The enquiry report of MVI Vaikom revealed the following.

1. Total distance of the route : 22 Kms. [Daily Mileage of 220 kms]

2. Intra/ Inter District route : Intra District.

3. Details of Virgin Portion : Yes. 1.2 kms from Madiyathara to Nerekadavu Jn.

4. Details of Road Fitness certificate : Not Received.

5. Details of Overlapping : Total overlapping is 900 meter ie, 4.09 % of the total route length [22 km] which is within the permissible limit.

1) Route portion of 900 meter from Vaikom KSRTC to Ring Road objectionably overlaps on notified Scheme 42/2009 Trans dtd 14/07/2009.

8. Necessity, recommendation if any : Enquiry officer reported that in the proposed route AMbika Market to Vaikom town is well served sector and Vaikom to Nerekadavu sector is ill served sector. The proposed permit offers 12 trips and it will provide better conveyance to travelling public and students in the above sector to Vaikom Town. The proposed permit offer 8 trips to the ill served sectors and if all trips extended to ill served sector, it will be more beneficial to travelling public. The major portion of the route length is Ambika Market – Vaikom where STU’s are conducting service, hence their objection may be considered.

10. Other relevant points : There is no direct time clash noticed. However timings may settled after conducting Timing conference. 11. Item No.05 G1/2218/2018/K

Agenda-1) To peruse the Judgment in WP[c] No 42129 of 2017 of Honorable High Court of .

2.To reconsider the application for the re issue of a 04 months Temporary permit U/S 87(1) c of MV Act to SC KL 05 V 2963 to operate on the route S N Puram - Kottayam Via , Lakkattoor, Kothamangalapady, Poothirickal, Oravackal, Manrcadu and in the vacancy of a defaulted service.

Applicant- Smt. Suma Lalu, Pareparambil,S N Puram P O,Kottayam.

Notes- On 04/08/2001, Smt. Suma Lalu was applied for the grant of fresh regular permit/04 months TP to operate on the route S N Puram - Kottayam Via Kooroppada, Lakkattoor, Kothamangalapady, Poothirickal, Oravackal, Manrcadu and Kanjikuzhy in the vacancy of a defaulted service to his vehicle KL 05 D 3060.The regular permit application submitted by the applicant has rejected by the RTA Kottayam held on 07/08/2007 stating that the applied route objectionably overlaps for a distance of 08 Kms from Kottayam to Manarcadu on the notified Ernakulam-Thekkady and Kottayam-Thekkady Scheme. There after the applicant had been operated on this route on the strength of TP issued U/S 104 of MV Act with his various vehicle. Later application for the re issue of TP U/S 104 of MV Act submitted by the R/O of SC KL 05 V 2963 has been rejected by the RTA Kottayam held on 16/11/2013 stating the following reason.

“Heard. This is an application for the re issue of 04 months TP U/S 104 of MV Act in respect of SC KL 05 V 2963 to operate on the route S N Puram-Kottayam.As per Judgment of Honorable High Court of Kerala in WA No.1943/2012 and 1957 of 2012 dated 23/08/2013, wherein the Division Bench has pointed out that on the basis of Judgment of Honorable Supreme Court in UP State RTC Vs Sanjitha Bhanu & others(2005 KHC1697 & 2005(10) SCC 250),that the private stage carriage operators have no right to claim any grant of stage carriage temporary permits on the notified route or portions thereof. It has ordered that once the scheme is in force and the overlapping is permitted only to a certain extent, it is not possible to grant temporary permit based on the proviso to Section 104 of the MV Act. The benefit of the proviso to section 104 can be granted only in instances where there is no scheme and where no permits have been issued in such route. The proviso to section 104 cannot have any independent application and it is subject to the scheme framed by the Govt.in nationalized routes.

In this case the applied route is of 22 Kms. 08 Kms of the route portion from Kottayam to Manarcadu overlaps on the notified Ernakulam-Thekkady and Kottayam-Thekkady Scheme. KSRTC vehemently objected the grant. Hence rejected.”

