of the Local Government (Dublin) Act,1993), as also shown on drawing No. TT-107-01-09 County Speed Limits (shaded green), except those roads specified in the following second, third, fourth, fifth, sixth, seventh and eighth schedules to these Bye-Laws;

3.2 Second Schedule – Special Speed Limit 60 km/h 60 km/h shall be the special speed limit for mechanically propelled vehicles on those public roads coloured yellow on drawing No. TT-107-01-09 County Speed Limits and as specified hereunder: -

The N11 National Road (i) Both Sides of the N11 National Road (Stillorgan Road), from its northern intersection with the Dún Laoghaire-Rathdown County Council Administrative Area boundary to a point 89 metres south-east of its junction with Kill Lane.

Roads forming a junction with the N11 (Southbound) (i) Merrion Grove, for a distance of 23 metres in a north-easterly direction from its junction with the N11 National Road (Stillorgan Road). 3.6 Sixth Schedule – Special Speed Limit 100 km/h 100 km/h shall be the special speed limit for mechanically propelled vehicles on those public roads coloured blue on drawing No. TT-107-01-09 County Speed Limits and as specified hereunder:-

M50 Motorway (i) The M50 Motorway (Northbound and Southbound Lanes) from its intersection with the boundary of South Dublin County Council to a point 250 metres east of its junction with the M50 off ramp to Junction 14 (Sandyford Rotary).

M50 ON/Off Ramps (i) The M50 Motorway southbound off ramp at Junction 13 (Ballinteer), eastwards from its junction with the M50 Motorway to a point 50 metres west of its junction with the Ballinteer Road Brehon Field Road Roundabout. (i) Stonebridge Road from a point 10 metres west of its junction with Dublin Road westwards to a point 10 metres east of its junction with the Falls Road. (ii) Library Road for a distance of 15 metres in a southerly direction from its junction with Stonebridge Road. 1.0 Definitions and General

61 1.1 Dún Laoghaire-Rathdown County Council in exercise of the powers conferred on them by section 9 of the Road Traffic Act 2004 (No. 44 of 2004), and subject to the written consent of the Garda Commissioner and the National Roads Authority, relating to national roads and motorways hereby make the following bye-laws in respect of the area comprising the administrative area of the Dún Laoghaire-Rathdown County Council, as defined by the map prepared in accordance with Section 10 of the Local Government (Dublin) Act 1993.

1.2 These Byelaws shall come into operation on the …. day of 2013.

1.3 In these bye-laws: “administrative area” has the meaning assigned to it by the Act of 2001; “built-up area” has the meaning assigned to it by the Act of 2004; “commissioner” means the commissioner of the Garda Síochána; “distance” means distance as measured along the centre line of a road; “local road”, “regional road”, “national road”, and “motorway” have the meaning assigned to them, respectively, in the Roads Act 1993; “speed limit” applies to a road in both directions unless specified otherwise; “the Act of 1961” means the Road Traffic Act 1961 (No. 24 of 1961); “the Act of 1993” means the Roads Act 1993 (No. 14 of 1993); “the Act of 1994” means the Road Traffic Act 1994 (No. 7 of 1994); “the Act of 2001” means Local Government Act 2001; “the Act of 2004” means the Road Traffic Act 2004 (No. 44 of 2004); “the Act of 2010” means the Road Traffic Act 2010 (No. 25 of 2010); “the Minister means the Minister for Transport, Tourism and Sport;

1.4 Default speed limits apply, except where special speed limits or road works speed limits apply and subject to the provisions of Section 10 and Section 11 of the Road Traffic Act 2004, to the following public road categories. (1) Built-up area speed limit is 50 kilometres per hour for all mechanically propelled vehicles. (2) Regional and local roads speed limit is 80 kilometres per hour for all mechanically propelled vehicles. (3) National roads speed limit is 100 kilometres per hour for all mechanically propelled vehicles. (4) Motorway speed limit is 120 kilometres per hour for all mechanically propelled vehicles.

