(d) An estimated fare, which the Fresno COG Board would determine to be sufficient to meet farebox recovery requirements, but would not be so high it would pose a financial burden on transit dependent patrons
SOCIAL SERVICES TRANSPORTATION ADVISORY COUNCIL (SSTAC)
The Fresno COG Policy Board established its Social Service Transportation Advisory Council (SSTAC) on May 26, 1988, to aid in its review of transit issues with emphasis on the annual identification of transit needs within Fresno County. These needs include the needs of transit dependent and transit disadvantaged persons, including the elderly, disabled, and persons of limited means. The Fresno COG’s establishment of this Advisory Council is consistent with State Law (SB 498, Chapter 673, 1987), which mandates both the purpose and minimum membership of this body. A list of SSTAC members is included with this report (Attachment A).
The purpose of the SSTAC is to:
(1) Annually participate in identification of transit needs (Unmet Transit Needs Public Hearing Process)
(2) Review and recommend appropriate action by the Fresno CoG for a jurisdiction which finds by resolution, that:
(a) There are no unmet transit needs;
4 (b) There arc no unmet transit needs, which are reasonable to meet;
(c) There are unmet transit needs, which are reasonable to meet.
(3) Advise the Fresno COG on any other major transit issues, including the coordination and consolidation of specialized transportation services.
SSTAC UNMET TRANSIT NEEDS PROCESS
The SSTAC has developed an annual process for soliciting unmet transit need comments from the public. Over 400 letters are sent to agencies and individuals interested in providing feedback on their public transportation needs within Fresno County (Attachments B-i, B-2 and B-3). The letter was prepared in English and Spanish versions, and included a request for information regarding any unmet transit needs within Fresno County. Respondents were requested to include the following information to assist Staff in an initial evaluation of proposed services:
• Where new service is needed, and where the potential trips would start and end; • When, and how often trips would need to be scheduled; and • A description of the individuals needing the service including age group, financial constraints, and whether they have disabilities requiring special services.
As part of the information gathering process, SSTAC held three (3) public outreach meetings (Attachment C) to seek Unmet Transit Needs comments from residents throughout the County.
The first outreach meeting was held in the City of Kingsburg, on February 16, 2012, in the City Council Chambers at City Hall, 1401 Draper Street, Kingsburg, CA 93631. The meeting location was set to facilitate comments from the residents of Eastern Fresno county including: Fowler, Kingsburg, Orange Cove, Parlier, Reedley, Sanger, Selma, and the surrounding unincorporated communities. The meeting time was set for 2:00 p.m. No comments were received.
The second outreach meeting was held in the City of Fresno on February 22, 2012, in the Yosemite Room at the Manchester Office of Caltrans located at 2015 E. Shields Ave., Fresno, CA 93726. The meeting location was selected to facilitate comments from the residents of the Fresno-Clovis Metropolitan Area (FCMA) and surrounding unincorporated communities. The meeting time was 5:30 p.m. One comment was received from Vidal Medina from Resources for Independence, Central Valley. His concern was for paratransit service in the areas outside of the Fresno Area Express Handy Ride service area. Jeffrey Webster, FCRTA General Manager, informed Mr. Medina two (2) years ago the FCRTA had implemented an additional subsystem to address the transit needs of individuals living beyond cuaTent transit service area boundaries. The “Rural Transit” service is available Monday through Friday, from 8am to 5pm, with a twenty-four (24) hours prior reservation. To date the FCRTA has provided rides to residents living both East of the FA.X/ Handy Ride and Clovis Transit service area boundary and West of the FAX / Handy Ride service area boundary.

