A.1 Introduction This application for a Waste Water Discharge Licence is made by Kilkenny County Council and for the agglomerations of Kilmacow. The application is made pursuant to the Waste Water Discharge (Authorisation) Regulations, 2007, (S.I. No. 684 of 2007). All drawings referred to in this document can be found in Appendix 1 at the back of the document.

A.2 Location Kilmacow is located in the Southern area of close to the Waterford City, (256210E, 118087N). It is located 7.5km North West of Waterford City and 7.5km East of . Drawing “KK-WWDL-840-A.2.1” details the geographical location of Kilmacow, highlights some of the main roads and identifies the location of the waste water treatment plant which will serve the agglomeration.

A.3 Plant & Agglomeration Operation

The plant in Kilmacow is just newly built and it accepted some flows on the 28th July 2010. The plant is in operation but the number of connections to the scheme is still at an early stage. The WWTP was constructed as a Design Build & Operate Scheme. The pipe network is fully built and ready for operation. Once operational Kilkenny County Council will be responsible for the Network and the Operation of the plant For inspection purposes only. Consent of copyright owner required for any other use. will be the responsibility of the DBO contractor, EPS, Mallow, Co. Cork. The WWTP will treat influent for the whole village of Kilmacow as denoted in the Agglomeration Drawing KK-WWDL-840-B.1.1. It is expected that each household and business will connect to the scheme but until confirmation of this, the agglomeration boundary is unconfirmed. Once all the connections are confirmed then a confirmation of the agglomeration boundary will be added to the application.

24 hour composite samplers are provided as part of the contract. The Design Build Operate contract allows for 52 samples a year to be taken by EPS plus an additional 12 samples that are sent to an independent laboratory for testing.

A.4 Plant & Agglomeration Supervision

The WWTP will have a caretaker from the DBO contractors. The Agglomeration has a part-time caretaker from Kilkenny County Council.

KILMACOW SEWERAGE SCHEME

1. Introduction:

1.1 This County Managers report has been prepared for submission to Kilkenny County Council in order to comply with Section 179, Part XI of the Planning and Development Act 2000 and the provisions of Part 8 of the Planning and Development Regulations 2001 and deals with the Waste Water Treatment Plant element of the proposed Kilmacow Sewerage Scheme.

1.2 The full scheme includes the:  Construction of a new Waste Water Treatment Plant and access road.  Construction of 2 no. submersible Sewage Pumping Stations.  Construction of new rising mains and gravity sewers.

1.3 The scheme was originally advertised in the ‘Kilkenny People’ and ‘Munster Express’ on week ending 9th March 2001. The scheme received approval from the Council Members at the Ordinary Meeting held on the 21st May 2001.

This 2001 proposal included a general arrangement plan drawing showing an extended aeration treatment plant. This was only an indicative layout and did not include cross sections showing either underground or overground tanks. 1.4 The scheme was subsequently advertised in the ‘Kilkenny People’ and ‘Munster Express’ on week ending 23rd December 2005 as the 2 no. proposed Submersible Sewage Pumping Stations were relocated. Approval was received from the Council Members at the Ordinary Meeting held on the 20th March 2006.

1.5 The scheme was subsequently advertised in the ‘Kilkenny People’ and ‘Munster Express’ on week ending 13th June 2008, as the proposals submitted under the DBO Tender Process for the Waste Water Treatment Plant could not rely on the Part X Approval by the Council

1.6 Due to a potential legal challenge, in relation to the location of the public notice on site for the Part 8 Planning application advertised on 13th June 2008, the scheme was readvertised on 3rd June 2009 (see copy of Newspaper Public Notice appendix A).

1.7 In section 4 details of the recommendation to proceed with the project are outlined and the bases for the decision made are given.

2. Project Description:

2.1 Brief Description of the Proposed Works The project involves the construction of a new Waste Water Treatment Plant and access road. This approval application refers to the Wastewater Treatment Plant element of the scheme (see drawings – appendix F) of which the principal features include:-

 Control Building  2 no. Sequence Batch Reactor Tanks (SBR)  Inlet works including flume and screens  Picket Fence Thickener  Storm Tank

The full scheme involves the construction of 2 no. Submersible Sewage Pumping Stations, and the construction of new sewage rising mains and gravity sewers (see layout map of Scheme appendix E), which have already been approved as outlined in section 1.

3. Implications for Proper Planning and Development

In the 2008 County Development Plan it is the policy of the Council to extend waste water treatment to meet the expanding domestic, commercial and industrial needs of the County.

