genealogy Article A Tale of Two Stories: Unsettling a Settler Family’s History in Aotearoa New Zealand Richard Shaw Politics Programme, Massey University, PB 11 222 Palmerston North, New Zealand; [email protected]; Tel.: +64-27609-8603 Abstract: On the morning of the 5 November 1881, my great-grandfather stood alongside 1588 other military men, waiting to commence the invasion of Parihaka pa,¯ home to the great pacifist leaders Te Whiti o Rongomai and Tohu Kakahi¯ and their people. Having contributed to the military campaign against the pa,¯ he returned some years later as part of the agricultural campaign to complete the alienation of Taranaki iwi from their land in Aotearoa New Zealand. None of this detail appears in any of the stories I was raised with. I grew up Pakeh¯ a¯ (i.e., a descendant of people who came to Aotearoa from Europe as part of the process of colonisation) and so my stories tend to conform to orthodox settler narratives of ‘success, inevitability, and rights of belonging’. This article is an attempt to right that wrong. In it, I draw on insights from the critical family history literature to explain the nature, purposes and effects of the (non)narration of my great-grandfather’s participation in the military invasion of Parihaka in late 1881. On the basis of a more historically comprehensive and contextualised account of the acquisition of three family farms, I also explore how the control of land taken from others underpinned the creation of new settler subjectivities and created various forms of privilege that have flowed down through the generations. -

It has been another successful year. I would like to thank the Directors and Council Staff for their enthusiasm and co-operation. Thanks also to Karen and Donna for their work ethic, their enthusiasm and their productivity. The strong working relationship between Councils and the Group has continued as we strive to meet our regional targets of reducing waste, increased recycling and best practice waste management. I was personally pleased with Cohuna/Leitchville attaining two years plastic shopping bag free status and we had a terrific day handing out certificates with Kaye Darveniza, MP officiating the ceremony and we received lots of positive feedback from the traders as we met with each of them during the day. Across the region the continued rolling out of the plastic bag free program has been a success with 33 towns now ‘Plastic Bag Free’. Mention should also be made of the Loddon Shire and CMRWMG who received a Keep Australia Beautiful State Award for the Shire being Plastic Shopping Bag Free. -

161 A DECAY OF RIGHTS: THE DECISION IN NEW HEALTH NEW ZEALAND INC V SOUTH TARANAKI DISTRICT COUNCIL Rose Louise Goss* The decision in New Health New Zealand Inc v South Taranaki District Council is the most recent legal development in the New Zealand debate about fluoridation of public water supplies. That decision centred on the interpretation of s 11 of the New Zealand Bill of Rights Act 1990, the right to refuse medical treatment. The Court held that the fluoridation in question was legal, and reached a limited definition of medical treatment that did not encompass fluoridation. This article analyses the reasoning leading to that interpretation, concluding that the decision is problematic and that the definition of s 11 needs to be remedied. The use of the wording of s 11 to limit the definition of medical treatment was inappropriate, as was the policy reasoning used to support that limitation. The structure of the reasoning exacerbated these issues and adhered too closely to the reasoning in United States cases. Furthermore, the application of a de minimis threshold was conducted without adequate scrutiny, and such a threshold should not be applied to s 11. I INTRODUCTION In Texas and Colorado in the 1900s, a peculiar phenomenon of stained teeth became noticeable and was referred to as both "Texas Teeth" and "Colorado Brown Stain".1 Investigations soon revealed that the stained teeth, while unsightly, were also more resistant to dental caries.2 Further analysis revealed that the cause of both the resistance and the staining was fluoride. The benefits of fluoride were soon acknowledged by public health authorities and fluoride was added to public water supplies.3 Fluoride has since become a common additive to water supplies worldwide.4 * Article submitted as part of the LLB(Hons) programme at Victoria University of Wellington. -

The Council is required under the Sale and Supply of Alcohol Act 2012 (the Act) to provide a report for each financial year, on the proceedings and operations of its District Licensing Committee (DLC). This report recommends that the Annual Alcohol Licensing Report be adopted, a copy provided to the Alcohol Regulatory and Licensing Authority (ARLA) and also be made available to the public. Recommendations THAT the Council a) Adopts the South Taranaki District Council Annual Alcohol Licensing Report – 2018/19 in accordance with Section 199 of the Sale and Supply of Alcohol Act 2012. b) Notes that adoption will trigger public notification of the report and that a copy will be provided to the Alcohol Regulatory and Licensing Authority (ARLA). Background 2. Every territorial authority is required under the Act to provide an annual report to the ARLA on the proceedings and operations on its DLC for every financial year. Local Government Purpose 3. Under the Local Government Act 2002, the Council’s purpose is to “promote the social, economic, environmental and cultural well-being of communities in the present and for the future”. 4. sustainability Article Resilient Forms of Shopping Centers Amid the Rise of Online Retailing: Towards the Urban Experience Fujie Rao Melbourne School of Design, University of Melbourne, Melbourne 3010, Australia; [email protected] Received: 13 June 2019; Accepted: 17 July 2019; Published: 24 July 2019 Abstract: The rapid expansion of online retailing has long raised the concern that shops and shopping centers (evolved or planned agglomerations of shops) may be abandoned and thus lead to a depletion of urbanity. Contesting this scenario, I employ the concept of ‘retail resilience’ to explore the ways in which different material forms of shopping may persist as online retailing proliferates. Through interviews with planning and development professionals in Edmonton (Canada), Melbourne (Australia), Portland (Oregon), and Wuhan (China); field/virtual observations in a wider range of cities; and a morphological analysis of key shopping centers, I find that brick-and-mortar retail space is not going away; rather, it is being increasingly developed into various shopping spaces geared toward the urban experience (a combination of density, mixed uses, and walkability) and may thus be adapted to online retailing. While not all emerging forms of shopping may persist, these diverse changes, experiments, and adaptations of shops and shopping centers can be considered a form of resilience. Introduction Shopping has been at the heart of urbanity since the earliest cities developed as sites of exchange. One sees and touches the product, perhaps smells and tastes it, bargains with the trader and experiences the larger social, political and cultural life that comes with traditional marketplaces.