A. Additional service to the rural communities of: Coalinga; Firebaugh; Mendota; Orange Cove; Reedley; and San Joaquin.
According to Mr. Jeff Webster, General Manager of the Fresno County Rural Transit Agency (FCRTA), direct service from the Coalinga area was provided on a daily round trip basis. In addition, an express service operated one day per week to facilitate medical appointments in the metropolitan area. Neither of these services met the minimum performance criteria required to continue the service. The conclusion was that none of the eight communities, by themselves, are able to support their own direct service to Fresno, but together the service continues to be viable.
B. Expand the number of pick-up/drop-off locations between Orange Cove and Reedley
Currently there are two round trips provided for service between Orange Cove and Reedley with continuing service to Fresno. Actual ridership would not justify an additional trip.
C. Expand transportation hours between the Mendota, San Joaquin and Firebaugh areas to and from the Metropolitan Fresno area
From 2000 to 2003, the Fresno County Human Services Department of Employment and Temporary Assistance funded the FCRTA to expand services in response to Federal “Welfare to Work” and State CalWorks directives. FCRTA was contracted to provide service from 6:00 am to 6:00 pm. During the service expansion period, the Westside Transit service was increased to three daily round trips including early morning and late afternoon to facilitate employment, training, education and childcare. Despite a significant number of clients in the rural areas and coordination by case workers who issued prepaid monthly passes, actual ridership was not significant or regular enough to warrant service continuation, and services were reduced to respond to actual ridership. Currently, the Fresno County Economic Opportunities Commission (FCEOC) is under contract to provide transportation services under the CalWorks program seven days a week from 6:00 pm to 6:00 am.
As recommended in previous Unmet Needs reports, the Fresno COG’s van pool program is a viable option for transportation from the rural areas. As an added incentive, FCRTA purchased a number of vans to buy down the daily cost operating a van pool. Additional information can be ohtamed from Valley Rides at 441-RIDE or

The Fresno COG’s Social Service Transportation Advisory Council (SSTAC) will continue to be involved in determining appropriate Staff responses. Other proposals may yet be presented at the Fresno COG’s Annual Unmet Transit Needs Public Hearing scheduled for 5:30 p.m. on Thursday, June 28, 2012. After adoption, other amendments may be funded with available contingency funds.
To fulfill their role in making a recommendation to forward onto the Fresno COG Advisory Committees and ultimately to the Fresno COG Policy Board, the SSTAC (following an expressed opportunity for public comment) made the following recommendation, based on its May 15, 2012 findings:

The Regional Transportation Plan calls for fixed-route service within the Metropolitan Area to be provided by the City of Fresnos Fresno Area Express (FAX), with financial participation from the City of Clovis and Fresno County for service to non-Fresno City residents within FAX’s Service Area. Demand responsive Handy-Ride service is provided through FAX under contract with MV Transportation Services, Inc. The Short-Range Transit Plan for the Fresno-Clovis Metropolitan Area sets forth the specific service implementation plan for the five (5) fiscal year period of July 2011 to June 2016. It is this Short-Range Transit Plan (SRTP) that actualizes the more general service goals and objectives of the Regional Transportation Plan. The FCMA SRTP was adopted on June 30, 2011.
The Regional Transportation Plan and the FCMA Short-Range Transit Plan also continue to emphasize specialized service for disabled and elderly residents who are unable to utilize the fixed-route buses.
The estimated cost for operation of FAX in FY 2012-2013 is $45.6 million. Service will be funded with $15.7 million in State Transportation Development Act - Local Transportation Funds and $2.6 million in State Transit Assistance funds. FAX is also anticipating $7.8 million in Measure C, and an additional $9.7 million will be funded by the Federal Transit Administration. The remaining funds are derived from farebox revenues and special services provided under contracts with outside agencies such as the City of Clovis, Fresno County, and Children’s Hospital of Central California. Although the City of Fresno does not propose to expend any Local Transportation Funds on streets and roads in FY 2012, a “transit needs finding” is necessary to be consistent with SB-498. SB-498 states the lack of available resources shall not be the sole reason for finding a transit need is not reasonable to meet.
The City of Clovis operates two types of public transit service. Clovis Stageline provides general public fixed-route service within the City Limits. Clovis Round Up operates specialized demand-responsive service for the elderly and disabled residents. The City of Clovis has designated Round Up services as the Consolidated Transportation Services Agency (CTSA) for the Clovis Transit Service Area. The estimated cost for operation of Clovis Transit in FY 2012- 2013 is $2.5 million.