Kilmacow currently has no public sewerage scheme. All buildings and commercial developments are served by individual septic tanks or other means of waste water disposal. The proposed treatment Plant will allow for the treatment of all existing developments in the Kilmacow area to an acceptable standard.

The proposed development is consistent with the proper planning and sustainable development of the area in which it would be located, and is in conformity with the current Kilkenny County Development Plan 2008 – 2014 and the Draft Kilmacow Local Area Plan 2009-2015 as outlined in the Senior Planners report.

4.1 Publicity for Scheme Kilkenny County Council advertised its intention to carry out this scheme in the ‘Irish Independent’ Newspaper on 3rd June 2009, inviting interested parties to make written submissions or observations in respect of the scheme insofar as it affected the proper planning and development of the area. Also the Environmental Impact Report including drawing showing the Proposed WWTP General Arrangement for the proposed Sewerage Scheme were on public display in Water Services Office, County Hall, John Street, Kilkenny and at Kilkenny County Council Area Office, Newrath, Waterford from the 3rd June 2009 to 30th June 2009.

4.2 It should be noted that the primary purpose of this Part 8 procedure is to seek permission for revisions to previously approved Waste Water Treatment Plant, as the proposals submitted under the DBO Tender Process for the Waste Water Treatment Plant could not rely on the Part X Approval by the Council Members at the Ordinary Meeting held on the 21st May 2001 as planning consent for the project (see copy of Newspaper Public Notice appendix A) and also to overcome the potential legal challenge, in relation to the location of the public notice on site for the Part 8 Planning application advertised on 13th June 2008.

4.3 The following is a list of bodies who were invited to make written submissions or observations on the proposed development, dealing with the proper planning and development of the area in which the Waste Water Treatment Plant is located

5. Issues

5.1 Issues raised in submissions.

5.2 Managers Response to issues raised

Section 2.2.3 of the Environmental Impact Report (June 2009) proposes that the WWTP be carried out in two distinct phases. It will not now be necessary to proceed with Phase 2 and it is proposed to only proceed with Phase 1 i.e Treatment Plant capacity for 2,500 pe.

5.2.2 Visual Impact: A preliminary design has been completed for the WWTP and the General Arrangement Drawing Y4327/PL/113 and the Typical Site Sections Drawing Y4327/PL/112 showing the Part 8 Planning proposal as against the Now Proposed are contained in appendix F. The following are some of the changes which have been made:-  Replacement of Aeration Tanks (3no.) and Clarifier tanks (3 no.) by SBR tanks (2 no).  Rearranged layout of tanks on site.  Reduced diameter of SBR tanks from 18.1m to 11.94m  Reduction in height of SBR tanks from 5.6m to 4.264m  Relocation of storm tank, picket fence thickener, control building and inlet works

These proposed changes to the plant layout, together with a comprehensive landscape proposal as already outlined in the EIR will have the effect of ensuring that the proposed plant has minimal visual impact on the area.

5.2.3 Odours & Noises: The DBO Contract Documents have been written in accordance with SI 787 of 2005 (European Communities (Waste Water Treatment) (Prevention of Odours and Noise) Regulations 2005) and states the following:

Odour: The WWTP will be designed so that it does not give rise to odour nuisance and a performance standard of 2 ou/m3 on a 98%-ile basis at the boundary to the plant, is specified. This initial performance standard will be reviewed by the Liaison Monitoring Committee (LMC*) to ensure that odour nuisance does not occur. * (LMC consists of a Director of Services or their appointee, KCC Senior Engineer, Contractors Representative and the Plant Manager). Odour sampling analysis using olfactometry shall be carried out upon commencement of the O&M Contract and then on request of the Local Authority.

Noise: Noise levels shall be within the measures set out in the Environmental Impact Report, which was available for inspection by the public as required by the Part 8 planning process. This states that the noise at the site boundary shall be limited to the following:-

Noise monitoring shall be carried out upon commencement of the Operation and Maintenance (O&M) Contract and then on request by the Local Authority. Noise shall be monitored at the site boundaries. Noise shall be monitored at different locations and on different boundaries on consecutive tests;

The failure of the Contractor to implement the Operation and Maintenance Phase in accordance with the Employers requirements above will result in penalties being imposed on the Contractor as detailed below:-

Failure to Prevent Environmental Nuisance The Contractor is required to manage the facilities in a manner that ensures there is no environmental nuisance caused. Specifically the Contractor is obliged to maintain specified standards for certain types of potential environmental nuisance, including odour and noise, and is

EPA Export 27-07-2013:23:21:01 otherwise generally obliged to minimise negative environmental impacts and prevent environmental nuisance as detailed above.

