481 BE IT FURTHER RESOLVED, That the Chairman and Vice Chairman 482 of the Standing Joint Legislative Committee on Reapportionment 483 shall file with the Secretary of State the Split Precinct Block J. It is also intended that such districts contain all the 507 inhabitants in this state. It is further intended that the 508 redistricting provided for in this resolution result in the 509 creation of districts which are substantially equal in population. 510 It is also intended that no district shall include any of the area 511 included within the description of any other district. 512 BE IT FURTHER RESOLVED, That the redistricting of 513 representative districts and senate districts shall be deemed to

514 be separate from each other. The invalidity of the districts of 515 one house shall not affect or require the redistricting of the

No. 201 *SS26/R1416AS* 02/SS26/R1416AS PAGE 16 516 other house when the districts of the other house have been found 517 to be valid by a court of competent jurisdiction. 518 BE IT FURTHER RESOLVED, That if the districts described in 519 this resolution do not carry out the purposes thereof, because of 520 unintentional omissions; duplications; overlapping areas; 521 erroneous nomenclature; lack of adequate maps or descriptions of 522 political subdivisions, wards or other divisions thereof, or of 523 their boundary lines, then the Secretary of State, at the request 524 of the Senate Elections Committee shall, by order, correct such 525 omissions, overlaps, erroneous nomenclature or other defects in 526 the description of districts so as to accomplish the purposes and 527 objectives of this resolution. 528 BE IT FURTHER RESOLVED, That in promulgating such orders, the 529 Secretary of State, in addition to achieving equality in the 530 population of districts and insuring that all areas of the state 531 are completely and accurately encompassed in such districts, shall 532 be guided by the following standards: 533 (a) Gaps in the description of any district shall be 534 completed in a manner which results in a total description of that 535 district in a manner which is consonant with the description of 536 adjacent districts and results in complete contiguity of 537 districts; 538 (b) Areas of the state included within the descriptions 539 of more than one district shall be allocated to the district 540 having the lowest population; 541 (c) Areas of the state not included within the 542 descriptions of any district shall be allocated to the adjacent 543 district having the lowest population; 544 (d) In the event that the area subject to corrected 545 description or allocation as provided in paragraphs (a), (b) and

546 (c) of this clause is of such size or contains such population 547 that its inclusion as a unit in any district would result in 548 substantial disparity in the size, shape or population of such J. No. 201 *SS26/R1416AS* 02/SS26/R1416AS PAGE 17 549 district, then the Secretary of State may allocate portions of 550 such area to two or more districts; and 551 (e) In any allocation of area or correction of 552 descriptions made pursuant to this resolution, the Secretary of 553 State shall, consistent with the foregoing standards, preserve the 554 contiguity and compactness of districts and avoid the unnecessary 555 division of political subdivisions. 556 BE IT FURTHER RESOLVED, That copies of such orders shall be 557 filed by the Secretary of State in his own office and in the 558 offices of the affected commissioners of election and registrars. 559 The Secretary of State may adopt reasonable rules regulating the 560 procedure for applications for orders under this resolution in the 561 manner of serving and filing any notice or copy of orders relating 562 thereto. Upon the filing of such an order, the description of any 563 affected district shall be deemed to have been corrected in the 564 manner provided in such order to the full extent as if such 565 correction had been contained in the original description set 566 forth in this resolution. 567 BE IT FURTHER RESOLVED, That the Standing Joint Legislative 568 Committee on Reapportionment is directed to provide all 569 information necessary to assist the counties in identifying the 570 boundaries of the districts described in this resolution. 571 BE IT FURTHER RESOLVED, That the redistricting contained in 572 this resolution shall supersede any prior redistricting, and any 573 prior redistricting shall be null and void upon the date this 574 resolution is effectuated pursuant to the provisions of Section 5 575 of the Voting Rights Act of 1965 or pursuant to a final decision 576 by any court of competent jurisdiction, whichever shall first 577 occur. 578 BE IT FURTHER RESOLVED, That this resolution shall be placed