1.5 Special speed limits may be specified in bye-laws and applied as follows: a) (i) 30 kilometres per hour, and (ii) 40 kilometres per hour, in respect of a road or roads in accordance with guidelines issued by the Minister under Section 9(9) of the Road Traffic Act 2004. b) 50 kilometres per hour, in respect of any road other than a road in a built-up area c) 60 kilometres per hour. d) 80 kilometres per hour, in respect of a motorway, a national road or a road in a built-up area. e) 100 kilometres per hour, in respect of a motorway, a non-urban regional or local road or a road in a built-up area. f) 120 kilometres per hour, in respect of a dual carriageway that forms part of a national road that is not a motorway in accordance with guidelines issued by the Minister under Section 9(9) of the Roads Traffic Act 2004.

1.6 The speed limit does not apply to a driver of a fire brigade vehicle, an ambulance or the use by a member of An Garda Síochána of a vehicle in the performance of the duties of that member or a person driving or using a vehicle under the direction of a member of the Garda Síochána, where such use does not endanger the safety of road users.

1.7 The Dún Laoghaire-Rathdown Road Traffic Special Speed Limit Byelaws as dated 11th January 2010 are hereby revoked.

2.0 Citation

2.1 These bye-laws may be cited as the Dún Laoghaire-Rathdown County Council Road Traffic Special Speed Limit Bye Laws, 2013.

3.0 Special Speed Limits 3.1 First Schedule – Special Speed Limit 50 km/h 50 km/h shall be the speed limit for mechanically propelled vehicles on public roads located within the boundary of Dún Laoghaire-Rathdown County Councils administrative area (as shown on the county boundary map prepared in accordance with section 10 of the Local Government (Dublin) Act,1993), as also shown on drawing No. TT-107-01-09 County Speed Limits (shaded green), except those roads specified in the following second, third, fourth, fifth, sixth, seventh and eighth schedules to these Bye-Laws;

3.2 Second Schedule - Special Speed Limit 60 km/h 60 km/h shall be the special speed limit for mechanically propelled vehicles on those public roads coloured yellow on drawing No. TT-107-01-09 County Speed Limits and as specified hereunder: -

Stillorgan Road and Bray Road (part of) (i) Both Sides of the Stillorgan Road, from the Belfield intersection with the Dún Laoghaire-Rathdown County Council Administrative Area boundary to a point 89 metres south-east of its junction with Kill Lane.

Roads forming a junction with the Stillorgan Road and Bray Road (part of) (Southbound) (i) The slip road from the Stillorgan Road southbound carriageway to a point 156 meters north west of its junction with the bridge over the Stillorgan Road at Belfield. (ii) The slip road to the Stillorgan Road southbound carriageway opposite Belfield between its junction with the Stillorgan Road and a point 203 metres south east of its junction with the bridge over the Stillorgan Road. (iii) (Old) Stillorgan Road (at Fosterbrook) for a distance of 20m in a north-westerly direction from its junction Stillorgan Road. 3.3 Third Schedule – Special Speed Limit of 60 km/h 60 km/h shall be the special speed limit for mechanically propelled vehicles driving in the bus lanes on those public roads coloured magenta on drawing No.TT-107-01-09 County Speed Limits and as specified hereunder:-

Bray Road (Southbound) (i) The Bray Road southbound Bus Lane from a point 89m south-east of its junction with Kill Lane to a point 15 metres north-west of its junction with Old Bray Road. (ii) The Bray Road southbound Bus Lane from a point 15 metres south-east of its junction with Old Bray Road to a point 15 metres north-west of its junction with Clonkeen Road. (iii) The Bray Road southbound Bus Lane from a point 15 metres south-east of its junction with Clonkeen Road to a point 7.5 metres north west of its junction with Johnstown Road. (iv) The Bray Road southbound Bus Lane from a point 15 metres south-east of its junction with Johnstown Road to a point 5 metres north-west of its junction with Shanganagh Vale. Bray Road (i) Southbound side of the Bray Road, excluding the Southbound nearside Bus Lane, between a point 89 metres south-east of its junction with Kill Lane to a point 100 metres north of the Loughlinstown Roundabout junction. (ii) Northbound side of the Bray Road, excluding the Northbound nearside Bus Lane, between its junction with Cherrywood Road / Bray Road to a point 89 metres south-east of its junction with Kill Lane.

The Report recommends - an increase in the number of Councillors to 40 (20 in the Dundrum area, 20 in the Dún Laoghaire area) - the renaming of the Ballybrack Electoral Area to Killiney-Shankill - moving the Clonskeagh-Milltown Electoral Division from the Dundrum Local Electoral Area to the Stillorgan Local Electoral Area

Overview of present position The position at present is as follows:

Number of members and population variance Based on the formula at paragraph 9 of the terms of reference of the Committee the new number of elected members to be assigned to Dún Laoghaire - Rathdown County Council is set out in the table below.