E. City of Fresno

Fresno Area Express contracts with MV Transit Services, Inc. for weekday and weekend demand-responsive service on Handy-Ride. This service is oriented toward those who are unable to use the fixed-route service.
Recommendation:
It is recommended the Fresno COG Policy Board find that public transportation needs within the City of Fresno will be reasonably met. Service requirements contained within the Regional Transportation Plan will be satisfied.
F. City of Huron
The FCRTA, under an inter-agency services agreement with the City of Huron contracts with the Fresno County Economic Opportunities Commission (FCEOC) as the Rural CTSA for the provision of general public transportation service within the Sphere of Influence, and surrounding area utilizing two (2) FCRTA wheelchair accessible modified vans. The intra-city services are available, during an approximate eleven (11) hour period, Monday through Friday.
The City of Huron continues to provide funding for an inter-city “life-line” service to Coalinga. Two (2) round trips are provided during a five (5) hour period, Monday through Friday.
Coalinga Transit also provides inter-city fixed route service, with route deviation to pick-up disabled passengers, between Coalinga and Fresno. The bus provides one (1) round trip through Pleasant Valley Prison, Huron, Five Points, Lanare, Riverdale, Caruthers, Raisin City and Easton, during an approximate eleven (11) hour period, Monday through Saturday.

G. City of Kerman
The FCRTA, under an inter-agency services agreement with the City of Kerman, provides demand responsive public transportation service with a FCRTA vehicle within its Sphere of Influence and surrounding area using a lift equipped FCRTA van, for approximately eight (8) hours a day, Monday through Friday.
The FCRTA also contracts with the Rural CTSA to operate Westside Transit as a multiple round trip general public commuter service, for approximately nine and a half (9-1/2) hour period, Monday through Friday, using a lift equipped vehicles, which may deviate from its route to pick-up disabled passengers. The service is provided on a scheduled fixed route to serve patrons “between” Firebaugh, Mendota, San Joaquin and surrounding unincorporated communities, and Kerman and “to” and “from” Fresno.
Recommendation:

H. City of Kingsburg
Two (2) FCRTA wheelchair lift equipped vehicles are available for providing public transportation services to Kingsburg Area residents. These transit services are provided by the Fresno County Economic Opportunities Commission (FCEOC), as the Rural CTSA, to the City of Kingsburg under an inter-agency services agreement with FCRTA. Service within the Sphere of Influence, and surrounding area, are available on a demand responsive basis during an approximately nine and a half (9.5) hour service period, Monday through Friday and approximately eight (8) hours on Saturday utilizing just one (I) vehicle.
The FCRTA also contracts with the Rural CTSA to operate Southeast Transit as a multiple round trip general public commuter service, during an approximately nine and a half (9-1/2) hour period, Monday through Friday, using a lift equipped bus, which may deviate from its route to pick-up disabled passengers. The service is provided on a scheduled fixed route to serve patrons “between” Kingsburg, Selma, and Fowler and “to” and “from” Fresno.

