OVERVIEW

The Past Year. In the past 12 months since the last Land Session, the District’s land acquisition program has successfully acquired significant tracts of land while completing long-standing acquisition priorities. Chief among both the large scale acquisitions and long-standing priorities was the 990-acre Stonebrae dedication recorded in August 2015, led by the ASD Division’s Advance Planning group in tandem with the Land Acquisition Department. This dedication was the culmination of a 35-year effort by past and current staff to preserve open space resources atop Walpert Ridge by preventing the encroachment of urban development in the hills above Hayward. The dedication increased the land mass of Garin/Dry Creek Pioneer Regional Park by almost 20% of its then current 4,800 acres, and also provided for 3.5 miles of the Bay Area Ridge Trail. Other significant long-term acquisition objectives that were achieved in this same time period include the 362-acre Wiedemann Ranch Ag Lot 2 acquisition linking Bishop Ranch Open Space Regional Preserve and Dublin Hills Regional Park, and negotiation of Burton Ridge trail easements joining together the District's Olympic Boulevard staging area and City of Lafayette property with the body of the Calaveras Ridge Trail leading into Las Trampas Wilderness Regional Preserve. All told, from June 7, 2015 to June 7, 2016, the land acquisition program succeeded in closing escrow on over 2,240 acres of additional land and over nine acres (approximately 4.6 miles) of regional trails at a purchase price of approximately $11.1 million, almost 50% paid for by outside funding sources.

Where We Are Today. The real estate market and land acquisition issues described in last year’s Land Session memorandum are still pertinent today. The successful passage of Measure WW in 2008 has allowed the District to achieve many short and long-range goals in a balanced approach to both land preservation and opportunities for outdoor recreation. This District, more than most other agencies, also has been able to leverage its funds to create acquisition partnerships and provide matching funds for competitive grants because of WW. At the same time, with the end of the recession and subsequent economic recovery, the District’s land acquisition program has experienced increasing competition for marketed properties and property owners that are less motivated to sell. The flip side of the strengthening economy and higher levels of development, however, are the increased opportunities to work with developers and public agencies to condition development approvals with the provision of open space dedications, trail linkages and staging areas that enhance park access for the surrounding communities. Land Acquisition

23 staff will continue to work closely with the District’s advance planners to achieve these objectives.

Looking Forward. Looking forward over the next 12 months, staff recommend that land acquisition priorities focus on providing access into and staging for existing parklands; completing critical trail gaps where feasible and as opportunities arise; and, rounding out and completing final park boundaries. Staff will also continue to look for opportunities to acquire additional tracts of land in priority areas for new parks as designated in the Master Plan, while at the same time work hard to meet the challenge of providing a balance of acquisitions throughout the District. The District is doing well in Contra Costa County, but Alameda County, especially the Oakland – Berkeley – Albany shoreline, remains a particularly difficult environment in which to achieve results. Nonetheless, staff will continue to prioritize the Army Corp of Engineers Inner Harbor Canal transfer; the San Francisco Bay Trail, including the Golden Gate Fields litigation; the wind down of the Flexi-Van lease at Martin Luther King Jr. Regional Shoreline to allow for park development; and, future East Bay Gateway Regional Shoreline conveyances from the U.S. Army and Caltrans as important long-held goals. In terms of funding, the District will reach the half- way point for Measure WW in a couple of years. The tremendous success of the program since 2008, particularly in several parks at unanticipated levels, serves as both encouragement and caution to current staff to continue leveraging public bond funds to every extent possible.

2015 – 2016 ACCOMPLISHMENTS

Key Acquisitions. The acquisition of land rights is the Land Acquisition Department’s number one goal. Since the last Land Session, the District’s land acquisition program has acquired an additional 2,240 acres at a cost of over $12.4 million and been awarded over $5.4 million in grants for their purchase. These new parklands will provide recreational opportunities for park visitors while preserving important viewsheds, wildlife corridors, and natural and cultural resources. Key acquisitions since the last Land Session include, in addition to those properties cited above, the 3.89-acre GSA property settlement agreement spearheaded by the District’s Legal Division, providing the opportunity to expand existing facilities and further open up and preserve the shoreline for public recreation at Crown Memorial State Beach; the 646-acre Nunn property, a joint acquisition with the East Contra Costa County Habitat Conservancy (ECCCHC) for restoration of rare dune habitat, tidal marshes and alkali wetlands in eastern Contra Costa County, as well as potential development of a segment of the future Delta Trail Extension; the 26.87-acre Russell City Energy Co. donation at Hayward Regional Shoreline to expand marshland restoration in the area; the 71.37-acre Heilig property at Las Trampas Wilderness Regional Preserve serving to round out parkland boundaries south of Bollinger Canyon Road; and a new 25-year management agreement with the United States Department of the Interior Bureau of Reclamation through 2041 for the continued administration, operation, maintenance and development of the Park District's 780-acre Contra Loma Regional Park.

