Downloads/Pressreleases/2007-12-27- Unmin.Srsg.Press.Statement.Eng.Pdf From Peace Settlement to Political Settlement State Restructuring and Inclusive Measures for Marginalised Groups in Nepal Balkrishna Mabuhang IPS Paper 10 Abstract Nepal has been going through a historical momentum since the peaceful settlement of the Maoist Armed Insurgency which resulted from the 2006 Comprehensive Peace Accord (CPA). The Hindu nation, kingdom and monarchy was abolished, replaced by a federal democratic republic. The conflict issues accumulated over the centuries aspired to be resolved in the ongoing state reform process. However, the constitution–making process is yet to be accomplished. The State is still primarily controlled by forces of the old regime, who do not let new aspiring forces become seriously engaged in the discussion over how to resolve the remaining conflict issues. Thus, this paper highlights both the historical and the present condition of power contending forces, with a particular focus on marginalised societal groups and their mobilisation (or instrumentalisation) through the Maoist Insurgency. In addition, this paper seeks to portray the inclusive measures adopted since 2006 to make the State move representative of, and responsive to, the makeup of society. The study relies on secondary information as well as data collected through key informant interviews in three regions of Nepal. It also aims to inform national and international practitioners and policy-makers on effective practices for enhancing participation, representation, and responsiveness in post-war state-building and governance. About the Author Balkrishna Mabuhang is Associate Professor at the Central Department of Population Studies, Tribhuvan University, Nepal. He worked as the General Secretary of the Nepal Federation of Nationalities (NEFEN) from 1999 to 2002. He has also written many articles on Janajati issues in national as well as international publications, and has also participated in national, regional and global forums to raise the issues of the Janajati. This exclusionary system is based on patriarchal norms, the supremacy of Hindu religion and a hierarchical caste system that can be traced back to the very foundation of the State of Nepal in 1779. A number of popular movements1 have attempted to challenge this exclusive State, most remarkably through the Maoist 'People’s War' which began in 1996. This war ended in November 2006 with the signature of a Comprehensive Peace Accord (CPA). The CPA has resolved the immediate and underlying causes of violence through direct mutual engagement by the main conflict parties – the Nepali State represented by the King and the main political parties, and the rebel armed movement formed by the Communist Party of Nepal (Maoist) (CPN (M)). However, these parties have so far been unable to deliver a new constitution due to conflicting interests between the dominating political elites, and between the State and society. In other words, the peace settlement has not yet given way to a new political settlement. Manjushree Thapa, a well-known literary writer, opined: What do you do if you’re the high caste leader of a democratic party faced with a vote that will end your caste’s supremacy? You avoid voting at all costs. This is what the leaders of the Nepali Congress and the Communist Party of Nepal (Unified Marxist and Leninist) did in Kathmandu on May 27 [2012]. Their refusal to compromise with the Unified Communist Party of Nepal (Maoist) and other parties led to the failure to pass a new constitution and the dissolution of the country’s only democratically elected body, the 601-member Constituent Assembly. This was an unforgivable betrayal of public trust: the citizenry had waited for four years for a new constitution that would mark the birth of a “New Nepal”. (Thapa 2012)

In other cultural terms, being Sanyasi means having dissociation himself/herself with whatever caste career or caste-based social rank one might imagine. To explore the philosophical foundation of Sanyasi, they sacrificed caste rituals and fire (symbol of power, desire, and creation). By the virtues of sacrifice, Sanyasi set images of universalism, higher than caste order, and otherworldly being. Therefore, one should not ask the renouncer caste identity. Traditionally, Sanyasi lived in Akhada or Matha,and leadership, including ownership of the Matha transformed from Guru to Chela. On the contrary, DasnamiMahanta started marital and private life, which is paradoxical to the philosophy of Sanyasi.Very few of them are living in Matha,but the ownership of the property of Mathatransformed from father to son. According to a legend, they got their name from a warrior saint, Guru Gorkhanath, who lived 1200 years ago. He had predicted that his people would become world famous for their bravery. The word Gurkha also comes from the name of a city, Gorkha, in western Nepal. Britain tried to invade Nepal when it was trying to conquer the northern parts of India. The British soldiers had fine rifles whilst the Ghurkas were armed only with their traditional knives called Kukris. But the Nepali soldiers were such courageous and clever fighters that the British soldiers could not defeat them, After six months of fighting, Britain decided to make peace with Nepal. The British army began to recruit Gurkha soldiers because they wanted them to fight on their side. Since that day, the Ghurkas have fought alongside British troops in every battle across the world. Nepal became a strong ally of Britain. One hundred thousand Gurkhas fought in the First World War. They fought and died in the battlefields of France in the Loos, Givenchy, Neuve Chapelle and Ypres as well as many other countries. Again the whole of the Nepali army fought for Britain during the Second World War. There were 250,000 Gurkha in total. The were used by the British to put down revolts in India. Gurkhas fought in Syria, North Africa, Italy, Greece and against the Japanese in Singapore and in the jungles of Burma.

First, the reinstated parliament declared the country secular in June 2006, which undermined the religious-political significance attributed to Hindu kings. Second , the Maoists successively signed the Comprehensive Peace Accord with the government (November, 2006), and joined the parliament (January, 2007) and the coalition government (March, 2007). Third, the first historic constituent assembly elections took place (April, 2008). Then the constituent assembly declared the country a republic and formally abolished the monarchy (May, 2008). In other words, a collective upsurge of April 2006, which had started to fight monarchy, ended up abolishing in two years. Thereafter the country headed towards a new phase of history with a collective political thrust for restructuration into a federal republic. The project of restructuring the country through the abolition of Shah Dynasty brought into question the historical recognition of the eighteenth-century unification. Starting in the 1970s, and rapidly increasing since the 2000s, land outside of the Valley’s Newar cities has transformed from agricultural fields into a mixed development of planned and unplanned localities consisting of migrants from the hinterland and urbanites from the city center.