In the event that complaints are received with regards to noise and odour, the Project Management System (PMS) complaints procedure will be implemented and the Local Authority will instruct the Contractor to investigate the complaint and if necessary undertake noise and odour surveys and provide an appropriate solution (if appropriate).

Notwithstanding the Contractors responsibilities under the DBO contract in relation to environmental nuisance, Kilkenny County Council as owners of the plant will be directly answerable to the EPA in respect of any environmental nuisance should it occur.

Failure by the Contractor to manage the environmental impacts of the facilities in a proper manner will result in the implementation of penalties. The penalties, to be deducted from the monies due to the Contractor, will be subject to a minimum value of €1,500 for each day on which negative impacts or nuisances occur.

5.2.4 Proximity to adjacent dwellings: The EPA Wastewater Treatment Manual for Treatment Systems for Small Communities, Business, Leisure Centres and Hotels Table 4 gives a recommended minimum distances from Treatment Systems and for populations above 161PE the distance from existing development is 50 meters. The closest permitted dwellings to the plant are those granted under P05/997 and P08/356. When applying for planning permission, both applicants were aware that the subject site had been earmarked for a Waste Water Treatment Plant. The dwelling is approximately 90m from the boundary of the WWTP site and 103m from the nearest unit. Planning permission 08/356 was granted for a new dwelling adjacent to the entrance to the WWTP. Construction has not commenced on this site but the site layout drawing shows the dwelling to be located 71m from the boundary of the WWTP site and 87m from the nearest unit (see attached drawing Y4327/PL/114 appendix F). The closest distance of any permitted dwelling to any unit of the treatment plant is 87m and this is considered acceptable.

5.2.5 Underground Tanks: Since the original Part 10 Planning application in May 2001 there have been significant advances in wastewater treatment technologies and the installation of wastewater package plants for small communities is now standard industry practice. The benefit of package plants is the standardisation of equipment and technologies which creates economies of scale and faster onsite installation times as most of the plant and equipment including tank structures are manufactured off-site and then are erected above ground which saves on expensive excavation and

EPA Export 27-07-2013:23:21:01 reinforced concrete costs. The benefits, of having tanks and equipment above ground, is that the plant and equipment is easily accessible for maintenance purposes. The overall benefit of package plants is that they can be constructed efficiently at reasonable cost and are easily maintained due to the above ground structures. This ability to reduce costs has considerable impact on the feasibility of projects and in many cases permits projects to proceed, which otherwise might have been considered too costly and not representing value for money

5.2.6 Importing of sewerage from outside: The WWTP has not been designed to accept imports of sewerage from outside the catchment area. Although operated by a private company, the plant will remain in the ownership of Kilkenny County Council and can only be used for Council approved operations. There is no proposal to accept any effluent or commercial waste from outside the catchment area.

5.2.7 Landscaping An allowance is included in the tender documents to provide the following at design stage :-

Site layouts will be provided detailing the extent of landscaping to be provided. The layout should indicate the species and number of the various plants, the soft and hard landscaping surfaces. This is to be reviewed & approved by the Employer/Employer’s Representative.

Maintenance of Landscaping is included within the operational and maintenance phase in accordance with the Project Management System (PMS). 5.2.8.Traffic During the construction period there will be a moderate increase in traffic. It is a requirement of the contract that the Contractor will be required to implement a traffic management plan to ensure the safety of his workforce and the general public. During the normal operation and maintenance phase of the project there will be a negligible number of vehicles visiting the WWTP.

5.2.9 Archaeology An archaeological desktop study was carried out assessing the Archaeological potential of the WWTP site. A copy of the study was included in the Environment Impact Report (EIR). An allowance is included in the tender documents to undertake any necessary archaeological investigation in line with the DoEHLG requirements.

EPA Export 27-07-2013:23:21:01 5.2.10 Employment The proposed WWTP will facilitate the general socio-economic development of Kilmacow i.e. population growth and associated commercial activities. The area will be expected to benefit from:-  increased construction activity in the housing sector  potential increases in related commercial and service activities  increased employment in the general region.

