Randy Price entered into the record the Project Review, dated August 19, 2014 and revised October 3, 2014, the 2000 Land Development Code, the Mesa County Land Use Plan, a PowerPoint presentation as Exhibit A, and correspondence from Keith Corey, dated October 3, 2014, as Exhibit B. Mr. Price summarized the site location, the surrounding lands uses, zoning, project history, and the notification buffer. He described, the condition of Rapid Creek Road, the permitted number of trucks per day, access permits and easements along the road, safety concerns associated with the road and the one-lane bridge that crosses Rapid Creek, and plans for future maintenance to improve safety.

Mr. Price read the Conditions of Approval and the CUP criterion included in the Project Review on Pages 60- 62. Commissioner Acquafresca noted Condition No. 1 should reference Rapid Creek Road. Randy Price revised Condition No. 1 to include Rapid Creek Road.

Rudy Fontanari, Property Owner, 3316 E ¾ Road, Clifton; and Trevor Grosse, Owner Representative, 3305 E 3/4 Road, Clifton; provided additional project information and summarized the historic use of the quarry, specifics of the CUP, alternative access routes; and the ownership, use and restrictions of Rapid Creek Road.

Mike Meininger, Engineering Division Director, provided details of the condition of Rapid Creek Road and the one-lane bridge, explained sight distance and safety issues, summarized the location of pull-out areas on the road, plans for maintenance and tree removal along the road, and explained the need for roadway signage after maintenance. Jim Nall, Division Director, Mesa County Traffic Department, provided details regarding accidents along Rapid Creek Road.

David Frankel informed the Board that he evaluated the documentation entered into the record, confirmed his opinion that it is a public road, and discussed the basis for his opinion.

Public comments included: Historic and present uses of Rapid Creek Road, ownership of road, daily number of trucks using the road, current road standards, health and safety concerns, use of jake brakes, and wear-and- tear of the road.

Carol Harrison provided a PowerPoint presentation and video, which was entered into record as Public Comment Exhibit 1. The presentation and video are on file at the Mesa County Clerk and Recorder.

A request to appeal an administrative decision to approve Project 2014-0105 SP, a major site plan application for a home occupation permit for a dog grooming business to be located in a 14’ x 23’ structure built alongside the south side of the existing garage. The owner is anticipated to be the only employee and there will be no retail sales or outdoor activities. Staff Recommendation: Uphold staffs’ administrative decision.

Linda Dannenberger entered into record the File 2014-0156 SPA, the original site plan file 2014-0105 SP, the Mesa County Land Development Code, the Mesa County Master Plan, the Project Report, a PowerPoint presentation as Exhibit A, a letter from Heather Lambeth of New Image Realty as Exhibit B, and public comment letters included as Exhibit C. Linda Dannenberger summarized the project location, zoning, site plan, the residential roads in the project area, and discussed the points of the appeal.

The property owner, Chris Haertling, 2382 N. San Miguel Drive, provided additional details of the proposed project, explained the business plan, the anticipated operation of the proposed business, and parking for customers.

Public Comment

Public comments were provided by: John Gaarde, 2384 N. San Miguel Drive; Merlin Schreiner 2387 S. San Miguel Drive; and Madelyn Gaarde; 2384 N. San Miguel Drive.

Public comments included: Maintaining the residential character of the neighborhood, decline of property values, increased traffic in the neighborhood, safety of children and pedestrians, lack of sidewalks, zoning, traffic counts, and the proximity of the neighborhood to Scenic Elementary.

I. PRO2014-0125 CUP VICTORY LIFE CHURCH CUP AMENDMENT TO DAYCARE FACILITY TO ADD SIGN

II. SURROUNDING LAND USES AND ZONING:

The property is located within the AFT zoning district. The subject property is surrounded by a mixture of PUD and AFT zoning districts. The subject property is approximately 4,000 feet southeast from the city limits of the City of Fruita and approximately 2,300 feet northwest from the intersection of U.S. Highway 6 & 50 and 21 Rd.

Existing Land Use: The subject property is currently developed as a house of worship, an allowable use in the AFT zone. In 2011 Mesa County approved a CUP for the Victory Life Church (VLC) daycare facility, project number PRO2011-0225, BoCC resolution MCM2011-108. At that time signage was not addressed in the CUP application.

Future Land Use: The property is within the Fruita/Grand Junction Buffer Area, also known as the Cooperative Planning Area. This Area is the subject of an intergovernmental agreement, signed in 1998, between the Cities and Mesa County. Generally, the agreement requires that the City of Fruita and City of Grand Junction not annex any territory or extend any municipal utility services to the Buffer Area that are not already present without mutual consent of all parties. The intent of the agreement is to enhance the rural character of the area to provide a distinct separation between the cities of Fruita and Grand Junction.

III. PROJECT DESCRIPTION:

The applicant wishes to amend the CUP for the daycare facility to allow for a sign larger than the 24 square feet allowed for “noncommercial institutions” in an AFT zone. The applicant proposes a monument sign that is 25 feet in height and 12 feet wide. Mesa County Planning policy for signs in the AFT zone is that if an application is approved through the Conditional Use Permit process that signs included in the project details will be considered. Religious Assembly (churches) is allowed in all zoning districts in Mesa County but, there are no specific signage allowances for churches other than what is allowed in each zoning district. This application is reviewed as a non residential use and a free standing sign (Section 8.7.5, LDC) on a parcel with 1000 feet of frontage is allowed 750 square feet but not to exceed 300 square feet of signage. The maximum height of the sign is determined by the number of traffic lanes and Highway 6&50 at this location is 2 lanes wide and so the maximum height is limited to 25 feet. The applicant is proposing signage on an arch structure with an effective signage area of about 100 square feet.

IV. COMPLIANCE WITH MESA COUNTY CODE REQUIREMENTS:

Section 3.8.7 of the Land Development Code (2000, as amended) states that a Conditional Use Permit may be approved by the Board of County Commissioners after considering the following:

A. The proposed use is not significantly different from adjacent uses in terms of appearance, site design, operating characteristics (hours of operation, traffic generation, noise, odor, dust, and other external impacts) or, if the use is different, that any adverse impacts resulting from the use will be mitigated to the maximum extent practical and reclamation of the site will be adequate for appropriate future uses of the site where applicable.

Planning will require that the applicant remove the temporary signs located at the entrance of the church property. The white backlit portion of the top of the monument signs will not be bright enough to be glaring to traffic along highway 6&50. The message board portion of the sign will not flash or have messages that scroll. The messages will not be updated more frequently than 20 seconds to avoid distracting drivers.

This criterion can be met with conditions of approval.

B. Facilities and services (including sewage and waste disposal, recycling, domestic and irrigation water [where available], gas, electricity, security measures, police and fire protection, and roads and transportation, special fencing, and signage, as applicable) shall be available upon completion of the project to serve the subject property while maintaining adequate levels of service to proposed and existing development during regular, periodic, and peak usages.

This criterion has been met in the first CUP approval.

C. Access will be provided as necessary to prevent traffic hazards and to minimize traffic congestion in public streets and alleys.

This criterion has been met in the first CUP approval.

D. Adequate assurances of on-going maintenance have been provided.

This criterion has been met in the first CUP approval.

