The sub-volumes refer to the areas Migration, Imprisonment, Police and Justice, Gender Policy, Child and Youth Policy, Institutional Issues, as well as Business and Human Rights. The study analyses the commitments arising from the United Nations and Council of Europe human rights treaties ratified by Switzerland, the recommendations of the supervisory bodies and the UN Human Rights Council that are based on these agreements and issued in the course of the Universal Periodic Review (UPR), as well as the decisions against Switzerland in individual cases made under these treaties. In drafting the sub-studies, the recommendations and decisions were collected and substantially evaluated, and specific focal points were defined for every subject area. Except in the sub-study on Business and Human Rights, the evaluation was limited to the topics addressed by international human rights bodies – other problem areas in the human rights implementation were not further analysed. On the basis of the information gathered, the study evaluates the current state of the implementation of obligations and recommendations in Switzerland, demonstrates the difficulties in the implementation, and defines the current need for action. Moreover, the results from previous consultations with selected authorities, non- governmental organisations (NGO), and other relevant actors were also incorporated into this study. The Study on Human Rights Implementation in Switzerland represents a snapshot of the current situation. The present sub-study on Business and Human Rights takes decisions and developments up to July 2013 into account. The SCHR studies and all information on its further activities are available on the SCHR website, http://www.scehr.ch. The SCHR is a network consisting of the universities Berne, Fribourg, Neuchâtel and Zurich as well as the Institut Universitaire Kurt Bösch (IUKB), the Center of Human Rights Education (ZMRB) at the University of Teacher Education Central Switzerland – Lucerne (PHZ Lucerne), and the association http://www.humanrights.ch/MERS. The SCHR is a pilot project limited to five years and mandated by the Federal Council to strengthen and support capacities with regard to the implementation of international human rights obligations in Switzerland on all levels of the political system, the civil society, and the corporate sector, as well as to advance the public debate on human rights. To this end, the Centre will mainly author studies and expert reports, hold conferences, provide information, and offer continued education and trainings. It does not, however, offer any consultation services for individual cases. In the scope of its yearly performance mandate, the SCHR is financed with a basic contribution by the Federal Department of Foreign Affairs (FDFA) and the Federal Department of justice (FDJP). Moreover, the SCHR is supported by mandates from public authorities, NGOs and private businesses, as well as the resources of the network institutions. This Study on Human Rights Implementation in Switzerland is based on the SCHR’s own initiative, and the network partners financed its publication. At the end of the pilot phase in 2015, the Swiss Federal Council will decide on the future of the SCHR, and consider whether the Centre should be converted into an independent human rights institution. A specific route for the line is to be entered into the Zug Cantonal Development Plan so as to secure a long- term option on the project’s realization and to prevent any development that would prevent the project’s realization. The high-voltage (380/220kV) overhead transmission line that runs between the substations in Mettlen (Lucerne) and Benken/Grynau (St. Gallen) is a part of the Swiss national and European transmission grid. The transmission line passes through and depreciates residential areas in the Canton of Zug and also compromises the attractiveness of the landscape. In fact, landscapes that have been entered in the Swiss Federal Inventory of Landscapes and Natural Monuments (BLN) are affected to a considerable degree. The Canton of Zug is therefore determined to underground the transmission line as soon as the opportunity presents itself. Feasibility study to determine the best transmission route Working together with Axpo Netze AG, EBP has carried out a feasibility study to determine the most suitable transmission route for the project. The study’s aim was to identify and ascertain the technical, operational and zoning feasibility of possible routes for the transmission line, while ensuring environmental compatibility.

It shows that municipal self- government is particularly deeply rooted in Switzerland. All municipalities possess a wide range of powers and responsibilities and substantial rights of self-government. The financial situation of Swiss municipalities appears generally healthy, with a relatively low debt ratio. Direct-democracy procedures are highly developed at all levels of governance. Furthermore, the rapporteurs very much welcome the Swiss parliament’s decision to authorise the ratification of the Additional Protocol to the European Charter of Local Self-Government on the right to participate in the affairs of a local authority. The report draws attention to the need for improved direct involvement of municipalities, especially the large cities, in decision-making procedures and with regard to the question of the sustainability of resources in connection with the needs of municipalities to enable them to discharge their growing responsibilities. Finally, it highlights the importance of determining, through legislation, a framework and arrangements regarding financing for the city of Bern, taking due account of its specific situation. The Congress encourages the authorities to guarantee that the administrative bodies belonging to intermunicipal structures are made up of a minimum percentage of directly elected representatives so as to safeguard their democratic nature.