Then the vehicle has been operating on this route on the strength of temporary permit issued by the RTA Kottayam dated 14/08/2014. On the expiry of that temporary permit applicant produced a copy of the Judgment of the Honorable HC of Kerala in WPC No.35478/2014 dated 30/12/2014, in which it is ordered to re issue TP for 04 months, within one week from the date of production of the order, subject to preferential claim, if any. In order to comply the order within the time frame, Sy, RTA granted TP for 04 months to SC KL 05 V 2963 which is valid up to 21/05/2015. There after the vehicle has been operating on the strength of Temporary permit granted by the RTA Kottayam U/S 87(1) c of MV Act. Existing TP covered with the vehicle issued as per the decision of the RTA dated 25/07/2017 is valid till 29/12/2017. On 25/10/2017, the petitioner submitted an application for the re issue of a 04 months Temporary permit U/S 87(1) c of MV Act, from the date of expiry of the existing TP. MVI Kottayam reported that no necessity U/S 87(1) c of MV Act. Meanwhile the Division Bench of the Honorable High Court of Kerala has pronounced a Judgment in W.A.No.993 of 2017 dtd 15/06/2017 and in WP[c] No 30359/2017 (S) dtd 17/10/2017 clearly ordered that no temporary permit shall be granted U/S 87[1][b] and [c] of MV Act. The said application was placed before the RTA Kottayam, and the RTA considered the application at sitting dtd 30/11/2017 took the following decision in vide ORDER NO G1/117461/2017/K DTD 30/11/2017. “Heard the learned counsel represented the applicant. Considered the application for the re issue of 04 months TP U/S 87(1) C of MV Act to SC KL 05 V 2963 to operate on the route S N Puram - Kottayam Via Kooroppada, Lakkattoor, Kothamangalapady, Poothirickal, Oravackal, Manrcadu and Kanjikuzhy in the vacancy of a defaulted service. KSRTC vehemently objected the grant. Moreover, Judgment dtd 17/10/2017 in WP[c] No 30359/2017 and WA No 993/2017 dtd 15/06/2017 of Division bench of Honorable High Court of Kerala ordered that not to grant temporary permit U/S 87[1][a], [b] [c] of MV Act. Hence the application for temporary permit for 4 months U/S 87 [1][c] to SC KL 05 V 2963 to operate on the above route is rejected”

On 09/02/2018 a judgment in WP[c] No 42129/2017 of Honorable High Courtof Kerala has been received. In which the Honorable single Judge finds that the request made by the petitioner for re-issue of temporary permit requires re-consideration at the hands of 2nd respondent [RTA Kottayam], and the said respondent has to pass a reasoned order, taking note of the law laid down by this Court in the decisions referred to supra. In this result, the writ petition disposed of, setting aside Ext P2 Order [Decision of RTA Kottayam dtd 30/11/2017] of the 2nd respondent, dated 30/11/2017 and the said respondent is directed to re consider the matter with notice to the petitioner and also to the KSRTC, taking note of the law laid down by this court in the decisions referred to supra. A decision in its regard shall be taken, as expeditiously as possible, at any rate within a period of three weeks from the date of receipts of a certified copy of the judgment.

Hence RTA may hear the applicant peruse the judgment and take a decision.

Item No-06 G1/15081/2017/K

Agenda:-1.To peruse the Judgment dtd 02/12/2016 in WP[c] No 20524/2012 of Honorable High Court of Kerala. 2.To consider the request for issue granted fresh regular permit by the RTA Kottayam dtd 22/05/2012 on the route Paruthumpara – Kottayam via, Chozhiyackadu, Parackalkadavu, Nalkavala, Devalokam, Kanjikuzhy, Collectorate, Logos Jn., Old Bus Stand, and return through Kanjikuzhy, Devalokam, Nalkavala, Parackalkadavu, and Chozhiyackadu to leased S/C KL 05 S 9792.

