~~~mmr.:> Two applicants have applied for license under section 277(1) J of the Cantonment Act'2006 vide letter under reference. The licenses have been considered and issued by the Board to these applicants for last many years continuously for both the parties for the year 2018-19 subject to deposit of 10% enhanced as license on the previous year amount. In both the cases licenses have been renewed by the Excise Department, J&K at Sri nagar for the period of 05 years i.e. from 2018- 19 to 2022-23. A self attested photocopy of each renewed license provided with the applications.

The Ld Additional District Court Srinagar vide order dated 30.03.2019 passed stay order against this Office/Board relevant portion of the order reproduced below:-

SUPPL Y OF CASUAL LABOURS SKILLED/ UNSKILLED STAFF AND SUPPLY OF TIPPERS/ DUMPERS AND OTHER CONSERVANCY SERVICES ETC FOR BADAMIBAGH CANTT. SRINAGAR.

This office initiated tender process for the financial year 2019-20 for providing casual labours skilled/unskilled staff and supply of tippers/ dumpers & other conservancy services etc. at BB Cantt. But due to complain of M/s Salman Sons and in view of PDDE, NC letter dated 08.02.2019 and 29.03.2019 tender process could not be finalized.

Therefore, Mis Kuchay Traders was requested to submit their willingness to extend the period of agreements initially for three months w.e.f 01.04.2019 or till completion of new tender process vide this office letter No.1 1/5/2210/CBIBB/3669 and No. 11/5/2377/CBIBB/3670 both dated 25.03.2019. In response to that the contractor has forwarded his willingness for the above said extension vide letter dated 29.03.2019.

In response to that Airforce authorities Awantipora and Mis Kuchay Traders vide letter dated 27.03.2019 and 29.03.2019 respectively, forwarded their willingness for the above said extension. Accordingly, appropriate note alongwith relevant documents put up to respected PCB for seeking their approval under the provisions of section 26(2) (a) of Cantonments Act, 2006. The respected PCB approved the same on 30.03.2019 and the work order issued to the contractor vide this office letter dated 30.03.2019 to continue the said services as per rates, terms & conditions of agreements dated 30.03.2018 initially for three months w.e.f 01.04.2019 or till completion of new tender process, whichever is earlier.

Therefore, concern AF authorities vide CEO letter dated 30.03.2019 has been conveyed that due to above reasons this Board unable to provide services to their station w.e.f 01.04.2019 or till completion of new tender process and requested to arrange requisite services at their end till the finalization of new tender process or otherwise.
