1 INTRODUCTION

1.1 This Pre-Application Consultation (“PAC”) Report has been prepared by Barton Willmore LLP (“Barton Willmore”) on behalf of our client, Peak Gen Power 5 Limited (“the Applicant”), in support of a part retrospective application for an existing electricity generation operating reserve compound to support the National Grid at Land to the rear of Unit 6A Coed Darcy Business Park, Llandarcy, . This report sets out the statutory pre- application consultation process undertaken by the Applicant prior to the submission of the application.

1.2 The full description of the proposed development is as follows:

“Part retrospective application for an existing electricity generation operating reserve compound to support the National Grid comprising 10 no. generating containers, together with associated switchgear, site access, boundary treatments and ancillary plant and equipment with proposed installation of additional ancillary plant and equipment including the installation of Selective Catalytic Reduction units”

1.3 As the scheme comprises of an electricity generating station with an installed generating capacity of between 10 and 350MW, as detailed in Section 2, Paragraph 3 of the Developments of National Significance (Specified Criteria, Fees and Fees for Deemed Applications) () (Amendment) Regulations 2019, it falls within the definition of a ‘Development of National Significance (DNS), for the purposes of s62 (D) of the Planning (Wales) Act 2015 (“the Wales Act”). Consequently, this application is therefore made to the Welsh Ministers.

Legislative Context

1.4 Part 2 Article 8 of the Developments of National Significance (Procedure) (Wales) Order (DNSPWO) 2016 requires that the applicant must publicise the proposed application by:

a) Giving requisite notice – i. By site display in at least one place on or near the land to which the proposed application relates for not less than 42 days; ii. In writing to any owner or occupier of any land adjoining the land to which the proposed application relates; and

iii. By publication of the notice in a newspaper circulating in the locality in which the land to which the proposed application relates is situated;

b) Publishing the following information on a website maintained by the applicant, for not less than 42 days beginning with each day on which each of the notices referred to in subparagraph (a) or article 9(2) are given –

i. The draft application form published by the Welsh Ministers under article 12(1)(a) (or a farm substantially to the like effect), including the specified in or referred to in the form; ii. A plan which identifies the land to which the proposed application relates; iii. Any other plans, drawings and information necessary to describe the development which is the subject of the proposed application; iv. A copy of the notice required by article 6 which has not lapsed under paragraph (3) of that article; v. The design and access statement required by article 14; vi. Subject to article 12(3), the particulars or evidence required by the Welsh Ministers under section 62(3) of the 1990 Act (applications for planning permission) (1); vii. Where applicable, a statement referred to as the environmental statement for the proposed development; and viii. A written statement about any secondary consent (2) connected with the proposed application (3) in respect of which the applicant considers a decision on that consent is to be made or should be made by the Welsh Ministers, together with the draft application form and documents associated with such consents.

1.5 Article 9 of the DNSPWO requires that the following persons or descriptions of persons are consulted for the purposes of section 61Z (4) of the 1990 Act:

• Any community consultee; • Any specialist consultee; and • Any relevant person.

1.6 This Report confirms the extent of the pre-application consultation that has been undertaken by the Applicant prior to the submission of this planning application to the Welsh Ministers in accordance with the DNSPWO 2016.

1.7 A separate pre-application engagement outside of the statutory pre-application consultation is documented within the planning Statement of Common Ground submitted in support of the application. A Statement of Common Ground has also been produced with NRW and accompanies the application.

2 CONSULTATION PROCESS

2.1 This Section summaries the statutory consultation process undertaken by the Applicant in accordance with the requirements set out within the DNS (Wales) Regulations 2016.

Draft Planning Application Package

2.2 A full set of draft planning application documentation was made available online (www.peakgenllandarcy.co.uk) from 21st March 2019 for a period of 46 days, exceeding the minimum 42 day consultation period. The website remained open until the 6th May 2019 to allow all consultees to view the documents freely on a private computer or at any public library during normal opening hours. An extract of the webpage can be found at Appendix 1.

Site Notices

2.3 Five Site Notices (in both English and Welsh) were erected by the Applicant directly adjacent to and near the location of the site. A copy of the Site Notices can be found at Appendix 2. The location of Notices can be found in Appendix 3 and photographic evidence of the Site Notices in situ can be found at Appendix 4.

