During the visit to the island last weekend of a party of well connected and prominent citizens from New Caledonia, the question of Norfolk tapping into the potentially massive visitor market from that country, was raised. However, as there is no regular link, Mr. Hooper offered to send his private aircraft to Noumea to bring Max and his friends to Norfolk. The party flew down on Friday afternoon, 7th August and returned to Noumea on Monday morning after a busy shopping and sightseeing weekend. I caught up with Max on Sunday afternoon at ‘a cup of tea and scone function’ organised by Mr. and Mrs. Hooper at their home in Driver Christian Road. PROPERTY MATTERS This week’s topic: ‘Offers’ Real Estate Agents are obliged to pass on to sellers any and all offers made by prospective purchasers. Parties to any real estate transaction should be fully informed of all material facts, consequently Agents must convey all expressions of interest and offers relating to a property whether they be oral or written, unless the Agent has been provided with written instructions by the vendor to the contrary. Offers should be conveyed as soon as practicable after receiving them and can continue to be made up to the time an exchange of Contracts has taken place on the property. Most offers are made orally, though vendors should request that offers be put forward in writing for consideration. That way the vendor has the benefit of receiving a formally submitted offer and has further evidence or information on who made it. Agents generally do not know what a vendor will or won’t accept and vendors sometimes surprise by accepting offers below asking price due to their individual circumstances at the time. Irrespective, the best advice for potential purchasers is to submit an offer considered reasonable and one which is in tune with the market. Importantly, it should only be submitted after due diligence has been undertaken on the property and after financial capacity to proceed with the purchase has been clearly established. A good Agent will encourage the best possible offer on or near the listed price as, after all, they are appointed to seek the best outcome for the vendor. There is usually some room for negotiation on price, though buyers and sellers are generally not comfortable with negotiations that become protracted especially where initial offers are too low. Vendors are under no obligation to accept, reject or to counter any offer. Nor are they obliged to accept an offer even if it is made at the advertised price. Offers need not be made on price alone but can include various special conditions of sale, a particular deposit arrangement, and a suggested timeframe for settlement. Offer and acceptance on price at ‘fair market value’ is reached when there is agreement between a willing, informed buyer and a willing, informed seller both of whom act under normal circumstances and without pressure. ———————————–————————————————————————————————————————————————————————————————————————————————————————————————————————————–——————— This is Article 11 in a series offered by Dave Weekley, an experienced and licensed Agent with an extensive background in banking and real estate fields, and who is retained by Norfolk Island Real Estate as a Sales Consultant/Auctioneer.
