More than 300 retailers fi led for bankruptcy in 2017,1 many being smaller “Mom & Pop” shops. As of the end of 2017, there have been no less than thirty major retail bankruptcy fi lings, exceeding the total number of major retail cases fi led in 2016.2 As of the end of the third quarter of 2017, more than 6,400 store closings occurred—triple the number of closings during the fi rst half of 2016.3 Analysts predict the total number of storing closings for the year ending 2017 will be between approximately 8,600 to more than 9,000, well above the 6,200 closings during the 2008 fi nancial crisis, and signifi cantly more than that of 2016.4 At this rate, at least 10% of the total physical US retail landscape is estimated to have closed during 2017. These cutbacks resulted in an estimated 76,084 job cuts by retail employers in 2017, a 26% increase over 2016, unseen in any other industry in 2017.5 Retailers are confronted with market pressures and unique legal issues in bankruptcy that make successful reorganizations more diffi cult to attain. It is clear that the trend of failing retailers will intensify before it improves.

For­sale and for­lease signs proliferate. Storefronts are dark. Big­box stores that once packed them in sit empty. 2017 was the year of the so-called retailpocalypse. The steady growth of e-commerce sites like Amazon, Jet, Zappos, Groupon and eBay finally chipped away enough at brick-and-mortar traffic that many traditional retailers filed for bankruptcy, shuttered stores nationwide, and laid off scads of employees. Northwest Indiana lost some of its biggest sporting goods stores — MC Sports, Gander Mountain and Sports Authority — which folded and closed all their stores, leaving behind Dick’s Sporting Goods as the largest purveyor of jerseys, balls and other sporting equipment remaining in the Region. As retailers that have long been part of the Northwest Indiana landscape waned, upstart companies as diverse as Blue Apron and Netflix made it less likely that consumers would venture out of the house. Mounting losses Strack & Van Til’s parent company, Joliet­based Central Grocers, went out of business under the weight of $225 million in debt, after creditors like Coca­Cola Co., General Mills, Mars Financial Services and Post Consumer Brands forced it into bankruptcy. Strack & Van Til ended up shrinking to 20 stores from 38, and discontinuing the entire discount Ultra Foods brand it debuted in Highland in 1981.

    Athletic Hall of Fame Bios Chris Konrad - Football Mr. Konrad came to Montgomery College from Year attended MC - 1987 Springbrook High School. He was a two-year starter as offensive line center. In 1985 the coaching staff voted him “Hardest Worker”; and in 1986, he was team captain, offensive MVP, First Team All Coastal Conference, and First Team All-NJCAA Region XX. He started all 21 games in his career with the Knights. In 1986, his leadership and playing ability helped the Knights go 9-and-1 in the regular season, earning a #4 ranking in the NJCAA and the opportunity to play #1 Northeastern Oklahoma A&M in the Mid-America Bow. in Tulsa, OK — considered the NJCAA national championship game. SOLLOWAY** This Article takes a topical approach to the notable real property cases in the courts of the State of Indiana in this survey period, October 1, 2005, through September 30, 2006, and analyzes noteworthy cases in each of the following areas: restrictive covenants, contracts, landlord/tenant law, governmental action and eminent domain, tax sales, mortgages, and developments in the common law. I. RESTRICTIVE COVENANTS A. Fair Housing Act The Indiana Court of Appeals, in Villas West II of Willowridge v. McGlothin,1 was confronted with a situation that began in 1996, when Algie and Edna McGlothin purchased a “duplex condo-style home” in Villas West II in Kokomo, Indiana (“Villas West”).2 A set of restrictive covenants (the “Covenants”) for Villas West was recorded in 1992 by the developer.3 The Covenants provide that each unit may only be occupied by the owner and their immediate family and that owners are specifically prohibited from leasing their units.4 After both Algie and Edna moved into nursing homes in 1998, they leased their unit to a non-family member.56 Algie subsequently passed away. In 2002, Edna McGlothin (“McGlothin”) leased her unit to another non-family member for a term of three years.7 Shortly thereafter, the homeowner’s association for Villas West (the “Association”) notified McGlothin that she was in violation of the Covenants.8 McGlothin refused to cancel the lease, so the Association filed a complaint for injunctive relief.9 McGlothin admitted that she had leased her unit, but argued that the covenant was invalid and unenforceable because it * Vice President of Legal, Kite Realty Group, Indianapolis.

    SECTION 9: LAND USE & MARKET Overview This section analyses the three primary land uses in the City: commercial, industrial/business, and residential. The spatial distribution of these uses within the City and their physical character were reviewed as a part of the analysis of the existing land uses. (See Figure 2.4 in Section 2 for citywide land use and spatial distribution information) A market analysis was conducted to assess the potential support for new commercial, industrial/business, and residential development in Gary. The market study builds upon the existing land use analysis and assesses the competitive position of the City in relation to the regional market to evaluate opportunities for future growth and to provide further guidance to the Comprehensive Plan. Commercial The primary commercial districts within Gary include the Downtown, Broadway Avenue south of Downtown, and sections of Fifth Avenue, Grant Street, Ridge Road, U.S. 20, and Lake Street. These areas have a wide variety of retail/commercial uses and draw consumers from surrounding neighborhoods and beyond. Older neighborhoods within the City also have a few corner stores or shops in mixed-use buildings along secondary arterial corridors or at intersections of secondary arterial streets. These smaller pockets of retail typically serve a convenience function to the immediate neighborhood and form the secondary retail corridors/nodes.