2011 Population 206,261 1 member for every 4,830 of the population 43 206,261 / 4,830 = 42.70 Additional members: 1 per town council, subject to a Not Applicable maximum of 4 (except in merging councils) New number of councillors (subject to a minimum of 40 18 and maximum of 40)

Having regard to the requirement that the number of councillors representing a local electoral area should be not more than 10 or less than 6, the 40 members have to be divided amongst 4, 5 or 6 local electoral areas.

Based on the new number of councillors, the population per member in Dún Laoghaire- Rathdown is 5,157. The terms of reference provide that “within any city or county the variance in representation of each local electoral area from the average for the city or county should, as far as practicable, be within a range of +/- 10%”. For Dún Laoghaire-Rathdown, this represents a range of 4,641 to 5,672.

Recommendations In making its recommendations, the Committee has taken note of the arrangements envisaged for the Dublin local authorities that are contained in the Action Programme for Effective Local Government. Local electoral areas are not being configured into municipal districts.

The recommendations of the Committee provide for the retention of the existing configuration of six local electoral areas, with the electoral division of Clonskeagh-Miltown 47

being moved from the Dundrum local electoral area into the Stillorgan local electoral area. The inclusion of this electoral division has the effect of providing that each of the proposed local electoral areas falls within the preferred representation variance range of + / - 10% that is specified in the terms of reference.

The boundaries for each of the other local electoral areas are unchanged.

These recommendations provide for the retention of the Stillorgan local electoral area and for the continuation of the east-west area arrangements currently operated by Dún Laoghaire-Rathdown County Council. The increase in the number of councillors from 28 to 40 allowed for the recommendations to be applied in this way. The Committee had regard to the submissions that were received in putting forward these proposed local electoral areas.

Having regard to the terms of reference which provide for local electoral areas to be formed around urban centres and to generally be named accordingly, a new title of Killiney – Shankill is recommended for the current Ballybrack local electoral area.

Item 3 Presentation on Provision of Fire and Rescue Services in Dún Laoghaire- Rathdown The County Manager gave a detailed presentation on a report which was being finalised in relation to the provision of Fire and Rescue Services in Dún Laoghaire- Rathdown which he would be presenting to a future meeting of the Council. The Corporate Policy Group discussed the presentation and the County Manager responded to their queries.

Item 3 Proposals for a Council Chamber to accommodate 40 members Pamela O’Connor, Senior Architect gave a presentation on the issues raised in relation to the Council Chamber due to the proposal to have 40 members after the Local Elections in 2014. The presentation included an explanation as to why it would not be possible to accommodate 40 members in the current chamber. Details of a number of options including a preferred option were presented and explained.

Information Item Submitted by Members for Written Reply (a) Councillor Victor Boyhan Progress report on the Pottery Road Project Reply: "The Pottery Road Improvement Scheme is included as a Six Year Road Objective in the 2010-2016 County Development Plan. Implementation of this road project is well advanced. Funding commitments are now in place, the detailed design of the scheme is completed, the associated CPO has recently been approved and it is anticipated the project will be going out to tender in the next 4-6 weeks. It is anticipated construction will commence during the summer of this year."

(b) Councillor Victor Boyhan “To ask the Manager to ensure that key transport / road objectives set out in the current County Development Plan are pursued as part of the current proposed ‘Variation’ underway in relation to lands abutting / surrounding the said lands (Rochestown Avenue – Pottery Road – Johnstown Road) and to report to the Transportation SPC on same.”

Reply: "The proposed Variation No.12 will not impact adversely in any way on the delivery of the Pottery Road Improvement Scheme.

74 The Rochestown Road Improvement Scheme is also included as a Six Year Road Objective in the current County Development Plan. Unlike Pottery Road, however, there is no current commitment, fiscal or otherwise, to advancing this particular project for the foreseeable future. In the unlikely event that these circumstances were to change radically, and some commitment to Rochestown Road Improvement Scheme was forthcoming, there is nothing associated with Variation No. 12 that would hinder or impede the implementation of that roads objective.