E. Any significant adverse impacts on the natural environment will be mitigated to the maximum extent practical, including whether soils and geologic suitability are adequate for the proposed use, and whether prevailing winds might cause adverse impacts on site and off-site.

The facilities for this proposed use are already existing, and there will not be any additional adverse impacts to the natural environment.

This criterion has been met in the first CUP approval.

F. There is a need for the use on a community wide basis.

The applicant indicates that there is a need to relay church name, schedules and services offered by the church.

This criterion has been met.

Section 3.1.17, General Approval Criteria, must also be considered for Conditional Use Permit requests:

A. complies with all applicable standards, provisions, and purposes of this Land Development Code;

It appears that this request complies or can comply with all applicable standards, provisions and purposes of the Land Development Code.

This criterion has been met.

B. is consistent with review agency comments;

This request is or can be made consistent with all review agency comments. All review agency comments have been attached to this project review.

This criterion can be met.

C. is consistent with applicable intergovernmental agreements (IGA) between the County and other entities.

This proposal is consistent with the Cooperative Planning Area Intergovernmental Agreement between Mesa County, the City of Fruita, and Grand Junction. Both municipalities were sent notices. Only the city of Fruita responded with comments. Those comments are included in the review agency binder under the review agency comments.

This criterion can be met.

V. REVIEW AGENCY COMMENTS:

All review comments received are a part of the hearing packet and the file.

VI. PUBLIC COMMENTS:

As of the date of this review one public comment has been received objecting to the CUP amendment; this email is included in the hearing binder.

VII. PROJECT RECOMMENDATION:

The Planning Division recommends approval of the amendment to the CUP for the Victory Life Church Victory Garden daycare facility CUP, to allow a sign as described in the application subject to the following conditions:

1. Conditions of approval in resolution MCM 2011-108 for the approval of the day care facility are still applicable.

2. The applicant shall remove the temporary signs located at the entrance of the church property. The white backlit portion of the top of the monument signs will not be bright enough to be glaring to traffic along highway 6&50. The message board portion of the sign will not flash or have messages that scroll. The messages will not be updated more frequently than 20 seconds to avoid distracting drivers and the message board will automatically dim at night.

The basis for this recommendation: The petition complies with or has the ability to comply with the criterion in Section 3.8.7A – F, and Section 3.1.17.A - C of the Mesa County Land Development Code (2000, as amended).

Chairman Moreng called to order a scheduled hearing of the Mesa County Planning Commission at 6:06 p.m. Chairman Moreng led the Pledge of Allegiance. The hearing was held in the Public Hearing Room, Mesa County Administration Building at 544 Rood Avenue, Grand Junction, Colorado.

Staff Presentation Randy Price entered into the record the Victory Life Church amendment to the CUP daycare to allow a sign, project file PRO2014-0125, the 2000 Mesa County Land Development Code, the Mesa County Land Use Plan and his PowerPoint presentation

22 labeled as Exhibit A. Mr. Price also entered into the record a handout that he provided to the commissioners that is titled the Cooperative Planning Agreement between Fruita and Mesa County and labeled this as Exhibit B.

Mr. Price explained that the request is to allow signage for the church and daycare that is larger than what is allowed in the AFT zone. The church was constructed in 2009, the property is on 33 acres and it is located between Grand Junction and Fruita in the cooperative planning area. He went on to explain that the property is surrounded by a planned unit development (PUD). Mr. Price provided more history about the church and showed several maps and photos showing the location of the property and the proposed sign. He explained that the applicant is proposing to amend the CUP in order to have a sign larger than that allowed which is a 2 foot square sign. He explained that the proposed sign is 12 feet wide and 25 feet high and part of it will be an archway with decorative stone and the top portion that is 10 feet by 5 feet will be back lit and in the middle of the sign, which is approximately 3 feet by 7 feet 9 inches, will be an LED display sign where messages can be changed remotely and below that it will say Victory Garden, which is the name of the daycare facility.

Mr. Price went on to show photos of the current signs on the property which are temporary and would be removed when the new sign is constructed. He also discussed the impacts of the sign which is brightness, having an LED flashing or scrolling sign that could distract drivers but they are willing to limit the brightness of the sign during the evening hours with light sensors and to have the scrolling message only change every 20 seconds to also avoid driver distractions.

The recommendation for this project is approval with conditions and Mr. Price said this has the ability to comply with the criteria in Section 3.8.7 A through F and Section 3.1. 17 A of the Mesa County Land Development Code. Mr. Price continued on to read the comment sent in by the City of Fruita, who is against this sign. He also read the conditions of approval.

Questions Commissioner Jones asked why the sign application that came through in 2013 was denied. Mr. Price explained that it was presented as a Sign Permit application and the Land Development Code doesn’t allow signage greater than 2 square feet in an AFT zone. Mr. Price discussed this with the applicant and suggested they amend the CUP for their daycare and apply for the larger sign with this type of application.

Chair Moreng inquired about the properties on the other sides of the church. Mr. Price stated that there is an irrigation pipe company, a facility that stores oil and gas trailers, a site that stored large tanks and there are a few residences west of the church. There are also some strip mall types of trade shops. Commissioner Flynn stated that there are other businesses that also have their signage along their properties. These other businesses were constructed prior to Mesa County’s Land Development Code in regards to zoning and creation of the buffer.

Chair Moreng asked what the purpose of the new sign is. Mr. Price explained that the church wants to advertise their daycare and also what time their church services are. Further discussion took place about other signage and billboards along that section of

23 the highway and they talked about this sign being a possible safety concern. It was also mentioned that there is a turn lane off of the highway that goes directly into the church and this sign would better direct people to that road.

Applicant Robert Cook 2528 Greystone Drive, Grand Junction Mr. Cook stated that he has been the senior pastor of the church since August of 2012. Pastor Cook explained that they are willing to be flexible and will change the design of the sign to please the community and so it doesn’t distract traffic nor detract from street appeal. He said he believes that there is a need for a sign this size due to the fact that the highway is about 100 feet away and it would be difficult to see a smaller size sign.

Public Comments Tom Groves, 1049 20 Road, Fruita Mr. Groves presented comments against the application to include statements about the buffer zone being under attack as it is and to allow this sign will let others do the same thing in the future. He also stated that he believes with too much growth the leach fields will fail and there will be a need to put in sewer. The commissioners stated that this application is only for signage at this point in time.

Roland Cole-659 Grand View Drive and Janet Rowland-611 Stan Drive spoke in favor of this sign application stating that it would be compatible with other signage in the area and with the speed limit of 55 miles per hour on the highway, a larger sign is necessary so people know where the road is to turn into the church. Ms. Rowland stated facts about the church already being there and discussed the intent of the buffer zone.

Applicant Rebuttal and Questions Chair Moreng inquired about also having a small sign showing where the road is to turn off to the church. Mr. Price stated that would need to be a Department of Transportation (DOT) approval. Pastor Bob stated that the current signs face to the south and it’s difficult for people coming from the east or west to see them. He said with the size of the new sign and the fact that it faces north and south it will be easier for people to see the turn lane which is right after where the sign will sit on the property.