M. City of Sanger
To provide public transportation service within the Sanger Sphere of Influence and the surrounding area, the FCRTA, under an inter-agency services agreement, with the City of Sanger contracts with Transportation Specialties. Three (3) wheelchair accessible FCRTA vehicles offer service in Sanger. The vehicles provide staggered service during an approximate nine and a half (9-1/2) hour period, Monday through Friday, and one (1) vehicle during an eight (8) hour period on Saturday.
FCRTA also contracts with the Rural CTSA to operate Orange Cove Transit as a multiple round trip general public commuter service, during approximate nine and a half (9-1/2) hour period, Monday through Friday, using a lift equipped bus, which may deviate from its route to pick-up disabled passengers. The service is provided on a scheduled fixed route to serve patrons ‘between” Orange Cove, Reedley, Parlier, Sanger and “to” and “from” Fresno.
Recommendation:
It is recommended the Fresno COG Policy Board find that public transportation needs within the City of Sanger, its Sphere of Influence, and surrounding area will be reasonably met. Service requirements contained in the Regional Transportation Plan will be satisfied.
N. City of San Joaquin
The FCRTA, under an inter-agency agreement with the City of San Joaquin, contracts with the Fresno County Economic Opportunities Commission (FCEOC), as the Rural CTSA, for demand responsive Intra-City service within their Sphere of influence and surrounding area. Inter-community service is also provided between the unincorporated communities of: Cantua Creek, El Porvenir, Halfway, Three Rocks, and Tranquility. Inter-City service to Kerman and Mendota is also available. These services are provided, during a nine and a half (9.5) hour period, Monday through Friday using an FCRTA lift equipped vans.
Ridership demands continue to increase and may warrant a second vehicle, for operation during an eight (8) hour period. The expanded service will be done on a demonstration basis when warranted to carry additional passengers and ensure access to the inter-city service in Kerman on Westside Transit. The additional service expansion will he funded by FCRTA’s Measure-C funds.

