IV-SEM MUSLIM LAW BY Dr. JAVED AHMED QURESHI DATE- 04-04-2020 MALIKI SCHOOL Maliki school is one of the four schools of fiqh or religious law within Sunni Islam. It is the second largest of the four schools, followed by about 25% Muslims, mostly in North Africa and West Africa. This school is not a sect, but a school of jurisprudence. Technically, there is no rivalry or competition between members of different madrasas, and indeed it would not be unusual for followers of all four to be found in randomly chosen American or European mosques. This school derives its name from its founder Imam Malik-bin-Anas. It originates almost to the same period as the Hanafi school but it flourished first in the city of Madina. Additionally, Malik was known to have used ray (personal opinion) and qiyas (analogy). This school is derives from the work of Imam Malik. It differs in different sources from the three other schools of rule which use it for derivation of regimes. All four schools use the Quran as the primary source, followed by Prophet Muhammad's transmitted as hadith (sayings), ijma (consensus of the scholars or Muslims) and Qiyas (analogy).In addition, the School of Maliki uses the practice of the people of Madina (Amal Ahl al-Madina) as a source. While the Hanafi school relies on Ijma (interpretations of jurists), the Maliki school originates from Sunna and Hadis. -

Tape Transcription Islam Lecture No. 1 Rule of Law Professor Ahmad Dallal ERIK JENSEN: Now, turning to the introduction of our distinguished lecturer this afternoon, Ahmad Dallal is a professor of Middle Eastern History at Stanford. He is no stranger to those of you within the Stanford community. Since September 11, 2002 [sic], Stanford has called on Professor Dallal countless times to provide a much deeper perspective on contemporary issues. Before joining Stanford's History Department in 2000, Professor Dallal taught at Yale and Smith College. Professor Dallal earned his Ph.D. in Islamic Studies from Columbia University and his academic training and research covers the history of disciplines of learning in Muslim societies and early modern and modern Islamic thought and movements. He is currently finishing a book-length comparative study of eighteenth century Islamic reforms. On a personal note, Ahmad has been terrifically helpful and supportive, as my teaching assistant extraordinaire, Shirin Sinnar, a third-year law student, and I developed this lecture series and seminar over these many months. Professor Dallal is a remarkable Stanford asset. Frederick the Great once said that one must understand the whole before one peers into its parts. Helping us to understand the whole is Professor Dallal's charge this afternoon. Professor Dallal will provide us with an overview of the historical development of Islamic law and may provide us with surprising insights into the relationship of Islam and Islamic law to the state and political authority. He assures us this lecture has not been delivered before. So without further ado, it is my absolute pleasure to turn over the podium to Professor Dallal. -

It is said that on his deathbed h e bestowed his khirqa t o Ahmad-i Jam Zandapil , who was just abou t to be born. Ahmad-i Jam was a Persian saint who was the opposite of Ab u Sa cld i n almos t ever y respect: stern , prou d o f his mystical power, drawing people to repentance, not t o love, and ofte n usin g his spiritual strengt h for revenge and punishment. -

