TREATMENT OF ALIENS AND NATIONALITY TH e DI P L O M AT I C Row B etween Ital Y and AU stria o V er Vienna ’s dra F t laws on d U al nationalit Y and cons U lar assistance F or German - and Ladin -spea K in G So U t H TY roleans German-speakers in the Provincia Autonoma di Bolzano – Alto Adige (Autonomous Province Bolzano – South Tyrol, hereinafter “South Tyrol”) con- stitute 69.6% of the total population of the Province, the rest belonging to the Italian (25.8%) and Ladin (4.5%) ethno-linguistic groups.7 South Tyrol enjoys a high level of self-government and fiscal autonomy, according to Article 6 of the Italian Constitution,8 the provisions of the 1946 Accordo De Gasperi – Gruber (De Gasperi – Gruber Agreement) between Italy and Austria,9 also known as Paris Agreement, and the 1972 second Autonomy Statute for South Tyrol.10 Under the Paris Agreement, in particular, Austria exercises a protective func- tion for South Tyrol, historically monitoring progress towards the attainment of autonomy by the Province. To this extent, in 1960, Austria submitted the ques- tion of the implementation of South Tyrol’s autonomy to the General Assembly of the United Nations (UN). The dispute was settled on 19 June 1992, by means of a discharge issued by both States before the UN, after all the measures that make South Tyrol’s autonomy a unique model of minorities’ protection had been enacted.11 Against this background, in 2017, the decision of the Austrian Government to support a reform of its domestic legislation favoring the acquisition of dual citizenship by German and Ladin South-Tyroleans became a significant source of tension between the two neighboring countries. Indeed, the debate on the at- tribution of the Austrian citizenship to South Tyroleans can be traced back to at least a decade before. In 2017, 19 South-Tyrolean Councilors sent a letter to the FPÖ and the Österreichische Volkspartei (ÖVP – Austrian People’s Party) leaders, Mr Heinz Christian Strache and Mr. Sebastian Kurz, claiming that “South Tyroleans have lost their Austrian citizenship with the involuntary annexation of South Tyrol by Italy. The regaining of citizenship would now be an act of reparation”,17 thus securing the official support of the Freedom Party of Austria. During the period from 1948 to 1993 (commonly referred to as the First Republic), Italy was a consensual democracy; whereas the system (commonly referred to as the Second Republic) that emerged from the dramatic changes brought about by the end of the Cold War functions according to the logic of competitive democracy. The transformation of Italy’s political system has thus been significant. However, there remain important hurdles on the road to a coherent institutionalisation of the competitive model. The article reconstructs the transformation of Italian democracy, highlighting the socio-economic and institutional barriers that continue to obstruct a competitive outcome. Introduction As a result of the parliamentary elections of 13-14 April 2008, the Italian party system now ranks amongst the least fragmented in Europe. Only four party groups are represented in the Senate and five in the Chamber of Deputies. In comparison, in Spain there are nine party groups in the Congreso de los Diputados and six in the Senado; in France, four in the Assemblée Nationale an d six in the Sénat; and in Germany, six in the Bundestag. Admittedly, as is the case for the United Kingdom, rather fewer parties matter in those democracies in terms of the formation of governments: generally not more than two or three.

    Remarks by David Thorne, U.S. Ambassador to Rome Thank you for inviting me to this panel discussion in such illustrious company. Franco Frattini and Lamberto Dini are two experts when it comes to the European Union, and I am delighted to hear their insights. I would like to congratulate Prof. Federiga Bindi on the publication of this new book. Rather than speak in an academic manner about whether the European Union’s foreign policy is real or imagined, I thought I would speak briefly about how I in my work deal with the reality of the policies of the European Union every day. I would also like to start out by saying that for President Obama, who has sought at every turn to be multilateral in his approach, the European Union is an essential partner. In fact, I myself sometimes wonder why there is so much handwringing over the importance of Europe, because from the perspective of this administration, Europe is real, and Europe matters. For those of us who work for the USG, then, the foreign policy of the European Union is no myth, but it is a foreign policy borne both of the common interests of European countries and of the interests of individual states. For the United States or any other country to influence the European Union’s foreign policy, therefore, means engaging both in Brussels and individually with each of the Union’s members. This means that our dealings with Italy, as with all EU countries, are automatically double-pronged: we want to have input into relations bilaterally, but also to leverage each EU country’s influence in Brussels on issues of strong interest to us.

    The Persistence of Corruption in Italy: Politicians and the Judiciary since Mani Pulite Raffaele Asquer Department of Political Science University of California, Los Angeles Paper prepared for the WPSA 2013 ANNUAL MEETING March 28th, 2013 PRELIMINARY DRAFT – PLEASE DO NOT CITE OR CIRCULATE 1 Abstract Starting in 1992, the Mani Pulite (“Clean Hands”) anti-corruption campaign promised to eradicate corruption from Italian political life. For a brief, yet intense period, the public rallied behind the prosecutors, and punished the allegedly corrupt politicians and parties at the polls. However, twenty years later, Italy is still ranked as highly corrupt by Western standards. Why, then, did the Mani Pulite campaign fail to have a long-lasting effect? Relying on original data on the anti-corruption investigations in Milan, as well as on a variety of datasources from the existing literature, this paper argues, first, that the investigations left essentially untouched entire parts of the country where corruption was widespread. Overall, the Mani Pulite campaign had limited deterring effects because judicial inquiries were obstructed by the statute of limitations, and even in case of conviction the sentences were generally mild. Second, the paper finds that the structures of corruption networks have changed since the Mani Pulite season, becoming less vulnerable to further judicial inquiries. There now seem to be multiple sites for corrupt transactions, somewhat dispersed throughout the political system, whereas in the past such activities were centrally managed by a cartel of parties. We reach this conclusion by combining evidence from the literature with original data on two subnational legislatures, the Regional Council of Campania (1992-94) and the Regional Council of Lombardy (2010-12) in which political malfeasance in general seemed widespread.

We document that the spread of the Mafia in Sicily at the end of the 19th century was in part caused by the rise of socialist Peasant Fasci organizations. In an environment with weak state presence, this socialist threat triggered landowners, estate managers, and local politicians to turn to the Mafia to resist and combat peasant demands. We show that the location of the Peasant Fasci is significantly affected by a severe drought in 1893, and using information on rainfall, we estimate the impact of the Peasant Fasci on the location of the Mafia in 1900. We provide extensive evidence that rainfall before and after this critical period has no effect on the spread of the Mafia or various economic and political outcomes. In the second part of the article, we use this source of variation in the strength of the Mafia in 1900 to estimate its medium-term and long-term effects.
