P. Venkat Reddy, Suryapet District Respondent : Public Information Officer (U/RTI Act, 2005) O/o the Primary Agricultural Cooperative Society, Palakeedu Mandal, Suryapet District. Order Sri. P. Venkat Reddy, Suryapet District has filed a complaint dated 17-12-2018 which was received by this Commission on 18-12-2018 for not getting the information sought by him from the PIO / O/o the Primary Agricultural Cooperative Society, Palakeedu Mandal, Suryapet District. The brief facts of the case as per the complaint and other records received along with it are that the complainant herein filed an application u/s 6(1) of the RTI Act, 2005 dated 28-03-2018 before the PIO requesting to furnish the below information: Stating that the complainant did not get the information from the Public Information Officer even after 30 days of filing his 6(1) appeal, he preferred this complaint TSICbefore this Commission requesting to direct the PIO to furnish the information sought by him u/s 18(1) of the RTI Act, 2005. The complaint was taken on file and notices were issued to both the parties for hearing on 30-07-2019. The case is called on 30-07-2019. The complainant Sri. P. Venkat Reddy is present and stated that no information was furnished by the PIO. The PIO O/o the Primary Agricultural Cooperative Society, Palakeedu Mandal, Suryapet District is called absent. The Commission perused the material papers on record and found that the complainant addressed 6(1) application to the PIO O/o the Primary Agricultural Cooperative Society, Palakeedu Mandal, Suryapet District. The Commission observed that the PACS does not fall within the ambit of section 2(h) of RTI Act 2005. Note: This is system generated copy and no signature is required. Hence, the Commission advised complainant to file the 6(1) application before the concerned Public Authority seeking information of the concerned PACS with reference to section 2(f) of the RTI Act. In view of the above, the complaint is closed.