24 Support Services. In addition to acquiring property and various types of real estate rights in fulfillment of the District’s Master Plan, the Land Acquisition Department provides responsive support services to other District departments. Land Acquisition staff support the ASD, Legal and Operations Divisions with land rights research, real estate document interpretation, as well as boundary dispute and encroachment resolution; the Design & Construction and Trails Development Program Departments by acquiring the property rights necessary to construct capital improvement projects; the Planning Department by conducting research needed to provide baseline land rights data for Land Use Plans and Land Use Plan Amendments and by assisting with developer negotiations; Finance and Management Services with right-of-way needed for Information Services’ fiber optics cable installation project; and recently, the Public Affairs and Public Safety Divisions with procurement of leased facilities to support their operations. Examples of these efforts include acquisition of right-of-way necessary for the Breuner Marsh restoration project at Point Pinole Regional Shoreline; negotiation of public trail rights required for the Robert Sibley Volcanic Regional Preserve checklist amendment project scope on the former McCosker property; and, procurement of licenses, leases and easements from outside agencies necessary to support the construction of railroad crossings to be granted to the District via the Amended and Restated Memorandum of Understanding with Union Pacific Railroad completed by the Legal Division and Trails Development Program Department this year.

Leveraging Resources. Finally, a third goal of the Department will be to continue spending down remaining Measure AA funds and utilizing Measure WW funds in accordance with the Master Plan and the Board’s priorities, while leveraging these funds with outside funding sources. Thanks to partners such as the East Contra Costa Habitat Conservancy, the California Coastal Conservancy, the Wildlife Conservation Board, the Moore Foundation, the Alameda County Altamont Landfill and Resource Facility Open Space Advisory Committee, the Alameda County Surplus Property Authority, and the City of Livermore, the District has been able to maximize opportunities to purchase strategic properties. In fact, since the passage of Measure WW in 2008, the District has acquired 21,974 acres for $126.5 million, of which $74.6 million (59%) was provided by third party sources. Staff also have worked closely with local land trusts such as the Land Trust, Save Mount Diablo and the Tri-Valley Conservancy on projects of mutual interest to preserve land and create trail corridors.

Summary tables and maps under the 2015 and 2016 Acquisitions tabs of the Land Session booklet (pages 29 - 74) provide more detailed information on the various projects and outside funding sources reflected in the accomplishments and goals described above.

FUTURE CHALLENGES

Master Plan Priorities and Staff Capacity. The Land Acquisition Department shares similar challenges with other departments throughout the District in terms of setting priorities that balance the goal of meeting the District’s Master Plan objectives while being mindful of staff capacity. Setting acquisition priorities and focusing efforts on projects

25 providing opportunities for success at a reasonable cost will be critical to our success. At the same time, Land Acquisition staff are dedicated to providing excellent internal customer service to other District divisions. In particular, we want to be able to support Operations’ management of these ever growing real estate assets, and the District’s capital improvement projects’ provision of parkland improvements for the public, while looking outward to future additional acquisitions.

Balanced Parkland Distribution. The District’s land acquisition program also strives to acquire properties and other real estate rights throughout the District and in every parkland unit in keeping with the Master Plan’s goal of providing a balanced system of regional parks, trails and services for all District residents. Acquiring parks, open space and trail connections along our urban shorelines and highly developed population centers, however, will continue to be among our most challenging goals. Properties and easements within these areas are particularly difficult to acquire because of the relative scarcity of supply, high level of demand, and complicated land use patterns. Nonetheless, staff is committed to focusing on key projects with realistic prospects within each of the three District metropolitan sectors, keeping in mind the sectors’ unique characteristics and understanding that balanced parkland distribution is a goal to be achieved over a period of time. For the west metropolitan sector in particular, as noted above, staff are committed to working to complete the Army Corp of Engineers Inner Harbor Canal transfer; key segments of the San Francisco Bay Trail; the reclaiming of the entire Martin Luther King Jr. Regional Shoreline for public use and park purposes with the termination of the long-standing Flexi-Van lease; as well as future East Bay Gateway Regional Shoreline conveyances from the U.S. Army and Caltrans.

Balanced Parkland Funding exhibits under the Funding tab of the Land Session booklet (pages 75 - 76) demonstrate how the relationship between acquisition expenditures and population within the District’s three metropolitan sectors change overtime and from year-to-year. It is important to note that population numbers and acquisition dollars reflected in these exhibits serve as proxies for the equitable distribution of District-wide resources per the Master Plan Balanced Parkland Distribution Policy. These figures do not include the real estate value of property dedications, donations or other no-cost right-of-way conveyances, nor do they incorporate capital improvement project dollars invested within each metropolitan area to date.