Notes:- Smt. Sheeja Thomnas, Thakidiyelparambil, CHannanickadu, Kottyam had filed an application for the grant of regular permit on the route Paruthumpara – Kottayam, which was placed before the RTA Kottayam dtd 09/07/2008. The Honorable High Court of Kerala vide Judgment in Wp[c] No 5616/2008 dtd 17/03/2008 had ordered to grant the permit. In the light of the judgment, the RTA considered the application as vide Item No 15 and granted regular permit applied for subject to settlement of timings. The decision of the RTA dtd 09/07/2008 was communicated to the applicant on 30/09/2008. But the while typing the decision the Item No 15, decision of item No 17 was typed and communicated to the applicant as follows. “Heard. 1.Perused. 2.Adjourned. The Secretary RTA is directed to enquire and report violation of scheme any after the modification of route.” RTA Kottayam dtd 22/05/2012 was rectified the mistake happened and granted regular permit on the route Paruthumpara – Kottayam subject to settlement of timings. The decision of the RTA Kottayam dtd 22/05/2012 was communicated to the applicant and the grantee has requested that she needs more time for the production of current records for obtaining the regular permit granted to her. This request was considered by the RTA Kottayam dtd 21/07/2012 granted extension of time for producing current records as per Rule 159[2] of KMV Rules for a period of 4 months from 18/06/2012. Another operator in this sector Smt. Sindhu George, Vakkaparambil [H], Kollad P O, Kottayam has filed a WP[c] No 20524/2012 before Honorable High Court of Kerala on 03/09/2012. The Honorable Court dismissed the case on 02/12/2016 as follows. “The writ petition is filed by a stage carriage operator having a regular permit till 24/08/2016 on the route Paruthumpara – Kottayam. She has approached this Court aggrieved by Ext P6 decision of the RTA Kottayam dtd 22/05/2012. Considering the fact that the regular permit issued to the petitioner has already expired and also taking note of the fact that the remedy of the petitioner is to seek settlement of timings if the petitioner has any other grievances, this court is of the view that the writ petition shall be dismissed leaving open all the issues. Accordingly, the writ petition is dismissed.” On 05/12/2017 Smt. Sheeja Thomas stated that the regular permit was not issued since the Honorable Court was issued a stay. Hence she has requested to issue regular permit on leased vehicle KL 05 S 9792 after settling the timings. But no records ie, RC, IC, CF of S/C KL 05 S 9792 was produced. A lease agreement executed is also produced. S/C KL 05 S 9792 is 48 seated stage carriage with a registration date of 03/02/2005 owned by Sri. Anilkumar, Kurisinchira [H],Pulikkuttissery, Kottayam. The RTA Kottayam dtd 30/11/2017 taken a decision in vide item No 102 that the age limit for the stage carriages in applying and grant fresh regular stage carriage permits as 8 years for Ordinary stage carriages. In this case, the offered vehicle has 13 years of age now.

Hence RTA may hear the applicant, peruse the judgment and take a decision.

Agenda - To consider the request of RTA Idukki for the concurrence for the grant of Fresh Permit in respect of stage carriage KL-38-D-2149 for operating on the route Karimkunnam – Via Purappuzha Health Centre, Kodikuthy, , Chennaparampu, Kundur Mana Jn., Poovakkulam, Karamala, Mangattuthazham L P School Jn., as Ordinary Service.

Notes:-

RTA, Idukki has requested concurrence of this RTA for Fresh Regular Permit in respect of stage carriage KL-38-D-2149 operating on the route Karimkunnam – Koothattukulam Via Purappuzha Health Centre, Kodikuthy, Kuninji, Chennaparampu, Kundur Mana Jn., Poovakkulam, Karamala, Mangattuthazham L P School Jn., as Ordinary Service since.

Enquiry report submitted by the MVI, reveals the following.

1. Route length in : 3.3 km from Choozhikkara – Manjinikkarappady via, Moolakkattu Kavala and Poovakkulam School Jn..

2, Virgin portion if any :From Choozhikkara to Moolakkulam Kavala 1.00 kms is virgin. Road Fitness may be obtained from the competent Authority.