Adjoining Landowners / Occupiers

2.4 Notice letters (addressed to the owner / occupier) accompanied by a copy of the Site Notice were posted by recorded delivery to adjoining and surrounding properties on 21st March 2019 and where royal mail recorded delivery confirmed that it was not possible to deliver to addresses, a further letter was hand delivered on the 5th April 2019. A copy of the letter and list of consultees can be found at Appendix 5.

Community Consultees

2.5 In terms of community consultees, the relevant consultees were confirmed by NPTCBC in its pre-application advice letter dated the 28 th August 2018. On the 21st March 2019, Barton Willmore (acting on behalf of the Applicant) gave requisite notice in writing (by post) to West Community Council (the relevant Community Council for the area) and to Councillor Clarke (the local Ward Member for Community Council). Copies of the relevant letters and notices can be found at Appendix 6 and Appendix 7 respectively.

2.6 In accordance with Article 9 of the DNSPWO and DNS (Wales) Regulations 2016, the Applicant is required to consult all relevant specialist consultees . These consultees include:

• Network Rail; • Welsh Government; • Welsh Ministers; • The local highway authority concerned (Neath Port Talbot Council Highways Authority; • Natural Resources Wales (South West Wales Office); • Health and Safety Executive; • Cadw; • Dwr Cymru Welsh Water; and • The Coal Authority.

2.7 The notice letters issued to the above consultees can be found at Appendix 8.

3 SUMMARY OF CONSULTATION RESPONSES

3.1 This Section summarises the responses received via the statutory pre -application consultation process undertaken by the Applicant and sets out the Applicant’s response to the feedback received. All comments received between 21st March 2019 and 6th May 2019 have been considered.

Summary of Public Consultation Responses

3.2 During the public consultation process, no responses were received from members of the public by post and/or email.

Summary of Community Consultee Responses

3.3 With regards to community consultees, the Applicant received one response in total, which came from Coedffranc West Community Council (the relevant Community Council for the area). The Applicant did not receive a response from Councillor Clarke (the local Ward Member for

Coedffranc West Community Council) [a copy of the response is provided within Appendix 9]. The response by the Community Council is set out below:

• Coedffranc West Community Council confirmed that with regards to this part retrospective planning application for the land at the rear of Unit 6A Coed Darcy Business Park, Llandarcy, the Council members do not have any observations at this point.

Summary of Specialist Consultee Responses

3.4 In addition to the public and community consultation responses received and summarised above, six responses were also received from specialist consultees including:

• Welsh Government; • The local highway authority concerned (Neath Port Talbot County Borough Council Highways Authority; • Cadw; • Natural Resources Wales; • Dwr Cymru Welsh Water; and • The Coal Authority.

3.5 Copies of each consultation response can be found at Appendix 10. In accordance with part 3 of section 9 of the DNSPWO 2016, table 1 sets out the responses from the specialist consultees.

Specialist Consultee Response Network Rail The Applicant did not receive a response from Network Rail. Welsh Ministers The Applicant did not receive a response from Welsh Ministers. Welsh Government The Welsh Government confirmed that they have no objection on trunk road grounds.

The local highway authority Provided confirmation of no highway and drainage objections to the concerned (Neath Port Talbot proposed application. County Borough Council Highways Authority) Health and Safety Executive The Applicant did not receive a response from the Health and Safety Executive. Cadw Confirmed that the proposed development will not have any impact on the scheduled monument GM291 (Llandarcy Round Cairn) or its setting due to the intervening buildings, vegetation and natural topography. Noted that there might be undesignated historic assets that could be affected by the proposed development and it is advised that consultation with the Historic Environment Record held by the Gwent-Archaeological Trust should be undertaken; and Overall, no objections to the proposed development based on its impacts on the scheduled monument.

Dwr Cymru Welsh Water The site is crossed by a private foul water only sewer, prior to commencing operational development DCWW advises contacting the owners of this asset. No foul water will be generated by development proposals. Advised that the applicant may need to apply to Dwr Cymru Welsh Water for any connection to the public sewer under S106 of the Water Industry Act 1991 if the connection to the public sewer network is either via a lateral drain or via a new sewer because it is now a mandatory requirement to first enter into a Section 104 Adoption Agreement (Water Industry Act 1991).

