Re: Notice of Decommissioning of the Corporation’s Analogue Television Rebroadcasting Transmitters
Dear Mr. Traversy:
1 The Federal budget released 29 March 2012 significantly reduced CBC/Radio- Canada's Parliamentary appropriation. As a result, the Corporation must find substantial cost savings. The Corporation has determined that it is no longer possible to continue operating its analogue television retransmitters. CBC/Radio-Canada will therefore cease transmitting from all analogue television rebroadcasting transmitters on July 31, 2012.
2 As the Commission is aware, last year the Corporation undertook to keep its over- the-air analogue television transmitters in operation for as long as technology and financial constraints would permit. Analogue technology and the related equipment and parts for repair are no longer readily available in the world. As we noted to the Commission and to the public last year in the lead-up to the August 2011 DTV transition, the expected life of these analogue transmitters is therefore very uncertain, and limited at best. With this uncertainty, and in the current financial environment, the Corporation has determined it is no longer possible to continue operating its analogue television retransmitters.
3 As a result of this decision, CBC/Radio-Canada has already given notice to affected tower landlords and has terminated all of the Corporation’s leases on the sites where our analogue television transmitters are located. We have also formally notified all BDUs of the termination of our analogue over-the-air television transmission at all sites effective July 31, 2012. We will be conducting a communications campaign to inform Canadians in the affected markets of this upcoming change.
4 In light of these operational developments, CBC/Radio-Canada is requesting that the Commission:
i. revoke the broadcasting licences for the Corporation’s two analogue conventional television programming undertakings and all their related analogue rebroadcasting transmitters identified in Appendix A; and
ii. amend the broadcasting licences of the Corporation’s 27 digital English- and French-language conventional programming undertakings identified in Appendix B to remove the associated analogue rebroadcasting transmitters.
5 The Corporation notes that from a procedural perspective this request can be dealt with on an administrative basis. Broadcasting and Telecom Information Bulletin 2010- 960 provides guidance on the types of applications that do not require a public process. In that Bulletin, the Commission states at paragraph 6 that applications involving “revocation of a licence at the licensee’s request” and “changes to the authorized contours of over-the-air programming undertakings in cases where …the revised contours do not enter a new market” will be dealt with on an administrative basis. In CBC/Radio-Canada's view the current request satisfies these criteria.

Objet : Avis de mise hors service des réémetteurs analogiques de télévision de la Société
Monsieur,
1 Le budget fédéral déposé le 29 mars 2012 réduit de manière considérable les crédits parlementaires de CBC/Radio-Canada. Par conséquent, la Société doit trouver des moyens lui permettant de réaliser d’importantes économies de coûts. La Société a déterminé qu’il ne lui était plus possible de continuer d’exploiter ses réémetteurs analogiques de télévision. Ainsi, CBC/Radio-Canada cessera ses activités de transmission à partir de tous ses réémetteurs analogiques de télévision à compter du 31 juillet 2012.
2 Comme le Conseil le sait, l’an dernier, la Société a entrepris de maintenir en service ses émetteurs hertziens de télévision analogique aussi longtemps que les contraintes technologiques et financières le lui permettraient. La technologie analogique ainsi que l’équipement et les pièces requis pour effectuer les réparations se font maintenant rares sur le marché. Comme nous l’avions mentionné au Conseil et au public l’an dernier avant le passage à la télévision numérique en août 2011, la durée de vie prévue de ces émetteurs analogiques est par conséquent très incertaine et limitée dans le meilleur des cas. En raison de cette incertitude, et étant donné le contexte financier actuel, la Société a déterminé qu’il n’était plus possible de continuer d’exploiter ses émetteurs de télévision analogique.
3 En raison de cette décision, CBC/Radio-Canada a déjà avisé les propriétaires des pylônes concernés et mis fin à tous les baux liant la Société sur les sites où sont installés ses émetteurs de télévision analogique. Nous avons aussi avisé officiellement toutes les EDR de l’arrêt de notre service hertzien de télévision analogique dans tous les sites d’émetteurs à compter du 31 juillet 2012. Nous mènerons une campagne de communication en vue d’informer les Canadiens vivant dans les marchés concernés de ce prochain changement.
4 Par suite de ces décisions opérationnelles, CBC/Radio-Canada demande au Conseil de :
i. révoquer les licences de radiodiffusion pour deux entreprises de programmation de télévision analogique traditionnelle de la Société ainsi que pour tous leurs réémetteurs analogiques décrits dans l’annexe A ci-jointe;
ii. modifier les licences de radiodiffusion des 27 entreprises de programmation numérique traditionnelle de langue française et anglaise de la Société décrites dans l’annexe B afin de mettre hors service les réémetteurs analogiques qui y sont associés.
5 La Société remarque que, du point de vue de la procédure, cette demande peut être traitée par voie administrative. Le Bulletin d’information de radiodiffusion CRTC 2010-960 précise les types de demandes qui n’exigent pas de processus public. Dans son Bulletin, le Conseil mentionne au paragraphe 6 que les demandes de « révocation d’une licence à la demande d’une titulaire » et de « modification du périmètre de rayonnement autorisé d’une entreprise de programmation en direct dans le cas où… le nouveau périmètre de rayonnement ne pénètre pas dans un nouveau marché » seront traitées par voie administrative. CBC/Radio-Canada est d’avis que la présente demande répond à ces critères.