5.2.11 Natural Environment The proposed WWTP will result in a significant reduction in untreated wastewater discharging to the River Blackwater and a consequential improvement in water quality in the river. An Ecological Assessment on the existing freshwater flora and fauna of the River Blackwater adjacent to the proposed WWTP was carried out in August 2005 to:-

 provide baseline data against which future changes can be assessed  Assess the potential impact of the proposed WWTP on water quality and aquatic flora and fauna  To suggest mitigation measures where negative impacts are possible.

I have examined the above proposal for the Kilmacow Sewerage Scheme – Waste Water Treatment Plant

The proposed scheme will receive the wastewater from the collection system in Kilmacow village, treat it and discharge to the Blackwater River.

The EIS for WWTP proposes that it be delivered in two distinct phases:

Phase 1:

Design build and operate and maintain a treatment plant with a population equivalent ( PE )of 2,500.

Phase 2:

Design build operate and maintain for the increase capacity of the treatment plant to accommodate a population equivalent ( PE ) of 5,000

Planning History

Kilmacow sewerage treatment plant was passed by the Council under Part X of the Local Government (Planning and Development) Regulations, 1994 in May 2001.

The scheme proposed at that time was:  Construction of a new sewerage treatment works and access road  Construction of 2 no. submersible sewage pumping stations.

Since the original approval there have been advances in wastewater treatment technology which has resulted in changes to the design of the proposed plant. A revised Part 8 under the Local Government Planning & Development Regulations 2001 was approved by the Council in 2008.

EPA Export 27-07-2013:23:21:01 An issue arose with the Part 8 approval in connection with the adequacy of the site notice.

The Water Services section of the Council took the view to embark on this current Part 8 procedure in order to rectify any inadequacies there may have been with the previous Part 8 approval.

Development Plan

The County Development Plan was adopted by the Council on the 16th June 2008.

In the 2008 County Development Plan it is the policy of the Council to extend waste water treatment to meet the expanding domestic commercial and industrial needs of the County.

There is a specific policy in the County Development Plan as follows:

RD1 : To implement the Council’s investment programme for waste water treatment and water supply schemes in the towns and villages and rural areas of the County.

There is a Local Area Plan for Kilmacow currently on public display until the 31st July. The Local Area Plan is based on the assumption that the existing deficiencies in relation to waste water treatment will be resolved during the life of that Plan.

Kilmacow currently has no public sewerage scheme. All buildings and commercial developments For inspection are served purposes only.by individual septic tanks or other Consent of copyright owner required for any other use. means of waste water disposal.

The proposed treatment plant will allow for the treatment of all existing developments in the Kilmacow area to an acceptable standard.

The settlement strategy within the County Development Plan does not envisage Kilmacow having major residential expansion into the future and the draft Local Area Plan supports and reinforces that strategy.

It is therefore recommended that this current Part 8 should only cover approval for Phase 1 of the proposed scheme, i.e. a population equivalent of 2,500.

Section 3.3.2 of the environmental report proposes the production of a landscape plan as part of the development.

Any landscape plan for the proposed development should be agreed with the Council’s landscape architect in order to minimize the visual impact of the development.

(i) Managers Report on Submissions to Proposed Amendments to the Draft Local Area Plan. At this stage Cllr. Pat O’ Neill excused himself from the meeting. A presentation was made by Caitriona Reilly Executive Planner who briefly outlined the report.

A discussion took place regarding submission PAB6. This related to the Proposed Variation which rezoned an area of land adjacent to the River Nore from Residential to Open Space on the grounds that it may form part of a flood plain and may be subject to flooding.

Following a debate on this matter the County Manager Joe Crockett agreed that if it was the case that a more detailed flood risk assessment was submitted which proved that the site is not at risk from flooding, the zoning could be subject to review. It was agreed that a statement would be put into the Manager’s Report to this effect.

A request was made to include an objective in the LAP for the provision of a footpath from Kilree to Bennettsbridge. The Proposed Variations include this objective and it was not necessary to modify this.

Number 10.206658), pursuant to Planning Application Reference 03/1739 issued by An Bord Pleanala. The amendment is sought to permit non-agricultural related events within the area defined as the “HUB” @ Cilin Hill, Leggetsrath East, Kilkenny”.