Specialist Consultee Response The applicant is also advised that some public sewers and lateral drains may not be recorded on DCWW maps of public sewers because they were originally privately owned and were transferred into public ownership by nature of the Water Industry (Schemes for Adoption of Private Sewers) Regulations 2011. The presence of such assets may affect the proposal.

The Coal Authority Confirmed that the proposed development site falls within the coalfield, however, it is located outside the defined Development High Risk Area meaning that there are no recorded coal mining legacy hazards at shallow depth that could pose a risk to land stability. Accordingly, there is no requirement to submit a Coal Mining Risk Assessment in support of a planning application for the redevelopment of this site, The Coal Authority confirmed that Neath Port Talbot County Council will not need to consult with The Coal Authority on any planning application for this site.

Natural Resources Wales The operation will require a permit from NRW. It is encouraged that the permit application runs parallel with the DNS Application. No adverse comments relating to noise which will be c onsidered under the environmental permit application. Identified sensitive receptors (European and UK protected sites) within 2km of the site, which were correctly identified in December 2018 produced by AECOM, however, NRW consider that any effect on the identified sites is unlikely as the air quality impact assessment report shows the emission levels from the development to be low. NRW stated that a HRA document is required to aid the competent authority in assessing the application under Regulation 61 of the Conservation of Habitats and Species Regulations 2010 (as amended). NRW confirms that additional landscaping for the purposes of visual amenity is not required for the application.

• A permit application will be submitted to NRW at the appropriate time. • The Air Quality Impact Report (Ref: 60580051) submitted with the application confirms that no significant impacts are predicted on ecological receptors. The applicant sought additional clarification in respect of the need to undertake a standalone HRA report. NRW confirmed the combination of the air quality report and an Ecology Statement Technical Note (AECOM, October 2018) that will be submitted alongside this report as part of the application is sufficient and therefore, the Applicant is not required to prepare a Habitat Regulation Assessment Report is not required. This additional clarification is set out in correspondence provided in Appendix 11.

5 CONCLUSIONS

5.1 This Report demonstrates that the pre-application consultation undertaken by the Applicant has met the requirements of the DNSPWO 2016 and Development of National Significance (Wales) Regulations 2016 . Members of the public, together with community and specialist consultees, have been given the opportunity to comment on the proposals.

5.2 Having considered the responses received, no additional action, amendments or further clarification is required prior to submitting the application to the Welsh Ministers.

Introduction Peak Gen Power 5 Limited is preparing a planning application at land to the rear of Unit 6A Coed Darcy Business Park, Llandarcy, Neath Port Talbot for the following Development Summary development: Pre-Application Consultation “Part retrospective application for an existing electricity generation operatingreserve compound to Documentation supportthe National Gridcomprising10 no.generatingcontainers,togetherwithassociated switchgear, site access, boundary treatments and ancillary plant and equipment with proposed Get in Touch installation ofadditionalancillaryplant andequipmentincludingthe installation of Selective Catalytic Reduction units.” Planning permission was granted on 21st January 2013 (Application Reference No. P2012/1061) for a 20MW electricity generation facility at the site. The planning permission has been implemented and the facility has been built and operated since 2013. However, certain pre-commencement planning conditions werenotsatisfied andfollowing the introduction ofnew legislation the facility nowqualifies asa Developmentof National Significance, which meansthatanewplanning application is required underthenew legislation to regularise theposition. Inaddition, Peak Genare seeking permission to install exhaust gas treatment to the generating units in order to comply with tighter emissions targets effective from January 2019 under the Environmental Permitting (England and Wales) (Amendment) Regulations 2018.

Peak Gen Power 5 Limited has instructed ateamofconsultants toundertake detailed technical surveys and assessments to support the planning application. This team includes Barton Willmore and AECOM.