3, Details of overlapping : Nil.

4, Details of width of the road : Width of the road from Choozhikkara to Moolakkattu Kavala seen comparatively less, which are sufficient for one side travel of Heavy Vehicles only.

5, Other relevant Points : The portion from Choozhikkara to Moolakkattu Kavala is virgin with comparatively less width and it can be develop by the concerned authority with the sufficient width for two way traffic of Heavy Vehicles by clearing the edges of the existing roads. Fitness certificate of the roads in this Virgin portion [1 km] may be obtained from the concerned competent Authority. The proposed route is passing through the area of Ordinary common public and it will decrease the efforts of the citizens both physically and economically.

Hence RTA may peruse the file and take a decision.

“Heard The learned counsel represented the applicant. Considered the application for variation of regular permit in respect of S/C KL 05 Z 4866 on the route Kottayam - Kattappana via, Mulakkuzha, Pakkil, Chingavanam, Kurichy Out Post, Eera, Kainady, Parakulam, Njaliyakuzhy, Thottakkad, Pampady, 14th Mile, Kanjirappally, Mundakkayam, Kuttikkanam and Elappara as Kainady – Kattappana by curtailing the 1st trip from Kottayam to Kurichy Out Post and in the last trip from Kurichy Out Post to Kottayam and changing the halting place from Kottayam to Kurichy out post.. Perused the file and enquiry report. As per the application it is not clear that whether the applicant is intended to limit the route length up to 140 kms as prescribed in the rule 2(oa) in the KMV Rules, 1989 and in obedience with GO(P) No 8/2017/Tran dated 23/03/2017 by curtailing the route length. All these facts considered the RTA and decided Vide Order No.C3/135952/2014/K dated 14.05.2015 as follows ”Heard Sri. I Dinesh Menon, learnt counsel represented the applicant Smt. Anees John. Considered the application for regular variation of permit in respect of Stage Carriage KL 38 C 7203 operating on the route Anakkayam-Kottayam. Enquiry officer specifically reported that the curtailment portion is an ill served one and curtailment will adversely affect the travelling public.The enquiry officer also reported that the application for curtailment couldnot be recommended since there is no urge of travelling public. The applicant failed to establish the necessity under Rule 145 (6) of KMV Rules 1989 to grant variation. On the above mentioned facts the application for variation of permit in respect of stage carriage KL 38 C 7203 is hereby rejected.” Against this order the permit holder filed the Honorable STAT and as per the Judgment in M.V.A.A No.214/2015 as follows “The appeal is allowed and the impugned order passed by the first respondent is set aside, The first respondent shall reconsider the application for variation of permit made by the appellant after obtaining concurrence of the Regional Transport Authority of the region in which curtailment of service is sought by the appellant”

The Hindu sucession [Kerala Amendment] Act 2015 [Act 17 of 2016] inter alia would show that any property inherited by a female from her predeceased son shall devolve, not upon the order heirs of the predeceased son shall devolve, not upon the other heirs referred to in sub –section [1] in the order specified therein, but upon the heirs of the predeceased son from who she inherited the property .Judged by the above standards , the petitioner ha s no legal right to claim any right over the permit or the bus originally belonged to the third respondents husband .The 3rd respondent and her daughters , who succeeded to the vehicle and permit, are the legal heirs in accordance with the provisions under the Hindu Succession Act. In paragraph 2 of revision petition , the petitioner admitted that Sudhakaran was registered owner an d permit holder in respect of the stage carriage KL 05 R 6212[ New Reg .kl 39 j 767], which was covered with a regular permit to operate on the route Kottayam – Ernakulam . Sudhakaran died on 22/12/2010. His mother also died on20/12/2013. There is no meaning in cotending that the petitioner who was in possession of the vehicle and who had 1/4th share in the estate of the permit holder and whose suit for partition has been pending is entitled to get the permit in his name. The order passed by the RTA granting the renewal of permit in favor of the 3rd respondent is strictly I in accordance with law. There is no illegality, irregularity or impropriety in the impunged order. The revision petition is devoid of any merit and is liable to be dismissed. In the result, the revision petition is dismissed .’’