Closed to public comment Motion: Commissioner Flynn made a motion for approval of 2014-0125 CUP Victory Life Church sign with the staff’s recommendations and to move this on to the Board of County Commissioners on November 18, 2014. Second: Commissioner Page

Commissioner Jones voted Nay. He stated that he is conflicted because he believes the sign is very tastefully done and there is a large amount of frontage on the highway but he doesn’t know why they should approve the sign now when it was denied in 2013 and the only change being the addition of a daycare. 27 CITY FRUITA CITY FRUITA 10/3/2014 As the County is aware, Fruita was opposed to the construction of 1:57:43 PM this urban land use (a large church) in the buffer area as it does not meet the intent of the Cooperative Planning Area (Buffer) Agreement nor does it meet Fruita's & the County's Master Plans for this area. As per the Agreement and Master Plans, development in this area should enhance rural character. It appears that Mesa County's laws limit signs in the AFT zone to 10 feet in height and less than 25 square feet in area. The applicants request a 25-foot tall sign with approximately 150 square feet of sign area including scrolling LED lights. Section 8.8 of the County's Land Development Code indicates that through the Conditional Use Permit process, a variance to the maximum total surface area of signs shall not be permitted, but the maximum sign allowance for the entire development or use may be aggregated and the total allowance redistributed. Allowing a taller and larger sign to advertise the church through a Conditional Use Permit process for a day care center at the church is inappropriate. A larger sign for the church should be granted through the variance process (Section 3.12 of the County's Land Development Code) or through a change to the County's Land Development Code to be fair to all other religious institutions and other property owners in the AFT zone. The City of Fruita does not support commercial development in the buffer area, including commercial signage. The tall and large sign, including the LED lights with moving copy as is proposed, is more appropriate in the commercial corridors of the County, not the area intended to retain its rural characteristics through the Cooperative Planning Area Agreement and the City and County' Master Plans.

The Goodwin Solid Waste Disposal Facility (Deer Creek) is located 20 miles southeast of Grand Junction, 1 mile east of Highway 50 and 1 mile north of the Mesa/Delta County line. The facility is 96 acres in size and was first permitted is 1993 as a solid waste disposal facility accepting sand

1 37 trap and grease trap waste. The permit has been amended several times to change the types of waste received. In 2010 the permit was amended to add exploration and production waste from oil and gas operations. The CUP 2010-0200 approved 2 evaporation ponds approximately 3 acres in size each. The ponds have been constructed and have been operational for 2 years.

II. SURROUNDING LAND USE The permit area is bounded by public lands administered by the Bureau of Land Management (BLM) to the north, south, and east and by private property and BLM property to the west. All property within the notification area is zoned Agricultural Forestry Transitional (AFT). The rural future land-use classification is Large Lot Rural Agricultural 35+ (LL R/A 35+).

Within the 2,500 ft. public notification area there is one residence owned by Thomas and Kathleen Panter. The residence is a yurt and is off the grid. It is powered by photovoltaic, propane and has an ISDS. The yurt is 1,200 feet from the western boundary of the permit area. The Panter residence was constructed in 2010. In 2010 the operator relocated the access road around Panter’s property. The road was relocated onto the surrounding BLM property. Prior to this, the access road crossed the Panter’s property on an easement.

Three miles to the northwest is another waste disposal facility approved by the BoCC (CUP 2010-0031) in 2010. The Indian Mesa facility has not yet been constructed. The land was purchased by Alanco the owners of the operators of the E&P waste portion of the Goodwin facility. They are currently in the final steps of receiving CDPHE approval for the Engineering, Design and Operation Plan (EDOP). The Indian Mesa facility will be located adjacent to the Department of Energy’s Cheney Uranium mill tailings waste disposal cell. The hours of operation are approved to be 24 hours a day and 7 days a week.

III. PROJECT DESCRIPTION:

In November of 2013 the BoCC approved a one year variance from the approved hours of operation from sunup to sundown, 6 days per week. The applicant requested this variance because wastewater truckers often operate 24/7 and to be competitive with other disposal facilities, the Goodwin Deer Creek facility had requested a permanent change to the hours of operation. TC Operating, the company that operates the oil and gas waste disposal portion of the facility is permitting the Indian Mesa facility, but access across BLM and general slowness of the wastewater disposal industry may delay the opening of the facility. The Indian Mesa facility is permitted for 24/7 operation since its haul route is not located near residences.

The hours of operation were set in the 2010 CUP as a condition of approval. The operator claims that business is going to the Danish Flats disposal facility located near Thompson Springs, Utah. That facility is open 24 hours, 7 days a week and this schedule is more desirable since waste haulers work 24 hours a day and make continuous round trips to the facilities.

During the summer of 2014, three electrically powered aerators were added to the east pond to remedy an anaerobic condition that had developed in late May 2014 due to the rising temperatures and biological oxygen demand from the nutrients in the pond. The pond turned anaerobic and odor complaints were received by CDPHE and Mesa County Health Department from residents on Purdy Mesa Road, Kannah Creek Road, Blue Sage Drive, a resident living ½ mile west of the facility and residents living across Highway 6&50 near Bridgeport Road. The first complaint was received during the fourth week of May. By June 12th, seven complaints were received. The facility treated the pond with chlorine and then peroxide this worked for a period of time before returning to an anaerobic condition. The facility worked out a treatment regime of adding peroxide every 4 days. This was not a long term solution and the facility petitioned the CDPHE to allow provisional use of aerators to circulate and add oxygen the east pond. During the period that the facility worked out a treatment schedule, there were periods that

the pond reverted to an anaerobic odor situation. Mesa County Environmental Health and Planning with CDPHE Solid Waste personnel conducted several inspections of the facility. The last inspection was to use a certified odor inspector using air sampling equipment. At that time the pond was not anaerobic and it was determined that odor levels were not outside the range that would be considered enforceable for an odor complaint. The east pond was the only pond experiencing a problem and new waste was not being added to the west pond. During this time E&P waste water was not being added to the west pond and that pond did not have the problems that the east pond experienced; this pond was only about 10% full. Additionally, a walnut shell pretreatment filter was installed to remove some of the organic material in the waste stream that contributed to the high biological oxygen demand.

IV. COMPLIANCE WITH MESA COUNTY CODE REQUIREMENTS:

Section 3.8.7 and Section 3.1.17 of the Mesa County Land Development Code were used to evaluate this application.

Section 3.8.7 of the Land Development Code (2000, as amended) states that a Conditional Use Permit may be approved by the Board of County Commissioners after considering the following:

A. The proposed use is not significantly different from adjacent uses in terms of appearance, site design, operating characteristics (hours of operation, traffic generation, noise, odor, dust, and other external impacts) or, if the use is different, that any adverse impacts resulting from the use will be mitigated to the maximum extent practical and reclamation of the site will be adequate for appropriate future uses of the site where applicable.

Potential adverse impacts to operating 24 hours a day, seven days a week will be additional noise from nighttime truck traffic and off-loading liquid waste, also light pollution from lighting. To mitigate noise and visual impact, the applicant in the 2010 permit amendment moved the access road 1200 feet to the south of the Panter residence. Additionally, material excavated from the construction of the waste ponds was used to construct a >20’ high, 1000’ long berm on the west side of the ponds. The waste off-loading area was placed on the far east side of the permit area, 2,800 feet from the Panter residence.