(i) Finance Update Before commencing discussion on this item. Members commented on the extract from the report of the special group on public service numbers and expenditure programmes which had been circulated in advance of this meeting. This extract dealt with Environment, Heritage and Local Government. Members contributing unanimously rejected any proposals circulated in the media to amalgamate the counties of Carlow and Kilkenny. The County Manager pointed out to members that there was no specific mention of what counties where to be amalgamated. The meeting discussed the recent resolution by Kilkenny Borough Council to extend the Kilkenny Borough Boundary. It was agreed that this issue be parked for the time being pending further clarity on the contents of the report and clarification as to what aspects of the report central government intend to implement. It was proposed by Cllr. T. Breathnach, Seconded by Cllr. P. O’ Neill and resolved:- “That the party whips meet with a view to fixing a date for a special joint meeting of Kilkenny County Council and Borough Council’s to discuss Kilkenny Local Authorities response to the proposals contained in this report”.

Following on from this discussion, the County Manager Joe Crockett outlined to members the report dated 13th July, 2009 which had been circulated to them. Amongst the main headings of the report were:-  The details of the adopted 2009 Budget  Current operational projections – operational budget which highlighted the main elements of the 1.6million income shortfall.  The higher then expected bad debt and rates strike off costs amounting to €400,000.  The current 2009 projections on development contributions which showed that given the severity of the down turn almost all development activity is stopped.  2010 expectations  He also drew member’s attention to the attached schedule showing the 2009 budgeted expenditure reductions.

He informed the meeting that he would be reverting to them with a revised capital programme factoring in what money was expected from central government. In response to a query raised the County Manager confirmed that the charge on 2nd houses would be collected and advertised nationally. With regard to the recently published reports proposed cut in the Department of Environment funding nationally of €100million to local government, he informed the meeting that this represented an approximate decrease of 25%. (c) Corporate Affairs - Gnóthaí Corparáideacha (i) Report regarding necessary bye laws to prohibit the consumption of alcohol in all public/amenity areas A discussion took place regarding the advice received from Kilkenny County Council’s legal advisors. Following same it was agreed that this matter be referred to SPC 5 for drawing up of the necessary bye laws. It was agreed that the Council legal advisor would be invited to attend the next meeting of SPC 5 and that other

(ii) Pandemic Influenza- Business Continuity Planning – Overview. The County Manager informed the meeting that Kilkenny County Council are taking steps for training of staff to cover the areas of water, waste water and fire service i.e. the most essential services in Kilkenny County Council. He confirmed that the flu virus now had full pandemic status but that the nature of the flu was at present relatively mild. In response to a query from Cllr. P. Crowley he confirmed that he was as yet unsure as to the timing of the widespread availability of the necessary vaccine. (iii) Draft Strategic Policy Committee Scheme. Proposed by Cllr. M. H. Cavanagh, Seconded by Cllr. M. Shortall and resolved:- “That the Draft Strategic Policy Committee Scheme which had been circulated in advance of this meeting for the period 2009-2014 be and is hereby approved”. The Cathaoirleach informed the meeting that on a trial basis of 6 months, the party whips were being invited to attend Corporate Policy Group meetings. (iv) Appointment of 13 members to Kilkenny County Joint Policing Committee – Item deferred from the Annual Meeting The meetings administrator confirmed that under the guidelines pertaining to membership of joint policing committees this number of members could be increased to 14 with the addition of the Cathaoirleach as an ex officio member of the committee. Accordingly it was proposed by Cllr. M. H. Cavanagh, seconded by Cllr. M. Doran: - “That the following members be Kilkenny County Council’s nominations to the Joint Policing Committee: - Cllrs. M. O’ Neill and resolved:- “That Kilkenny County Council now commences the procedures required to gain legal approval for this Abstraction, culminating in an Abstraction Order under the Water Supplies Act 1942, as amended”. (ii) Part 8 – Kilmacow Sewerage Scheme WWTP. Proposed by Cllr. T. Breathnach, Seconded by Cllr. C. Long and resolved:- That Kilkenny County Council hereby agrees to proceed with the development in accordance with the Manager’s Recommendation including the modifications outlined on Page 13 of the Planning Report subject to the following additional modifications being included as integral to this Recommendation. 1. Pat Crowley. (c) Report on Piltown Electoral Area Meeting held on 9th July, 2009 It was noted that Cllr. P. Dunphy had been elected as the new chair of the Piltown Electoral Area. Amongst the items raised by members was the issue regarding the lack of wheelchair access facilities on some Bus Eireann vehicles and the raising of concerns regarding the location of some bus stops in the area which were considered to be unsafe. It was agreed that both of these items would be directed for discussion to the Council’s SPC for Transportation.

