Cupar Sheriff Court Aliment Decrees, 1830 - 1854

When an unmarried woman gave birth to an illegitimate child, very often she brought an action against the father for aliment, claiming for inlying expenses, whilst she was pregnant, and also for financial support for the child. These expenses varied from case to case, but usually inlying expenses were awarded at around £2, and child aliment at around £5 yearly, until the child reached 10-12 years. Damages were also awarded for breach of promise (marriage), and these were higher if aggravated by an illegitimate birth; in the listing below damages of £60, £100 and £200 have been awarded. If the woman could not afford the cost of the action, very often she would petition for admission to the Poor Roll, and the Court would appoint a Procurator for her (an early form of legal aid).

There now follows a list (quite extensive) of aliment actions brought in the period 1830-54, and recorded in the Extract Decree Books of Cupar Sheriff Court (Ref: SC20/4, Books 17 to 28),- now held at the Scottish Record Office in Edinburgh.

They are1isted under the name of the pursuer (mother) only.

In the listing below, the mother's name and designation are given first, then v for versus, followed by the father's name and designation. Then comes the child (male/female) and date of birth; and then the reference. Only an abbreviated reference has been given, 4/17, 4/18, etc. This should be prefixed by SC20 for the full reference. This is followed by the page number, and then by the decree number in brackets. Be aware that 4/27 is in 2 halves, with same page numbers in each half.

It is possible that a process of the action may still have survived; check the process boxes of Cupar Sheriff Court, held at Scottish Record Office (West Register House).

The listing below has been taken up to the end of 1854 and beginning of 1855, when Statutory Registration began. If you have an illegitimate ancestor born after then, it will still be worth checking the Extract Decree Books to see if an aliment action was brought.