The matter was enquired through MVI, Kottayam. The applicants appeared before Secretary RTA , Kottayam dated 17.08.2017 on enquiry, it is found that

1. The vehicle is now under control and possession of the 1st applicant. He intends to sell the vehicle to the 2nd applicant. 2. The 2nd applicant is intended to purchase the vehicle from the permit holder and he is financially sound to maintain stage carriage.

The applicants appeared before Secretary RTA , Kottayam on 14.02.2018. The matter was enquired through MVI,Kottayam ,on enquiry , it is found that

1. The vehicle is now under control and possession of the 1st applicant. He intends to sell the vehicle to the 2nd applicant. 2. The 2nd applicant is intended to purchase the vehicle from the permit holder and he is financially sound to maintain stage carriage.

PAILE KUNJU CHERIAN, THEKKEVEETTIL , MEMURY P.O, MANJOOR expired on 05/01/2017 and the death was intimated to this office in time. An application for transfer of ownership [ death] submitted on 18/04/2017 by Sri. PAULSON CHERIAN the successor of the vehicle .He has Produced legal heirship certificate issued by the Thahasildar Vaikom .Smt.Theyyamma Cheriyan and Sri . Paulson Cherian are the leagal heirs of the deceased permit holder .

The legal heirs were heard by the Secretary RTA Kottayam on 31/07/2017and the other legal heir has given consent to transfer the permit to the name of Sri. PAULSON CHERIAN. Genuiness of the application was also enquired through JRTO Uzhavoor and the same is reported to be genuine

Hence RTA may hear the applicant and take a decision

T.C.Jacob, Thannickal[H], Vadavathoor.P.O, Kottayam was expired on 04.04.2014 and the death was intimated in this office in time. The applicant Sri. Joseph Jacob Produced the will return by late Chacko Jacob, Thannickal[H], Vadavathoor.P.O,Kottayam dated 26/07/2013 and it was probated as L A O P No.19/2015 by the Honorable District Judge Kottayam and also produced the copy of the will. In the 3rd para of the will the testator clearly mention that his SC KL- 05-AD-9865 and its permit should go to his son Sri. Joseph Jacob .

Hence the RTA may hear the applicant, peruse the records and take a decision.

“The Petitioner Sri. Baby Antos is the basic permit holder. There is some disputes relating to the possession of vehicle and permit. However, the issue related to the transfer of permit and unauthorized change of possession of the vehicle KL 05 P 2187 covered by a valid regular permit without prior sanction of the RTA is clear violation and take appropriate action on regular permit. Therefore the secretary, RTA is directed to place the above matter for the consideration of RTA held on 30/11/2017 and take the following decision 1.Call original or certified copies of all the sale agreements executed with regard to the sale of vehicle between Sri. Baby Antos and Smt. Rency Noby and Sri. Noby Jose and Sri. Jojo Antony, Sri. Jojo Antony and Sri. K S Shereef etc and ascertain the authenticity of the documents and place the matter in the next sitting of this authority without fail. 2.Directed to conduct a detailed enquiry on allegation with regard to the unauthorized change of possession of vehicle and issue show cause notice to the permit holder if the unauthorized possession of the vehicle is evidenced in the original documents submitted by the objector and enquiry conducted. 3.As there is an order of the Honorable High Court to consider the application for the replacement of the vehicle subject to outcome of the OS No 201/2014 pending with Munsif Court Pala, this authority is of opinion that, it is not proper to dispose the application for the replacement during the pendency of the above suit. Hence adjourned.

Mean while on 14/12/2017 the application for transfer of permit has been submitted by the applicants and they were heard on the same day itself .Both of the applicant stated that the disputes among them regarding the possession of the vehicle and permit is compromised .