    SWITZERLAND 2017 HUMAN RIGHTS REPORT EXECUTIVE SUMMARY The Swiss Confederation is a constitutional republic with a federal structure. Legislative authority resides in a bicameral parliament (Federal Assembly) consisting of the 46-member Council of States and the 200-member National Council. Federal elections in 2015 were generally considered free and fair. Parliament elects the executive leadership (the seven-member Federal Council) every four years, and did so in 2015. A four-party coalition made up the Federal Council. Civilian authorities maintained effective control over the security forces. There were no reports of egregious human rights abuses. The government took steps to prosecute and punish officials who committed violations, whether in the security services or elsewhere in the government. Section 1. Respect for the Integrity of the Person, Including Freedom from: a. Arbitrary Deprivation of Life and Other Unlawful or Politically Motivated Killings There were no reports that the government or its agents committed arbitrary or unlawful killings. b. Disappearance There were no reports of disappearances by or on behalf of government authorities. c. Torture and Other Cruel, Inhuman, or Degrading Treatment or Punishment The constitution prohibits such practices. There were isolated reports that individual police officers used excessive force and engaged in degrading treatment while making arrests. In March the district court of Buelach in the canton of Zurich sentenced two police officers to suspended fines for abuse of authority after they used excessive force SWITZERLAND 2 against a motorist during a road patrol check. The officers reportedly handcuffed the driver and forced him to the ground, injuring his head, spine, ribcage, and larynx, after the driver insisted on retrieving his license from the officers.

Oktober 2018 MEDIENMITTEILUNG Selbstbestimmt oder «selbstbestimmter»? - Überparteiliches Komitee beider Basel gegen die «Selbstbestimmungs»-Initiative Am 25. November 2018 stimmt die Schweiz über die «Selbstbestimmungs»-Initiative ab. Ein breit abgestütztes überparteiliches Komitee beider Basel setzt sich für ein Nein der Vorlage ein, die uns Selbstbestimmung vorgaukelt. Im überparteilichen Wirtschaftskomitee sind über 80 Persönlichkeiten aus Politik, Wirtschaft, Wissen- schaft und Gesellschaft aus den beiden Kantonen Basel-Stadt und Basel-Landschaft vertreten. Alle Nati- onal- und Ständeräte der beiden Kantone der Grünen, SP, CVP, LDP und der FDP sowie Parteipräsiden- tinnen und Parteipräsidenten und weitere Vertreter aus Politik und Wirtschaft engagieren sich im Co- Präsidium gegen die Initiative und bekräftigen die negativen Auswirkungen dieser auf die Schweizer Wirt- schaft. Die Initiative will künftig die Bundesverfassung über das internationale Völkerrecht stellen, mit Ausnahme des zwingenden Völkerrechts. In einem Konfliktfall soll das entsprechende Abkommen angepasst oder gekündigt werden. Damit gefährdet sie das bewährte und stabile Zusammenspiel von nationalem und internationalem Recht. Die heute weltweit geschätzte Zuverlässigkeit und Vertragstreue der Schweiz wird unter Vorbehalt gestellt. Das ist ein unnötiger und gefährlicher Angriff auf die Rechtssicherheit und die aussenpolitische Handlungsfähigkeit der Schweiz. Die Schweiz und insbesondere die Region Basel ist auf eine funktionierende internationale Verflechtung angewiesen, denn alleine in unserer Region werden 20 Millionen Tonnen Wirtschaftsgüter im- und expor- tiert. Dies entspricht rund 30% des schweizerischen Aussenhandels. Die Initiative betrifft über 600 Wirt- schaftsabkommen, die unseren Exportunternehmen – häufig KMU – einen sicheren und äusserst vorteil- haften Zugang zu internationalen Märkten ermöglichen.