CERTIFICATE

I have examined the above proposal for the Kilmacow Sewerage Scheme – Waste Water Treatment Plant

The proposed scheme will receive the wastewater from the collection system in Kilmacow village, treat it and discharge to the Blackwater River.

The EIS for WWTP proposes that it be delivered in two distinct phases:

Phase 1:

Design build and operate and maintain a treatment plant with a population equivalent ( PE )of 2,500.

Location The site is located in Lower Kilmacow on the west bank of the river Blackwater.

Planning History

Kilmacow sewerage treatment plant was passed by the Council under Part X of the Local Government (Planning and Development) Regulations, 1994 in May 2001.

The scheme proposed at that time was:  Construction of a new sewerage treatment works and access road  Construction of 2 no. submersible sewage pumping stations.

EPA Export 27-07-2013:23:21:02 Since the original approval there have been advances in wastewater treatment technology which has resulted in changes to the design of the proposed plant. A revised Part 8 under the Local Government Planning & Development Regulations 2001 was approved by the Council in 2008.

An issue arose with the Part 8 approval in connection with the adequacy of the site notice.

The Water Services section of the Council took the view to embark on this current Part 8 procedure in order to rectify any inadequacies there may have been with the previous Part 8 approval.

Development Plan

The County Development Plan was adopted by the Council on the 16th June 2008.

In the 2008 County Development Plan it is the policy of the Council to extend waste water treatment to meet the expanding domestic commercial and industrial needs of the County.

There is a specific policy in the County Development Plan as follows:

RD1 : To implement the Council’s investment programme for waste water treatment and water supply schemes in the towns and villages and rural areas of the County.

There is a Local Area Plan For inspectionfor Kilmacow purposes only. currently on public display until the st Consent of copyright owner required for any other use. 31 July. The Local Area Plan is based on the assumption that the existing deficiencies in relation to waste water treatment will be resolved during the life of that Plan.

Kilmacow currently has no public sewerage scheme. All buildings and commercial developments are served by individual septic tanks or other means of waste water disposal.

The proposed treatment plant will allow for the treatment of all existing developments in the Kilmacow area to an acceptable standard.

The settlement strategy within the County Development Plan does not envisage Kilmacow having major residential expansion into the future and the draft Local Area Plan supports and reinforces that strategy.

EPA Export 27-07-2013:23:21:02 It is therefore recommended that this current Part 8 should only cover approval for Phase 1 of the proposed scheme, i.e. a population equivalent of 2,500.

Section 3.3.2 of the environmental report proposes the production of a landscape plan as part of the development.

Any landscape plan for the proposed development should be agreed with the Council’s landscape architect in order to minimize the visual impact of the development.

Application to the Environmental Protection Agency for a Waste Water Discharge Licence

In accordance with the requirements of Sections 9 and 11 of the above Regulations Kilkenny County Council hereby gives notice of the Council’s intention to make an application to the Environmental Protection Agency for a Discharge Licence. The application shall be made within a period of two weeks from the date of publication of this notice and not later than 22nd December 2010.

The Discharge Licence application relates to the discharge from the Kilmacow Agglomeration which is served by Kilmacow Waste Water Treatment Plant, Kilmacow, Co. Kilkenny (256813E, 117244N). The sole discharge point from the plant discharges directly to the River Blackwater at Kilmacow, Co. Kilkenny, (256826E, 117321N).

Kilmacow Waste Water Treatment Plant treats wastewater influent from Kilmacow Agglomeration, wastewaters are supplied by Pumping Stations from the agglomeration. The sewer network includes two pumping stations and three storm water overflows, one of which is located at the treatment plant.

A copy of the application, together with such further information relating to the application as may be furnished to the Agency, shall be made available, as soon as is reasonably practicable post receipt, for public inspection or purchase at the Agency’s headquarters, Johnstown Castle Estate, County Wexford.

As this is a Design Build Operate scheme, the sampling is carried out by the contractor and forwarded to Kilkenny County Council. The Design Build Operate contract allows for 52 samples a year to be taken by EPS plus an additional 12 samples that are sent to an independent laboratory for testing.

As the plant only commenced in late July this year with very little flows there is very little sampling data to date. Kilkenny County Council intends to carry out some more sampling, both routine & dangerous substances on the effluent as well as the river once the wastewater treatment plant is operational in full.

Until this time Kilkenny County Council are not in a position to give an answer on the Impact on Receiving Surface Water. We intend to have this submitted to the Agency no later than June 2011.