Truck traffic on highway 50 may be a source of additional night-time noise as trucks traveling on highway 50 slow to turn into the facility access road. Truckers sometimes use “jake brakes” to supplement regular brakes. Jake Brakes can be noisy and to mitigate night-time noise pollution a condition of approval will be to prohibit truckers from using these brakes at night.

In order to mitigate the adverse impacts to the Panter residence, the change of hours of operation of the facility should not be permanent and should be limited to a period of two years and an administrative review conducted by the Division after one year. This will allow time for the Indian Mesa waste facility that was approved for 24 hours a day and 7 days per week, to become operational.

To mitigate nighttime pollution the facility is required to have full cutoff lighting (required in section 7.6.7 MCLDC) and non-essential lighting will be turned off when not needed.

This criterion can be met with conditions of approval.

B. Facilities and services (including sewage and waste disposal, recycling, domestic and irrigation water [where available], gas, electricity, security measures, police and fire protection, and roads and transportation, special fencing, and signage, as applicable) shall be available upon completion of the project to serve the subject property while maintaining adequate levels of service to proposed and existing development during regular, periodic, and peak usages.

Minimal services will be required for this facility. The area is sparsely settled partially due to the lack of any services. There is no potable water system, no sewer system, no irrigation water, no phone service, and no electrical network. Fire protection would be provided by the Lands End Fire Department and police protection by the Mesa County Sheriff’s department. Electrical needs will be provided by an on-site 50KW generator, with a hospital muffler to mitigate noise. Water for dust suppression would be trucked to the site. Portable toilets will serve sanitary needs, but an Individual Sewage Disposal System (ISDS) might be required per comments from Mesa County Environmental Health.

This criterion can be met with conditions of approval.

C. Access will be provided as necessary to prevent traffic hazards and to minimize traffic congestion in public streets and alleys.

A new access road was constructed to this facility in 2010 on BLM land. The current CDOT access permit for Highway 50, sets the maximum allowable trucks to 20 per day; any more would trigger the requirement for additional improvements to the Highway.

This criterion has been met.

D. Adequate assurances of on-going maintenance have been provided.

The Engineering Design and Operations Plan approved by the Colorado Department of Public Health and Environment solid waste disposal permit outlines required monitoring, reporting and closure requirements for this facility.

This criterion can be met with conditions of approval.

E. Any significant adverse impacts on the natural environment will be mitigated to the maximum extent practical, including whether soils and geologic suitability are adequate for the proposed use, and whether prevailing winds might cause adverse impacts on site and off-site.

The facility has been in compliance with the existing air emissions permit. The odor problem that the facility experienced this past summer seems to be under control and the operator conducts regular testing for dissolved oxygen to make sure the problem doesn't occur again. Roads are treated for dust suppression. The leachate collection system of the ponds is monitored for leakage per CDPHE requirements and there is an ongoing water monitoring program.

This criterion can be met with conditions of approval.

F. There is a need for the use on a community wide basis.

There is a need for wastewater treatment facilities to meet the demands for treatment of produced water as the oil and gas industry recovers in western Colorado. A shortage of sufficient treatment facilities has caused some producers to truck their water into Utah. Having a facility available 24 hours a day, 7 days a week helps to meet the needs of the oil and gas industry that is a vital part of the region's recovering economy.

This criterion has been adequately addressed by the applicant.

Section 3.1.17 General Approval Criteria must also be considered for Conditional Use Permit requests:

A. Complies with all applicable standards, provisions, and purposes of this Land Development Code;

It appears that this request complies or can comply with all applicable standards, provisions and purposes of the Land Development Code if all review agency comments and recommended conditions of approval are met.

This criterion can be met with conditions of approval.

B. Is consistent with review agency comments;

No concerns have been identified in review agency comments which could not be addressed by the review agency requests and the recommended conditions of approval.

This criterion can be met with conditions of approval.

C. Is consistent with applicable intergovernmental agreements (IGA) between the County and other entities.

This project is subject to MCA 97-18 between Mesa County and the Bureau of Land Management and MCA 2001-26 between Mesa County and the USDA Forest Service. These IGAs promote cooperation in land development review. Review requests were provided to the BLM, no comments have been received.

This criterion has been met.

V. REVIEW COMMENTS:

All review agency comments received are attached to this project report.

VI. PUBLIC COMMENTS:

At the time of the writing of the project review one written public comment had been received and this is included as part of the hearing binder.

VII. PROJECT RECOMMENDATION:

The Mesa County Division of Planning staff recommends approval of this amendment to the Conditional Use Permit subject to the following conditions:

1. The change to the hours of operation to 24 hours a day, 7 days a week will be restricted to a 2 year period starting with the resolution adoption if this application is approved. This will allow additional time for the Indian Mesa Facility to become operational. After one year an administrative review will be conducted to assure compliance with environmental regulations. 2. The facility shall use full cutoff light fixtures and turn off non-essential lighting when not needed. 3. Truckers will be prohibited from using Jake brakes for night-time deliveries on the access road and along the State Highway on the approach to the access road. 4. All review agency comments not in conflict with the conditions of approval shall be addressed. 5. The applicant, owner and operator shall not significantly deviate from the site plan and documents submitted with this application. Any modification or expansion of this facility, not including minor modifications as determined by the Planning Director, shall require an amendment of the Conditional Use Permit. 6. Conditions of approval of the prior Mesa County Board of County Commissioners resolutions shall still be applicable unless specifically amended in later BOCC resolutions. Prior resolutions are, MCM 96-140, MCM 97-129, MCM 99-134, MCM 2004-034, MCM 2004-073 and MCM-2011-109 and MCM-2012-049.

Chairman Moreng called to order a scheduled hearing of the Mesa County Planning Commission at 6:06 p.m. Chairman Moreng led the Pledge of Allegiance. The hearing was held in the Public Hearing Room, Mesa County Administration Building at 544 Rood Avenue, Grand Junction, Colorado.

Staff Presentation Randy Price entered into the record the Goodwin Deer Creek Waste Disposal Facility amendment to the CUP, project file PRO2014-0146, the 2000 Mesa County Land Development Code, the Mesa County Land Use Plan and his PowerPoint presentation labeled as Exhibit A. Mr. Price entered into the record an additional exhibit that

Mr. Price explained the proposal and the location of the project. He showed maps and stated that there is one resident within the buffer area of the facility. He stated that the facility was originally permitted in 1993 for septic tank and grease–trap waste and in 2010 they received an amendment to add the disposal of liquid exploration and production wastes and the Exploration and Production Waste (E & P) facility was completed in 2012. He explained that there was also an amendment in 2013 to allow operations for 24 hours, 7 days a week for a period of one year and the applicant would like to continue those hours of operation and to make them be permanent.

