Dogs on Lead by Direction (Mid Devon) DOGS ON LEAD BY DIRECTION (MID DEVON) ORDER 2012 CLEAN NEIGHBOURHOODS AND ENVIRONMENT ACT 2005 THE DOG CONTROL ORDERS (PRESCRIBED OFFENCES AND PENALTIES, ETC.) REGULATIONS 2006 (SI 2006/1059) 1. Mid Devon District Council (in this Order called “the Council”) hereby makes the following Order under the Clean Neighbourhoods and Environment Act 2005: 2. This Order may be cited as the Dogs on Lead by Direction (Mid Devon) Order 2012, and shall come into force on 1st December 2012. 3. The land to which this Order is to apply is to land specified in the attached Schedule 1. 4. In this Order, “an Authorised Officer of the Authority” means an employee of the authority who is authorised in writing by the Authority for the purpose of giving directions under this Order. 5. A person in charge of a dog shall be guilty of an offence if, at any time, on any land to which this Order applies, he does not comply with a direction given to him by an authorised officer of the authority to put and keep the dog on a lead, unless he has a reasonable excuse for failing to do so, or the owner, occupier or other person or authority having control of the land has consented (generally or specifically) to his failing to do so. 6. This Order does not apply to a person in charge of a dog working on the land and acting with the consent of the owner or occupier of the land, or of any other person or authority that has control of the land. 7. For the purpose of this article, (a) A person who habitually has a dog in his possession shall be taken to be in charge of the dog at any time unless at that time some other person is in charge of the dog. (b) An Authorised Officer of the Authority may only give a direction under this Order to put and keep a dog on a lead if such restraint is reasonably necessary to prevent a nuisance or behaviour by the dog likely to cause annoyance or disturbance to any other person on any land to which this Order applies, or the worrying or disturbance of any animal or bird. 8. A person who is guilty of this offence shall be liable on summary conviction to a fine not exceeding level 3. The Common Seal of Mid Devon District Council Was affixed this date: 1 December 2012 Simon Johnson Schedule 1: Land to which a Dog on Lead by Direction Order would apply All land within the Mid Devon District Council area which is open to the air and to which the public are entitled or permitted to have access (with or without payment) other than land subject to a Dog Control Order excluding a dog from specific land or requiring a dog to be on lead at all times or a bye-law prohibiting dogs or requiring a dog to be on a lead at all times (see Schedule 1.1 below) or any land owned or managed by the Forestry Commission.