Development Summary

The development is a 20-megawatt electricity generation facility providing electricity to meet consumer requirements at periods of peak electricity demand when there is insufficient electricity available to the National Grid from the UK's base load power stations. The facility is designed tomeetthe requirements of National Grid's contracts and sits in standby/idle mode ready to operate when called on by the National Grid to do so being fully operational and generating electricity in less than 5 minutes. Typically, the plant operatesforperiods ofnotmorethanthirty minutesatatimetotalling 500 hours or less in a year.

The application site is located within the Coed Darcy Strategic Regeneration Area (SRA) allocated by way of Policy SRA1 of the Neath Port Talbot County Borough Council Local Development Plan. It lies within thecommercial area ofthe SRA. Thesite, therefore, is located within a wholly industrial complex and the surrounding land is characterised by industrial buildings andcommercial storage. It is considered thatthenature, scaleand location ofthedevelopmentdonotconflict with theaimsofthe SRA. Thereasonwhythe facility is locatedwhere it is hasbeendictated bytheavailability ofasuitable connection

point to the local electricity grid with available land zoned in planning policy terms as suitable for this type of use. National Planning Policy (as set out in PPW Paragraph 5.7.13) supports development of this natureas it helps providevital exibility tosupportan increasing amountoflow carbon generation and to maintain security of supply. is type of development is essential supporting infrastructure which is needed to support the National Grid and Land to the Rear of Unit 6A continuous supplyofelectricity is essential fortheeconomyandsocietyasawhole. As an adjoining landowner, I am writing to you today to notify you that PeakGen Power 5 Limited is preparing a planning application at land to the rear of Unit 6A Coed Darcy Business Park, Llandarcy, Neath Port Talbot. The description of the proposed development is as follows:

“Part retrospective application for an existing electricity generation operating reserve compound to support the National Grid comprising 10 no.x 2 megawatt generating containers, together with associated switchgear, site access, boundary treatments and ancillary plant and equipment with proposed installation of additional ancillary plant and equipment including the installation of Selective Catalytic Reduction units”.

By way of background, planning permission was granted on the 21 st of January 2012 (Application Reference Number: P2012/1061) for a 20MW electricity generation facility. The planning permission has been implemented and the facility has been built and operated subsequently. However, certain pre- commencement planning conditions were not satisfied and following the introduction of new legislation the facility now qualifies as a Development of National Significance, which means that a new planning application is required under the new legislation to regularise the position. I n addition, Peak Gen are seeking permission to install exhaust gas treatment to the generating units in order to comply with tighter emissions targets effective from January 2019 under the Environmental Permitting (England and Wales) (Amendment) Regulation s 2018.

Development Summary

The development is a 20-megawatt electricity generation facility providing electricity to meet consumer requirements at periods of peak electricity demand when there is insufficient electricity available to the National Grid from the UK's base load power stations. The fa cility is designed to meet the requirements of National Grid's contracts and sits in standby/idle mode ready to operate when called on by the National Grid to do so being fully operational and generating electricity in less than 5 minutes. Typically, the plant operates for periods of not more than thirty minutes at a time totalling 500 hours or less in a year.

The application site is located within the Coed Darcy Strategic Regeneration Area (SRA) allocated by way of Policy SRA1 of the Neath Port Talbot County Borough Council Local Development Plan. It lies within the commercial area of the SRA. The site, therefore, is located within a wholly industrial complex and the surrounding land is characterised by industrial buildings and commercial storage. It is considered that the nature, scale and location of the development do not conflict with the aims of the SRA. The reason why the facility is located where it is has been dictated by the availability of a suitable connection point to the local electricity grid with available land zoned in planning policy terms as suitable for this type of use.

National Planning Policy (as set out in PPW Paragraph 5.7.13) supports development of this nature as it helps provide vital flexibility to support an increasing amount of low carbon generation and to maintain security of supply. This type of development is essential supporting infrastructure which is needed to support the National Grid and continuous supply of electricity is essential for the economy and society as a whole.

As the scheme comprises an electricity generating station with an installed generating capacity of between 10 and 50 MW, it falls within the definition of a ‘Development of National Significance’ (DNS) under section 4 of the Developments of National Significance (Specified Criteria and Prescribed Secondary Consents) (Wales) Regulations 2016, for the purposes of s62(D) of the Planning (Wales) Act 2015 ("the Wales Act"). This application is therefore made to the Welsh Ministers seeking planning permission for development carried out before the date of the application without compliance with some conditions subject to which planning permission was granted.

