  • The Functioning of the Pensions Insurance System in the Countries of Former Yugoslavia
    Velizar Golubović The functioning of the pensions insurance system in the countries of former Yugoslavia Abstract This article analyses the functioning of the pensions insurance system in the coun- tries of the former Socialist Federal Republic of Yugoslavia. The first part of the article shows that the implemented reforms comprised stricter conditions for the realisation of pensions rights through an increase in the retirement age and a de- crease in the statutory replacement rate. The second part of the article presents the main indicators of the functioning of the pensions systems. The analysis of the results achieved reveals an exceptionally unfavourable picture. This primarily refers to the unfavourable ratio of the number of insured and pensions beneficia- ries due to high unemployment, resulting in a high deficit in the pensions system. The third part points to the need for, and direction of, further reforms of the pen- sions systems aiming at the creation of adequate and financially sustainable pen- sions systems. The conclusion summarises the results of the conducted analysis. The downfall of Yugoslavia was motivated by a desi- re for the creation of nation states, which led to intra-national conflicts in Croatia (1991-1995) and Bosnia and Herzegovina (1992-1995).1 The war conflicts brought a number of victims and mass deportations, as well as large-scale destruction and mate- rial damage.

Its utmost objective is to point and argue several measures, which would improve the insurance market conditions in the already mentioned countries, i.e. would contribute to the development increase and the acceleration of these insurance markets. As the number of inhabitants of the planet grows, food production has greater significance. Its production will certainly be affected by climate changes and the potential of agricultural land, which will be followed by changes in insurance cover of crops. Total area of arable land doesn’t have the same quality, but it’s especially common for underdeveloped and developing countries is that arable land is not used in the appropriate percent. For Serbia which belongs to that group of countries with low yield on arable land, it can be pointed out that insurance does not cover a sufficient share of that area. The reason for this lies in the lack of trust of potential insured, habits and consciousness of the insured, economic policy pursued by the state in relation to this issue, inadequate training of insurance agents and the lack of proper insurance products. Agronomy usually happens on open and unprotected space, which means that it is exposed to various risks. As a country striving to join the European Union, Serbia is making progress in the implementation of a considerable number of reforms, which involves the adoption of new laws and by-laws and definition of particular underdeveloped areas in insurance industry. Since difficult economic situation currently represents a grave problem, Serbia must put all its efforts and knowledge into becoming one of the countries where insurance is in the general national interest.

Belgrade A SUMMARY Prior the commencement of the clinical trial in Serbia the Sponsor is obliged to pro- vide the insurance policy covering the patient’s bodily injury and damaged health caused by the clinical trial. According to provisions of Serbian Insurance law insurance polices have to be issued by the insurance companies established in Serbia. Every insurance policy not issued by the insurance company established in Serbia shall be deemed as null and void. The only exceptance, is when the foreign clinical trial liability policy is stipulated that the insurance contract acknowledges the jurisdiction of Serbian domestic courts and other Serbian authorities to decide on damage claims (that never happend in Serbian practice). The Sponsor will fulfi ll this obligation stipulated in Serbian law when provides the Clinical Trial Liability policy issued by the Serbian insurance company. Nowadays, few of Serbian inusrance companies are issuing such polices. Under the clinical trial liability insurance cover the insureds are: Sponsor, Medical Centers in Serbia performing or controlling the clinical trial, Principal Investigators and their assistant staff performing or controlling the clinical trial. The benefi ciaries of the insurance cover are patients and/or members of their families – inheritresses. The insurance company will indemnify the benefi ciary mentioned in the policy when the insured event occurred i.e. when occurred bodily injury, psychic disease and alienation, psychic damages, illnesses and deaths caused by the clinical trial.
