Data sheet, October 2012 Police investigation of vandalization of Palestinian trees in the Yesh Din monitoring data, 2005-2012

Data summary A The human rights organization Yesh Din has since 2005 been monitoring the results of 162 investigation files being conducted by the Israel Police SJ (Samaria and Judea) District concerning the vandalism of Palestinian-owned trees in the West Bank. The vandalism of trees includes incidents in which fruit trees1 have been cut down, uprooted, stolen or damaged. Most of them are olive trees but some are almond, lemon, fig and other trees. Besides the data summary, this report specifies each incident and the results of its investigation.

The current data indicates that of the 162 aforesaid incidents, only one investigation produced an indictment against a person suspected of vandalism against ' trees.2

Yesh Din does not monitor the investigation of every incident in which Israeli citizens are involved in vandalizing Palestinian trees in the West Bank. However, the data presented here relies on a broad sample of investigation files, which allows a representative review of the results of the investigation of the aforesaid crimes. The results of the monitoring indicate an ongoing failure of the SJ District to investigate crimes of tree vandalism: 142 investigation files were closed under circumstances that indicate the failure of the investigators in their investigation.3 Only one investigation (of an incident that occurred in the summer of 2007) yielded an indictment.

The failure of the SJ District police to investigate incidents of tree vandalism is only one aspect of its continuous and broad failure to enforce the law against ideological crimes by Israeli citizens against Palestinians in the occupied territories. Yesh Din's data from the total of investigation files under the organization's monitoring indicates that in less than 9% of monitored files does the investigation conclude with an indictment being submitted4. the state of law enforcement upon Israeli citizens - settlers and others - involved in criminal offenses against Palestinians and their property, Israel continues to abuse its duty to defend the Palestinian civilians in the areas subject to its military occupation. B Incidents of tree vandalism in the years 2005-2012 Of 162 investigation files into vandalization of Palestinian trees under Yesh Din's monitoring: ..One investigation resulted in an indictment;5 ..147 investigation files were closed. Of those: • 124 files were closed on grounds of "perpetrator unknown," which indicates the investigators' failure to locate and identify suspects in committing the offenses; • 16 files were closed on grounds of "insufficient evidence," which indicates the investigators' failure to collect and consolidate sufficient evidence to prosecute the suspects who were located; • two investigation files closed on grounds of "absence of criminal culpability;” • as for five investigation files Yesh Din was not provided with the grounds for their closure. • 11 files are still under investigation; ..the investigation of one incident ended and the investigation material was transferred to a prosecutor’s review to decide whether to submit an indictment or close the investigation file; ..two files were lost and never investigated.

Since our intention in this document is to present data solely on the vandalism of trees, we did not include here incidents of attacks on harvesters during the harvest, theft of fruit (when such theft was not accompanied by vandalism of trees) or vandalism of wheat fields or vegetables. 2. Since this report was issued in October 2011 another 35 incidents were added but not a single indictment was filed. It should be noted that following one incident of stone throwing at the home of a Palestinian family in Hebron and the arson of a tree in the home's yard an indictment was filed against the suspect (this too only after Yesh Din appealed the initial decision to close the file without submitting an indictment against the suspect). However, in this case the arson of the tree was part of the assault incident and therefore is not included in the data presented herewith. 3. The indictment was filed in investigation file ID 1579/07 of the Binyamin Police (Yesh Din file 1280/07). On July 17, 2007 M., a resident of the village of Qaryut, discovered that some 300 olive, apricot and almond trees had been uprooted and stolen from his land. On that very day M. filed a complaint with the Binyamin police. On October 22, some four months later, the investigation file was transferred for the review of a prosecutor in the SJ District prosecution unit. On April 26, 2011 Yesh Din was informed that a draft indictment had been prepared, but only in August 2011, more than four years after the incident, did the prosecution unit inform Yesh Din that an indictment had been filed on charges of trespassing, theft and property damage.