JRTO PALA has submitted interim report regarding the unauthorized possession of the vehicle and which reported that the case OS No 201/2014 is still pending before the Hon .Munciff Court Pala .In this circumstances , the permit holder has produced a Judgment in WPC No 41937of 2017 dtd 16/01/2018 , which directs to consider and pass appropriate orders on Joint application for transfer of permit made by the petitioners along with the matter already placed before the said authority regarding cancellation of the said permit with notice to the petitioners and after affording them an opportunity of being heard. A decision in this matter shall be taken, strictly in accordance with law as expeditiously as possible at any rate , within a period of one month from the date of production of a certified copy of this judgment . Also the report from JRTO Pala about the transfer of permit application it is reported that the disputes among the applicant and the pending case regarding the same is compromised and the cases were dismissed .

Hence RTA may hear the applicant peruse the file and take a decision in this matter

Agenda:- To take action against the Permit holder of SC-KL-05-W-7799 on the route PNKUNNAM - KOTTAYAM on the incident happened at SIavaji Nagr that the crew of the vehicle absconded by stopping dangerously the vehicle at the middle of the road without going to Lakkattoor MGM NSS HSS.

Notes:

Stage carriage bearing Registration number KL-05-W-7799 was issued with regular stage carriage permit on the route PNKUNNAM-KOTTAYAM up to 13.03.2018.

AS per the letter of Sub Inspector of Police Pamapdy, on 30/10/2017 at 9.30am, the driver and the conductor of the vehicle KL 05 W 7799 on the route Ponkunnam – Kottayam was absconded by stopping dangerously the vehicle at the middle of the rod at Sivaji Nagar. There are 40 odd students and other passengers were as the passengers at that time. A crime case was registered as 1628/2017 U/S 283 IPC and 120[b] of KP Act r/w 34 IPC, and produced the vehicle before Honorable Court now keeping at Pampady Police custody. He has also reported that so many complaint was previously received at Pallickathodu Police Station against the crew of this bus for misbehavior of staff of this vehicle. Hence he has recommended action against the violation of permit condition against the permit holder of this vehicle.

The MVI ,Kottayam submitted a detailed report which states that the initial permit was issued on 14.03.2003 to SC KL-05-K-8979. The Stage Carriage KL-05-W-7799 was started service in this route from 05.02.2007 onwards. Certificate of fitness continuously issued and No mechanical defect of the vehicle noticed. The out of 2 kms only a distance of 900 meters is steep. On enquiry this vehicle can conduct service up to MGM NSS Higher Secondary School without alighting students at the bottom of the steep. The act of the crew is punishable U/R 213 of KMV Rules 1989. The permit holder has not exercised effective supervisions over the work of his employees, hence violated the conditions stipulated under sub sections 2 and 3 of KMV Rules 153.

On the basis of the report, Secretary RTA issued show cause notice to the permit holder of SC KL-05- W-7788 on 03.11.2017.The permit holder appeared before the Secretary RTA on 11.11.2017 and give an explanation for the reason of permit violation. The permit holder states that the vehicle is usually conducting service by alighting students at the bottom of the steep. On 30/10/2017, the students got angry and tried to assault the staff. So the crew was went away from the place by stopping the vehicle.

Hence RTA may peruse the file and take a decision.

Agenda:- To consider the application for surrender of regular permit No 5/1812/2016 in respect of S/C KL 34 3895 on the route Erattupetta – Chenappady- Thampalakkad.

The permit holder of S/C KL 34 3895 on the route Erattupetta – Chenappady- Thampalakkad via Thidanadu, Pinnakkanadu, , Kappadu, Anakkullu, Kanjirappally, Kurisinkal, Anchilippa and Pallippady as Ordinary Service has requested to surrender the regular permit vide No 5/1812/2016 valid up to 10/07/2021 for cancellation. Surrender of Permit without prior intimation was compounded and collected Rs.3000/- vide receipt no.5/11789/2018,dated 02/02/2018. The applicant was heard by Secretary, RTA on 20/01/2018 and accepted the request.

Surrender of Permit without prior intimation was compounded and collected Rs.5000/- vide receipt no.5/139964/2018,dated 18/12/2017. The applicant was heard by Secretary, RTA on 18/12/2017 and accepted the request.