Mr. Price went on to show photos of the site, maps of the property, and tanks, he also pointed out where the one resident lives in the area and where the haul route is. He stated that in May when the temperatures were rising that one of the ponds went anaerobic. The pond contains Exploration and Production Waste (E & P) and it’s meant to evaporate and there is also organic matter in the waste. He went on to explain that if the organic matter has enough oxygen it will break it down but if temperatures raise the bacteria doesn’t have enough oxygen and therefore it creates a sewer and asphalt type order. He stated there are two ponds and the eastern pond is the one that went anaerobic and therefore it turned black. The other pond is shallow and green with algae in it and it is a healthy pond.

Mr. Price explained that in mid-May he received a complaint from a resident in Kannah Creek and they asked about oil and gas operations in the area due to the smell that was similar to something burning. He referred the complaint to the County Health Department and they got involved. He went on to say that a site visit was done in late May and they noticed there was a very strong odor that resembled asphalt and was metallic and at that time the pond was black. The applicant tried to remedy the smell by using chlorine and peroxide, which worked for a period of time but the pond, went anaerobic again. Mr. Price went on to discuss the things that were done and how the pond acted and reacted to the chlorine treatments and when it’s not anaerobic it doesn’t smell. He stated that the applicants decided something different needed to be done to remedy the situation so they purchased equipment that would aerate the pond.

Mr. Price also stated that more complaints were received by Tom Orr with the County Health Department and he contacted the State Department to do an odor measurement. Additional explanation was given about testing the air quality using a certified nose called a nasal ranger that it is like a megaphone that goes over your nose and is a calibrated piece of equipment. Mesa County does not have this equipment so it has to be provided by someone in Denver and it takes time for people to do this testing. The majority of the complaints from people living in the area are that the smell is worse on Fridays, the weekends and in the evenings. These people live within 4 to 5 miles of the facility and they have said they have to close their windows at night because the smell is so bad. A test was done recently and it was found that the area didn’t exceed the odor standards and the pond was in an aerobic condition at that time.

Mr. Price went on to explain the conditions of the application, visual and noise impacts were discussed, the haul route was mentioned as well as the berm, full cut off lighting and he talked about details in Section 3.8.7 b, c, d & e of the code and that there is a need for this type of wastewater treatment facility on a community wide basis. He went on to read the conditions of approval.

Questions Commissioner Flynn asked how often the ponds are tested for odor. Mr. Price stated that the recent test was the second time it had been done and that testing would occur more often if the equipment was available locally. He also said that the applicant preforms water tests and provides that information to the county but doesn’t know how often those are performed. Further discussion took place about the wind blowing off of the Grand Mesa and causing the smell to blow down the valley and to the north west. Commissioner Jones asked what the difference is between now and a year ago regarding the smell. Mr. Price explained that it may depend on the type of waste they are taking in, it could be E&P Waste, return flow from fracking fluids which can have guar gum which is a thickener and is organic and can create a problem regarding breaking down the organic matter.

Applicant Thomas Pool 1650 Fillmore St., Denver He stated that also present with him are Willie Swanda, Operations Manager and Josh Gale of Goodwin Services for technical questions. Mr. Pool explained that the 24/7 operations are critical to their business and went on to state that they need these hours so that trucks can use the facility after they leave a well. He said there weren’t many times that they had to be open all through the night but those times do arise and they need to be available for the trucks. He went on to explain that when the odor issues arose last year that they tried to mitigate the issues right away using chemicals and quickly after that they added a lot of equipment to help with the smell and to avoid using the chemicals. He said it took time for the Colorado Department of Public Health and Environment (CDPHE) to get the equipment in place. He believes the odor that the people smelled was from the chemicals they were using. Mr. Pool explained all of the equipment that is currently in place and expressed that they are planning on staying in operation for the next 15 years. He would like the 24/7 hours to be permanent and this will allow them to deal with conditions of the ponds quickly if there are problems.

Questions Commissioner Jones asked if the odor issues were foreseeable. Mr. Pool stated that they didn’t know this would happen and didn’t see any issues with anaerobic problems the previous year but in the spring when the weather warmed up it happened very quickly. He stated that they have developed a protocol now and they can address it ahead of time. He said they now have employees checking this on a regular basis and they keep a log of that is required by the Engineering Design and Operations Plan (EDOP)

Mr. Pool explained that between the business itself and the civil engineers; have in

combination approximately 35 to 40 years of experience. He also stated that having the aeration is a critical part of eliminating the smell.

Further discussion took place with the commissioners expressing their disappointment with the company not having the expertise to see the potential for problems. Mr. Price stated that a lot of clean up goes on prior to things going into the pond and it decreases the amount of Volatile Organic Compounds (VOCs) that go into the pond. Mr. Pool stated that they carefully test what is loaded into the trucks before they come to the facility. They stay under the VOC emissions allowed which is 20 tons per year.

Chair Jones suggested that the two facilities in the area could share the dumping and when Goodwin was closed they could use the Danish Flats facility. Mr. Pool stated that he believes the producers would prefer to have everything going to one facility. He also mentioned that they can’t anticipate how many trucks could be coming in at night. Mr. Price stated that these applications do not have any limits on them but the Colorado Department of Public Health and Environment Solid Waste Division reviews these plans and requires a bond to be placed for reclamation and clean up. Chair Moreng asked if a CUP holder doesn’t perform to regulations their CUP could be potentially pulled or cancelled. Ms. Dannenberger said that this could happen and would involve various agencies, not just the county.

A break was taken at 8:10 p.m.

Public Comments Public comments against the application were provided by Robert Sanders-39154 Bridgeport Road, Thomas Painter-5170 Highway 50, Jerry Cares-34971 Pronghorn Drive, Marc Coutu-39022 Bridgeport Road, Lindy Guinn-4240 Blue Sage Drive, Gwen Russell-38540 Bridgeport Road. Comments against the proposed project included: concerns regarding the potentially hazardous, sickening odor, what it is doing to them and their children when they are outside. The odor can last from 30 minutes to all night, it causes sore throats and itchy watery eyes. They also hear the noise from the equipment that is in place to try to minimize the smell, these are aerators and bubblers. Also mentioned was the truck noise taking place day and night, dust on the road that it is not being mitigated, and they are unable to have outdoor barbeques. These people are questioning if are they running the aerators at night since that’s when the smell is the worst. They also complained about how a rainstorm causes the smell to increase and there is also a smell that comes off of Deer Creek. One of the neighbors mentioned that most VOCs are cancer causing.

Willie Swanda Operations Manager of Alanco Mr. Swanda stated that they did diagnose the anaerobic issue prior to the complaint and the hydrogen peroxide was received in Grand Junction the next day. He explained that they have engaged an engineering firm in Grand Junction (HRL) and this firm has been assisting with the water analysis. Mr. Swanda explained that they could not anticipate the anaerobic condition because it’s not conducive to this type of pond. He said they

52 Mesa County Planning Commission October 23, 2014 Public Hearing Minutes dealt with this issue most of the summer but now have the bubblers and aeration equipment in place and if they have to shut the aerators off then they have to go back to chemical dependency. He stated that they are trying to get the pond back to a natural state which is a salt water pool.