Under Policy T5: Quality Bus Network there is an objective in the 2010-2016 County Development Plan to develop a QBC along the Abbey Road- Rochestown Avenue alignment with a view to facilitating upgraded linkages to-and-from the Cherrywood and Blackrock Feeder Routes. The implementation of the Rochestown Avenue section of this QBC is, however, very much linked to, and predicated upon, the upgraded carriageway/junction layouts to be delivered through the Rochestown Avenue Six Year Road Objective. Until such time as there is a meaningful commitment to advancing that Objective the implementation of the Rochestown Avenue QBC in the short-to-medium term seems unlikely."

3. Business submitted by Director of Services (d) N11 Safety Review Report It was AGREED to take this report first. A presentation on the N11 Safety Review Report was made by Ronan O’Callaghan, RPS. This was followed by a question and answer session on various aspects arising from the report.

Following discussion, the report was NOTED.

(a) Draft Noise Report 2013-2018 Update on new plan (summary draft Dublin Noise Action Plan relating to DLRCC – March 2013).

(e) DLR Public Bike Hire Study Gerry Flaherty, Senior Executive Engineer gave a report on the DLR Public Bike Hire Study.

Following on from the report, there was a debate among the members in relation to the location constraints noted within the Bike Hire Study brief. It was agreed that the Manager would engage further with the NTA outlining the strong concerns of the Committee regarding the constraints of the feasibility study being focussed solely on Dún Laoghaire town centre, while noting that the larger County towns and key destinations such as Sandyford Business Park, Dundrum, DART, LUAS etc. are not being considered at this time. The Manager agreed that this item would be brought to the attention of the NTA at the next interface meeting of the working group developing the brief, with a view that the NTA would consider the extension of the study brief beyond

75 the confines of Dún Laoghaire town centre.

Following a discussion, the Manager indicated that the study brief for the Bike Hire feasibility study would incorporate a wording to allow for the future expansion of any Bike Hire scheme for Dún Laoghaire town to other parts of the County and that a report would be brought to the next SPC.

The report was NOTED.

(c) Annual Safety Plan Evaluation It was AGREED to defer this item to the next Transportation SPC Meeting.

C/507/13 Derelict Site Act

“That the Manager report on what, in the opinion of the Planning Office of this County Council, constitutes “the neglected, unsightly or objectionable condition of the land or any structures on the land in question” as laid out in the Derelict Site Act 1990, Section 3 (b).”

The following report of the Manager, copy of which had been circulated to the Members, was CONSIDERED:

“Under the Derelict Sites Act 1990 Section 3 a “Derelict Site” can be defined as ‘any land which detracts or is likely to detract to a material degree from the amenity, character or appearance of land in question because of (a) The existence on the land in question of structures which are in a ruinous, derelict or dangerous condition, or (b) The neglected, unsightly or objectionable condition of the land or any structures on the land in question, or (c) The presence, deposit or collection on the land in question of any litter, rubbish, debris or waste, except where the presence, deposit or collection of such litter, rubbish, debris or waste results from the exercise of a right conferred by statute or by common law.’

Item (b) is open to interpretation, but generally further to an inspection, a building may be considered derelict if:

• The site is overgrown or there is overhanging vegetation • There are broken window panes or roof tiles missing • The boundary treatment or door to the property is not secure and allows unauthorised access which could lead to a further deterioration of the site/buildings

In certain circumstances when a site is declared non derelict but requires minor works to be carried out to improve its appearance, a letter is sent to the owner requesting that those works be carried out. Such a request does not have a legal status.”

80 S2S (Sutton to Sandycove) Project

It was proposed by Councillor M. Baker and seconded by Councillor B. Ward:

“That this committee supports the S2S (Sutton to Sandycove) project and requests that the Manager seeks a solution to the environmental issues that are currently preventing it from going ahead.”

The following report of the Manager, copy of which had been circulated to the Members, was READ by Mr. R. Shakespeare, Director of Environment:

“In February 2011 the County Manager circulated to all Councillors of the Dún Laoghaire Area Committee a copy of the Consultant's Report on the Sutton to Sandycove (S2S) Promenade and Cycleway Phase2: Preliminary Design Report which he had received from Dublin City Council. In his accompanying report to this document the County Manager pointed out that the DCC report was not approved by the Steering Group for the project which in its composition included three representatives from DLRCC. The County Manager's report stated:

"Our representatives do not consider that the project as originally envisaged is feasible given major environmental/ecological constraints. In their opinion these constraints cannot be satisfactorily mitigated without seriously undermining the S2S project."