Grant Funding Impacts. While the District’s land acquisition program continues to take advantage of opportunities to leverage outside funding, leveraging District AA and WW acquisition bonds in a balanced geographic fashion may be more challenging in the future. Some grant funding sources that Land Acquisition formerly utilized on a fairly regular basis and could be applied to a relatively broad geographical area, such as the California State Coastal Conservancy grant funding, are no longer available or are much narrower in scope. Other sources, such as funding through the ECCCHC, while relatively plentiful and accessible largely due to the East Contra Costa County Habitat Conservation Plan (HCP) approved in 2007, may be applied only to acquisitions within the Preserve’s eastern Contra Costa County boundaries, and come with significant limitations in terms of how the acquired properties can be developed and utilized. In fact, since 2008 with the implementation of the HCP and passage of Measure WW, approximately 53% of total

26 acres acquired and almost 72% of grant funding obtained by the District were in partnership with the ECCCHC for properties within its Preserve area. More generally, while the ECCCHC has been a key partner in our acquisition efforts over the past eight years, staff’s challenges going forward will include completing management plans for lands acquired; balancing resource protection goals with the provision of public recreational access; and securing long-term management funding.

The Land Acquisition Project Funding graph under the Funding tab of the Land Session booklet (page 77) demonstrates the change in acquisition funding sources over the last ten years, with HCP monies dominating other grant funding sources in total for the period 2009 – 2015.

Measure WW Fund Balances. Related to future funding challenges, several parks have experienced unexpected levels of success in large tract acquisitions such that Measure WW funds have largely been depleted relative to the number of target acquisitions still remaining. These parks include Black Diamond Mines and Clayton Ranch Regional Preserves, Deer Valley Regional Park, Las Trampas Wilderness Regional Preserve, Pleasanton Ridge Regional Park, Point Pinole Regional Shoreline and Wildcat Canyon Regional Park. In the not so distant future, the Board will need to address whether funds from the General Fund, other AA and WW allocation areas, WW earned interest or other potential sources should be utilized to complete critical acquisitions in these parks.

The availability of Measure WW funding has been critical to the District’s recent successes. As demonstrated over the District’s 80-plus years of experience, some acquisitions take multiple years to accomplish. Looking to the future, when a property owner is willing to sell a strategic property, the District needs the assurance of knowing that Measure WW money will be there to achieve its objectives. Therefore, while the Board has the authority to move Measure WW funds from acquisition to development, staff continue to encourage and urge the Board to be very cautious about moving the funds prematurely.

Measure AA and Measure WW Acquisition Funding Summaries under the Funding tab of the Land Session booklet (pages 79 - 82) show the original allocations and balances remaining for each of the AA and WW allocation areas. Other Land Acquisition Funding Sources (page 83) lists the remaining funding sources and balances for land acquisition, going from most restricted use to most general application.

Planning and Operational Factors. Finally, growing the park system necessitates proper planning for the eventual development and operation of public parklands being acquired today. Land Acquisition staff have increasingly made it a priority to involve Operations and Planning staff early in the acquisition process, in particular with respect to properties that may contain historic or cultural resources; and for those properties where the need for safety and security funding upon close of escrow is evident. Staff will continue to challenge itself with looking for opportunities to provide endowments or other sources for operational and maintenance funding as part of its negotiations for new public parkland whenever possible.

The District will continue to acquire, develop, and operate parkland and facilities and provide programs and services with the primary goal of achieving a long-term balance throughout the park system. The District will continue to allocate resources based on the populations projected for the West Metropolitan, South Metropolitan, and Diablo sectors. The District also endeavors to take advantage of opportunities that can help to supplement or otherwise make the most of residents’ tax dollars. For example, as seen in the funding chart above, outside funding sources have been used to leverage District funding in each sector over the years.

84 GLOSSARY GLOSSARY OF REAL ESTATE TERMS

Fee simple Absolute ownership, unencumbered by any other interest or estate; the highest real estate ownership interest. Life estate An ownership interest in property for the duration of a specific person’s life. Upon that person’s death, the estate reverts to the grantor. Dedication The offering by the owner and acceptance by a public agency of real property for public use, in accordance with statute or common law. No compensation is paid. Easement A nonpossessory interest held by one person in the property of another where the first person is accorded partial use of the property for a specific purpose. An easement restricts but does not nullify the fee owner’s rights to use and enjoy the property. Conservation Easement A restriction that limits future property use to conservation or preservation. EVMA Easement Emergency Vehicle and Maintenance Access Easement. Scenic Easement An easement for protection and/or development of views and natural features. Right of Way The right to pass across the lands of another, or an interest in land or property for transportation purposes (e.g., roads, public transport, utilities, etc.). Access Rights The right of ingress to and egress from one's property to a public road. The right may be actual or implied. Access is a private right as distinguishable from the public’s rights. Encroachment An improvement (e.g., structure, sign, wall, or fence) that illegally intrudes on another’s property. Grant Deed A written document by which the ownership interests in real property are transferred from one party to another. Quitclaim Deed A deed conveying, without warranty, any right, title, or interest the grantor may have in the property conveyed. Final Order of The closing order of a court in a condemnation action. Condemnation Made after the requirements of the final judgment have been satisfied. It passes property title to the condemnor. Escrow A procedure whereby a neutral third party controls the legal documents and funds on behalf of a seller and buyer.