Chair Moreng asked Mr. Swanda to address some of the other concerns raised. He asked if he was aware of the smell problems and that they were worse at night. Mr. Swanda said, yes, he was aware of this and he has gone out there at night but has not smelled this when he’s been there. The dust mitigations were also discussed and Mr. Swanda said it’s difficult to keep up with this as the water disappears on the dirt road very quickly and they don’t want to use Mag Chloride. He stated that they have been adding more gravel to try to keep the dirt compaction covered but they can’t continuously run water trucks up and down the road. Commissioner Flynn inquired about the ponds being lined. He stated that they were lined with 3 layers of liners and they were put in place before the water was added. He explained that there are also pumps in between the liners and they are monitored on a monthly basis to make sure they are functioning. He also stated that the aerators run all night part of the time but bubbler systems do not. They have a generator that runs 24/7 to keep the things moving so they can stay ahead of the anaerobic bacteria and not have to use the chemicals.

Applicant Rebuttal Thomas Pool addressed the complaints about the odor coming off of Deer Creek. He stated that there is no water leaving their facility that goes into Deer Creek and it seems that some kind of testing of the creek should be done. He stated that if they are allowed to be open 24/7 they can address all of the issues with no problem. Mr. Pool said he will check with the BLM and see if Mag Chloride is allowable on the roads.

Further discussion took place about the possibility of more set hours in the summer or having this facility closed at different times. The statement was made that they need to be open 24/7 for the business to survive and that the other facility in the area is closed on Sundays and holidays so trucks need to come to this facility and they can’t anticipate when trucks are coming down from the Rifle area.

Mr. Price Randy addressed the question about landscaping in regards to the berm. He stated that here wasn’t a vegetation plan for the berm due to the soil content which is gravel and basalt. He also said that the maximum number of trucks is limited by the CDOT permit and that the applicant should keep records and monitor this. Ms. Dannenberger stated that if these records needed to be checked it would need to be an administrative review item.

Commissioner Page discussed the points that were brought forward from the people affected that live in this area. He stated that he has had a long standing issue with this and the element of responsibility that goes along with this application in regard to the chemicals used in these processes and that responsibility is on the company to show

how they are making this happen. He doesn’t support this extension because they are not taking care of what’s in the air and making it safe for the neighbors. Further discussion took place in regards to how advanced and progressive the oil and gas industry is and that things should be foreseeable but this isn’t the case and issues are not being taken care of in advance of them happening. The statement was also made that the county appreciates the money brought in by the business but they also believe that the property values in that area are being diminished.

As long time residents of Kannah Creek, we wish to take this opportunity to express our opposition to the application by Alanco Energy Services, Inc. Asking to amend the existing CUP to permanently extend the hours of operation to 24 hours a day, 7 days per week is premature. As residents of Kannah Creek located 5 miles from the facility, we would like to share with you our objection.

Since May, 2015 the ponds located at the facility have gone anaerobic several times (May thru October) giving off a smell that awakenster us in the middle of the night. Peroxide was added by Alanco to the pond early June, also aerators were set up using generators because there is no electricity to the facility. Since June, we have encountered this horrible smell several more times. I (Teri) was told, by Alanco the generators were replaced with upgrades. Since the replacement, the generators haven’t been able to keep up. As late as October 21, 2014, 2:01 am, we were awaken by this smell and neither the County, nor Alanco can account for it. As temperatures change from night to morning, the odor dissipates and becomes difficult to detect and pinpoint its source. We know this because, I (Teri) have talked with Randy Price and Tom Orr several times about this odor and they have tried to work with Alanco without success to eliminate the odor.

We believe the existing infrastructure necessary for the facility to perform the disposal process properly is inadequate and should be fixed to ensure functioning effectiveness before the Board considers granting this permit extension at a later time.

I am emailing regarding Alanco's request to obtain a permanent 24/7 land use permit at their Deer Creek facility located at 5180 HWY 50, Whitewater CO 81527. My family and I live at 39154 Bridgeport Road, which is about 1.5 miles from this facility. I strongly object to Alanco receiving this permanent permit, as the smell coming from this facility during the evening hours, and sometimes extending into the early morning hours is horrendous. We have small children that do not need to be breathing in the noxious chemical smell that invades our house as a direct result of their operations. In addition, I have a 14 year old with asthma that is negatively affected by this strong chemical odor. I strongly feel that until they become compliant and get this smell under control permanently, they should no longer be allowed to conduct business at the Deer Creek facility, or begin operations at their Indian Mesa site.

68 II. SURROUNDING LAND USES AND ZONING: The public notification area is 5,280 feet as required in Section 3.1.8 of the Land Development Code. III. PROJECT HISTORY AND DESCRIPTION: This right of way was granted as part of a deed recorded on April 2, 1906 at Reception Number 60082 (attached). No road has been built in the right of way, but a driveway has been created over time and is starting to be used by the general public as a public road. Drivers use this as a short cut between Bower Avenue (37 9/10 Road) and Elberta Avenue (37 3/10 Road). Property damage and dust problems to houses and peaches are causing problems for the adjacent property owners (Stahl and Cox).

69 A bridge over the Government Highline Canal (constructed by the Bureau of Reclamation and managed by Grand Valley Water Users Association) at the Main Street alignment appears to have been removed sometime between 1994 and 1997. An existing bridge at Bowers Avenue (37 9/10 Road) is a two lane, 20 foot wide paved surface. County records show this as partly County maintained and partly privately maintained. A Conservation Easement was placed on the Cox property (Palisade Estates Subdivision) in 2009. The Palisade Estates Subdivision has been annexed into the Town of Palisade.

Location of shortcut route:

On October 6, 2014, Mesa County Planning met with Bob Levine of the Bureau of Reclamation; Mark Harris, Shirley Joslin and Kevin Conrad of the Grand Valley Water Users Association; Ron Quarles from the Town of Palisade; Bruce Stahl (applicant) and John Curran (applicants surveyor). The following is a summary of comments:  Grand Valley Water Users Association wants to keep cars off the canal road. They have worked with the Mesa County Sheriff’s Office, but it is difficult to catch trespassers. They don’t want to put up gates as it would slow down the ditch riders work on the canals.  The Bureau of Reclamation doesn’t want a bridge crossing the canal.  Town of Palisade has Main Street as a future connection on their Transportation Plan. The Town supports the vacation with the ability to obtain the right of way in fee simple without having to purchase it if the road is needed in the future.  Bruce Stahl says there are power poles in the middle of the 20’ wide right of way.  Bruce Stahl and Dave Cox have discussed this vacation and Mr. Cox has removed his objection to the vacation (see email attachments).

70 IV. COMPLIANCE WITH MESA COUNTY LAND USE POLICIES AND MESA COUNTY LAND DEVELOPMENT CODE. Section 3.10 Vacation of Rights-of-Way and Renaming of Streets The applicable criteria of Section 3.10 apply. This Code Section sets forth the following criteria for evaluating right-of-way vacation requests. Section 3.10.6.A The requested vacation will not:

(1) Create any landlocked parcels; This application will not create any landlocked parcels or lots. The right of way is located between the Government Highline Canal maintenance road and right of way dedicated as part of the Palisade Estates Subdivision (now placed in a conservation easement). Bruce Stahl has access from 37 9/10 Road and Dave Cox has access from 37 3/10 Road. This criterion has been met.

