1. INTRODUCTION

1.1 The Arley Consulting Company Limited has been commissioned by Thomas Crompton Quarries Limited (TCQ) to prepare a Site Condition Report (SCR) in support of a permit variation application for Lane Side Quarry Landfill, Kirkheaton, .

1.2 The site is currently regulated under environmental permit EPR/FP3603BU which allows the landfilling of non-hazardous waste. The permit was originally issued to P Casey Enviro Limited in 2011 allowing disposal of a broad range of non-hazardous waste types. The permit was transferred to TCQ in October 2020. The landfill site has not yet been constructed and no waste has been deposited.

1.3 The variation application proposes to restrict landfilled waste to non- biodegradable soils and construction and demolition waste; and to add a waste activity to allow the production of aggregates from the treatment of inert wastes.

1.4 The SCR is relevant to the addition of the new waste treatment activity only. The area covered is shown on Drawing No 19877/5 Site Layout Plan which can be found in Appendix C.

1.5 The proposed waste treatment area is situated within the footprint of Cell 2 which will be landfilled in the future. The treatment activity will be relocated at that time and the SCR updated accordingly.

1.6 The SCR has been prepared using the EA SCR template (Version 2, 4 August 2008). Sections 1 – 3 of the EA template have been completed based on the condition of the site prior to the commencement of waste treatment activities. Subsequent sections of the SCR will be completed to support the surrender of the waste treatment activity of the permit. This may be carried out as a part- surrender of the site permit in advance of the completion of landfill closure arrangements.

3. CONDITION OF THE LAND AT PERMIT ISSUE

3.1 This section represents Section 2 of the EA guidance template relating to the condition of the land at the point of submission of the permit variation application to add a new waste treatment activity.

3.2 The information provided is specifically in reference to the waste treatment area as shown on MWP Drawing No 10167/03, which is situated within the overall permit boundary and within the landfill footprint. As such, some matters have been addressed based on information collated in relation to the landfill permit. The landfill is pre-operational and no waste has been deposited since the permit was issued in 2011.

3.3 The waste treatment area is situated within an area of the site that is expected to be landfilled in the future. Therefore, it will be necessary to relocate the waste treatment activity. This section of the SCR should be updated to include any additional areas of site which are used for future waste treatment activities.

3.3 The required information is summarised in Table 2.

Surface Waters

Cockley Hill Beck, a small stream, runs through the quarry approximately north-east to south-west and discharges into Ox Field Beck to the south of quarry. Ox Field Beck flows westerly and discharges in to Fenay Beck approximately 600 m to the south-west of the quarry.

The EA Catchment Data Explorer shows that the site is situated within the Fenay Beck - Source to River Colne Catchment, which is described as ‘heavily modified’ with an overall quality classification of moderate in 2019.

Historical / Previous Land-uses

Selected historical Ordnance Survey (OS) maps for the site and its vicinity are available in the ESID.

Mineral Workings

Lane Side Quarry has been used for mineral extraction since the late 1800s initially providing coal and fireclay. More recently (up to 1976 based on OS information) brick making materials were quarried and a brickworks was present.

The Coal Authority has produced Coal Mining Reports confirming the quarry complex, including the treatment area, is within an area likely to be influenced by underground workings which were operational until 1928. No mine entries are reported within the waste treatment area. Further details are provided within the ESID (Report No 19877/1).

Landfill

The restored Kirkheaton Brickworks Landfill Site is located within the quarry to the south-east of the treatment area beyond Cockley Hill Beck. Landfilled waste types comprised “household, industrial, commercial and other wastes”, in accordance with a resolution held by West Yorkshire Metropolitan County Council which was rescinded in 1992.

Deposit for Recovery

Waste soils have been used to construct several areas newt habitat within the quarry complex and regulated under two separate waste recovery activities. Permit No EPR/CB3830RE (SR2010 No 10) and Permit No EPR/BB3505MH (SR2010 No 8) were issued to P Casey Enviro Ltd in 2012 and 2014 respectively. Both permits were surrendered in 2017 under the low risk surrender criteria.

The location of historic waste activities is shown on Drawing No 19877/23 (Appendix C). There historic waste deposit areas are outside of the proposed treatment area.

Site Walkover Observations

TCQ have confirmed that there is no visual or olfactory evidence of contamination within the proposed waste treatment area. The area is currently used to store stockpiles of overburden and site won clay, as shown on the aerial image (Figure 1) provided in Appendix A and dated May 2019.

The logs show the area to comprise mudstone bedrock with some made ground reported at PH6 in the south of the waste treatment area, and possible evidence of underground mine workings at 12.5 mbgl (reported as ‘void/broken ground’) at PH4.

The full set of borehole logs for the quarry complex are appended to the ESID (Report No 19877/1).

Baseline soil and Ground underlying the treatment area will comprise groundwater reference predominantly naturally occurring mudstone bedrock with no data evidence of contamination.

Groundwater and surface water monitoring data is available for boreholes and locations across the landfill and quarry complex. Baseline quality is discussed in detail in the Hydrogeological Risk Assessment (Report No 19877/3).

Surface water quality within Cockley Hill Beck is considered to be the a relevant indicator when assessing the impact of waste treatment activities due to its location approximately 25 m to the south of the waste treatment area (as shown on MWP Drawing No 10167/03). Background surface water quality is discussed in Section 3.4 of the HRA.

4. PERMITTED ACTIVITIES

4.1 This section represents Section 3 of the EA guidance template and summarises the permitted activities which comprise the proposed waste treatment activity. The required information is presented in Table 3.

5. SITE CONDITION DURING PERMIT OPERATIONS

5.1 The information required to complete Sections 4 – 7 of the EA guidance template will be recorded over the course of waste treatment operations while an extant permitted activity.

5.2 These sections may be completed as relevant events occur and will be included in the version submitted in support of a permit surrender application. Table 4 summarises the requirements for reference.

6. SITE CONDITION AT PERMIT SURRENDER

6.1 Following the permanent cessation of permitted treatment activities and reinstatement of the treatment area Sections 8 – 10 of the EA guidance template will be completed. The updated SCR will be reissued for submission with a permit surrender application.

6.2 Table 5 summarises the information and assessments required to adequately complete the SCR prior to permit surrender.

7. CONCLUSION

7.1 The SCR has been completed in accordance with the EA guidance template (Version 2, 4 August 2008) in support of a permit variation application to add a new waste treatment activity to an existing preoperational landfill permit.

7.2 Baseline conditions have been established in this SCR and as referenced in the ESID (Report No 19877/1), H1 Risk Assessment (Report No 19877/2) and the HRA (Report No 19877/3).

7.3 Following the cessation of waste treatment activities and reinstatement of the treatment area the SCR will be updated and reissued in advance of a permit surrender application.