Surrender of Permit without prior intimation was compounded and collected Rs.5000/- vide receipt no.5/669/2018,dated 03/01/2018. The applicant was heard by Secretary, RTA and accepted the request.

Agenda:-Implementation of traffic system in Vaikom Town for stage carriages operating through Delavakulam Bus Stand.

Representation from Kottayam District Private Bus operators ssociations Vaikom Unit dated 20-06-2017. 7. Notes:- RTA, Kottayam held on 9-10-2001 approved the Dalavakulam Bus stand at Kizhakkenada, Vaikom. In order to implement some traffic reforms in Vaikom Town and for start functioning of Delavakulam Bus stand, the Traffic regulatory Committee Vaikom submitted recommendations before the RTA held on 16-11-2013 a decision was taken but not implemented. So many decisions were taken by the RTA & Traffic regulatory committee Vaikom in this matter. AT last, the Traffic Regulatory Committee held on 29-06-2017 examined the representations from various organizations and scrutinized the matters relating to the implementation of the traffic reforms as follows.

1. All stage carriages coming from Ernakulam, Kottayam side should proceed through the link road and halt at Dalavakulam stand after alighting passengers in the various stops at Thekke Gopuram, Padinjare Gopuram, Kacherikavala, KSRTC, Valiyakavala. Stage carriages having only passing time shall continue their service from Dalavakulam stand. 2. Stage carriages coming from Vechoor, Alappuzha, Cherthala, Kaipuzhamuttu should operate through Padinjare Gopuram, Kacherikavala Old Stand, Valiyakavala, Link road to Dalavakulam stand and those vehicles having no passing time should continue their service. 3. Stage carriages coming from T.V Puram should operate through Kacherikavala, Old stand Valiyakavala, link road and parking at Dalavakulam stand. Those vehicles having no passing time should continue service with destination board, and others should run one round service for the convenience of passengers. 4. All buses should operate through Dalavakulam Bus stand including KSRTC, Ordinary, FP, SFP and other higher class services. 5. New bus stop is to be considered at Dalavakulam Stand for all classes of KSRTC services. 6. No entry is allowed for stage carriages and goods vehicles through link road from south to north. 7. One way system to be insisted between Kacherikavala to Thekke Gopuram except 2&3 wheelers.

RTA Kottayam at its sitting dtd 31/01/2017 took the following decision in vide Order No G1/8420/2017/K. dated 25/07/2017 the above proposal was accepted but directed Chairman Trafeic Advisary committee vaikom to report any variations needed in the proposed system after hearing all the objectors. The above decision was communicated to Joint RTO Vaikom and directed to submit report on the direction contained in the decision of RTA and Joint RTO Vaikom submitted a report that Chairman of Traffic Regulatory Committee Vaikom was convened a meeting on 12/10/2017 and discussed the matter in detail. There were 14 Participants in the meeting and no new proposals / suggestions were arrived at. While considering the matter by the RTA Kottayam dtd 30/11/2017, same objectors including Municipal Councilor Vaikom raised their contention against the new traffic reforms. Hence RTA Kottayam once again directed Chairman Traffic advisory committee Vaikom to report if any variations needed in the proposed system after hearing all the objectors and hence Adjourned. Joint RTO Vaikom submitted a detailed report in this regard as follows.

“In Compliance to the direction, meeting was held on 15.01.2018 with due notice to the objectors, the members of Vaikom municipal council, various residence associations and other interested public. In the meeting there were 70 participants from different sides and the objections/ suggestions etc raised have been heard and examined.