(2) Negatively impact adjacent parcels; This vacation should improve adjacent parcels. The Stahl property is currently suffering property damage from people crossing the canal road to the driveway through the Cox Orchard. The Cox orchards suffer from dust mites due to the dust caused by traffic going through this area. This vacation does not change the existing road layout or cause traffic issues. This criterion has been met.

(3) Restrict access to any parcel so that access is unreasonable or economically prohibitive; Initially Dave Cox protested this right of way vacation because he uses it to access his orchards. However, in discussion with Bruce Stahl, Mr. Cox has withdrawn his objection because the public is starting to use the driveway as a shortcut, and damaging the properties is a result. Mr. Cox farms property on both sides of the canal (see below), and has access at Elberta Avenue (37 3/10 Road). This application will not cause any restrictions to future access to adjacent property owners. It is intended to stop the public from travelling on these driveways. This criterion has been met.

71 (4) Reduce the quality of public service to any parcel of land; No comments were received from any reviewing agency that would indicate there would be a reduction in the quality of public service if this request were approved. An irrigation easement is located as shown on the survey, and this will be required to be granted by deed if the right of way is vacated. This criterion can be met.

(5) Be inconsistent with any adopted transportation plan, including the Grand Junction/Mesa County MPO Transportation Plan; This proposed road vacation is on the Palisade Long Range Transportation Improvement Plan. While the Town of Palisade has identified the extension of Main Street sometime in the future, comments allow that it may be a long time in the future. The Town supports this right of way vacation, with a reservation on the deed for future dedication to the Town. This is a condition of approval. This criterion can be met.

(6) Affect the historic movement of livestock; This right of way is not used for livestock movement, and has no known historic movement of livestock associated with it. This criterion has been met.

(7) Create a circuitous alternate route for area residents or other members of the public; Dave Cox, a neighbor, uses this right of way for ease of access between properties he has in cultivation. The problem is that it is starting to be used by the public, to the detriment to the Cox orchards and to the Stahl property. This right of way is not built and is not open to the public. The Government Highline Canal is at the end of this right of way, and use of this canal maintenance road is considered trespassing.

The right of way for G 7/10 Road on the east end of this project was vacated in 1983 (file #C55-83), and the right of way on the west side of this project is through the Cox orchards. G 7/10 Road is not built and the Cox properties have a conservation easement on them. Dust from public access on this driveway is detrimental to the peach trees.

The alternate route for the public is to return to G 4/10 Road (First Street) and access both Bowers Avenue (37 9/10 Road) and Elberta Avenue (37 3/10 Road). The distance between G 7/10 Road and First Street is approximately ¼ mile. These roads are County or Town of Palisade maintained roads. This criterion has been met.

(8) Negatively affect utility access or utility distribution networks; or No utility companies have provided comments that this vacation will cause problems with utilities in the right of way. An existing irrigation pipe is located in the right of way proposed to be vacated, and an easement is required to be reserved on the deed. This is a condition of approval. This criterion can be met.

(9) Eliminate public access to public lands. This right of way is not located adjacent to public lands and does not provide public access for any land in the area. No public land is located adjacent to this vacation area. The Government Highline Canal is not public access for use of the canal road. Grand Valley Water Users Association works with the Mesa County Sheriff’s Office to reduce trespassing on the canal maintenance road. This criterion has been met.

72 Section 3.1.17 General Approval Criteria must also be considered for Vacation of Right-of- Way requests: A. Complies with all applicable standards, provisions, and purposes of this Land Development Code; It appears that the proposed vacation of this right of way is consistent with all applicable standards, provisions, and purposes of the Land Development Code. The right-of-way will be reserved for the Town of Palisade if it is needed in the future. This criterion can be met.

B. Is consistent with review agency comments; There are no review agency objections to the proposed vacation. The Town of Palisade has requested wording on a deed that allows the Town to obtain the right of way in the future without additional payment if and when a road is needed to be built. This criterion can be met.

C. Is consistent with applicable intergovernmental agreements (IGA) between the County and other entities. The Town of Palisade was notified and comments are included in the Review Agency Comments sheet. The Bureau of Land Management (BLM) was also notified but did not comment on the application. This criterion has been met.

V. REVIEW COMMENTS: All review agency comments received are included in the binder for this project.

VI. PUBLIC COMMENTS: No public comments have been received as of the date of this project review.

VII. PROJECT RECOMMENDATION: The Planning Division recommends approval of the request for a right of way vacation, with the following condition: 1. Require survey to be deposited and deed to be recorded with the following wording: a. The Town of Palisade reserves the right for a public roadway on land affected by the right of way vacation, and right of way will be granted for the benefit of the public when it is deemed necessary for connections consistent with the Town’s Long Range Transportation Improvement Plans. b. Reservation of an easement for the existing irrigation line

The basis for this recommendation is: The petition demonstrates compliance with Section 3.10.6.A (1 - 9) and 3.1.17 (A-C) of the Mesa County Land Development Code (2000, as amended).

The 37 8/10 Road (Main Street) alignment is identified in the plan to include a future extension across the Highline Canal to a connection with the G 7/10 Road. Preservation of the existing right-of –way at this location is consistent with the recommendations of the Comprehensive Plan.

111 Narrative - 3781 Road ROW Vacation

This road vacation will eliminate 191.54 feet of road frontage that Dan Cox and Bruce E. Stahl have along 37 8/10ths Road (aka Main Street, Palisade) which is a dead end road that no longer serves any useful purpose. Any useful function of this portion of Main Street, Palisade disappeared with the demolition of the bridge that was used to cross the Government Highline Canal.

The impact this road vacation will have on the general area will be a positive one. The general public is starting to use the Canal Road and this small portion of 37 8/10ths Road as a general through fare. The Canal Company does not like having the public using their Right of Way as a Road. This has the potential of creating some liability issues for them. The Canal company has even erected a lot of No Trespassing signs on their Right of Way. What this traffic does is create a lot of dust in the area. This dust has a tendency to permeate peoples houses and settle on the fruit trees. This dust settling on the fruit trees attracts dust mites. This causes the farmer to have to spray for dust mites which is one of the most expensive pesticides on the market. Vacating this portion of the 37 8/10ths road will eliminate the dust problem along with any liability issues that the Canal Company might incur with the public utilizing their maintenance road.

This vacation will not have any affect on utilities supplying services to the area including underground irrigation lines. This vacation also won't have any affect on the access to lots 6 and 7 of Palisade Heights Subdivision which has been historically achieved from 37 9/10ths Road (aka Bowers Avenue). Dan Cox off to the West of Main Street Palisade will still have his historic access from G 7/10ths Road which is a 45' Right of Way. Dale R. and Betty L. Ferguson, Don Cox's predecessor’s in chain of title, dedicated the northerly 25 feet of the NE 1/4 of the NW 1/4 of Section 9, Township 11 South, Range 98 West to Mesa County for road purposes on April 19, 1995, cementing Dan Cox's access. ( See Book 2143, Page 215 Reception 17146381). Also the Road Proclamation adopted by the County Commissioners of Mesa County on Tuesday, March 11th, 1890 and recorded at 4:00 O’clock P.M. on August 7, 1957 at Reception No. 700396 also establishes a Right of Way on G 7/10 this Road, Dan Cox’s historic access.