The County Manager wrote to the Department of Arts, Heritage and the Gaeltacht in March 2011 seeking clarification on the ecological constraints raised by the National Parks and Wildlife Section (NPWS) in their capacity as members of the Steering Group for the S2S project.

On the 16th December 2011 the Department wrote to the County Manager and confirmed the views of the NPWS that the project would have potentially significant impacts on the Special Area of Conservation and the Special Protection Area in particular between Merrion Gates and Booterstown and also at Maretimo. In particular the Department stated that mitigation by avoidance may be the only option between Merrion Gates and Williamstown and that the Councils should consider alternative routes for a number of sections of the S2S route. The Department also stated "It is hard to see how the adverse impacts on the SPA can be fully mitigated as this would entail providing alternative bird roosts and bird feeding areas/sandflats."

The Department also pointed out that if adverse impact on the integrity of any of the Natura 2000 sites potentially affected cannot be ruled out then the project cannot be consented to in law without the existence of Imperative Reasons of Overriding Public Interest (IROPI). However for this to pertain it must be demonstrated that there are no viable alternatives including that of not proceeding with the project, and compensatory measures must be taken to make up for the damage to the Natura 2000 network.

It is proposed to engage an environmental consultant to review the Council's file on this project and to get an independent view on the significance of the environmental constraints for the original S2S project.”

A discussion took place, during which Mr. R. Shakespeare, Director of Environment and Mr. O. Keegan, County Manager responded to Members queries.

On the 16th December 2011 the Department wrote to the County Manager and confirmed the views of the NPWS that the project would have potentially significant impacts on the Special Area of Conservation and the Special Protection Area in particular between Merrion Gates and Booterstown and also at Maretimo. In particular the Department stated that mitigation by avoidance may be the only option between Merrion Gates and Williamstown and that the Councils should consider alternative routes for a number of sections of the S2S route. The Department also stated. "It is hard to see how the adverse impacts on the SPA can be fully mitigated as this would entail providing alternative bird roosts and bird feeding areas/sandflats." The Department also pointed out that if adverse impact on the integrity of any of the Natura 2000 sites potentially affected cannot be ruled out then the project cannot be consented to in law without the existence of Imperative Reasons of Overriding Public Interest (IROPI). However for this to pertain it must be demonstrated that there are no viable alternatives including that of not proceeding with the project, and compensatory measures must be taken to make up for the damage to the Natura 2000 network.

It is proposed to engage an environmental consultant to review the Council's file on this project and to get an independent view on the significance of the environmental constraints for the original S2S project.

A discussion took place, during which Mr. R. Shakespeare, Director of Environment and Mr. O. Keegan, County Manager responded to Members queries.

“The National Parks and Wildlife Service are the public body responsible for the designation of proposed Natural Heritage Areas. Target 16.1 (reproduced below) of the National Biodiversity Plan 2011-2016 outlines the current timeframe for reviewing the status of pNHA.

Target 16.1 By 2015, review previously proposed Natural Heritage Areas and designate as appropriate under the Wildlife (Amendment) Act, 2000.”

83 Dún Laoghaire-Rathdown Bike Hire Study

“As part of the Sustainable Transport Measures Programme 2013, funding has been allocated by the National Transport Authority to Dún Laoghaire-Rathdown County Council and South Dublin County Council to jointly carry out a feasibility study into the provision of a public bike hire scheme for Dún Laoghaire town and Tallaght.

The tender process for the appointment of a Technical Consultant to carry out a feasibility study into the provision of a public bike hire scheme for Dún Laoghaire town and Tallaght is nearing completion and the appointed consultant is expected to be appointed in mid June. The following are the key elements being examined as part of the study:-

Demand analysis in each town Market Research to assess potential usage Extensive Stakeholder engagement including elected members Bike Scheme definition and potential for expansion Cost estimation – installation and operation

The expected timeline for the project is 4 months. During this time, the appointed Consultant will be expected to attend a Council Meeting on behalf of the relevant Council, give a presentation on the proposals to the Elected Members and incorporate any changes following these meetings as appropriate.”