The facility will additionally be operated under an environmental permit from Natural Resources Wales (NRW). The permit will ensure that the site is operated and monitored in a way that meets the environmental criteria set out in legislation and required by NRW.

National Planning Policy (as set out in PPW Paragraph 5.7. 13) supports development of this nature as it helps provide vital flexibility to support an increasing amount of low carbon generation and to maintain security of supply. This type of development is essential supporting infrastructure which is needed to support the National Grid and continuous supply of electricity is essential for the economy and society as a whole.

As the scheme comprises an electricity generating station with an installed generating capacity of between 10 and 50 MW, it falls within the definition of a ‘Development of National Significance’ (DNS) under section 4 of the Developments of National Significance (Specified Criteria and Prescribed Secondary Consents) (Wales) Regulations 2016, for the purposes of s62(D) of the Planning (Wales) Act 2015 ("the Wales Act"). This application is therefore made to the Welsh Ministers seeking planning permission for development carried out before the date of the application without compliance with some conditions subject to which planning permission was granted.

By way of background, planning permission was granted on the 21 st of January 2012 (Application Reference Number: P2012/1061) for a 20MW electricity generation facility. The planning perm ission has been implemented and the facility has been built and operated subsequently. However, certain pre- commencement planning conditions were not satisfied and following the introduction of new legislation the facility now qualifies as a Development of National Significance, which means that a new planning application is required under the new legislation to regularise the position. In addition, Peak Gen are seeking permission to install exhaust gas treatment to the generating units in order to comply with tighter emissions targets effective from January 2019 under the Environmental Permitting (England and Wales) (Amendment) Regulations 2018.

Our role

Our statutory role in the planning process is to provide the local planning authority with an assessment concerned with the likely impact that the proposal will have on scheduled monuments, registered historic parks and gardens, registered historic landscapes where an Environmental Impact Assessment is required and development likely to have an impact on the outstanding universal value of a World Heritage Site. We do not provide an assessment of the likely impact of the development on listed buildings or conservation areas, as these are matters for the local authority. It is for the local planning authority to weigh our assessment against all the other material considerations in determining whether to approve planning permission.

National Policy

Applications for planning permission are considered in light of the Welsh Government’s land use planning policy and guidance contained in Planning Policy Wales (PPW), Technical Advice Notes and related guidance.

PPW (Chapter 6 – The Historic Environment) explains that it is important that the planning system looks to protect, conserve and enhance the significance of historic assets. This will include consideration of the setting of an historic asset which might extend beyond its curtilage. Any change that impacts on an historic asset or its setting should be managed in a sensitive and sustainable way.

The conservation of archaeological remains and their settings is a material consideration in determining a planning application, whether those remains are a scheduled monument or not. Where nationally important archaeological remains are likely to be affected by proposed development, there should be a presumption in favour of their physical protection in situ. It will only be in exceptional circumstances that planning permission will be granted if development would result in a direct adverse impact on a scheduled monument (or an archaeological site shown to be of national importance).

Technical Advice Note 24: The Historic Environment elaborates by explaining that when considering development proposals that affect scheduled monuments or other nationally important archaeological remains, there should be a presumption in favour of their physical preservation in situ, i.e. a presumption against proposals which would involve significant alteration or cause damage, or would have a significant adverse impact causing harm within the setting of the remains.

Assessment

Scheduled monument Llandarcy Round Cairn (GM291) is located within a 1km buffer of the application area, but due to intervening buildings, vegetation and natural topography, the application area is not inter-visible with the scheduled monument. Therefore, the proposed development will have no impact on the scheduled monument GM291or its setting.

Finally, there may also be undesignated historic assets that could be affected by the proposed development and, if you have not already done so, we would advise that you consult the Historic Environment Record held by the Glamorgan-Gwent Archaeological Trust (www.ggat.org.uk).

Just to confirm, there is no requirement for the applicant to produce a standalone HRA report and the competent authority will be able to undertake the assessment based on the submitted standard application documents?