APPROVAL OF A REQUEST TO REZONE THE HAYDEN INVESTMENTS LLC PROPERTY LOCATED AT 3208 SPRINGFIELD ROAD, GRAND JUNCTION FROM THE C-2 DISTRICT TO THE I-1 DISTRICT

WHEREAS, Julie Hayden of Hayden Investments, LLC, sought approval to rezone an approximately 3.6 acre parcel located at 3208 Springfield Road, Grand Junction from a General Commercial (C-2) District to the Limited Industrial District (I-1) within the County of Mesa, State of Colorado and shown on attached Exhibit "A" and more particularly described as follows: Lot 2, Springfield Estates; and

WHEREAS, the staff recommendation was contained in a staff report dated September 15, 2014 and amended October 6, 2014, and

WHEREAS, the Mesa County Planning Commission recommended approval at the September 25, 2014 Planning Commission public hearing, and

WHEREAS, the public hearing duly noticed was held before the Mesa County Board of County Commissioners on October 14, 2014.

NOW, THEREFORE, THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF MESA FINDS AS FOLLOWS:

THAT public notice requirements of Section 3.1.8 of the Mesa County Land Development Code (2000, as amended) have been met.

THAT a rezoning of an approximately 3.6 acre parcel located at 3208 Springfield Road, Grand Junction from a C-2 District to the I-1 District meets the applicable Approval Criteria for Rezonings (Zoning Map Amendments) of Section 3.4.7, and General Approval Criteria of Section 3.1.17 of the Mesa County Land Development Code (2000, as amended). The rezone is consistent with the Grand Junction Comprehensive Plan, an element of the Mesa County Master Plan.

THAT this request is in accordance with the health, safety and welfare of the residents of Mesa County.

WHEREAS Jeri and Robert Prescott, the owner, sought approval for Conditional Use Permit to conduct minor entertainment events for no more than 4 events per month, for up to 150 guests, with a maximum of 21 events per year in the Agricultural, Forestry Transitional (AFT) District at 3165 B 1/2 Road as shown on attached Exhibit “A” and more particularly described on attached Exhibit “B” Legal Description, and

WHEREAS, the attached Exhibit “C” is the site plan for the proposed use, and

WHEREAS, the staff recommendation was contained in a staff report dated August 18, 2014 and revised September 8, 2014; and

WHEREAS, the Mesa County Planning Commission recommended approval (4 to 3) of this project at the August 28, 2014 Planning Commission public hearing; and

WHEREAS, the public hearing duly noticed was held before the Mesa County Board of County Commissioners on September 16, 2014 and was approved unanimously by the County Commissioners.

NOW, THEREFORE, THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF MESA FINDS AS FOLLOWS:

THAT the Conditional Use Permit to conduct minor entertainment events for no more than 4 events per month, for up to 150 guests, with a maximum of 21 events per year in the Agricultural, Forestry Transitional (AFT) District at 3165 B 1/2 Road meets the applicable Approval Criteria for Conditional Use Permits (Section 3.8.7), and the General Approval Criteria (Section 3.1.17) of the Mesa County Land Development Code 2000, as amended, and that is consistent with the Mesa County Master Plan.

THAT the request for a Conditional Use Permit to conduct minor entertainment events for no more than 4 events per month for up to 150 guests, with a maximum of 21 events per year in the Agricultural, Forestry Transitional (AFT) District at 3165 B ½ Road is approved with the following conditions:

1. All review agency comments not in conflict with the following conditions of approval shall be addressed. The applicant shall comply with the conditions of approval for the access permit. Soils test showing that the road will handle the weight of the emergency vehicles. Show no parking areas, guest cannot park on the access road (signage). Turning around area needs to be dimensioned to show compliance with the fire code. The tree overhang must not conflict with the height of the emergency vehicles.

2. If signage is requested in the future, the applicant shall request a sign permit and signs shall be limited to no more than six square feet, in keeping with provisions for bed and breakfast standards in a residential area.

3. The grass area utilized for guest parking shall be maintained and preserved. The parking area will be watered after the event to maintain vegetation for dust suppression.

5. The applicant, owner, and operator shall adhere to the noise limit requirements of Colorado Revised Statutes Section 25-12-103. The applicant shall purchase a sound meter and conduct random sampling during events. The operator shall, at his or her own expense, conduct sound testing as necessary to demonstrate compliance with the above referenced Statutes. Other measures or methods to minimize noise, such as additional berming, structural screening, or relocation of the noise source, and landscaping may be required to minimize the noise impacts. The barn shall be insulated and entertainment limited to the inside of the barn and speakers pointed north away from Madison Acres.

6. Site lighting shall be unobtrusive and no flood lights will be used on the site. Lighting must be at a minimum, full cutoff and in accordance with Section 7.6.7 of the Mesa County Land Development Code.

7. Events are limited to no more than 4 events per month and hours of amplified entertainment shall not go beyond 10pm and the event will end at 10:30pm. Maximum of 21 events per year with no more than 150 guests per event.

8. Reflective markers, lawn lighting or string lighting shall be placed along the driveway to show the edge of the driving surface during the night time hours.

9. If existing restrooms in the residence are used for events, the applicant will have an engineer certify that the system can handle the anticipated load. The applicant must

Page 2 of 6 145 work with the Building Department to provide non-discharging portable restroom facilities for all events.

10. A commercial site plan shall be submitted prior to the first event to ensure compliance with the conditional use permit.

11. A Transportation Impact Fee is required prior to commercial site plan approval.

12. The applicant, shall consistently comply with all applicable provisions of the Mesa County Land Development Code

13. The applicant shall not significantly deviate from the site plan and documents submitted with this application including the project narrative.

14. Any modification or expansion of this facility, not including minor modifications as determined by the Planning Director, shall require an amendment of the Conditional Use Permit.

15. All required licenses and permits to serve alcohol shall be obtained.

16. Food served at the events shall be catered and not prepared on-site. The business preparing/serving the food must hold a current Colorado Retail Food Establishment license. Liquor license will be required if alcohol is to be served.

17. The fuel tank outside the barn shall be removed.

18. Screening along the south boundary will be installed to mitigate headlights, noise and dust.

THAT the request to amend the Conditional Use Permit to allow commercial vehicles from the Western Slope Flagstone mining operation to access to Rapid Creek Road is approved with the following conditions:

1. On Rapid Creek Road all commercial truck trips associated with the quarry are limited to 5 round trips per day for five days per week, the owners’ and employees’ use of commercial trucks to commute to and from the quarry. This condition of

Page 1 of 8 150 approval supersedes Condition #3 in Mesa County BoCC of County Resolution MCM 95–103. 2. Prior to using Rapid Creek Road as an access road for commercial trucks, Western Slope Flagstone shall obtain approval of a CDOT access permit for the intersection of Rapid Creek Road and Highway 6. Haul traffic will not use North River Road and will only use Highway 6. 3. Hours of truck traffic on Rapid Creek Road shall be limited to between 6:00 am and 7:00 pm as specified in the Land Development Code, Section 5.2.13.H, Mining and Extractive Uses hours of operation. 4. The requested 5 days per week to use commercial haul trucks on Rapid Creek Road shall be specified as Monday through Friday for enforcement purposes.
