Olmos Park Police Obsessed With Sex? 1by Johnson The greeting card was a photo collage: over a park scene was pasted a cut out of an attractive young male, in jeans but bare to the waist. The muscles of his chest were clenched, his head thrown back in sexual ecstasy; pasted in front of him, its muzzle to his crotch, was a small deer. Inside the card was the caption, " Oh deer." According to the Chief of Police of Olmos Park, this card depic­ ted bestiality. Under Texas law it was therefore legally obscene. The Chief arrested Michael Davis, owner of The Unicorn Shop at 4104 McCullough , and charged him with trafficking in pornographic mat­ erials. The court of Olmos Park agreed that the card was obscene and fined Davis $200. With the support of the local chapter of the ACLU, Davis appealed the conviction . The appeal came to trial November 3 at the Bexar County Courthouse. The prosecution was conducted by a leathery-skinned, middle­ aged city attorney who affected the demeanor of an old timey Texan, stumbling over big words, pronouncing "sodomy" and " bestiality" as though they offended his patriotic sensibilities and maybe hurt his throat. He called only two witnesses: the police officers who'd made the arrest. The Chief acknowledged that the card was a collage and was probably intended to be humorous. His assistant- t'he pol­ iceman who actually this particular card and selected it as the basis for the charge - insisted that it looked like "a real picture" to him. And, looking even more weather-beaten and Texan than the prose­ cutor , he declared that he didn't know enough about photography to distinguish between a photograph and a pasted-together collage. But he knew what was dirty when he saw it. The defense, led by a young ACLU attorney, called at least eight witnesses. They ranged from a San Antonio Vice Squad officer who testified that he saw nothing obscene about the card, to a local com­ edian who explained the humor in it, to the Program Director of local levision who testified that the movies on national networks, l , and Showtime, depicted more nudity and overt sexuality than Q card. The defense attorney, a member of the Hirschorn family, who donated most of the collection of the Hirschorn Museum, bran- dished a book of the museum's collection and maintained that art is necessarily a matt.er of individual taste and that, in a society linked together by national television networks, the "community stand­ ards" that obscenity laws depend on are pretty meaningless. The jury, probably pleased that they had such an easy case to decide, quickly found Davis not guilty .
