  • Congress Amends LDA Forms to Require Reporting of Lobbyist Convictions
Congress Amends LDA Forms to Require Reporting of Lobbyist Convictions April 8, 2019 Election and Political Law The recent passage of the Justice Against Corruption on K Street Act of 2018 (“JACK Act” or the “Act”) imposes new requirements on those registering and filing reports under the Lobbying Disclosure Act (“LDA”). The Act amends the LDA to require that LDA registrants disclose listed lobbyists’ convictions for criminal offenses involving bribery, extortion, embezzlement, illegal kickbacks, tax evasion, fraud, conflicts of interest, making a false statement, perjury, or money laundering. Background The JACK Act was inspired by Jack Abramoff, whose alleged corrupt lobbying activities placed him at the center of a political scandal that led to the conviction of more than twenty lobbyists, congressional aides, and politicians. Between 2006 and 2008, Abramoff himself was convicted of crimes including fraud, tax evasion, conspiracy to bribe public officials, and bribery of public officials. After serving four years in federal prison, Abramoff emerged as a purported political reformer, only to begin lobbying again. The Law Congress passed the JACK Act in response to Mr. Abramoff’s post-prison lobbying activities, in order to shed light on registered lobbyists with prior convictions. The Act specifically amends the LDA’s registration (form LD-1) and quarterly reporting (form LD-2) requirements to require registrants to report the date of conviction and a description of the offense “for any listed lobbyist who was convicted in a Federal or State court of an offense involving bribery, extortion, embezzlement, an illegal kickback, tax evasion, fraud, a conflict of interest, making a false statement, perjury, or money laundering.” Those who violate the JACK Act’s requirements are subject to the civil and criminal penalty provisions of the LDA.

Page printed from: http://www.law.com Back to Article DOJ Keeps Pressure on Former Abramoff Associate in Corruption Prosecution Mike Scarcella 07-07-2010 Just two weeks after the U.S. Supreme Court narrowed the scope of the honest services fraud laws, Justice Department attorneys Tuesday said they are pushing forward on the corruption prosecution of ex-lobbyist Kevin Ring, a former Jack Abramoff associate who is charged in a bribery scheme. At a hearing Tuesday in Washington federal district court, Public Integrity Section trial attorney Peter Koski said the high court's June 24 ruling in Skilling v. United States has "no impact whatsoever" on the prosecution of Ring. The Supreme Court in Skilling said the honest services law can reach only bribery and kickback schemes. Judge Ellen Segal Huvelle said she has a different take. The once wide-open honest service fraud statute "is not an unlimited category now," the judge said Tuesday. She said the "arena" today is different than when charges were first brought against Ring. There's a new definition of bribery and materiality, the judge said. Huvelle on Tuesday gave Ring's attorneys -- he is represented by a Miller & Chevalier team -- more time to file an amended motion for judgment of acquittal. Ring's trial last fall ended in a hung jury. Ring, a former lobbyist at Greenberg Traurig and then, later, at Barnes & Thornburg, could be retried this fall in the U.S.

  • The End of Economics, Or, Is
THE END OF ECONOMICS, OR, IS UTILITARIANISM FINISHED? By John D. Mueller James Madison Program Fellow Fellow of The Lehrman Institute President, LBMC LLC Princeton University, 127 Corwin Hall, 15 April 2002 Summary. According to Lionel Robbins’ classic definition, “Economics is the science which studies human behavior as a relationship between ends and scarce means that have alternate uses.” Yet most modern economists assume that economic choice involves only the means and not to the ends of human action. The reason seems to be that most modern economists are ignorant of the history of their own discipline before Adam Smith or Jeremy Bentham. Leading economists like Gary Becker attempt to explain all human behavior, including love and hate, as a maximization of “utility.” But historically and logically, an adequate description of economic choice has always required both a ranking of persons as ends and a ranking of scarce goods as means. What is missing from modern economics is an adequate description of the ranking of persons as ends. This is reflected in the absence of a satisfactory microeconomic explanation (for example, within the household) as to how goods are distributed to their final users, and in an overemphasis at the political level on an “individualistic social welfare function,” by which policymakers are purported to add up the preferences of a society of selfish individuals and determine all distribution from the government downwards, as if the nation or the world were one large household. As this “hole” in economic theory is recognized, an army of “neo-scholastic” economists will find full employment for the first few decades of the 21st Century, busily rewriting the Utilitarian “economic approach to human behavior” that dominated the last three decades of the 20th Century.

“ … measuring him by the sentiment of his country, a sentiment he was bound as a statesman to consult, [Lincoln] was swift, zealous, radical, and determined.” — FREDERICK DOUGLASS, APRIL 14, 1876 LINCOLN AT PEORIA The Turning Point by Lewis E. Lehrman Lincoln at Peoria: The Turning Point explains how Lincoln’s speech at Peoria on October 16, 1854 was the turning point in the development of his antislavery campaign and his political career and thought. Here, Lincoln detailed his opposition to slavery’s extension and his determination to defend America’s Founding document from those who denied that the Declaration of Independence applied to black Americans. Students of Abraham Lincoln know the canon of his major speeches — from his Lyceum Speech of 1838 to his “Final Remarks” delivered from a White House window, days before he was murdered in 1865. Less well-known are the two extraordinary speeches given at Springfield and Peoria two weeks apart in 1854. They marked Mr. Lincoln’s reentry into Book Information the politics of Illinois and, as he could not know, his preparation for the U.S. History Hardcover Presidency in 1861. These Lincoln addresses catapulted him into the July 2008 debates over slavery which dominated Illinois and national politics for the $29.95 rest of the decade. February 11, 2016 VIA CERTIFIED MAIL The Honorable Charles Grassley Chairman The U.S. Senate, Committee on the Judiciary 224 Dirksen Senate Office Building Washington, D.C. 20510-6050 The Honorable Jason Chaffetz Chairman The U.S. House of Representatives, Committee on Oversight and Government Reform 2157 Rayburn House Office Building Washington, D.C. 20515 Dear Chairmen Grassley and Chaffetz: I write on behalf of Cause of Action Institute, a strategic oversight group committed to ensuring that government decision-making is open, honest, and fair. As you are aware, former Secretary of State Hillary Clinton used a private email system during her tenure to conduct official government business. That conduct violated federal recordkeeping guidelines and regulations established under the Federal Records Act, jeopardized the security of classified information, and obstructed citizen oversight by frustrating numerous Freedom of Information Act requests. Cause of Action Institute has been following and investigating this matter ever since it was first reported in the New York Times last year.1 A new development in this saga has recently come to our attention. We have learned that some of Mrs. Clinton’s aides and ex-campaign staffers from her 2008 bid for the Democratic nomination for president, who followed her to the United States Department of State (“State Department”), continued to use communication devices and email accounts associated with Mrs. Clinton’s presidential campaign committee during their subsequent employment at the State Department. Former campaign staff used these campaign devices and email accounts to communicate on official channels and co-mingle agency records with their personal communications.