Auberry Transit is provided, through an inter-agency service agreement between the FCRTA and the Fresno County Economic Opportunities Commission (FCEOC), as the Rural CTSA. The service area includes the communities of: Alder Springs, Auberry, New Auberry, the Big Sandy Indian Rancheria, Burrough Valley, Cold Springs Indian Rancheria, Jose Basin, Marshall Station, Meadow Lakes, Mile High, Prather, Sycamore, and Tollhouse. A lift equipped vehicle provides, approximately six (6) hours of service per day, Monday through Friday. A second Auberry Transit van is to provide “life-line” inter-city service from the foothill communities and through Friant and the Table Mountain Indian Rancheria to the Fresno-Clovis Metropolitan Area, one (1) day a week during an eight (8) hour service period.
Del Rey Transit operates as a general public demand responsive service. The Rural CTSA continues to fund the service four (4) hours per service day and Fresno County TDA monies fund the remaining four (4) hours. The service is under contract for driver services through the Rural CTSA and continues to be available during an approximate eight (8) hour period Monday through Friday. The operation will continue to maintain priority service to seniors attending the mid-day Hot Meal Nutrition Program. The service transports passengers within the community on a shared ride basis; arranges passenger grouping for trips to Sanger; and transfers passengers in Sanger to access Orange Cove Transit for service to Fresno, Parlier, Reedley, and Orange Cove. rd) Dinuba Connection is in its third (3 year of service. In cooperation with the FCRTA, the City of Dinuba (in Tulare County) provides an inter-County service, referred to as the Dinuba Connection, between Dinuba and Reedley (in Fresno County). The SSTAC Chairman received two(2) letters regarding perceived “UnmetTransit Needs”. Copies of the actual letters and Staff response are attached to this Report They are summarized as follows:
1. The first comment was received from Mr.Walter J. Ramirez-Delgado of California Rural Legal Assistance Foundation (CRLAF). Mr. Ramirez-Delgado’s comments were on behalf of the residents residing in the Hidalgo Elementary School area in Fresno The stated comments referenced multiple concerns and are addressed in the report.
2. The second comment letter came from Mr. Howard K. Himes of the County of Fresno Department of Social Services. Mr. Himes identified three areas of concern: 1) Additionalservice to the rural communities of: Coalinga; Firebaugh; Mendota; Orange Cove; Reedley; and San Joaquin, 2) Expand the number of pick-upldrop-offlocations between Orange Cove and Reedley and 3) Expand transportation hours between the Mendota, San Joaquin and Firebaugh areas to and from the Metropolitan Fresno area After thorough review of all items, the Social Services Transportation AdvisoryCommittee (SSTAC) found there to be no unmet transit needs that are reasonable to meet in Fresno County.
Mayor Dhahwal (San Joaquin) opened the Public Hearing. Walter Ramirez-Delgado and several members of the public gave testimony regarding needs for bus stop shelter at Belmont and First St. and service in Lanare. Followingtheir testimony, itwas suggested that staff followup on their concerns and report back in 60-90 days on the findings. There being no other testimony, the hearing was closed. A motion was made by Mayor Dhahwal (San Joaquin) and seconded by Mayor Yep (Kerman) to approve Resolution 2012-17 making the finding that there are no unmet transit needs that are reasonable to meet in Fresno County. A vote was called for and the motion carried. Staff willreport back to the Policy Board on their findings.
D. Adoption of Annual AvaIlabilIty Advisory Percentages for DIsadvantaged Business Enterprise (DBE) Participation — ResolutIon 2012-16 [Beshears] (APPROVE] - PUBLIC HEARING
Les Beshears (Fresno COG) reported that the U.S. Department ofTransportation, pursuant to revisions to 49 CFR Part 26, recently issued a new rule affectingthe implementationand management of the Departments Disadvantaged Business Enterprise (DBE)program that requires a three year goal setting methodology. The three year goal for the period 2013 -2015 shall be submitted by August 1, 2012 and willbe expressed as a percentage of all FHWAor FTAassisted contracts exclusive of FTAfunds used for the purchase of transit vehicles.
A California State Department of Transportation Availabilityand Disparity Study revealed statistically significant underutilization in four of six groups presumed to be disadvantaged as defined in 49, CFR Part 26. As a result the Federal Highways Administration (FHWA)has approved the California State Department of Transportation Disadvantaged Business Enterprise Program requiring implementation of race conscious measures. Local agencies adopted the California Department of Transportation Disadvantaged Business Enterprise Program Implementation Agreement and set race conscious goals for the presumed four underutilized groups, African American, Asian Pacific American, Native American, and Women. Mayor Dhaliwal(San Joaquin) opened the Public Hearing. There being no comments, the hearing was closed. This was an information item and required no further action by the Policy Board.
F. Exchange of Regional Surface Transportation Funds (RSTP) and Congestion Mitigation and Air Quality Funds (CMAQ)Unobligated Prior Year Apportionment Balances with San Joaquin COG [Garza] (APPROVE]
Melissa Garza (Fresno COG) explained that the Fresno Council of Governments currently has CMAQand RSTP apportionment balances from projects that were not delivered in previous years. To avoid the risk of exposing those balances to a possible federal rescission, Fresno COG proposed to exchange the funds withanother regional agency, the San Joaquin Council of Governments. As itcurrently stands, San Joaquin COG does not have remaining current or prior year apportionments to deliver their projects, therefore they requested that FCOG exchange $1 millionin CMAQand $1.6 millionin RSTP “prior year apportionments withthem so they can deliver their projects in FFY 11/12, with the agreement that FCOG will receive repayment from San Joaquin COG in “new”apportionment in FFY 12/13.
The exchange of prior year apportionments is favorable to both agencies and to the State for several reasons: 1. it prevents FCOG’s apportionment balances from being subjected to a federal rescission. 2. Itwillprovide additional apportionments for FCOG as programming capacity in FFY 12/13 to deliver more projects. 3. Itallows the State to obligate more federal-funded projects, which may allow itto use federal funding that is unused by other states at the end of the FFY, also referred to as “August Redistribution”. While FCOG plans to deliver all of its programmed projects every year, delivery issues do arise in the normal course of a project which causes a delay in a phase or the entire project. Also, bid savings from delivered projects results in surplus which cannot be predicted or estimated but still needs to be captured. Ifapportionments are not delivered in any given federal fiscal year, regional agencies may exchange federal apportionments through a memorandum of understanding which willpreserve the agency’s funding. Upon execution of the agreement, the State allows the borrowing regional agency access to the lender’s apportionment to obligate funds for projects. The apportionment is later returned to the lender based on the terms that are identified in the MOU,