While examining the issues raised against the present system with effect from 01.07.2017, the outcome are as follows,

1. In general, Every participant in the meeting strongly wanted to operate all S/C’s including KSRTC bus through Dalavakulam Bus stand 2. There were representations from seven municipal counselors, that the coming buses from Ernakulam side shall operate through Vadakkenada and to halt at Dalavakulam. The reason put forward is for the convenience of the students of Govt. School and Govt. Offices situated at Vadakkenada. The private operators Association also made this proposal as it is economically benefitted. 3. The other matter is to provide waiting time for private buses at old bus bay and to implement the RTA decision dated 16.11.2013. 4. Another representation is that there is fall in daily business among the shop situated at Vadakkenada since the introduction of traffic system with effect from 01.07.2017. 17 municipal councilors, representatives of various residents associations and others have stated that the present system of S/C operation, touches or passes through every centers of the town and convenient to the travelling public. They strongly put the request to continue the existing system as it is the only solution in Vaikom town with the existing facilities.

The demerits and new proposal to the existing system have been examined in detail and following facts revealed.

The matters and circumstances of the introduction of present traffic system in Vaikom is due to the non compliance of the decision of RTA Kottayam held on 16.11.2013. Prior to 01.07.2017, the private S/C’s did not enter Dalavakulam bus stand and parked unauthorizedly at road sides, making inconvenience to the road users and other vehicles. At that time, there were lot of complaints against the private buses and by the introduction of present system of operations, all private S/C’s are halting and starting trip from Dalavakulam Bus stand and thereby any complaint can easily be pursued by taking immediate action.

On examining the matters related to the students of higher secondary school, the following facts are revealed. The earlier bus stop at Vadakkenada was benefited to the passengers from Thalayolaparambu, Chembu areas, while the passengers from Vechoor, Moothedathukavu, Vazhamana etc earlierly used the same Westnada bus stop. It is also a fact that during the evening time, for return journey the passengers belonging to Thalayolaparambu, Chembu used the Valiyakavala / Westnada as Bus stop as it was one way through Vadakkenada. The distance from the school to Valiyakavala, East Nada, West nada Bus stops are equal and due to the introduction of present system they can easily access the nearby Dalavakulam Bus stand.

In the case of stopping of buses at old bus bay there is no restriction for a stop in the old bus bay without providing waiting time.

The present situation after introduction of present traffic system with effect from 01.07.2017

1. Dalavakulam Bus stand is functioning very effectively. Some arrangement has to be made in the bus stand including the installation of destination board to different places inside the bus stand. 2. In the present system anyone get the facility of travelling to all places from Dalavkulam Bus stand. 3. The passengers can reach to education institutions, Offices, Hospitals etc easily from Dalavakulam Bus stand. 4. Reduced traffic congestion in Valiyakavala and also between the portion Valiyakavala- link road 5. The present system is highly benefited to the pilgrims to Vaikom Temple as their vehicles can be parked through the left side of the road from Valiyakavala to Vadakkenada without any disturbances.

After final approval of present traffic system, necessary parking area, speed breaker etc… can be provided at Vadakkenada for the better management of vehicles during festival season.

For these above stated circumstances RTA may peruse the reports, consider the matter and may give final approval to the present traffic system, already implemented and running smoothly with effect from 01.07.2017”

RTA may take a decision in the light of the report.

Agenda-To consider the request for the sanctioning of stop for LSOS, Fast Passenger buses of KSRTC at Rationkada Jn. Bus Stop.

Ref:-Request from Sri. Zacharias Kuthiraveli, District Panchayath President, Member Kuravilangadu Division.

Notes- Vide reference cited, sanction bus stops at Pattithanam Rationkada Jn for LSOS and Fast Passenger buses to KSRTC. A detailed enquiry has been conducted through MVI Vaikom regarding the matter and he has submitted a detailed report as follows.

Pattithanam Rationkada Jn is situated in between Retnagiri Jn. and Vembally Jn. Majority of the busses are LSOS, FSLS and FP of KSRTC. But only a few ordinary services of KSRTC are stopping at Pattithanam Rationkada Jn at morning and evening time at present. More over many religious institutions are situating at this place and this highly populated area also. Hence there is much travelling difficulty is existing in this region. The Secretary RTA shall obtain detailed route enquiry and ascertain that there is no variation in the existing route along with the feasibility of the renewal application before placing it in the concerned RTAs.