INTERPRETING THE QUR’AN AND THE CONSTITUTION: SIMILARITIES IN THE USE OF TEXT, TRADITION, AND REASON IN ISLAMIC AND AMERICAN JURISPRUDENCE Asifa Quraishi* INTRODUCTION Can interpreting the Qur’an be anything like interpreting the Constitution? These documents are usually seen to represent overwhelming opposites in our global legal and cultural landscapes. How, after all, can there be any room for comparison between a legal system founded on revelation and one based on a man-made document? What this premise overlooks, however, is that the nature of the founding legal text tells only the beginning of the story. With some comparative study of the legal cultures that formed around the Qur’an and the Constitution, a few common themes start to emerge, and ultimately it turns out that there may be as much the same as is different between the jurisprudence of Islam and the United States. Though set against very different cultures and legal institutions, jurists within Islamic law have engaged in debates over legal interpretation that bear a striking resemblance to debates in the world of American constitutional theory.1 We will here set these debates next to * Assistant Professor, University of Wisconsin Law School. Iran and Yemen; Study the Reflection of the Islamic Revolution of Iran on Yemen and Its Results Amir Reza Emami¹, Fatemeh Zare² ¹,2 Graduate of Political Science (International Relations), Department of Law and Political Science, Faculty of Social Sciences and Humanities, Yazd, Yazd University, Iran. Abstract The Islamic Revolution of Iran took place in 1789 and was the first successful revolution inspired by Islam. Undoubtedly, this revolution had repercussions on the peripheral and semi-peripheral countries of Iran, and among the semi-peripheral countries of Iran, which was affected by the Iranian revolution, was Yemen. In the following years, with the beginning of the Arab Spring (Islamic Awakening), this country underwent changes and protest movements were formed in it, the content of which was very close to the foundations of the Islamic Revolution of Iran in 1789. These protests and anti-government movements in Yemen at the time led to the revolution and ultimately to the victory of the Yemeni Houthis and the Ansarullah movement. But what could be the consequences of this event in Yemen? Do these results include the system of the Islamic Republic of Iran? In fact, the main question of this research is what are the results of the reflection of the Islamic Revolution of Iran on Yemen. Therefore, this study seeks to first examine the reflection of the Islamic Revolution in Yemen and then explain its results. The method of the present research is qualitative and based on descriptive-analytical and the method of collecting data and information is based on documentary studies, libraries and reputable research and extension science journals and various statistics. -

Completion of Yassarnal Qur’an Course Objectives: This syllabus is designed for the two years’ program of Level-1for children of age 7 and 8 year. It is based on the Ahmadiyya Children Sunday School ‘Curriculum’ Document created by National Department of T`alim Canada. Therefore it is advised to always refer to the ‘Curriculum’ document provided while implementing this syllabus. The level 1 class is designed to provide fundamental and basic knowledge of Islam-Ahmadiyyat that will enable students to understand and appreciate this wonderful religion. This course level will be dealing with the Holy Qur’an, Salāt, Ahadith, Prayers and General Religious Knowledge. After successful completion of this level, the student will have beginner’s level knowledge and will be able to: demonstrate the recitation of the Holy Qur’an properly. memorize Surah Fatiha and last 5 chapters with translation. correctly perform Wudhu and offer Salāt with some knowledge of related details such as prayer names, timings and number of Raka`āt, etiquettes of mosque, Eid and Friday prayers. demonstrate introductory level knowledge of basic principles of Islam- Ahmadiyyat including pillars of Islam, Articles of Faith and simple social, moral and family values. Memorize the following with translation and basic understanding of the concept: o Five Prayers (from the Holy Qur’an & prayers of the Holy Prophetsa) o Five Ahadith. MARSHALL ISLANDS 2018 INTERNATIONAL RELIGIOUS FREEDOM REPORT Executive Summary The constitution provides protections for religious freedom with “reasonable restrictions” to ensure public order and the rights of other individuals. The constitution provides for the right to freedom of thought, conscience, and belief and to the free exercise of religion. Members of the Ahmadiyya Muslim Community said authorities did not allow them to use the government conference center that other religious groups use, and said they experienced longer waits at government hospitals than others. Members of the Ahmadiyya Muslim Community reported societal religious intolerance, which they attributed to international news reports linking Islam to terrorism. One Ahmadi Muslim leader said leaders of local Christian congregations tried to dissuade fellow Christians from converting to Islam by saying Islam promoted violence and Muslims used bribery to entice new members or influence their congregation. There were instances of anti-Semitic graffiti in several locations in Majuro. Christian parishioners reported feeling increased pressure to give more of their income to their church or face severe penalties from church leaders, including excommunication, if donation quotas were not met. Embassy officials met with leaders of the Church of Jesus Christ of Latter-day Saints (Church of Jesus Christ,) Assembly of God, Seventh-day Adventist, and Ahmadiyya Muslim Community. The Ambassador spoke at the Fourth Annual National Conference of the Ahmadiyya Muslim Jama’at in Majuro. The organizers said the objective of the conference was to promote a better understanding of the Ahmadis as a peaceful and contributing element of society so as to reduce societal suspicion and promote greater freedom for the community.
